Guidelines for managing and settling investment capital for compensation, relocation, and resettlement projects

for the Son La Hydropower Project

Pursuant to Decree No. 52/1999/NĐ-CP dated July 8, 1999 of the Government on the issuance of the Investment Management and Construction Regulation, Decree No. 12/2000/NĐ-CP dated May 5, 2000, and Decree No. 07/2003/NĐ-CP dated January 30, 2003 of the Government amending and supplementing certain provisions of the Investment Management and Construction Regulation;

 

Pursuant to Decision No. 92/QĐ-TTg dated January 15, 2004 of the Prime Minister on approving the investment project of the Son La Hydropower Plant;

Pursuant to Decision No. 459/QĐ-TTg dated May 12, 2004 of the Prime Minister promulgating regulations on compensation, relocation, and resettlement policies for the Son La Hydropower Project;

WHEREAS, pursuant to Decision No. 182/2003/QD-TTg dated September 5, 2003 of the Prime Minister on the issuance of government bonds for investment in important transportation and irrigation works of the country;

The Ministry of Finance provides guidelines for managing and settling investment capital for the relocation and resettlement projects of the Son La Hydropower Project in three provinces: Son La, Lai Chau, and Dien Bien as follows:

This technical regulation sets out technical requirements, testing methods, sampling procedures; management requirements; responsibilities of organizations and individuals producing, trading, and importing cigarettes.

1. Scope and Applicability This Circular applies to compensation, relocation, and resettlement projects within the overall compensation, relocation, and resettlement plan for the Son La Hydropower Project approved by the Prime Minister and detailed resettlement area and site plans approved by the People's Committees of Son La, Dien Bien, and Lai Chau Provinces.

Article 2. Sources of investment capital for the compensation, relocation, and resettlement project of the Son La Hydropower Project include:

Sources of capital include the Vietnam Electricity Corporation and state budget funds for implementing compensation, relocation, and resettlement.

The amount of capital allocated from these sources is determined according to Decision No. 92/QĐ-TTg dated January 15, 2004, and transferred to the Development Support Fund (an agency assisting the Vietnam Electricity Corporation in settling investment capital) to settle the compensation, relocation, and resettlement projects of the Son La Hydropower Project. The Development Support Fund does not charge settlement fees.

These two sources of capital are managed, settled, and finalized according to the current Investment Management and Construction Regulations and the provisions of this Circular.

Other sources of capital as stipulated in Decision No. 459/QĐ-TTg dated May 12, 2004 of the Prime Minister promulgating regulations on compensation, relocation, and resettlement policies for the Son La Hydropower Project (hereinafter referred to as Decision No. 459/QĐ-TTg) shall be managed according to current regulations applicable to those sources of capital.

3. Compensation, relocation, and resettlement projects must ensure all necessary investment and construction procedures under the Investment Management and Construction Regulation, be included in the annual investment plan, and have the required conditions for capital allocation before being settled according to the provisions of this Circular.

In cases of direct compensation and support to organizations, households, individuals, 5% of the annually allocated settlement capital of the project will not be retained for final settlement. For basic construction projects (transportation, irrigation, power transmission lines, schools, etc.), the retention of 5% of the annually allocated settlement capital for final settlement shall be carried out according to current regulations.

4. The People's Committees of Son La, Lai Chau, and Dien Bien Provinces, as the principal investors, are responsible for managing and organizing the implementation of compensation, relocation, and resettlement projects in accordance with state policies and investment schedules approved by competent authorities.

The Provincial Project Management Board for Relocation and Resettlement (Provincial Project Management Board), the District Project Management Board for Relocation and Resettlement (District Project Management Board), and specialized Project Management Boards (if any) are responsible for organizing the implementation, supervising, and managing projects within the resettlement area and site planning according to tasks assigned by the Provincial People's Committee.

Organizations, households, individuals, and community residents (collectively referred to as households) benefiting from compensation, relocation, and resettlement policies must be responsible for using the capital for its intended purpose, in accordance with policy, ensuring the quantity and quality of work undertaken.

II. ANNUAL PLAN FORMULATION.

Article 1. Formulation and announcement of the annual plan:

During the time of preparing the state budget estimate each year, based on the construction progress of the Son La Hydropower Plant, the overall relocation and resettlement plan for the Son La Hydropower Project within the province, the implementation status of compensation, relocation, and resettlement, and the compensation, relocation, and resettlement objectives and schedule of the National Steering Committee for the Son La Hydropower Project, the Provincial People's Committee directs the Provincial Project Management Board to coordinate with relevant agencies to formulate the annual capital plan for compensation, relocation, and resettlement of the Son La Hydropower Project to be included in the provincial investment plan and submitted to the Provincial People's Council for approval and sent to the Ministry of Finance, Vietnam Electricity Corporation, the Ministry of Planning and Investment, and the Ministry of Agriculture and Rural Development before July 20 of the previous year. (Annex 1).

Based on the annual plan for compensation and resettlement capital of Son La, Dien Bien, and Lai Chau Provinces; the capital plan of Vietnam Electricity Corporation for compensation and resettlement projects of the Son La Hydropower Project, and the plan to mobilize government bonds, the Ministry of Finance checks and notifies the capital settlement plan for the Son La Hydropower Project's relocation and resettlement projects to the People's Committees of Son La, Dien Bien, and Lai Chau Provinces and the Development Support Fund before November 20 of the previous year.

The content of the capital settlement plan includes the total annual compensation and resettlement capital; the capital of Vietnam Electricity Corporation and state budget support from government bond sources.

The capital of Vietnam Electricity Corporation and state budget is determined by multiplying the annual compensation and resettlement capital plan by the proportion of each type of capital over the total compensation and resettlement capital for the Son La Hydropower Project approved by the Prime Minister.

The Development Support Fund notifies the capital settlement plan to the Provincial Branch of the Development Support Fund.

The Provincial People's Committee assigns the plan to the Provincial Project Management Board, District Project Management Board, and specialized Project Management Board (if any).

THE PROVINCE PROJECT MANAGEMENT BOARD, DISTRICTS, AND SPECIALIZED SECTIONS (IF ANY) SHALL REGISTER THE DETAIL INVESTMENT PLAN WITH THE PROVINCIAL DEVELOPMENT SUPPORT FUND BRANCH AS THE BASIS FOR CAPITAL PAYMENT.

2. PLAN ADJUSTMENTS:

If the actual implementation progress and investment capital needs of the project change during the annual plan compared to the beginning of the year, the Provincial People's Committee formulates an adjusted and supplemented investment capital plan and sends it to the Ministry of Finance, the Ministry of Planning and Investment, and Vietnam Electricity Corporation for the Ministry of Finance and Vietnam Electricity Corporation to adjust the capital mobilization plan. Adjustments to the plan must not delay the relocation and resettlement progress, affecting the construction schedule of the Son La Hydropower Plant already approved by competent authorities. The time for adjusting the investment capital plan is in August each year.

IF THE ENTIRE CAPITAL INVESTMENT PLAN ARRANGED FOR THE YEAR IS NOT COMPLETED, IT MAY BE TRANSFERRED TO THE NEXT YEAR FOR CONTINUOUS IMPLEMENTATION UNTIL THE END OF THE PROJECT.

III. CAPITAL TRANSFERS

1. Based on the annual plan divided into quarters, the progress of implementation and capital disbursement of the provinces, quarterly, the Development Support Fund shall submit a document requesting capital transfer to the Ministry of Finance and Vietnam Electricity Corporation.

2. PROCEDURE FOR CAPITAL TRANSFERS:

The Ministry of Finance shall transfer capital to the Development Support Fund from the government bond deposits at the State Treasury.

Vietnam Electricity Corporation shall transfer capital into the account of the Development Support Fund.

The Development Support Fund shall transfer capital to the Branches of the Development Support Fund in the provinces, while notifying the project management boards (Provincial Project Management Boards) and the provincial Departments of Finance for monitoring the transferred capital.

3. The amount of each capital transfer by Vietnam Electricity Corporation and the Ministry of Finance shall be based on the requested capital amount of the Development Support Fund and the proportion of capital of Vietnam Electricity Corporation and the Ministry of Finance in the annual plan.

IV. CAPITAL PAYMENT.

1. OPENING ACCOUNTS:

The Provincial Project Management Board (district, specialized) (hereinafter referred to as the Project Management Board) shall open an account at the Branch of the Development Support Fund in the province.

The Branch of the Development Support Fund shall guide the procedures for opening an account.

2. CAPITAL PAYMENT DOCUMENTS:

For projects and construction works in resettlement areas, the settlement of investment capital shall be carried out in accordance with Circular No. 44/2003/TT-BTC dated May 15, 2003, issued by the Ministry of Finance, guiding the management and settlement of investment capital and operational funds with an investment nature from state budget sources (hereinafter referred to as Circular No. 44/2003/TT-BTC).

2.3. In cases of compensation for land and assets for displaced households or local households losing production land; support for relocation, living support, production support, training and vocational training costs, project management board expenses, and other expenses: there must be a compensation and support plan approved by the competent authority, and economic contracts when purchasing materials, seedlings, livestock, etc., from supplying enterprises or organizations, or training contracts when conducting training and vocational training.

Before establishing, reviewing, and approving the compensation plans and budgets for land and assets, the Project Management Board shall organize an inventory and assessment of actual losses of land and assets in accordance with current regulations through the Compensation, Relocation, and Resettlement Council.

2.4. The annual budget of the Project Management Board, based on assigned tasks for the year, shall be approved by the competent authority; management and use thereof shall comply with current laws.

3. Payment of investment capital for construction works at resettlement areas:

3.1. Construction projects invested and built at resettlement areas shall be implemented according to the scale prescribed in Decision No. 459/QĐ-TTg.

3.2. Advance payments, recovery of advance payments, and capital settlement for construction projects and project components shall be carried out in accordance with Circular No. 44/2003/TT-BTC.

4. Payment for housing construction and ancillary works (hereinafter referred to as housing) at resettlement areas:

4.1. In cases where housing in resettlement areas is provided by the Project Management Board signing contracts with construction contractors according to standards and scales (area), model designs (or apartment building designs for urban resettlers) and approved housing budgets, the procedures for advance payments, settlements, and conditions shall be as stipulated in Section 2 and Section 3 of Part IV above.

4.2. In the case where housing is self-built by households:

a) Households constructing their own houses shall receive compensation for housing at the value of the new construction budget according to the standard and scale (area) specified in Point 4.1 of Section 4 of Part II above, without having to pay taxes.

b) Settlement shall be carried out as follows:

For the Project Management Board and Branch of the Development Support Fund:

Advance payment of capital: The Project Management Board shall send to the Branch of the Development Support Fund a request for payment, the housing budget of the household entitled to compensation as approved by the competent authority, the household's registration for self-construction of housing, and a list of households constructing their own houses. The amount of advance payment shall meet the construction needs of each household but shall not exceed the annual capital allocation for self-construction by households.

Capital settlement: The Project Management Board must prepare a list of housing values for completed households accompanied by a completion certificate signed by the Project Management Board and the household, and send it to the Branch of the Development Support Fund. The Branch of the Development Support Fund shall review and settle the capital for the Project Management Board, simultaneously recovering the advance payment.

For households: The Project Management Board shall pay compensation to households constructing their own houses in accordance with the regulations of the Provincial People's Committee, but not more than three times. The Project Management Board must ensure capital for households to purchase construction materials and conditions for house construction when they are preparing to build; compensation will be paid to each household in subsequent installments based on the volume of construction work. Households will only receive the final compensation payment upon completion of house construction and signing a completion certificate with the Project Management Board. Each time receiving compensation for housing, each household must sign for receipt and have confirmation from the Compensation, Relocation, and Resettlement Council or local authorities.

4.3. In the case where housing is jointly constructed by households and the Project Management Board:

The value of housing compensation equals the value of the new construction budget according to the standard and scale (area) of the entitled household; the procedures, conditions, and advance payment and settlement are as stipulated in Point 4.1 of Section 4 of Part II above. The value of the construction volume undertaken by the household does not require payment of taxes.

The Project Management Board and the household shall agree on the workload undertaken by each party through a contract or commitment. The Project Management Board shall allocate advance payments and settlements to each party according to the proportion of capital each party undertakes. The procedure for advance payment and settlement of housing constructed by households shall be implemented as stipulated in Section 4.2; the portion of advance payment and settlement undertaken by contractors shall be settled by the Project Management Board as stipulated in Section 4.1.

4.4. If households wish to construct houses with structures and areas exceeding the prescribed limits, they must make up the additional value difference; the Project Management Board shall only settle the value of housing construction related to the prescribed standards for households.

5. Compensation, relocation support, livelihood support, and other supports.

5.1. The content, level, and conditions for compensation for land value, assets, relocation support, livelihood support, and other supports shall be implemented in accordance with the provisions of Decision 459/QĐ-TTg.

5.2. Settlement of compensation and support funds:

a) For compensation and support with construction characteristics, projects to compensate for damage to public works, infrastructure for households and communities affected but not relocated, or communities with mixed resettlement points,... must have complete investment procedures, advance payment and capital settlement documents as stipulated in Section 2 and Section 3 of Part IV above.

b) Expenditures for land and property compensation, relocation support, livelihood stabilization support,... must have initial documentation as prescribed in Section 2 of Part IV above and be included in the approved annual investment capital plan.

The settlement of capital shall be carried out as follows:

- As for contractors and beneficiaries:

Advance payment of capital: The Project Management Board sends to the Branch Development Support Fund a request for advance payment and detailed budget estimate for each compensation and support expenditure. The level of advance payment for compensation and support expenditures according to payment requirements but not exceeding the annual capital plan allocated for that work or expenditure. The Branch Development Support Fund reviews and pays to contractors and beneficiaries based on the Project Management Board's proposal, while also recovering advances.

Capital settlement: The Project Management Board must prepare a price list or detailed payment statement along with a determination of the actual value of completed compensation and support work by contractors and beneficiaries or the cost of compensation and support transferred to implementing enterprises, and related payment vouchers and invoices. The Branch Development Support Fund reviews and pays to contractors and beneficiaries based on the Project Management Board's proposal, simultaneously recovering advances.

- For households:

The Project Management Board sends to the Branch Development Support Fund a request for advance payment and detailed budget estimate for each household's compensation and support expenditure. The level of advance payment for compensation and support expenditures according to payment requirements but not exceeding the annual capital plan allocated for that work or expenditure. When making payments, the Project Management Board must prepare a price list or detailed payment statement along with a signed receipt of compensation and support payments made to each household. The Branch Development Support Fund reviews, provides advances, and pays to the Project Management Board.

The Project Management Board directly pays compensation and support to each household, and each household must sign for receipt, with confirmation from the local Land Compensation and Relocation Committee or local authorities. The Provincial People's Committee specifies the method and number of payments suitable for each type of compensation and support to avoid multiple payments.

In cases where there is no approved compensation and support plan and budget estimate but relocation must proceed according to schedule, the Project Management Board may temporarily receive up to 30% of the compensation and support costs within the total investment estimate of the detailed project planning for the resettlement area or point, as approved.

6. Capital Payment for Production Support

6.1. The content, level, and conditions for production support (including vocational training) shall be implemented in accordance with the provisions of Decision 459/QĐ-TTg.

6.2. Settlement of production support capital:

a) For contractors and beneficiaries:

Advance payment of capital: The Project Management Board sends to the Branch Development Support Fund a request for advance payment and a detailed budget estimate for production support costs (including vocational training support), calculated based on the number of households receiving support, economic contracts for purchasing seedlings, livestock, fertilizers, pesticides, or training contracts if applicable. The level of advance payment for production support is the amount required to be paid according to economic contracts, training contracts, or necessary production requirements but not exceeding the annual capital plan allocated for that work or expenditure. The Branch Development Support Fund pays the advance capital to contractors and beneficiaries based on the Project Management Board's proposal.

Capital settlement: The Project Management Board sends to the Branch Development Support Fund a price list or detailed payment statement along with acceptance and handover records, and related payment vouchers and invoices according to economic contracts and training contracts between the Project Management Board and enterprises and training institutions. The Branch Development Support Fund reviews and pays to contractors and beneficiaries based on the Project Management Board's proposal, simultaneously recovering advances.

b) For households:

The Project Management Board sends to the Branch Development Support Fund a request for advance payment and a detailed budget estimate for each production support expenditure. The level of advance payment for production support expenditures according to payment requirements but not exceeding the annual capital plan allocated for that expenditure. The Branch Development Support Fund reviews and provides advances to the Project Management Board.

The Project Management Board directly pays production support to households, with each household signing for receipt, confirmed by local authorities regarding the received capital. The Provincial People's Committee specifies the method and number of payments suitable for each type of production support to avoid multiple payments.

When making payments, the Project Management Board sends to the Branch Development Support Fund a detailed payment statement along with related payment vouchers and invoices and signed receipts for each household's production support expenditures. The Branch Development Support Fund reviews and pays to the Project Management Board, simultaneously recovering advances.

7. Settlement of capital for other expenses:

7.1. Other expenses include project management costs, planning and investment preparation costs, insurance costs, land construction licensing fees...

7.2. The Project Management Board sends to the Branch Development Support Fund a request for advance payment, withdrawal vouchers, and notifications from specialized agencies requiring payment (if any). The level of advance payment according to the needs of the work or expenditure but not exceeding the annual capital plan allocated for that work or expenditure.

7.3. When paying other expenses, the Project Management Board sends to the Branch Development Support Fund a price list or detailed payment statement along with related payment vouchers and invoices (contracts, handover records, acceptance records). The Branch Development Support Fund reviews and pays, simultaneously recovering advances.

For the Project Management Board's expenses, in cases where the annual plan is delayed or the budget for the Project Management Board has not yet been approved, temporary advance payments for salaries and travel expenses, essential office supplies may be made.

8. Payment for voluntary relocation households:

8.1. Households voluntarily relocating without going to a resettlement point will be compensated for land, housing, ancillary structures, and assets, and supported according to the content, level, and conditions specified in Decision No. 459/QĐ-TTg.

8.2. Settlement of expenses for voluntary relocation households.

a) For the Project Management Board:

Advance payment of capital: The Project Management Board sends to the Branch of the Development Support Fund the application for advance payment, settlement, relocation plan of voluntary relocating households (including the process of obtaining confirmation at the intended destination), budget estimates for expenses for voluntary relocating households, and relevant documents required for voluntary relocating households as stipulated in Decision No. 459/QĐ-TTg. The level of advance capital for expenses for voluntary relocating households according to the payment requirements but not exceeding the annual capital plan allocated for the work, such expenses. The Branch of the Development Support Fund checks and advances funds to the Project Management Board.

Settlement: The Project Management Board sends the settlement statement along with the verified and signed records of expenditures for voluntary relocating households, related vouchers, and invoices. The Branch of the Development Support Fund reviews and settles payments for the Project Management Board, simultaneously recovering the advance payments.

b) For households:

When making direct payments to households, each household must sign for receipt, with confirmation from the Local Resettlement Compensation Committee (commune) or local authorities.

Payments for voluntary relocating households are divided into two stages: Stage 1 is the settlement of costs for obtaining confirmation at the new location. Stage 2 is the settlement before the relocation date registered with the Project Management Board. Voluntary relocating households are responsible for managing and using all compensation and support funds to ensure a stable life and production development at the new residence.

9. Payment deadline:

9.1. Based on the settlement request documents sent by the Project Management Board (as specified in items 2, 3, 4, 5, 6, 7, and 8 above), within seven working days from the date of receiving complete documents, the Branch of the Development Support Fund will check and provide capital to the Project Management Board so that the Project Management Board can settle payments to households or implement settlements to contractors and beneficiaries as requested by the Project Management Board.

9.2. The Project Management Board is responsible for settling accounts with households within seven working days from the date of receiving funds from the Branch of the Development Support Fund.

V. REPORTING, SETTLEMENT, AND INSPECTION REGIME.

1. Reporting System:

a) For the project owner, the Provincial Project Management Board (county, specialized)

Monthly, county-level Project Management Boards and specialized Project Management Boards are responsible for reporting on investment implementation and capital settlement to the Provincial Project Management Board.

Monthly, the Provincial Project Management Board is responsible for reporting on investment implementation, received capital, and capital usage in the month to the Provincial People's Committee and provincial consolidation agencies, concurrently sending reports to the Ministry of Finance, Vietnam Electricity Corporation, and the Development Support Fund.

Quarterly and annually, the Provincial People's Committee is responsible for reporting on investment plan implementation and capital settlement to the National Steering Committee for the Son La Hydropower Project, the Ministry of Finance, and the Ministry of Planning and Investment. (Annex 2)

b) For the Development Support Fund:

Monthly (quarterly), the Provincial Branch of the Development Support Fund reports on the reception, provision, settlement, and final settlement of completed projects, and other necessary information to the provincial Department of Finance and the Development Support Fund.

Monthly (quarterly), the Development Support Fund reports to the Ministry of Finance and Vietnam Electricity Corporation on the received and settled capital. Quarterly, it reconciles with the Ministry of Finance and Vietnam Electricity Corporation regarding received and settled capital. (Annex 4). Specifically, the fourth quarter report is replaced by an annual report submitted by January 20th of the following year.

2. Settlement regime:

At the end of the planning year, the Provincial Project Management Board, county-level Project Management Board, and specialized Project Management Board (if any) are responsible for annual investment capital settlement according to current regulations with the project owner (Provincial People's Committee) or the Provincial Project Management Board (if assigned by the Provincial People's Committee).

The Provincial Project Management Board aggregates and settles annual investment capital with the project owner (Provincial People's Committee) or the provincial Department of Finance (if assigned by the Provincial People's Committee).

Annually, the Development Support Fund reports on the final settlement of received and utilized capital, detailed by source, to the Ministry of Finance and Vietnam Electricity Corporation.

Upon completion of compensation, resettlement, and rehabilitation projects, the Provincial Project Management Board, county-level Project Management Board, or specialized Project Management Board is responsible for preparing and settling the final investment capital report with the project owner (Provincial People's Committee). The Provincial People's Committee organizes a review and approves the final investment capital report (of the Project Management Boards) according to Circular No. 45/2003/TT-BTC dated May 15, 2003, issued by the Ministry of Finance, guiding final settlement of investment capital.

Upon completion of the overall resettlement and rehabilitation project in the province, the Provincial People's Committee is responsible for final settlement of investment capital with the Ministry of Finance according to Circular No. 45/2003/TT-BTC.

3. Inspection regime:

The Ministries of Agriculture and Rural Development, Finance, Planning and Investment, and the Provincial People's Committees, based on their respective functions and responsibilities, organize inspections of compliance with investment management and construction regulations, progress implementation, management, and capital settlement.

Financial agencies at all levels organize inspections of the Branch of the Development Support Fund on the implementation of capital provision and settlement regimes.

VI. RESPONSIBILITIES OF RELATED AUTHORITIES

1. Responsibilities of the People's Committees of Son La, Dien Bien, and Lai Chau Provinces:

Implement this Circular. Based on the contents of this Circular, issue specific and detailed guidelines suitable for local conditions. Direct the construction of centralized or interwoven resettlement areas according to approved plans and projects in accordance with current regulations. Allocate annual compensation, resettlement, and rehabilitation plans.

Inspect and urge the Project Management Boards for resettlement and rehabilitation to implement investment plans, properly receive and use investment capital according to the purpose and state regulations.

Report on investment implementation as prescribed and bear responsibility for decisions made according to assigned functions and responsibilities.

2. Provincial Project Management Board, County Project Management Board, Specialized Project Management Board, and Commune Project Management Board (if any):

Organize management and implementation of investment projects in accordance with current regulations on investment management and construction, bidding rules. Properly receive and use capital according to the purpose, target group, economically and efficiently.

Regularly inspect and supervise the implementation regarding the quantity and quality of construction works and sub-works (including housing and workloads undertaken by households).

When the basic construction volume is completed and meets the conditions for payment, proceed with acceptance procedures and promptly process payments to the contractor.

Be responsible for the accuracy and legality of the completed basic construction volume subject to payment and the data and documents provided to the Development Support Fund and relevant state agencies.

Timely carry out periodic reporting and final accounting of investment capital, and submit periodic reports and final accounting of investment capital according to regulations.

3. Development Support Fund:

Be responsible for inspecting and organizing timely, full, and correct payment procedures when the basic construction volume is completed and meets the conditions for payment.

Timely carry out information reporting and final accounting of investment capital according to regulations.

Promptly report difficulties and obstacles encountered during the implementation of tasks related to the disbursement and settlement of compensation, relocation, and resettlement funds for the Son La Hydropower Project to the Ministry of Finance for consideration and resolution.

4. Organizations, households, individuals:

Be responsible for implementing relocation according to the project schedule.

Receive, manage, and use compensation, relocation, and resettlement funds for their intended purposes, economically and effectively.

Regularly inspect and supervise the implementation regarding the quantity and quality of works carried out by the Project Management Board and contractors in conjunction with households and communities. Verify the accuracy and legality of compensation and support amounts received, comparing them with state policies and regulations.

VII. IMPLEMENTATION PROVISIONS

This Circular takes effect fifteen days from the date of publication in the Official Gazette and replaces Circular No. 67/2002/TT-BTC dated August 7, 2002, issued by the Ministry of Finance, providing temporary guidance on managing and settling state budget funds for the resettlement project of the Son La Hydropower Project in Son La and Lai Chau provinces.

Any difficulties encountered during implementation should be reported promptly to the Ministry of Finance for study, guidance, supplementation, and amendment./.
