THE MINISTER OF FINANCE

Pursuant to Decree No. 57/2002/NĐ-CP dated June 3, 2002 of the Government detailing the implementation of the Ordinance on Fees and Charges;

Pursuant to Decree No. 24/2006/NĐ-CP dated March 6, 2006 of the Government amending and supplementing certain articles of Decree No. 57/2002/NĐ-CP dated June 3, 2002 of the Government detailing the implementation of the Ordinance on Fees and Charges;

Pursuant to Decree No. 77/2003/NĐ-CP dated July 1, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance.

After receiving the opinion of the Ministry of Transport at Circular No. 5274/BGTVT-TC dated July 15, 2008;

At the proposal of the Director of the Policy Department;

DECISION:

Article 1. Individuals who are Vietnamese citizens, overseas Vietnamese, and foreigners residing in Vietnam, upon being granted certificates of practice in waterway transport vessel design services including ship hull and marine equipment design; marine engine and propulsion system design; marine radio and telephone equipment design; marine electrical system design (collectively referred to as marine design), must pay the fee for issuing certificates of practice in waterway transport vessel design services according to the specific levels of collection as follows:

1. Issuance of new certificates or supplementary content to certificates: VND 1,000,000 per certificate;

2. Reissuance due to expiration, loss, or damage: VND 250,000 per certificate.

Article 2. The revenue from the collection of fees for issuing certificates of practice in waterway transport vessel design services under this Decision is a revenue source belonging to the state budget, to be managed and utilized as follows:

1. The fee collection agency (Vietnam Maritime Administration) is entitled to retain 80% (Eighty percent) of the collected fee revenue to cover costs for management and fee collection according to prescribed regulations.

2. The fee collection agency is responsible for remitting 20% (Twenty percent) of the collected fee revenue into the state budget according to the corresponding chapters, types, sections, items, and sub-items of the current state budget classification.

Article 3. Other contents related to the collection, submission, management, utilization, receipt, and public disclosure of the fee collection regime not mentioned in this Decision shall be implemented in accordance with the guidance provided in Circular No. 63/2002/TT-BTC dated July 24, 2002, and Circular No. 45/2006/TT-BTC dated May 25, 2006, amending and supplementing Circular No. 63/2002/TT-BTC dated July 24, 2002, issued by the Ministry of Finance guiding the implementation of legal provisions on fees and charges.

Article 4. This Decision takes effect fifteen days after its publication in the Official Gazette.

Article 5. Organizations and individuals subject to payment, the Vietnam Maritime Administration, and relevant agencies are responsible for implementing this Decision./.
