Guidelines for managing and using non-reimbursable funds for some newspapers and magazines for ethnic minority and mountainous regions

Pursuant to the State Budget Law No. 01/2002/QH11 dated December 16, 2002, and other current guiding documents implementing the State Budget Law;
Pursuant to Decree No. 77/2003/NĐ-CP dated July 1, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Pursuant to Decision No. 1637/QĐ-TTg dated December 31, 2001 of the Prime Minister on providing some newspapers and magazines for ethnic minority and mountainous regions;
After receiving consistent opinions from relevant ministries and sectors, the Ministry of Finance provides guidelines for managing and using non-reimbursable funds for some newspapers and magazines for ethnic minority and mountainous regions as follows:
I. OBJECTS RECEIVING NEWSPAPERS AND MAGAZINES AND QUANTITIES FOR DISTRIBUTION
The objects receiving newspapers and magazines and quantities for distribution shall be implemented according to the provisions from Clause 1 to Clause 8 of Article 2 of Decision No. 1637/QĐ-TTg dated December 31, 2001 of the Prime Minister on providing some types of newspapers and magazines for ethnic minority and mountainous regions and Circular No. 869/CP-VX dated June 30, 2003 of the Government on financial mechanisms for the Ethnic Minorities and Development Newspaper of the National Ethnic Minorities Committee, specifically as follows:
1. Classes in schools:
1.1. Classes in primary schools in mountainous, highland, border, and island communes shall be provided with one copy of the Special Issue on Ethnic Minority Children and Mountainous Regions.
1.2. Classes in secondary schools in mountainous, highland, border, and island communes shall be provided with one copy of the Special Issue on Ethnic Minority Teenagers and Mountainous Regions.
1.3. Classes in boarding schools at the primary level in mountainous provinces and ethnic minority regions shall be provided with one copy of the Special Issue on Ethnic Minority Children and Mountainous Regions.
1.4. Classes in boarding schools at the secondary level in mountainous provinces and ethnic minority regions shall be provided with one copy of the Special Issue on Ethnic Minority Teenagers and Mountainous Regions.
2. Libraries:
2.1. Libraries of boarding schools shall be provided with:
- Five copies of the Special Issue on Ethnic Minority Arts and Mountainous Regions.
- Five copies of the Cultural Magazine of Ethnic Groups.
- Five copies of the Ethnic Group Magazine.
- One copy of the Ethnic Minorities and Development Newspaper.
2.2. Libraries of provinces, counties in mountainous and ethnic minority regions shall be provided with:
- Two copies of the Special Issue on Ethnic Minority Arts and Mountainous Regions.
- Two copies of the Cultural Magazine of Ethnic Groups.
- Two copies of the Ethnic Group Magazine.
- Two copies of the Ethnic Studies Magazine.
- Two copies of the Ethnic Minorities and Contemporary Times Magazine.
3. People's Committees at commune level:
3.1. People's Committees in mountainous and ethnic minority communes shall be provided with:
- One copy of the Ethnic Minority and Mountainous Region News and Photos Magazine of the Vietnam News Agency.
- One copy of the Special Issue on Ethnic Minorities and Mountainous Regions of the Vietnam News Agency.
3.2. People's Committees in mountainous and ethnic minority communes along the border shall be provided with:
- One copy of the Ethnic Minority and Mountainous Region News and Photos Magazine of the Vietnam News Agency.
- One copy of the Special Issue on Ethnic Minorities and Mountainous Regions of the Vietnam News Agency.
- One copy of the Border Defense Newspaper of the Border Guard Command.
3.3. People's Committees in communes under Program 135/TTg shall be provided with:
- One copy of the Ethnic Minority and Mountainous Region News and Photos Magazine of the Vietnam News Agency.
- One copy of the Special Issue on Ethnic Minorities and Mountainous Regions of the Vietnam News Agency.
- One copy of the Special Issue on Ethnic Minorities and Mountainous Regions of the following newspapers: Agriculture Vietnam, Rural Today, Health and Life, Rural Economy, Science and Life, Culture, and Vietnam Industry Newspaper.

4. Party Committees of communes under Program 135/TTg:
- One copy of the Ethnic Minorities and Development Newspaper.
5. People's Committees at county level:
5.1 People's Committees in mountainous and ethnic minority counties shall be provided with:
- Three copies of the Ethnic Minority and Mountainous Region News and Photos Magazine of the Vietnam News Agency.
- Three copies of the Special Issue on Ethnic Minorities and Mountainous Regions of the Vietnam News Agency.
5.2. People's Committees in counties with communes under Program 135/TTg shall be provided with:
- Three copies of the Ethnic Minority and Mountainous Region News and Photos Magazine of the Vietnam News Agency.
- Three copies of the Special Issue on Ethnic Minorities and Mountainous Regions of the Vietnam News Agency.
- One copy of the Special Issue on Ethnic Minorities and Mountainous Regions of the following newspapers: Agriculture Vietnam, Rural Today, Health and Life, Rural Economy, Science and Life, Culture, and Vietnam Industry Newspaper.
- Two copies of the Ethnic Minorities and Development Newspaper (one for the Ethnic Minorities Settlement Department of the county, one for the Program 135 Steering Committee of the county).
6. People's Committees at provincial level:
6.1. People's Committees in mountainous and ethnic minority provinces shall be provided with:
- Three copies of the Ethnic Minority and Mountainous Region News and Photos Magazine of the Vietnam News Agency.
- Three copies of the Special Issue on Ethnic Minorities and Mountainous Regions of the Vietnam News Agency.
- Two copies of the Ethnic Minorities and Development Newspaper (one for the Ethnic Minorities Department of the province, one for the Program 135 Steering Committee of the province).
6.2. People's Committees in provinces with communes under Program 135/TTg shall be provided with:
- Three copies of the Ethnic Minority and Mountainous Region News and Photos Magazine of the Vietnam News Agency.
- Three copies of the Special Issue on Ethnic Minorities and Mountainous Regions of the Vietnam News Agency.
- One copy of the Special Issue on Ethnic Minorities and Mountainous Regions of the following newspapers: Agriculture Vietnam, Rural Today, Health and Life, Rural Economy, Science and Life, Culture, and Vietnam Industry Newspaper.
- One copy of the Ethnic Minorities and Development Newspaper (for the Program 135/TTg Steering Committee).
7. Provincial Ethnic Minorities Departments (ethnic minorities and mountainous regions working units):
- One copy of the Special Issue on Ethnic Minorities and Mountainous Regions of the following newspapers: Agriculture Vietnam, Rural Today, Health and Life, Rural Economy, Science and Life, Culture, and Vietnam Industry Newspaper.
- One copy of the Ethnic Minorities and Development Newspaper.
8. Border Posts and Stations:
Border posts and stations located in mountainous and ethnic minority areas shall be provided with:
- One copy of the Ethnic Minority and Mountainous Region News and Photos Magazine of the Vietnam News Agency.
- One copy of the Special Issue on Ethnic Minorities and Mountainous Regions of the Vietnam News Agency.
- One copy of the Special Issue on Ethnic Minorities and Mountainous Regions of the following newspapers: Agriculture Vietnam, Rural Today, Health and Life, Rural Economy, Science and Life, Culture, and Vietnam Industry Newspaper.
- One copy of the Special Issue on Ethnic Minority Arts and Mountainous Regions.
- One copy of the Cultural Magazine of Ethnic Groups.
- One copy of the Ethnic Group Magazine.
- One copy of the Ethnic Minorities and Development Newspaper.
9. Villages in mountainous and ethnic minority regions shall be provided with:
- One copy of the Ethnic Minority and Mountainous Region News and Photos Magazine of the Vietnam News Agency.
- One copy of the Ethnic Minorities and Development Newspaper.
II. NUMBER OF ISSUES TO BE DISTRIBUTED FOR EACH TYPE OF NEWSPAPER, MAGAZINE, AND SPECIAL ISSUE:
1. Special Issue on Ethnic Minority Children and Mountainous Regions is 24 issues/year (two issues/month).
2. Special Issue on Ethnic Minority Teenagers and Mountainous Regions is 24 issues/year (two issues/month).
3. Ethnic Minority and Mountainous Region News and Photos Magazine of the Vietnam News Agency is 12 issues/year (one issue/month).
4. Special Issue on Ethnic Minorities and Mountainous Regions of the Vietnam News Agency is 12 issues/year (one issue/month).
5. Seven Special Issues on Ethnic Minorities and Mountainous Regions under Program 135/TTg is 52 issues/year (one issue/week).
6. Special Issue on Ethnic Minority Arts and Mountainous Regions is 12 issues/year (one issue/month).
7. Cultural Magazine of Ethnic Groups is 12 issues/year (one issue/month).
8. Ethnic Group Magazine is 12 issues/year (one issue/month).
9. Ethnic Studies Magazine is six issues/year (one issue every two months).
10. Ethnic Minorities and Contemporary Times Magazine is 12 issues/year (one issue/month).
11. Border Defense Newspaper is 52 issues/year (one issue/week).
12. Ethnic Minorities and Development Newspaper is 52 issues/year (one issue/week).
The number of copies of newspapers, magazines, and special issues distributed in each period shall be based on the actual number distributed to the recipients listed in Part I above and the number of copies submitted for archival purposes. To ensure prompt and convenient delivery of newspapers, magazines, and special issues to each recipient, they shall be uniformly distributed through the Central Press Distribution Company under the Ministry of Posts and Telecommunications (except for the Border Defense Newspaper which has its own military postal service).
The Ministry of Education and Training shall take the lead and coordinate with relevant ministries and sectors to unify the announcement of lists and addresses of classes, primary schools, junior high schools, boarding schools for ethnic minorities, and libraries that will receive newspapers, magazines, and special issues free of charge, and consolidate and submit them to the National Ethnic Committee and the issuing agency.
The National Ethnic Committee shall take the lead and coordinate with relevant ministries and sectors to unify the announcement of lists and addresses of provincial, district, commune, village, and border guard posts that will receive newspapers, magazines, and special issues free of charge, and consolidate and submit them to the issuing agency.
III. ESTABLISHING, ALLOCATING, IMPLEMENTING AND SETTLING THE BUDGET FOR OPERATIONAL EXPENSES
1. Preparation of budget estimates:
Annually, the National Ethnic Committee shall take the lead and coordinate with the Ministry of Finance, the issuing agencies, and related sectors; based on the recipients of newspapers, the quantity of newspapers, magazines, and special issues provided free of charge, and the publication and distribution costs of each type of newspaper, magazine, and special issue approved by the competent authority, the National Ethnic Committee shall prepare the budget estimate for operational expenses, which will be consolidated in the budget expenditure plan of the National Ethnic Committee and submitted to the Ministry of Finance and the Ministry of Planning and Investment for consolidation and reporting to the Government for approval by the National Assembly. The source of funds for providing newspapers, magazines, and special issues free of charge to ethnic minority areas and mountainous regions as stipulated in this Circular shall be guaranteed by the central government budget.
2. Allocation and Implementation of Budget Estimates:
Based on the annual free-of-charge newspaper and magazine budget estimates announced, the National Ethnic Committee shall propose the allocation of funds for each newspaper, magazine, and issuing agency, which will be sent to the Ministry of Finance for review in accordance with the State Budget Law and its guiding documents. After obtaining the unified review opinion from the Ministry of Finance, the National Ethnic Committee shall enter into responsibility contracts with each entity and send them to the Ministry of Finance and the State Treasury where the National Ethnic Committee conducts transactions to coordinate implementation.
Based on the allocated budget and the contracts signed between the National Ethnic Committee and the Newspapers, Magazines, and Issuing Agencies, the Ministry of Finance shall provide funds according to the contracts by issuing payment orders to the National Ethnic Committee, and at the same time, on behalf of the National Ethnic Committee, pay the funds to the Newspapers, Magazines, and Issuing Agencies through payment authorization. The first advance payment shall be 70% of the contract value, and the remaining 30% shall be paid after the Newspapers, Magazines, and Issuing Agencies have completed the delivery of newspapers, magazines, and special issues according to the contract, confirmed by the Central Press Distribution Company for Newspapers and Magazines, and confirmed by the National Ethnic Committee for the Central Press Distribution Company.
At the end of the year, the National Ethnic Committee shall take the lead and coordinate with the Newspapers, Magazines, and Issuing Agencies to verify and confirm the actual number of copies of newspapers, magazines, and special issues delivered to each recipient during the year, implement the liquidation of signed contracts, and submit them to the Ministry of Finance as the basis for settling the budget for each agency and unit.
3. Settlement of Funds:
The state funds allocated for publishing and distributing free-of-charge newspapers, magazines, and special issues for ethnic minority and mountainous regions shall be recorded, accounted for, and reported for settlement by agencies and units in accordance with current accounting regulations. The National Ethnic Committee shall be responsible for reviewing the settlement of free-of-charge newspaper, magazine, and special issue funds, consolidating and submitting them to the Ministry of Finance for review and reporting the settlement in accordance with current regulations of the State Budget Law and its implementing guiding documents.
IV. IMPLEMENTATION
1. The Ethnic and Mountainous Region Department (or the department responsible for ethnic affairs and mountainous regions) of localities with beneficiaries of free-of-charge newspapers, magazines, and special issues shall be responsible for:
Taking the lead and coordinating with relevant sectors (Finance Departments, Culture and Information Departments, Education and Training Departments), based on the quantity of free-of-charge newspapers, magazines, and special issues provided to each recipient, they shall report to the Provincial People's Councils for specific directives and guidelines on receiving newspapers, magazines, and special issues from issuing agencies, storage locations, utilization targets, and management responsibilities, and shall guide and promote their use through various forms and means suitable to the actual situation in the locality. They shall define the responsibilities of district, commune-level authorities, and heads of units with recipients of free-of-charge newspapers, magazines, and special issues from the state in managing and utilizing these publications effectively.
Regularly inspecting quarterly the quantity of newspapers, magazines, and special issues provided by issuing agencies to each recipient as stipulated, the management work, and the effectiveness of utilizing each type of newspaper, magazine, and special issue, and identifying existing difficulties to promptly address them.
2. This Circular shall take effect 15 days after its publication in the Official Gazette and shall replace Circular No. 28/2002/TT-BTC dated March 26, 2002, issued by the Ministry of Finance, guiding the management and use of funds for free-of-charge newspapers and magazines for ethnic minority and mountainous regions. During the implementation process, if there are any difficulties, they should be reflected to the Ministry of Finance for supplementary guidance and appropriate amendments.
