Regulations on Command and Control of Road Traffic by Traffic Police

Pursuant to the Law on Road Traffic Order and Safety 2024;
Pursuant to the Law on Roads 2024;
Pursuant to the Law on Handling Administrative Violations 2012; the Law Amending and Supplementing Certain Provisions of the Law on Handling Administrative Violations 2020;
Pursuant to Decree No. 01/2018/NĐ-CP dated August 6, 2018 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;
At the proposal of the Director of the Traffic Police Corps;
The Minister of Public Security issues this Circular regulating command and control of road traffic by traffic police.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular stipulates requirements, standards, tasks, powers, responsibilities, equipment, means, weapons, support tools, principles, forms in command and control of road traffic; division of labor and classification in command and control of road traffic; management, operation, exploitation of road traffic signal systems; use of smart devices supporting command and control of road traffic; procedures for command and control of road traffic; handling specific cases while performing command and control of road traffic by traffic police and responsibilities of other forces assigned to guide traffic on roads.
Article 2. Applicability
This Circular applies to:
1. Officers and non-commissioned officers of traffic police performing command and control of road traffic (hereinafter referred to as traffic police commanding and controlling traffic).
2. Public security units and localities.
3. Agencies, organizations, and individuals related to road traffic activities within the territory of the Socialist Republic of Vietnam.
Article 3. Principles of Command and Control of Road Traffic
1. Compliance with provisions of this Circular, other relevant laws, and regulations on implementing democracy in ensuring traffic order and safety.
2. Ensuring that persons and vehicles participating in traffic travel orderly, safely, and smoothly. In case of priority vehicles participating in traffic, they must be allowed to proceed first based on the order of priority of the vehicles to open lanes for traffic. For sections with many vehicles, allow them to proceed first and for longer periods; for sections with fewer vehicles, allow them to proceed later and for shorter periods; for sections with motor vehicles, allow them to proceed before sections with non-motorized vehicles.
3. Ensuring unity in organization, direction, management, division of labor, and coordination in command and control of road traffic.
4. When encountering convoys carrying high-ranking Party and State leaders and foreign guests escorted by traffic police, traffic police commanding and controlling traffic must salute according to the People's Public Security Regulations (Form No. 01 issued together with this Circular), except when performing traffic control actions.
Article 4. Requirements and Standards for Traffic Police Commanding and Controlling Traffic
1. Requirements
a) Master and strictly implement the provisions of this Circular and other relevant laws;
b) Fully and accurately perform assigned tasks; regulations on implementing democracy in ensuring traffic order and safety and the People's Public Security Regulations.
2. Standards
a) Hold a College Degree in People's Public Security or equivalent or higher. For officers and non-commissioned officers graduating from non-Public Security institutions, they must have completed legal and Public Security business training courses as prescribed;
b) Have undergone professional training in command and control of road traffic according to the program and content of the Traffic Police Corps;
c) Must be trained or instructed on operating procedures, handling situations, methods of using and maintaining when assigned to manage, operate, and exploit road traffic signal systems; use smart devices supporting command and control of road traffic; command and control of road traffic at the Traffic Control Center. intelligent equipment supporting command and control of road traffic; command and control of road traffic at the Traffic Control Center.
Article 5. Tasks, Powers of Traffic Police Commanding and Controlling Traffic and Responsibilities of Other Forces Assigned to Guide Traffic on Roads
1. Tasks of Traffic Police Commanding and Controlling Traffic
b) Command and control traffic, reroute, prevent and resolve traffic congestion on assigned routes and areas in accordance with regulations, coordinate with competent agencies to ensure traffic order and safety on assigned routes and areas;
c) Timely and strictly handle violations of traffic order and safety laws and other laws, ensuring compliance with legal procedures and authority;
d) Protect accident scenes, coordinate rescue efforts for victims, and resolve traffic accidents in accordance with legal provisions;
đ) Coordinate with units and functional agencies to prevent and combat crimes operating on road traffic routes and vehicles in accordance with legal provisions;
e) Identify weaknesses and deficiencies in state management of security and order to propose timely measures to address and rectify them to competent authorities.
2. Powers of Traffic Police Commanding and Controlling Traffic
a) Temporarily suspend the movement of people and vehicles on certain sections of the road, re-route traffic, designate temporary parking areas when traffic congestion occurs or when necessary to ensure security and order.
b) Within the scope and area assigned for command and control of road traffic, or according to plans and orders from competent authorities, stop vehicles to inspect and control persons and vehicles violating traffic order and safety as provided by law;
c) Impose administrative penalties on violations in the field of road traffic, security, and order, and other administrative violations in other state management fields as prescribed by law; apply measures to prevent and ensure the handling of administrative violations as prescribed by law;
d) Request agencies, units, organizations, and individuals to cooperate and support in resolving traffic accidents, congestion, and obstacles to traffic or other situations causing disruption to road traffic order and safety;
đ) Use weapons, auxiliary tools, and technical equipment as prescribed by law;
e) Perform other powers as prescribed by law.
3. For traffic control police officers, in addition to the tasks and powers stipulated in Clauses 1 and 2 of this Article, they must be responsible for collecting, analyzing, and evaluating relevant factors to develop solutions for managing road traffic operations to ensure order, safety, and smoothness;
4. Responsibilities of other forces assigned the task of guiding road traffic
a) Other police forces when assigned the task of ensuring traffic order and safety at intersections and complex points regarding traffic order and safety shall be responsible for guiding traffic, allocating lanes, and routes according to the assignment of traffic control and command police;
b) Police investigation forces, fire prevention and firefighting rescue forces upon receiving reports about traffic accidents with criminal signs or incidents related to vehicle fires or explosions must promptly arrive at the scene to handle the situation in accordance with the law and cooperate with traffic control and command police in ensuring traffic order and safety;
c) Other forces outside the Public Security sector when assigned the task of guiding road traffic shall be responsible for guiding and allocating traffic flow at complex points regarding traffic order and safety; assist in traffic control and command operations on roads according to the assignment of traffic control and command police;
Article 6. Equipment, means of transportation, weapons, and auxiliary tools of traffic control and command police
1. In addition to uniforms, equipment, and means of transportation prescribed for traffic police, traffic control and command police shall be equipped with:
a) Horns, traffic direction batons, white gloves, reflective vests, flashlights, traffic police raincoats, and rain boots;
b) Motorcycles, eight-speed locks, short guns, gun cases, handheld radios, radio microphone cords, radio microphones, electric batons, portable battery-powered loudspeakers, and marking paint cans for accident scenes;
c) Smart devices supporting traffic control and command that have been safety certified by authorized agencies and approved for use by the Ministry of Public Security;
d) Other technical equipment and devices as prescribed by the Ministry of Public Security.
2. The use of technical equipment and devices, weapons, and auxiliary tools must comply with legal provisions and regulations of the Ministry of Public Security;
3. The position of wearing weapons and auxiliary tools of traffic control and command police shall be implemented according to models 02A, 02B, and 02C issued along with this Circular;
4. The provision of traffic control stands and rain and sun shelters at intersections
a) Traffic control stands shall be cylindrical or hexagonal, painted white, with blue directional arrows on each side around the stand;
b) Rain and sun shelters shall be made of yellow fabric material with the logo of traffic police and the word "CSGT"; the frame and base materials must be sturdy, easy to move, disassemble, repair, and replace;
c) Specific dimensions, shapes, and the provision of traffic control stands and rain and sun shelters shall be decided by the Director of the Traffic Police Corps and the Provincial Public Security Director to ensure suitability with organizational structures, infrastructure, and safety for traffic control and command police, as well as for persons and vehicles participating in road traffic.
Article 7. Forms in traffic command and control work on roadways
The forms in traffic command and control work on roadways accompanying this Circular are as follows:
1. Form of salutation gesture (Form No. 01).
2. Form of wearing weapons and auxiliary tools for traffic command and control police (Forms No. 02A, 02B and 02C).
3. Form of plan for arranging forces to perform traffic command and control tasks on roadways; report book on results of traffic command and control shifts on roadways (Forms No. 03A and 03B).
4. Form of gesture indicating prohibition of all-way traffic (Forms No. 04A, 04B and 04C).
5. Form of gesture indicating permission to proceed (Forms No. 05A, 05B and 05C).
6. Form of gesture indicating right lane faster (Form No. 06).
7. Form of gesture indicating left lane faster (Form No. 07).
8. Form of gesture indicating right lane slower (Forms No. 08A and 08B).
9. Form of gesture indicating left lane slower (Forms No. 09A and 09B).
10. Form of gesture indicating right lane stop (Form No. 10).
11. Form of gesture indicating left lane stop (Form No. 11).
12. Form of gesture indicating vehicles turning left to pass through (Forms No. 12A, 12B and 12C).
Chapter II
ASSIGNMENT, GRADATION; MANAGEMENT, OPERATION, EXPLOITATION OF THE TRAFFIC SIGNAL SYSTEM ON ROADWAYS; USE OF SMART EQUIPMENT TO ASSIST TRAFFIC COMMAND AND CONTROL AND PROCEDURES FOR TRAFFIC COMMAND AND CONTROL ON ROADWAYS

Article 8. Assignment and gradation in traffic command and control work on roadways
1. The unit assigned the task of ensuring traffic order and safety on a certain route or area shall carry out traffic command and control work on that route or area or according to the directive of the Director of the Traffic Police Corps or the Provincial Public Security Director.
2. The Traffic Police Corps shall organize the implementation of traffic command and control work on expressways under its management; direct the deployment of traffic command and control work on roadways, coordinate traffic flow distribution at national roadway traffic routes when complex traffic situations arise involving multiple localities or other requirements for security and order assurance.
3. Provincial and centrally-administered city public security organs shall decide on the assignment and gradation of traffic command and control work on roadways within their jurisdiction based on actual conditions.
Article 9. Management, operation, exploitation of the traffic signal system on roadways
1. The traffic signal system on roadways must be connected to data with the Traffic Control Center to meet requirements for management, operation, command, direction, and statistics in traffic order and safety assurance work.
2. When managing and operating the traffic signal system on roadways, traffic police forces have the following responsibilities:
a) Advising, proposing, and recommending policies on planning, investment plans, and development of the traffic signal system on roadways in accordance with traffic organization and infrastructure; effectively operating and exploiting equipment of the traffic signal system on roadways, researching and applying intelligent traffic control;
b) Arranging forces to monitor and update traffic order and safety conditions and related information on roadway traffic routes to promptly adjust traffic signal cycles appropriately; coordinating with forces performing traffic order and safety assurance tasks on routes and areas to command, control, and distribute traffic flows when priority vehicles are moving or congestion, accidents, traffic incidents are detected, and handling violations of traffic order and safety laws.
c) Continuously monitoring and inspecting the operation of the traffic signal system on roadways to report, propose, and recommend competent authorities to timely maintain, repair, and replace when damage is found, ensuring stable and continuous system operation.
Article 10. Use of intelligent devices to support command and control of road traffic
Clause 1. The use of intelligent devices to support command and control of road traffic must meet requirements for national security, defense, traffic police operations, and safety for persons and vehicles participating in traffic.
Clause 2. Intelligent devices supporting command and control of road traffic are used to record information and data on traffic conditions on various routes and transmit such information and data to the Traffic Control Center; based on the volume and density of people and vehicles participating in traffic, traffic police forces must promptly direct adjustments to the operation of road traffic signal systems or implement plans for deploying personnel and equipment to organize traffic flow and route management, handle, and resolve situations causing disorder and traffic safety issues, or coordinate with relevant agencies in ensuring security and order.
Clause 3. Provide information about traffic order and safety conditions through mass media for traffic participants to choose appropriate travel times and routes.
Article 11. Development and Implementation of Plans for Command and Control of Road Traffic
Clause 1. Based on superior plans and actual traffic order and safety conditions, as well as security and order requirements, traffic police units shall develop work plans within their authority and assigned areas, allocate personnel, and assign specific tasks to each traffic command and control police officer (according to Model No. 03A issued together with this Circular). Personnel allocation must be suitable for the situation and characteristics at each location and intersection. For locations and intersections where two or more traffic command and control police officers are deployed, one officer must be designated as Team Leader, and the others as Team Members.
Clause 2. Traffic command and control police officers must thoroughly understand the plan content and assigned positions before performing duties; prepare and carefully check all equipment, weapons, auxiliary tools, related documents, and other items serving traffic command and control operations.
Clause 3. Traffic command and control police officers must arrive at their duty positions ten minutes early to grasp traffic order and safety conditions and receive ongoing cases handed over from the previous shift (if any); inspect and monitor the operation of road traffic signal systems; if the road traffic signal system operates abnormally, immediately report to the unit commander or the Traffic Control Center for resolution. At the end of the shift, if traffic order and safety conditions remain complex, report to the unit commander for guidance and continue to cooperate with the next shift's traffic command and control police officers until traffic order and safety conditions return to normal.
Clause 4. Upon completion of the shift, the Team Leader or traffic command and control police officer (when there is only one officer) must compile the situation, report the results of the work (according to Model No. 03B issued together with this Circular), and hand over equipment, vehicles, weapons, auxiliary tools, and case files to the unit commander or duty officer.
Article 12. Forms of Operation of Traffic Command and Control Police
1. Directly commanding and controlling traffic on road traffic routes
a) Commanding and controlling traffic at intersections;
b) Commanding and controlling traffic at a location or area on the road when there is road traffic congestion;
c) Commanding and controlling road traffic in areas where events, festivals, conferences take place.
2. Commanding and controlling road traffic from the Traffic Control Center.
Article 13. Assignment of Tasks for Traffic Command and Control Police Operating Directly on Road Traffic Routes
1. Commanding and controlling traffic at intersections
a) For intersections with 01 Traffic Command and Control Police Officer
In cases where traffic order and safety at the intersection are normal, the Traffic Command and Control Police Officer must stand in a position that is advantageous for observation and monitoring to guide participants in traffic to move orderly, safely, and in accordance with regulations; detect and handle violations of traffic order and safety, initially resolve other law violations or traffic accidents, and implement reporting procedures as prescribed.
In cases where there are complex developments regarding traffic order and safety at the intersection, the Traffic Command and Control Police Officer stands at the center of the intersection or on a platform if the intersection is equipped with a control platform.
b) For intersections with 02 or more Traffic Command and Control Police Officers
The Team Leader is responsible for commanding and managing all activities of the Team and assigning specific positions to each Team Member.. When traffic signal lights malfunction or the density of people and vehicles participating in traffic is high, the Team Leader or assigns a Team Member to stand at the center of the intersection or on a platform if the intersection is equipped with a control platform; direct, inspect, and handle violations of traffic laws; and implement reporting procedures as prescribed.
Team Members stand at the edge of the stop line or between the centerlines of the stop line (on the main road, where the density of people and vehicles participating in traffic is high or complex regarding traffic order and safety). Depending on the complexity of traffic order and safety along different roads, Team Members may change their positions to another road direction when changing traffic signal lights. Team Members are responsible for directing traffic participants to move orderly and safely according to traffic signal lights or commands from the Traffic Command and Control Police Officer standing at the center of the intersection or on a control platform; detecting and handling violations of traffic order and safety, initially resolving other law violations or traffic accidents as prescribed; and performing other tasks assigned by the Team Leader. controls traffic from the central position of the intersection or on the traffic control stand; detects and handles violations of traffic order and safety, initially resolves other law violations or traffic accidents as prescribed; performs other tasks assigned by the Team Leader;
c) The scope of operation of Traffic Command and Control Police is from the center of the intersection to the stop lines or the boundary of the intersection area. In cases where incidents related to social order and safety or traffic accidents occur outside the intersection area, Traffic Command and Control Police must directly or coordinate with other forces to resolve them as prescribed.
2. Commanding and controlling traffic at a location or area on the road when there is road traffic congestion
Based on the situation and degree of traffic congestion, forces are deployed to command and control traffic at various locations on the road. Deployment of forces is carried out according to the following provisions:
a) Deploying forces at diversion points at the outermost part of the congested area. At these points, the assigned forces have the task of guiding and diverting traffic or temporarily stopping vehicles from afar according to preventive and congestion resolution plans or directives from superiors to limit vehicles entering the congested area, creating conditions for vehicles to exit the congested area.
b) Deploying forces along the route in the congested area to control and guide traffic, preventing vehicles from encroaching on each other's lanes, and quickly clearing traffic from outside to the congested area, creating conditions for rescue and emergency response forces to quickly reach the scene to resolve causes of congestion.
3. Commanding and controlling road traffic in areas where events, festivals, conferences take place
Based on the actual situation regarding traffic order and safety, security requirements, and the scale, nature, and importance of the event, festival, or conference being organized, traffic police units conduct surveys, develop plans, or deployment schemes to guide and control traffic, divert traffic, and delineate routes at intersections, complex areas regarding traffic order and safety within the event, festival, or conference organization area, and on surrounding roads to ensure orderly, safe, and smooth traffic.
Article 14. Commanding and Controlling Road Traffic at the Traffic Control Center at the Traffic Control Center
1. Traffic police officers responsible for commanding and controlling road traffic shall receive, record information, monitor, supervise, analyze, evaluate, forecast situations related to road traffic order and safety through the camera system and other monitoring tools connected to the Traffic Control Center to implement tasks according to plans and schemes approved by competent authorities.
2. In case of complex situations regarding road traffic order and safety or requirements for ensuring security and order within the assigned management area, traffic police officers must promptly adjust traffic signal cycles or report to competent authorities to direct the deployment of forces, traffic diversion, handling of violations of road traffic order and safety, providing traffic condition information to road users or informing relevant units to mobilize forces and means to perform rescue operations as prescribed.
3. The National Traffic Control Center directly directs road traffic command and control work on expressways managed by the Highway Police Department and directs provincial and centrally-administered city traffic control centers to implement road traffic command and control work according to Clause 1 and Clause 2 of this Article.
4. The provincial and centrally-administered city Traffic Control Centers shall be responsible for:
a) Implement regulations stipulated in Clause 1 and Clause 2 of this Article and directives from the National Traffic Control Center;
b) In case of complex situations regarding road traffic order and safety on roads under their management that may spread to neighboring provinces and cities, they must immediately report to the National Traffic Control Center for timely guidance.
Article 15. Use of Horn and Speaker Signals in Commanding and Controlling Road Traffic
1. Horn signals are used in conjunction with traffic command and control gestures, specifically:
a) A long, strong horn blast indicates stop;
b) A short, quick horn blast indicates permission to proceed;
c) A long horn blast followed by a short one indicates permission to turn left;
d) Two short, strong horn blasts indicate slow down;
e) Three short, quick horn blasts indicate speed up;
f) Continuous strong horn blasts indicate stopping for inspection or signaling a violation.
2. For certain locations with complex traffic order and safety conditions, traffic police officers may use speakers mounted on vehicles or handheld battery-powered speakers to remind, guide, or request road users to comply with traffic command and control operations.
Article 16. Gestures for Commanding and Controlling Road Traffic
1. Gesture indicating prohibition of all-direction traffic flow (according to models 04A, 04B, and 04C issued together with this Circular)
a) Stand at attention;
b) Blow one long, strong horn blast simultaneously raising the right hand holding the baton close to the body, turning it slowly clockwise towards the front until the arm is straight up, palm facing forward above the head, baton vertical, left hand hanging straight down along the seam of the trousers. This gesture prohibits traffic flow in all directions.
If people and vehicles are still moving within the intersection, they should quickly exit the intersection. At intersections where there are designated stopping positions, they must stop at the designated positions.
2. Gesture indicating permission to proceed (according to models 05A, 05B, and 05C issued together with this Circular)
After prohibiting all-direction traffic flow (when all people and vehicles within the intersection have passed, except those required to stop at designated positions), permission to proceed must be given, timing depending on traffic volume and conditions. The sequence of actions is as follows:
a) From the position of prohibiting all-direction traffic flow;
b) Blow one short, quick horn blast simultaneously lifting the left hand while rotating the right hand holding the baton counterclockwise in front of the face until both hands are stretched out horizontally at shoulder level, right hand holding the baton forming a straight line parallel to the ground, palm facing down. When giving the permission to proceed signal, if the permitted time is longer, traffic police officers may lower one hand. This gesture allows traffic on the right and left sides of the traffic police officer to proceed, while those in front and behind must stop.
3. Gesture indicating faster movement on the right side (according to model 06 issued together with this Circular)
From the position of granting permission to proceed, fold the right arm holding the baton from the elbow to the hand towards the chest, then extend it like the permission to proceed gesture, folding and unfolding the arm at least three times, each time combined with three short, quick horn blasts, looking to the right.
4. Gesture indicating faster movement on the left side (according to model 07 issued together with this Circular)
From the position of granting permission to proceed, fold the left arm from the elbow to the hand behind the neck, slightly tilted upwards, palm facing the neck, then extend it like the permission to proceed gesture, folding and unfolding the arm at least three times, each time combined with three short, quick horn blasts, looking to the left.
5. Gesture indicating slower movement on the right side (according to models 08A and 08B issued together with this Circular)
From the posture indicating permission to proceed, the right hand holds the baton and pulls it horizontally to waist level, the baton hanging straight along the trouser seam, the right palm facing down, lifting up and down at least three times, each time combined with two short, strong horn blasts, eyes directed to the right side.
6. The action to signal the left side to slow down (as per model number 09A and 09B issued together with this Circular)
From the posture indicating permission to proceed, the left hand pulls horizontally to waist level, the left palm facing down, lifting up and down at least three times, each time combined with two short, strong horn blasts, eyes directed to the left side.
7. The action to signal the right side to stop (as per model number 10 issued together with this Circular)

9. The action to signal vehicles to turn left through the lane (as per model number 12A, 12B, and 12C issued together with this Circular)
a) From the posture indicating permission to proceed, the right hand holds the baton and slowly turns it forward to extend straight across the shoulder level, the right palm facing down, combined with one long, strong horn blast. The left hand slowly moves forward from below to above the face, the left hand straight, the left palm facing down slowly tilts to vertical, moving back and forth at least three times, each time combined with one short horn blast, eyes directed to the left side where vehicles are permitted to turn left through the lane;
b) In this posture, all types of vehicles and pedestrians from the right side and behind the traffic control officer must stop; in front, vehicles are allowed to turn right; on the left side of the traffic control officer, vehicles are allowed to go in all directions.
Chapter III
RESOLUTION OF SOME SPECIFIC SITUATIONS DURING
THE PERFORMANCE OF TRAFFIC CONTROL AND COMMAND TASKS ON ROADS
Article 17. Resolution of road traffic congestion
1. Traffic control officers must be familiar with the plans for preventing and resolving traffic congestion at intersections and routes that have been approved by competent authorities.
2. When minor traffic congestion occurs at intersections or routes, they must base their actions on the actual situation and the plan for preventing and resolving traffic congestion to分流路況,分段,分道,進行允許通行或禁止通行的措施。如果超出自身能力範圍無法解決,則應立即報告單位指揮官增派人員,遠端分流,及時解決,防止嚴重和長期的交通堵塞。
3. When severe traffic congestion occurs involving multiple intersections, routes, or areas, the following measures should be taken: as follows:
a) Quickly determine the cause, location, time, and severity of the traffic congestion;
b) Immediately report to the unit commander to direct the reinforcement of personnel and equipment, coordinate with relevant units to guide and control traffic, implement appropriate diversion and channeling, and conduct remote diversion according to the plan for preventing and resolving traffic congestion.
4. When traffic congestion persists over a wide area and involves adjacent regions or interconnecting routes, the following actions should be taken:
a) If traffic congestion occurs within the jurisdiction of the Provincial Public Security Traffic Police Department, the Provincial Public Security Traffic Police Department shall be responsible for reporting to the Provincial Public Security Director and directly notifying the adjacent Provincial Public Security Traffic Police Department related to the traffic congestion to arrange personnel and equipment for coordination and remote diversion, preventing vehicles from entering the congested area. At the same time, report to the Highway Traffic Police Corps for unified command;
b) If traffic congestion occurs on expressways managed by the Highway Patrol and Inspection Department under the Highway Traffic Police Corps, the Highway Patrol and Inspection Department shall be responsible for reporting to the Corps Director for unified command and coordinating with the Provincial Public Security Traffic Police Department related to the resolution of traffic congestion in accordance with regulations.
5. During traffic congestion, traffic police forces must cooperate with information and communication agencies to announce on mass media about the traffic order and safety situation, traffic diversion measures implemented by the traffic police force, so that participants in traffic can choose appropriate travel times and routes.
6. For intersections and routes that frequently experience traffic congestion, traffic police forces must conduct surveys, evaluations, identify patterns and causes of traffic congestion, and take measures to resolve traffic congestion within their authority; propose to relevant functional agencies to address organizational traffic issues causing congestion.
Article 18. Commanding and controlling traffic in case of road traffic accidents
1. Upon discovering or receiving information about a road traffic accident, traffic command and control police must immediately report to their direct unit commander and carry out tasks according to the regulations of the Ministry of Public Security on responsibility allocation and coordination relationships in traffic accident investigation and resolution work; the traffic police's procedures for investigating and resolving road traffic accidents. 2. In cases where the accident does not fall within their jurisdiction, traffic command and control police must notify the competent authority to handle it; when the functional unit arrives to resolve the situation, traffic command and control police have the responsibility to exchange information, hand over tasks already performed, and cooperate in resolving the incident (if required) according to their assigned functions and responsibilities.
3. Deploy forces to guide and control traffic, reroute and zone traffic to ensure that traffic congestion and accidents do not occur in the accident area or promptly resolve traffic congestion caused by the accident.
Article 19. Handling situations where violators do not comply with traffic order and safety violations processed by traffic command and control police; motor vehicles parked causing traffic congestion
1. In cases where violators do not comply with traffic order and safety violations processed by traffic command and control police
a) Briefly and clearly explain to the violator their violation and the measures for resolution according to the law to encourage voluntary compliance;
b) If the violator does not comply, temporarily seize the relevant documents or vehicle, invite witnesses to sign the temporary seizure record, then invite the violator to the unit's headquarters for resolution or guide them on how to file a complaint according to the law.
2. In cases where motor vehicles are parked causing traffic congestion
a) Require the driver to present related documents for inspection, move the vehicle out of the congested area, issue an administrative violation record if the driver parks improperly or does not comply with traffic command and control police instructions, and resolve the situation according to the regulations; simultaneously organize forces to guide and control traffic, clear traffic congestion;
b) In cases where the driver locks the vehicle and leaves or is not present, use technical equipment to record images, report to the unit commander to take measures to move the vehicle out of the congested area, invite witnesses, seal necessary parts of the vehicle, and issue a record according to the regulations; simultaneously organize forces to guide and control traffic, clear traffic congestion.
Article 20. Handling situations where floods, storms, or other incidents obstruct road traffic
1. In cases of floods or storms
a) Post temporary prohibitory signs, guide and control traffic, reroute and zone traffic to ensure orderly, safe, and smooth passage for people and vehicles;
b) Immediately notify relevant authorities to take timely measures; at the same time, report to the unit commander for guidance.
2. In cases where vehicles traveling on the road suddenly break down, stall, or obstacles appear on the road causing traffic obstruction, traffic command and control police must require drivers and traffic participants to assist or coordinate with relevant authorities to move the vehicle or obstacle off the road to ensure the safe and smooth passage of vehicles and traffic participants.
2. In cases where a vehicle traveling on the road suddenly breaks down, stalls, or there is an obstacle in the road causing traffic obstruction, the traffic command and control police must request the driver or other traffic participants to assist or coordinate with relevant authorities to move the vehicle or obstacle out of the road to ensure safe and smooth passage for vehicles and traffic participants.
Article 21. Handling cases where public disorder incidents disrupt traffic order and safety on roads
1. Use technical equipment to record the incident; immediately stop the unlawful acts, confiscate weapons (if any), check the identity documents of those involved, organize emergency medical assistance (if necessary); cooperate with functional forces to apply measures according to regulations, preventing complex situations regarding security and public order.
2. Disperse crowds (if present).
3. Prepare a record documenting the incident and require those involved to report to the nearest police station or local authority for resolution.
4. In cases where the violator intentionally refuses to comply with the police's demands, uses force or threatens to use force against law enforcement officers, preventive, blocking, and handling measures against such resistance shall be implemented according to regulations. At the same time, use technical equipment or devices capable of recording audio and video to document the incident. If traffic congestion occurs, handle it according to Article 17 of this Circular. In serious cases beyond the capacity to resolve, immediately report to the unit commander for instructions; simultaneously, promptly inform the local police and authorities about the incident to coordinate in resolving it.
Article 22. Handling certain other cases
Drivers who do not comply with stop signals and flee; violators who do not comply with control requests, incite others to obstruct law enforcement; violators who verbally abuse, threaten, obstruct, or push law enforcement officers; violators who do not comply with inspections, requests to view patrol plans, inspection equipment, or recordings of traffic police operations; violators who exploit social media to disseminate false information, misinformation, distortions, slander, or insults against the reputation of traffic police forces or the honor and dignity of individual officers while performing their duties; drivers who ram into law enforcement officers; drivers who use violence, weapons, dangerous objects against law enforcement officers; cases of immediate crime detection involving the transportation of goods or items that indicate criminal activity; handling incidents involving foreign nationals or vehicles violating traffic order and safety or other violations shall be carried out by traffic police commanders according to Article 73 of the Road Traffic Order and Safety Law, relevant regulations of the Ministry of Public Security on patrol, inspection, and administrative violation handling in the field of road traffic, and other related laws.
Chapter IV
IMPLEMENTATION
Article 23. Effectiveness of Implementation
1. This Circular shall take effect from January 1, 2025.
2. Circular No. 26/2017/TT-BCA dated August 22, 2017 of the Minister of Public Security on traffic command and control by traffic police on roads becomes invalid from the date this Circular takes effect.
Article 24. Responsibility for Implementation
1. The Director of the Traffic Police Corps is responsible for:
a) Directing, monitoring, guiding, inspecting, and urging units and localities under the Ministry of Public Security to implement this Circular;
b) Directing the development of training programs, plans, and content for traffic command and control operations;
c) Organizing training for traffic command and control operations for officers and soldiers under the Traffic Police Corps and leaders and commanders of traffic police units nationwide;
d) Directing traffic command and control operations, organizing training or guidance on the operation procedures, usage methods, and maintenance of traffic signal systems and smart devices supporting traffic command and control operations for units.
2. The Provincial Public Security Director is responsible for:
a) Organizing training for traffic command and control operations for traffic police officers and other police forces assigned traffic guidance tasks within their jurisdiction according to the training materials compiled by the Traffic Police Corps;
b) Organizing training or guidance on the operation procedures, usage methods, and maintenance of traffic signal systems and smart devices supporting traffic command and control operations for units under the provincial public security agency.
3. Heads of units under the Ministry of Public Security; Provincial Public Security Directors, Directors of centrally-administered city public security agencies are responsible for implementing this Circular.
During implementation, if there are difficulties or obstacles, units and local public security agencies should report to the Ministry of Public Security (through the Traffic Police Corps) for timely guidance./.
