CIRCULAR
Regulations on salary grading and promotion of ranks for citizens recruited into the People's Police
These regulations apply to citizens recruited into the People's Police

Pursuant to Decree No. 77/2009/NĐ-CP dated September 15, 2009 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

Pursuant to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the Salary System for Civil Servants, Public Officials, and Military Personnel;

Pursuant to Decree No. 205/2004/NĐ-CP dated December 14, 2004 of the Government stipulating the wage scale and wage system and the allowance regime in state-owned enterprises;

Pursuant to Decree No. 43/2007/NĐ-CP dated March 26, 2007 of the Government detailing and guiding the implementation of certain provisions of the Law on the People's Police;

At the proposal of the General Director of the General Department for Building the Police Force;

The Minister of Public Security promulgates this Circular regulating salary grading and promotion of ranks for citizens recruited into the People's Police.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular regulates salary grading and promotion of ranks for citizens recruited into the People's Police who are assigned to be officers, non-commissioned officers, or technical specialists.

Article 2. Applicability

1. This Circular applies to:

a) Officials, civil servants, public employees, workers, and contractual laborers working in various sectors within the People's Police (hereinafter collectively referred to as officials and public employees);

b) Officers and professional military personnel of the People's Army transferred to work in the People's Police;

c) Graduates from academies, universities, colleges, vocational high schools, and intermediate vocational training programs;

d) Non-commissioned officers and soldiers serving with fixed-term contracts in the People's Police;

e) Citizens belonging to ethnic minorities selected to strengthen the cadre force in mountainous areas, highlands, border regions, and islands.

2. Non-applicable Subjects:

a) Citizens recruited to be assigned as public employees;

b) Workers under contractual labor agreements as stipulated by the Minister of Public Security regarding the use of contractual labor in the People's Police.

Article 3. Conditions and Principles for Salary Grading and Promotion of Ranks

1. Consideration for salary grading and promotion of ranks shall only be made for recruitment cases that comply with the regulations of the Ministry of Public Security on selecting citizens for the People's Police.

Recruitment cases where job assignments do not match the recruitment quota or educational qualifications must be reassigned according to regulations before considering salary grading and rank promotion.

2. Salary grading and promotion of ranks for recruitment cases must be carried out strictly in accordance with the provisions of Chapter II of this Circular.

3. The basis for salary grading and rank promotion for recruitment cases includes: recruitment quota, assigned position/title, work experience, and salary progression (with mandatory social insurance participation) prior to recruitment (if applicable).

4. Citizens recruited and graded for salary will be conferred corresponding officer or non-commissioned officer ranks (professional or technical) based on their salary grade. The review period for subsequent rank promotions and salary increments starts from the date of rank conferment (except in specific cases with different provisions).

Article 4. Salary Grading During Temporary Recruitment Period

Citizens recruited into the People's Police who undergo a temporary recruitment period shall have their salaries graded as follows during this period:

1. If they were receiving a salary (consistent with their field of study and job title) according to the salary scales issued together with Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary systems for officials, civil servants, public employees, and armed forces (hereinafter referred to as Decree No. 204/2004/NĐ-CP); and Decree No. 205/2004/NĐ-CP dated December 14, 2004 of the Government on the salary scale system and salary supplements in state-owned companies (hereinafter referred to as Decree No. 205/2004/NĐ-CP), then the temporary recruitment period retains the previously assigned salary level. This period counts towards work experience for salary grading and rank promotion upon formal recruitment as stipulated in Chapter II of this Circular;

2. If they were receiving a fixed amount salary or were not graded according to the salary scales prescribed by the State prior to the temporary recruitment period, then based on their work experience, field of study, and job title, they will be assigned to the corresponding salary grade in the salary scales issued together with Decree No. 204/2004/NĐ-CP. Upon completion of the temporary recruitment period, their salary grade during the temporary recruitment period and the assigned job title will be considered for salary grading and rank promotion as stipulated in Chapter II of this Circular;

3. If they are graduates from academies, universities, colleges, vocational high schools, or intermediate vocational training programs recruited during the temporary recruitment period, then their initial salary grade will correspond to the defined salary grade for administrative officials, civil servants, and public employees based on their educational qualifications.

Chapter II

SPECIFIC PROVISIONS

Article 5. Classification of salary and promotion of rank for recruited officers, workers, and staff members

Officers, workers, and staff members recruited into the People's Public Security who are currently receiving salaries according to the salary scales and tables issued together with Decree No. 204/2004/NĐ-CP and Decree No. 205/2004/NĐ-CP shall be classified and promoted to corresponding ranks as follows:

1. In the case of recruitment based on university (or higher) quotas and currently receiving salaries according to the A1 civil servant or equivalent grade:

Specifically, for doctors (graduated from regular programs, six-year training period), if they have not been classified or promoted to civil servant or staff member grades ahead of schedule before being recruited into the People's Public Security, they will be considered for promotion to the next rank one year ahead of the term limit.

2. In the case of recruitment based on college quotas and receiving salaries according to the A0 civil servant or equivalent grade:

4. In the case of recruitment based on secondary quotas and receiving salaries according to the C civil servant or equivalent grade, or administrative support staff grade or equivalent grade:

For officers, workers, and staff members who, prior to recruitment into the People's Public Security, have held the final grade of the B1 to B15 scale (issued together with Decree No. 205/2004/NĐ-CP) for three years or more, each full three years will be counted as an additional grade on the transfer classification table.

Example: Mr. Nguyen Van A, a driver at a company for 11 years, receiving a salary coefficient of 3.60/2010 (grade 4/4, Scale B12); in 2014 was recruited as a driver at the Public Security of Province H. At the time of recruitment (in 2014), Mr. A had been holding the final grade (4/4) for 4 years. Therefore, Mr. A is considered to have received grade 5 to transfer to the technical specialization salary with a coefficient of 4.20 (N1-SC).

5. In the case where the recruited officer, worker, or staff member is not in line with their educational level (based on recruitment quota) when recruited into the People's Public Security, the conversion to the corresponding grade of the civil servant or staff member grade matching the educational level (at the time of recruitment) shall be implemented as follows:

Based on the converted civil servant or staff member grade corresponding to the educational level at the time of recruitment and the length of service, the transfer to the corresponding salary grade and promotion to officer or non-commissioned officer rank (specialization or technical specialization) within the People's Public Security shall be carried out according to the provisions of Clauses 1, 2, and 3 of this Article.

Example: Ms. Nguyen Thi B has worked as an administrative support staff for 06 years, receiving a salary coefficient of 1.54/2013 (grade 4/12, Scale for Administrative Support Staff in State Agencies and Units - Issued together with Decree No. 204/2004/NĐ-CP), in 2014 was recruited by the Public Security of Province K under the vocational high school accounting quota to work as an accountant at PH41. Ms. Nguyen Thi B will be classified and promoted as follows: According to the above conversion table, the current grade (grade 4) is converted to grade 2, B-grade civil servant or staff member (corresponding to the vocational high school education level). With grade 2, having 06 years of service and the job title, referring to Clause 3 of this Article, Ms. B will be classified with a salary coefficient of 3.50/N2-TC and promoted to the rank of Senior Sergeant in technical specialization.

Article 6. Classification of salary and promotion of rank for officers and professional military personnel of the People's Army transferring to other sectors

Officers and professional military personnel of the People's Army who transfer to work in the People's Public Security shall be classified in salary and promoted in rank as follows:

1. Based on the time of service, the level of officer rank salary or the level of professional military personnel salary and the job title assigned to take charge of, they will be transferred to the corresponding level of professional rank salary or technical specialty salary in the People's Public Security.

2. On the basis of the professional rank salary level or technical specialty salary level classified to implement the promotion of corresponding ranks of the Public Security force. In cases where the technical specialty rank (corresponding to the converted salary coefficient) is lower than the military rank already promoted before transferring to another sector, the promotion of technical specialty rank equivalent to the military rank (without changing the converted salary level) will be implemented and this rank will be retained until the corresponding technical specialty salary grade is increased to a higher rank.

3. The period for considering further promotion and salary increase will be calculated from the date of salary increase or officer rank promotion in the military or professional military personnel salary grade increase before transferring to work in the People's Public Security.

Article 7. Classification of salary and promotion of rank for graduates of academies and schools recruited into the People's Public Security

Graduates of academies, universities, colleges, vocational high schools, and vocational training schools recruited into the People's Public Security shall be classified in salary and promoted in rank as follows:

1. If assigned to the category of officers or non-commissioned officers in professional positions, they shall be classified in salary and promoted in rank according to the provisions of Circular No. 66/2009/TT-BCA dated November 25, 2009, issued by the Minister of Public Security regarding the promotion and advancement of ranks for graduates of public security academies.

In cases of recruitment based on the quota for master's degree holders and doctors (full-time concentrated system), they will be classified in salary and promoted to the rank of Second Lieutenant. After one year of work, if the unit evaluates that they have effectively utilized their professional expertise in the assigned tasks, they will be considered for promotion to the rank of First Lieutenant.

2. If assigned to the category of officers or non-commissioned officers in technical specialties, they will be classified in salary and promoted in rank as follows:

a) Recruitment based on the quota for master's degree holders: classified at salary grade 2 in the corresponding job group, senior technical specialty position, and promoted to the rank of Second Lieutenant; after one year of work, if the unit evaluates that they have effectively utilized their professional expertise in the assigned tasks, they will be considered for promotion to salary grade 3 and the rank of First Lieutenant. The period for considering the next salary grade increase will be carried out according to the general regulations of the Ministry on annual rank promotion and salary increase.

b) Recruitment based on the quota for bachelor's degree holders: classified at salary grade 2 in the corresponding job group, senior technical specialty position, and promoted to the rank of Second Lieutenant; after two years of work, if the unit evaluates that they have effectively utilized their professional expertise in the assigned tasks, they will be considered for promotion to salary grade 3 and the rank of First Lieutenant. The period for considering the next salary grade increase will be carried out according to the general regulations of the Ministry on annual rank promotion and salary increase.

c) Recruitment based on the quota for college degree holders: classified at salary grade 1 in the corresponding job group, senior technical specialty position, and promoted to the rank of Senior Sergeant; after two years of work, if the unit evaluates that they have effectively utilized their professional expertise in the assigned tasks, they will be considered for promotion to salary grade 2 and the rank of Second Lieutenant. The period for considering the next salary grade increase will be carried out according to the general regulations of the Ministry on annual rank promotion and salary increase.

d) Recruitment based on the quota for high school degree holders: classified at salary grade 1 in the corresponding job group, intermediate technical specialty position, and promoted to the rank of Corporal.

đ) Recruitment based on the quota for vocational training degree holders: classified at salary grade 1 in the corresponding job group, junior technical specialty position, and promoted to the rank of Private First Class.

Article 8. Salary classification and promotion of rank for non-commissioned officers and soldiers serving on a fixed-term basis who are transferred to a professional system

1. Non-commissioned officers and soldiers serving on a fixed-term basis who are transferred to a professional system shall be classified in salary as follows:

a) If they undertake work within the scope of officer or non-commissioned officer technical service positions, they shall be transferred from the level of allowance corresponding to their fixed-term non-commissioned officer rank to the level of salary corresponding to their non-commissioned officer technical service rank (maintaining the same rank).

The period for considering promotion of rank (if applicable) or increase in salary grade shall be calculated from the date of promotion to fixed-term non-commissioned officer rank (prior to transferring to the professional system);

b) If they undertake work within the scope of officer or non-commissioned officer technical positions, they shall be transferred from the level of allowance corresponding to their fixed-term non-commissioned officer rank to the salary grade within the group and position of technical non-commissioned officer trainee corresponding to their fixed-term non-commissioned officer rank based on the work undertaken.

The period for considering the next salary grade increase shall be calculated from the date of promotion to fixed-term non-commissioned officer rank (prior to transferring to the professional system).

2. Non-commissioned officers and soldiers who have completed university, college, or intermediate-level education before being transferred to a professional system shall still implement the transfer of salary classification as prescribed in Clause 1 of this Article (not implementing initial salary classification and promotion of rank corresponding to educational qualifications). In cases where local public security units have a need and non-commissioned officers are assigned work suitable to their field of study, they may apply their educational qualifications to consider promotion and salary increase according to regulations of the Ministry.

Article 9. Salary classification and promotion of rank for citizens belonging to ethnic minorities recruited

Citizens belonging to ethnic minorities (who have not received training at the intermediate level or higher) recruited to strengthen the cadre workforce for operational work in mountainous districts, highland areas, border regions, and islands shall receive the benefits of Private Second Class for the first six months. From the seventh month onwards, they shall be classified in salary and promoted to the rank of non-commissioned officer technical service.

Article 10. Salary classification and promotion of rank for other cases

1. Cadres, workers, and staff members who were not properly classified in salary or had wage developments inconsistent with the salary conversion tables prescribed in Article 5 of this Circular prior to recruitment into the People's Public Security Force must be reclassified into the correct salary grades as prescribed in Decree No. 204/2004/ND-CP, in accordance with their educational qualifications, time of service, and job responsibilities. Based on this, they shall be converted into the salary coefficient and promoted to the rank of officer or non-commissioned officer (technical service or technical positions) in the People's Public Security Force according to the provisions of Article 5 of this Circular.

In cases where they were improperly granted a salary grade increase or a higher salary scale by their previous unit prior to recruitment into the People's Public Security Force, they must be reclassified into the salary coefficient in the People's Public Security Force based on the salary grade and scale before the increase.

2. Cadres, workers, and staff members whose salary grade was already determined (before recruitment) and which is not specified in the salary conversion tables in Article 5 of this Circular or not classified according to the salary scales prescribed by the State, local public security units must consult with the General Department of Public Security Force Construction to determine the salary classification and promotion of rank before implementation according to authority.

3. Cases recruited into the People's Public Security Force under primary, intermediate, or college quotas but who had higher educational qualifications (intermediate, college, or university) before recruitment, if local public security units have a need and officers and non-commissioned officers are assigned work suitable to their field of study, then after three years (from the date of recruitment), they may apply their educational qualifications to consider promotion and conversion to salary grade according to their educational qualifications. Local public security units must consult with the General Department of Public Security Force Construction to determine the promotion of rank and conversion to salary grade for officers and non-commissioned officers before implementation.

Chapter III

IMPLEMENTATION

Article 11. Effective Date

1. This Circular takes effect from February 12, 2014.

Abolish Decision No. 1779/2005/QĐ-BCA(X13) dated December 5, 2005, of the Minister of Public Security regarding the salary system and promotion of rank for cadres, civil servants, workers, and staff members recruited into the People's Public Security Force and previous regulations of the Ministry of Public Security that conflict with the provisions of this Circular.

2. The provisions of this Circular also apply to the salary classification and promotion of rank for police workers (within the People's Public Security Force establishment) transferred to officer or non-commissioned officer technical service positions or officer or non-commissioned officer technical positions.

Article 12. Responsibility for Implementation

1. The Director of the General Department, Heads of Units under the Ministry, Directors of Public Security, and Directors of Provincial Fire Prevention and Fighting Departments directly under the Central Government are responsible for:

a) Implementing the salary classification and promotion of rank for citizens recruited into the People's Public Security Force in accordance with the provisions of this Circular;

b) Cooperating with the General Department of Public Security Force Construction to implement the salary classification and promotion of rank for cases prescribed in Article 10 of this Circular before implementation according to authority;

c) Reporting to the Ministry (through the General Department of Public Security Force Construction) on the promotion of rank for cases recruited by local public security units where the rank to be promoted falls within the authority of the Minister of Public Security or the Director of the General Department of Public Security Force Construction.

2. The Director of the General Department of Public Security Force Construction is responsible for:

a) Providing guidance and inspecting the implementation of salary classification and promotion of rank for citizens recruited in accordance with this Circular. If any cases of local public security units improperly implementing salary classification and promotion of rank are discovered, they must require those units to re-implement salary classification and promotion of rank.

b) Exchange with the Public Security units and localities to implement salary grading and rank promotion for cases of recruitment as stipulated in Article 10 of this Circular;

c) Report to the Ministry leadership for consideration and decision on rank promotion for cases within the authority of the Minister of Public Security;

d) Decide on rank promotion for cases within the authority of the Director of the General Department of Public Security Force Construction.

3. In the process of implementation, if there are any difficulties, the Public Security units and localities shall promptly report to the Ministry (through the General Department of Public Security Force Construction) for timely guidance.
