Decree No. 69/2020/ND-CP amends and supplements certain articles of Decree No. 08/2016/ND-CP dated January 25, 2016, of the Government on the number of Deputy Chairpersons of People's Committees and the procedures and formalities for election, resignation, dismissal, removal, transfer, and disciplinary action against members of People's Committees.

AMENDING AND SUPPLEMENTING SOME ARTICLES OF DECREE NO. 08/2016/NĐ-CP

JANUARY 25, 2016 OF THE GOVERNMENT ON THE QUANTITY

DEPUTY CHAIRS OF THE PEOPLE'S COMMITTEE AND PROCEDURES FOR ELECTION, RESIGNATION, REMOVAL FROM OFFICE, DISMISSAL, TRANSFER, AND DISCIPLINARY ACTION AGAINST MEMBERS OF THE PEOPLE'S COMMITTEE

BASED ON THE LAW AMENDING AND SUPPLEMENTING SOME PROVISIONS OF THE GOVERNMENT ORGANIZATION LAW AND THE LOCAL ADMINISTRATION ORGANIZATION LAW ON NOVEMBER 22, 2019;

THE GOVERNMENT ISSUES THIS DECREE TO AMEND AND SUPPLEMENT SOME PROVISIONS OF DECREE NO. 08/2016/NĐ-CP JANUARY 25, 2016 OF THE GOVERNMENT ON THE QUANTITY OF DEPUTY CHAIRS OF THE PEOPLE'S COMMITTEE AND PROCEDURES FOR ELECTION, RESIGNATION, REMOVAL FROM OFFICE, DISMISSAL, TRANSFER, AND DISCIPLINARY ACTION AGAINST MEMBERS OF THE PEOPLE'S COMMITTEE. ARTICLE 1. AMENDING, SUPPLEMENTING, AND REPEALING SOME CLAUSES OF SOME ARTICLES OF DECREE NO. 08/2016/NĐ-CP JANUARY 25, 2016 OF THE GOVERNMENT ON THE QUANTITY OF DEPUTY CHAIRS OF THE PEOPLE'S COMMITTEE AND PROCEDURES FOR ELECTION, RESIGNATION, REMOVAL FROM OFFICE, DISMISSAL, TRANSFER, AND DISCIPLINARY ACTION AGAINST MEMBERS OF THE PEOPLE'S COMMITTEE

||| Based on the proposal of the Minister of Home Affairs;

1. REPEALING CLAUSE 2 OF ARTICLE 1. 2. AMENDING AND SUPPLEMENTING POINT C OF CLAUSE 1 AND POINT C OF CLAUSE 2 OF ARTICLE 7 AS FOLLOWS: "1. FOR RURAL ADMINISTRATIVE UNITSC. TYPE I AND TYPE II COMMUNES SHALL HAVE NO MORE THAN TWO DEPUTY CHAIRS OF THE PEOPLE'S COMMITTEE; TYPE III COMMUNES SHALL HAVE ONE DEPUTY CHAIR OF THE PEOPLE'S COMMITTEE.

2. FOR URBAN ADMINISTRATIVE UNITS

C. TYPE I AND TYPE II WARD AND TOWNHOODS SHALL HAVE NO MORE THAN TWO DEPUTY CHAIRS OF THE PEOPLE'S COMMITTEE; TYPE III WARD AND TOWNHOODS SHALL HAVE ONE DEPUTY CHAIR OF THE PEOPLE'S COMMITTEE."

FROM THE EFFECTIVE DATE OF THIS DECREE UNTIL THE ELECTION OF THE PEOPLE'S COUNCIL FOR THE 2021-2026 TERM, THE QUANTITY OF DEPUTY CHAIRS OF THE PEOPLE'S COMMITTEE IN TYPE II COMMUNES, WARD AND TOWNHOODS SHALL CONTINUE TO BE IMPLEMENTED ACCORDING TO THE PROVISIONS OF DECREE NO. 08/2016/NĐ-CP.

MINISTERS, HEADS OF GOVERNMENT AFFILIATED AGENCIES, HEADS OF GOVERNMENT AGENCIES, CHAIRS OF THE PEOPLE'S COMMITTEES OF PROVINCES AND DIRECTLY-GOVERNED CITIES, AND ASSOCIATED ORGANIZATIONS AND INDIVIDUALS ARE RESPONSIBLE FOR ENFORCING THIS DECREE./.

c) For commune type I and type II, there shall be no more than two Deputy Chairpersons of the People's Committee; for commune type III, there shall be one Deputy Chairperson of the People's Committee.

2. Regarding administrative units in urban areas

c) For ward and town type I and type II, there shall be no more than two Deputy Chairpersons of the People's Committee; for ward and town type III, there shall be one Deputy Chairperson of the People's Committee."

Article 2. Effective Date

This Decree takes effect from July 1, 2020.

Article 3. Transitional Provisions

From the date this Decree takes effect until the election of the People's Council for the 2021-2026 term, the number of Deputy Chairpersons of the People's Committee for communes, wards, and towns type II shall continue to be implemented according to the provisions of Decree No. 08/2016/NĐ-CP.

Article 4. Responsibilities for Implementation

The Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of the People's Committees of provinces and centrally governed cities, and related organizations and individuals are responsible for implementing this Decree./.
