ON THE RECEIPT, CLASSIFICATION, AND HANDLING OF PETITIONS, COMPLAINTS, AND SUGGESTIONS SUBMITTED TO THE NATIONAL ASSEMBLY, THE STANDING COMMITTEE OF THE NATIONAL ASSEMBLY

THE NATIONAL ETHNIC COUNCIL AND THE COMMITTEES OF THE NATIONAL ASSEMBLY

THE STANDING COMMITTEE OF THE NATIONAL ASSEMBLY
SOCIALIST REPUBLIC OF VIET NAM

BASED ON THE CONSTITUTION OF THE SOCIALIST REPUBLIC OF VIETNAM IN 1992 AS AMENDED AND COMPLEMENTED BY RESOLUTION NO. 51/2001/QH10;
Pursuant to the Law on the Organization of the National Assembly amended and supplemented by Law No. 83/2007/QH11;
Pursuant to the Law on the Supervisory Activities of the National Assembly No. 05/2003/QH11;
Pursuant to the Law on Petitions and Complaints amended and supplemented by Law No. 26/2004/QH11 and Law No. 58/2005/QH11;
Pursuant to Resolution No. 26/2004/QH11 of the National Assembly promulgating the Rules of Procedure of the Standing Committee of the National Assembly and Resolution No. 27/2004/NQ-QH11 of the National Assembly promulgating the Rules of Procedure of the National Ethnic Council and Committees of the National Assembly;
At the proposal of the Chairman of the Committee for People's Petitions,

RESOLUTION:

Article 1.

This Resolution stipulates the procedures for receiving, classifying, and handling petitions and letters submitted to the National Assembly, the Standing Committee of the National Assembly, and the committees of the National Assembly.

The National Ethnic Council, Committees of the National Assembly, the Committee for People's Petitions, and the Committee for Deputies' Work of the Standing Committee of the National Assembly shall be responsible for receiving and handling petitions and letters of complaints and suggestions from citizens within their respective areas of responsibility.

Article 2.

1. Petitions and letters submitted to the National Assembly, the Standing Committee of the National Assembly,

2. Petitions and letters submitted to the National Ethnic Council, Committees of the National Assembly shall be handled as follows:

a. Petitions and letters within the area of responsibility shall be handled by the National Ethnic Council, Committees of the National Assembly according to their authority;

b. Petitions and letters not within the area of responsibility shall be transferred to other National Ethnic Councils, Committees of the National Assembly, the Committee for Deputies' Work, or the Committee for People's Petitions for handling according to their authority.

Article 3.

The National Ethnic Council shall handle petitions and letters with the following contents:

1. Suggestions and complaints regarding the implementation of programs and projects for economic and social development in mountainous regions and ethnic minority areas; about training, nurturing, and utilizing cadres from ethnic minorities, and other suggestions and complaints within the area of responsibility of the National Ethnic Council;

2. Reports of violations by agencies, organizations, or individuals in the fields specified in Clause 1 of this Article.

Article 4.

The Committee for Legal Affairs shall handle petitions and letters with the following contents:

1. Suggestions and complaints related to property concerning the implementation of socialist transformation policies; treasury bonds, treasury bills, loans from the people during wartime; boundary disputes; administrative violations; and other suggestions and complaints within the area of responsibility of the Committee;

2. Reports of violations by agencies, organizations, or individuals in the fields specified in Clause 1 of this Article.

Article 5.

The Committee for Judicial Affairs shall handle petitions and letters with the following contents:

1. Suggestions and complaints about court decisions on criminal, civil, family, business, commercial, labor, administrative matters; about enforcement of judgments, judicial assistance; compensation in the field of justice; about arrest, search, seizure of assets, detention, pre-trial detention, prosecution, investigation, indictment, trial by judicial authorities; about requesting reduction of prison sentences, requesting pardon for death sentences; about applying judicial measures and other suggestions and complaints within the area of responsibility of the Committee;

2. Reports of crimes and information about criminal offenses;

3. Reports of corruption acts as defined in Article 3 of the Anti-Corruption Law;

4. Reports of violations by agencies, organizations, or individuals in the fields specified in Clauses 1, 2, and 3 of this Article.

Article 6.

The Economic Committee shall handle petitions and letters with the following contents:

1. Suggestions and complaints about economic management, monetary policy, banking; about production and business activities; about houses, land, and property on land under the jurisdiction of administrative state agencies; about compensation prices when land is reclaimed and other suggestions and complaints within the area of responsibility of the Committee;

2. Reports of violations by agencies, organizations, or individuals in the fields specified in Clause 1 of this Article.

Article 7.

The Finance and Budget Committee shall handle petitions and letters with the following contents:

1. Suggestions and complaints about finance, budget, tax, customs, securities, auditing, and other suggestions and complaints within the area of responsibility of the Committee.

2. Reports of violations by agencies, organizations, or individuals in the fields specified in Clause 1 of this Article.

Article 8.

The Defense and Security Committee shall handle petitions and letters with the following contents:

1. Suggestions and complaints about the implementation of systems and policies in the Army and Police; about houses and land managed by the Ministry of Defense and the Ministry of Public Security and other suggestions and complaints within the area of responsibility of the Committee;

2. Reports of violations by agencies, organizations, or individuals in the Army and Police, except for petitions and letters specified in Clause 4 of Article 5 of this Resolution.

Article 9.

The Committee for Culture, Education, Youth, Children, and Adolescents shall handle petitions and letters with the following contents:

1. Suggestions and complaints about culture, information, education, training, sports, press, radio, television, advertising, policies towards youth, adolescents, and children and other suggestions and complaints within the area of responsibility of the Committee;

2. Reports of violations by agencies, organizations, or individuals in the fields specified in Clause 1 of this Article.

Article 10.

The Committee for Social Issues shall handle petitions and letters with the following contents:

1. Suggestions and complaints about labor, employment, wages; about the implementation of policies for persons with meritorious service and preferential policies; about medical examination, treatment, hospital fees, health insurance, population and family planning; about social insurance; about the implementation of social policies, religious policies, and other suggestions and complaints within the area of responsibility of the Committee;

2. Reports of violations by agencies, organizations, or individuals in the fields specified in Clause 1 of this Article.

Article 11.

The Committee for Science, Technology, and Environment shall handle petitions and letters with the following contents:

1. Suggestions and complaints about science, technology, and environmental resources; policies for the development of science, technology, and environmental resources; about important national works as decided by the National Assembly and other suggestions and complaints within the area of responsibility of the Committee;

2. Reports of violations by agencies, organizations, or individuals in the fields specified in Clause 1 of this Article.

Article 12.

The Foreign Relations Committee shall handle petitions and letters with the following contents:

1. Suggestions and complaints from foreign organizations and individuals and other suggestions and complaints within the area of foreign relations or related to foreign relations;

2. Reports of violations by agencies, organizations, or individuals in the fields specified in Clause 1 of this Article.

Article 13.

The Committee for Deputy Work assists the Standing Committee of the National Assembly in handling complaints and reports from citizens regarding elections for National Assembly deputies; reports on National Assembly deputies, cadres managed by the Standing Committee of the National Assembly, and cadres working at the National Assembly under central management.

Article 14.

The Committee for People's Petitions assists the Standing Committee of the National Assembly in handling petitions and letters from citizens related to the areas of responsibility of multiple Committees and the National Ethnic Council of the National Assembly, petitions and letters not within the area of responsibility of the National Ethnic Council, Committees of the National Assembly, and the Committee for Deputy Work.

Article 15.

1. The Standing Committee of the National Assembly's Ethnic Council, the Standing Committees of the National Assembly's Committees, the Petitions Board, and the Deputies' Affairs Board shall report to the National Assembly's Standing Committee every six months or annually on the receipt, handling of complaints, petitions, and citizens' suggestions, and the results of oversight activities regarding the resolution of complaints and petitions.

2. The Petitions Board assists the National Assembly's Standing Committee in compiling the results of the receipt and handling of citizens' letters and the outcomes of the oversight activities conducted by the National Assembly's Ethnic Council, Committees, and Boards under the Standing Committee concerning the resolution of complaints and petitions, and shall periodically report to the National Assembly's Standing Committee according to the Rules of Procedure of the National Assembly's Standing Committee and the Rules of Procedure of the National Assembly sessions.

Article 16.

The Standing Committee of the National Assembly's Ethnic Council, the National Assembly's Committees, the Director of the National Assembly's Office, the Head of the Petitions Board, and the Head of the Deputies' Affairs Board of the National Assembly's Standing Committee are responsible for implementing this Resolution.

Article 17.

This Resolution replaces Resolution No. 715/2004/NQ-UBTVQH11 dated June 18, 2004 of the National Assembly's Standing Committee of the Eleventh Session and takes effect from the date of signing.
