Decree No. 7-CP on the establishment of the Vietnam Highway Administration under the Ministry of Transport

DECREE

OF THE GOVERNMENT NUMBER 7-CP JANUARY 30, 1993 ON THE ESTABLISHMENT OF THE VIETNAM HIGHWAY ADMINISTRATION UNDER THE MINISTRY OF TRANSPORTATION

THE GOVERNMENT

Pursuant to the Government Organization Law dated September 30, 1992;
At the proposal of the Minister of Transport and the Minister, Head of the Civil Service Committee of the Government,

DECREE:

Article 1. - The Vietnam Highway Administration is established under the Ministry of Transportation.

The Vietnam Highway Administration is a specialized state management agency for road traffic and transport within the entire country.

The Vietnam Highway Administration has legal personality, its own seal, and receives funding from the state budget, and is allowed to open accounts at the State Treasury.

The Director of the Vietnam Highway Administration is responsible to the Minister of Transportation for performing the specialized state management functions for roads throughout the country.

Article 2. - The Vietnam Highway Administration shall have the following tasks and powers:

1. Based on the national economic and social development directions and plans, develop strategies, planning, and plans for the development of road traffic and transport within the entire country to be submitted by the Minister of Transportation to the Prime Minister for approval;

2. Draft laws, sub-law documents, policies, systems, procedures, and regulations for specialized state management of roads (including special-purpose transport and transit transport) to be submitted by the Minister of Transportation to the Government for decision or issued by the Minister within his/her authority;

Issue technical and economic standards and norms within the specialized field of roads according to the authority of the Administration and provide guidance for their implementation;

3. Propose to the Minister of Transportation decisions on the division of responsibilities and levels of management for road traffic infrastructure facilities and road routes; directly manage the system of road traffic infrastructure facilities under central management within the entire country;

4. Act as the main investor for road construction projects within the specialized road infrastructure under central management according to the division of responsibilities;

5. Announce the road traffic system, announce regulations on vehicle types and mechanization, load capacity, dimensions, and other technical characteristics related to road structures as prescribed by law;

6. Establish and manage the road traffic signage system, issue permits for the construction of structures crossing roads or related to road structures; issue permits for the use and exploitation or suspension of use and exploitation on road routes;

7. Define conditions, standards, and issue permits and licenses for road transport operations and agents; organize administrative registration of road transport vehicles for organizations and individuals of all economic sectors nationwide (including foreign organizations and individuals operating in Vietnam); review and issue permits for the modification and repair of road transport vehicles; participate with relevant state agencies in defining the import and export of road transport vehicles;

8. Inspect and supervise road traffic safety and transport, coordinate with relevant agencies and local authorities to protect road traffic infrastructure, ensure transport safety, handle violations of road traffic order and accidents on road routes throughout the country;

9. Organize and direct research and application of scientific and technological progress in the specialized field of roads;

10. Collect various traffic and transport fees on roads according to the authorization of the Ministry of Finance;

11. Propose to the Minister of Transportation participation (or non-participation) in international conventions, signing agreements, and protocols on roads as prescribed by the Government;

12. Train and develop drivers and technical workers in the specialized field of roads;

13. Establish and dissolve assisting agencies to the Director and public service units; directly manage state-owned enterprises under the Administration according to the provisions of the law;

14. Manage organizational structure, cadres, labor, and assets entrusted to the Administration by the state according to current regulations.

Article 3. - The Vietnam Highway Administration is headquartered in Hanoi and has regional road management zones proposed by the Director of the Vietnam Highway Administration and decided by the Minister of Transportation.

Article 4. - The Vietnam Highway Administration is led by the Director, assisted by Deputy Directors.

The Director is appointed upon proposal by the Minister of Transportation, reviewed by the Minister and the Head of the Government's Organization and Cadre Affairs Board, and decided by the Prime Minister.

Deputy Directors are appointed by the Minister of Transportation after consultation with the Minister and the Head of the Government's Organization and Cadre Affairs Board.

Article 5. - The Director of the Vietnam Highway Administration shall restructure production and business units and public service units in the specialized field of roads for submission by the Minister of Transportation to the Prime Minister for decision.

Article 6. - This Decree takes effect from the date of issuance. Previous regulations contrary to this Decree are abolished.

Article 7. - The Minister of Transportation, Ministers of other Ministries, Heads of government agencies, and Chairmen of People's Committees of provinces and centrally governed cities are responsible for implementing this Decree.
