PRIME MINISTER
Pursuant to the Government Organization Law dated September 30, 1992;
Pursuant to Article 59 of the Constitution of the Socialist Republic of Vietnam in 1992;
Pursuant to Article 13 of the Law on Universal Primary Education dated August 12, 1992;
At the proposal of the Minister of Education and Training and the Minister of Finance,
DECISION:
Article 1. The tuition fees referred to in this Decision at public educational and training institutions within the national education system are contributions from families or students themselves to ensure educational and training activities together with the State.
Article 2. Objectives for collecting and exempting/reducing tuition fees:
1. Collect tuition fees from individuals studying at public educational and training institutions within the national education system, except for those specified in Clauses 2 and 3 of this Article.
2. Exempt tuition fees for the following groups:
- Students who enjoy preferential policies as stipulated in Decree No. 28/CP dated April 29, 1995 of the Government;
- Elementary school students;
- Students whose parents permanently reside in highland mountainous areas (excluding cities, towns, and townships) and remote islands;
- Disabled students and those facing economic difficulties;
- Students in the education major;
- Orphaned students without support;
- Students selected for ethnic minority preparatory universities, boarding schools, vocational schools for the disabled, and special needs schools (with disabilities);
- Students whose families (parents or guardians) are classified as destitute households according to state regulations.
3. Reduce tuition fees for the following groups:
3.1. Students who enjoy preferential policies as stipulated in Decree No. 28/CP dated April 29, 1995 of the Government.
3.2.1. Students who are children of war invalids; children of disabled veterans, and those receiving benefits equivalent to war invalids with a disability rate between 21% and 60%.
- Children of civil servants whose parents have been injured at work and are entitled to regular compensation.
- Students whose families (parents or guardians) are classified as poor households according to general state regulations.
Article 3. The framework for tuition fees applicable to full-time programs at public educational and training institutions is as follows:
1. For educational institutions:
1.1 In cities, towns, and industrial zones:
- Kindergarten: From VND 15,000 to 80,000 per student per month
- Junior High School: From VND 4,000 to 20,000 per student per month
- High School: From VND 8,000 to 35,000 per student per month
1.2 In rural plains and midlands:
- Kindergarten: From VND 7,000 to 20,000 per student per month
- Junior High School: From VND 3,000 to 10,000 per student per month
- High School: From VND 6,000 to 25,000 per student per month.
1.3 In rural lowland mountains:
- Kindergarten: From VND 5,000 to 15,000 per student per month
- Junior High School: From VND 2,000 to 8,000 per student per month
- High School: From VND 4,000 to 15,000 per student per month.
2. For training institutions:
2.1 Vocational Training: From VND 20,000 to 120,000 per student per month
2.2 Secondary Vocational Training: From VND 15,000 to 100,000 per student per month
2.3 College: From VND 40,000 to 150,000 per student per month
2.4 University: From VND 50,000 to 180,000 per student per month
2.5 Master's Degree Training: From VND 75,000 to 200,000 per student per month
2.6 Doctoral Degree Training: From VND 100,000 to 250,000 per student per month.
2. Level of Tuition Fee Collection:
Tuition fees shall be collected monthly. Kindergartens and short-term vocational training programs collect fees based on actual months of attendance. Junior high schools and high schools collect fees for nine months per year. Training institutions collect fees for ten months per year.
Provincial People's Councils and People's Committees directly under the Central Government shall, based on the need for educational development, the living standards of local residents, and the tuition fee framework set forth in this Article, establish specific tuition fee levels applicable to various forms of education and training, including continuous education and vocational training at technical and vocational centers, and other forms of education and training in each locality or region within the province or city.
Rectors of universities, Principals, and Heads of training institutions under central management shall, based on the tuition fee framework mentioned above, the characteristics and requirements for the development of the training sector, the form of training, and the circumstances of each type of student, establish specific tuition fee levels for each type of student.
Article 4. Organization of tuition fee collection, management, and use:
1. Educational and training institutions are responsible for organizing the collection of tuition fees and depositing them into the State Treasury. Receipts for tuition fee collection are issued by financial authorities.
2. Educational and training institutions and local education management agencies may use all collected tuition fees for the following purposes:
2.1 Strengthening infrastructure serving teaching and learning;
2.2 Supplementing funds for educational and training activities, including support for final examination organization;
2.3 Supporting direct teaching activities and services;
2.4 Supporting administrative work and overall regulation within the education and training sector at the local level.
3. Chairpersons of provincial People's Committees directly under the Central Government; Rectors of universities, Principals, and Heads of training institutions under central agencies shall specify the proportion of tuition fees allocated for the purposes listed in Clause 2 of this Article. Among these, the proportion of tuition fees allocated for strengthening infrastructure serving teaching and learning (Clause 2.1) must not be less than 35% for the education sector and not less than 45% for the training sector, while the proportion allocated for supporting administrative work and overall regulation (if applicable) within the education and training sector at the local level (Clause 2.4) must not exceed 20%.
4. Educational and training institutions must prepare budgets consistent with the provisions of Clauses 2 and 3 of this Article and obtain approval from authorized education management bodies. The State Treasury will disburse funds to educational and training institutions based on approved budgets.
Article 5. Other Fees that May Be Collected:
1. Educational and training institutions may collect admission fees as prescribed by the Provincial People's Councils and People's Committees (for institutions managed by localities) or the Ministry of Education and Training (for institutions managed by central agencies).
2. Early childhood education institutions and general education institutions shall collect funds for school construction according to Decision No. 248/TTg dated November 22, 1973 of the Prime Minister at levels specified by the People's Councils and People's Committees of provinces and centrally governed cities.
Article 6. This Decision takes effect from August 1, 1998. Prior to this date, the collection, management, and use of tuition fees and examination fees for graduation shall be carried out in accordance with Decision No. 241/TTg dated May 27, 1993. Previous regulations contrary to this Decision are hereby abolished.
Article 7.
- The Ministry of Education and Training shall coordinate with the Ministry of Finance to provide guidance on the implementation of this Decision.
- Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial and centrally governed city People's Committees are responsible for implementing this Decision./.
