Pursuant to the Law on the State Bank of Vietnam No. 01/1997/QD10 and the Law on Credit Organizations No. 02/1997/QH10 dated December 12, 1997;

Pursuant to the Government Decree No. 15/CP dated March 2, 1993 on the tasks, powers, and responsibilities for state management of ministries and ministerial-level agencies;

Pursuant to Decree No. 64/2001/NĐ-CP dated September 20, 2001 of the Government on payment activities through service providers;

At the proposal of the Director of the Organization and Training Department and the Director of the Information Technology Department of the State Bank,

 

DECISION:

Article 1. The Operational Regulations of the Management Board of the inter-bank electronic payment system are hereby issued together with this Decision.

Article 2. This Decision shall take effect from the date of signing.

Article 3. Members of the Management Board of the inter-bank electronic payment system, the Head of the Office, the Directors of the Organization and Training Department and the Information Technology Department of the State Bank, and the Heads of related units shall be responsible for implementing this Decision.

WORKING REGULATIONS

OF THE MANAGEMENT BOARD OF THE INTER-BANK ELECTRONIC PAYMENT SYSTEM

dated July 1, 2002 of the Governor of the State Bank of Vietnam

PART I

GENERAL PROVISIONS

Article 1.These regulations stipulate the tasks, powers, and principles of operation of the Management Board of the inter-bank electronic payment system (hereinafter referred to as the Management Board), consisting of individuals named in Decision No. 194/QĐ-NHNN dated March 14, 2001 of the Governor of the State Bank of Vietnam.

Article 2. Members of the Management Board work under a concurrent appointment system. In special cases where they cannot directly perform their duties or attend meetings due to objective reasons, members must report to the Chairman. Depending on specific circumstances, the Chairman may approve the delegation of tasks to another person. Any opinions and voting rights of the delegate have the same value as those of the member, and the member remains fully responsible.

Article 3. Principles of Operation of the Management Board

1- The Management Board operates according to the principle of democratic centralism and majority voting. In case of equal votes, the decision belongs to the side with the vote of the Chairman. Depending on the situation, the Chairman may determine important issues that need to be resolved through majority voting.

2- Members of the Management Board must implement and be responsible for the results of the tasks assigned to them.

3- When seeking guidance and decisions from the Chairman, members must submit written proposals and solutions for handling tasks. In necessary cases, the Chairman may convene some relevant members or the entire Management Board to discuss and unify opinions before making a final decision.

4- The Management Board meets regularly once every quarter in March, June, September, and December. In special cases or upon the request of two-thirds of the members, the Chairman will convene extraordinary meetings. The time and place of the meeting are decided by the Chairman of the Management Board.

Article 4. The specialized team assisting the Management Board and its operational costs

1- The Management Board has a specialized team. The composition and tasks of the specialized team are decided by the Chairman. The working location of the specialized team is at the National Payment Center, 28 Nguyen Chi Thanh Street, Dong Da District, Hanoi.

2- All expenses arising from the activities of the Management Board are paid according to the prescribed regulations and taken from the operational business expenses of the State Bank.

PART II

TASKS AND POWERS OF THE MANAGEMENT BOARD

Article 5. Tasks of the Management Board

Coordinate with related units to:

1- Monitor and direct the regular operations of the inter-bank electronic payment system.

2- Resolve issues related to the operations of the inter-bank electronic payment system.

3- Approve participation, suspension, or withdrawal from the inter-bank electronic payment system by members and member units.

4- Handle disputes between individuals and units participating in the inter-bank electronic payment system.

5- Decide on resolving important issues related to the inter-bank electronic payment system.

Article 6. Tasks and Powers of the Chairman

1- Convene and chair meetings of the Management Board; decide on the agenda of the meetings; compile proposals and conclusions of the meetings.

2- Direct, assign, and check the results of the work of each member of the Management Board.

Article 7. Tasks and Powers of the Deputy Chairman

1- Serve as the permanent representative of the Management Board and be responsible to the Chairman for the work assigned.

2- Act on behalf of the Chairman to handle the work of the Management Board when the Chairman is absent and report the results of the work to the Chairman upon his return.

Article 8Tasks and Powers of the Members of the Management Board

1- Propose or act as the main point of contact to propose solutions to issues related to the tasks of the Management Board based on their functions, tasks, and areas of responsibility, and carry out assigned tasks.

2- Participate in meetings of the Management Board and prepare opinions and discussion topics for the meetings.

3- Vote in writing on the participation, suspension, or withdrawal from the inter-bank electronic payment system of members according to the opinion solicitation form of the permanent representative of the Management Board.

4- Carry out other tasks assigned by the Chairman of the Management Board.

Article 9. Members enjoy the following benefits:

1- Their tasks in the Management Board are included in their work program.

2- They are entitled to benefits according to the prescribed regulations.

3- They are provided with necessary equipment to serve the common work of the Management Board according to the prescribed regulations.

CHAPTER III

IMPLEMENTING PROVISIONS

Article 10. Members of the Management Board are responsible for implementing these regulations.
