Issuing regulations on organization and operation of the National Management Board for the Global Environment Facility of Vietnam

MINISTER OF SCIENCE AND TECHNOLOGY AND ENVIRONMENT

Pursuant to Decree No. 22/CP dated May 22, 1993 of the Government on tasks, powers, and organizational structure of the Ministry of Science, Technology, and Environment;

Pursuant to the Prime Minister's Decision No. 07/TTg dated January 3, 1997 regarding the establishment of the National Management Board for the Global Environment Facility of Vietnam and the assignment of the lead agency for activities related to the Global Environment Facility (GEF);

Pursuant to Circular No. 2095/KGVX dated May 4, 1996 of the Government Office directing the Ministry of Science, Technology and Environment to issue regulations on the operation of the National Management Board for the GEF - Vietnam.

Considering the proposals of the Directors of the Environmental Protection Department and the International Relations Department,

Article 1: This Decision hereby promulgates the Regulations on the organization and operation of the National Management Board for the Global Environment Facility of Vietnam (hereinafter referred to as GEF - Vietnam).

Article 2: The Chairmen, members of GEF - Vietnam, the Director General of the Ministry's Office, the Heads of the International Relations Department, the Director of the Environmental Protection Department, and the Head of the Human Resources Department of the Ministry of Science, Technology and Environment shall be responsible for implementing this Decision.

Article 3: This Decision shall take effect from the date of signing.

REGULATIONS ON ORGANIZATION AND OPERATION

OF THE NATIONAL MANAGEMENT BOARD FOR THE GLOBAL ENVIRONMENT FACILITY OF VIETNAM

Article 1. Function:

The National Management Board for the Global Environment Facility of Vietnam (hereinafter referred to as GEF - Vietnam) assists the Minister of Science, Technology and Environment in coordinating activities related to global environmental protection under the Global Environment Facility (GEF).

Article 2. GEF - Vietnam has the following tasks:

Directing and guiding ministries, sectors, localities, and mass organizations to develop projects on environmental protection related to the GEF based on the orientation of economic and social development and environmental protection in Vietnam and the provisions of the GEF.

Compiling and reviewing projects and recommendations related to the GEF from ministries, sectors, localities, and mass organizations to assist the Minister of Science, Technology and Environment in presenting them to the Government and the GEF.

Supervising the implementation of GEF projects and other related activities.

Article 3. Powers of GEF - Vietnam:

GEF - Vietnam represents Vietnam in coordinating activities and handling relations with the GEF.

Assisting the Minister of Science, Technology and Environment in examining and approving projects for submission to the Government and the GEF, coordinating the management, monitoring, supervision, and evaluation of projects implemented within the framework of the GEF.

Article 4. Organization of GEF - Vietnam

GEF - Vietnam represents Vietnam in the GEF. The permanent office of GEF - Vietnam operates on a part-time basis and is responsible for managing the activities of GEF - Vietnam according to its functions, tasks, and powers stipulated in Articles 1, 2, and 3 of these Regulations.

The Chairman of GEF - Vietnam is a Deputy Minister of Science, Technology and Environment, appointed by the Minister of Science, Technology and Environment, operating on a part-time basis, and responsible for assisting the Minister in managing the activities of GEF - Vietnam according to the functions, tasks, and powers stipulated in these Regulations.

GEF - Vietnam has two Vice Chairmen appointed by the Minister of Science, Technology and Environment, who are responsible for carrying out tasks assigned by the Chairman, with one Vice Chairman being the representative of the Environmental Protection Department.

Members of the GEF - Vietnam Management Board are representatives of the Ministries of Science, Technology and Environment, Planning and Investment, Finance, the Government Office, and the Vietnam Environment Protection Association. Members of the National Management Board of GEF - Vietnam are nominated by their respective supervisory agencies and recognized by the Minister of Science, Technology and Environment through a Decision. Members of the GEF - Vietnam Management Board are responsible for fully participating in GEF - Vietnam activities and reporting on their work in their respective fields to the GEF - Vietnam Office for consolidation and presentation to the Prime Minister and the GEF Secretariat.

The GEF - Vietnam Office has a permanent secretary appointed by the Chairman. The GEF - Vietnam Office is located at the Environmental Protection Department and is responsible for assisting the Chairman in managing the activities of GEF - Vietnam in compiling, processing information for project evaluations, and preparing agendas for GEF - Vietnam meetings.

Article 5. Method of Operation:

GEF - Vietnam holds regular meetings every six months. In case of emergency, the Chairman may convene extraordinary meetings.

The Chairman presides over GEF - Vietnam meetings; in the absence of the Chairman, a Vice Chairman will be delegated to take over.

The operational plan of GEF - Vietnam is prepared by the GEF - Vietnam Office according to guidelines from the GEF and will be approved at regular GEF - Vietnam meetings.

Projects seeking funding from the GEF must be submitted to GEF - Vietnam. The GEF - Vietnam Office will review and select feasible projects to submit to the Chairman of GEF - Vietnam for forwarding to the GEF Secretariat for examination and reporting to the Government.

After projects have been approved by the Government and the GEF, the Chairman of GEF - Vietnam will notify the approved plans to the Management Board members and project leaders. Project leaders report on the implementation plan and progress every three months to the GEF - Vietnam Office. GEF - Vietnam reports the project implementation plan and progress to the funding agency for project execution.

Article 6. Operating funds of GEF - Vietnam:

Sources of operating funds for GEF - Vietnam include:

State budget funds allocated annually by the Ministry of Science, Technology and Environment. The operating budget of GEF - Vietnam is prepared by the GEF - Vietnam Office, submitted to the Management Board, decided upon by the Chairman of GEF - Vietnam, and included in the annual state budget of the Ministry of Science, Technology and Environment for submission to the Government.

Funds from the GEF are managed according to GEF regulations and current state financial management regulations.

Article 7. Implementation Provisions:
