PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

||| This Decree applies to organizations and individuals in Vietnam when conducting activities to establish, approve, plan, and project preservation, restoration, and recovery of relics; foreign organizations and individuals related to the preservation, restoration, and recovery of relics within the territory of Vietnam.

||| Preservation, restoration, and recovery planning for relics For coal-fired thermal power plants where the enterprise holds 100% of the registered capital and uses 100% of its own capital to invest in the project approved by the competent authority, E is determined as 100%;||| is the determination of the scope and measures for preserving, restoring, and recovering the elements of relics in a defined area, guiding the organization of spatial layout for new construction projects, technical infrastructure systems, and creating an appropriate landscape environment in the relic area.||| Preservation, restoration, and recovery project for relics

Article 2. Interpretation of Terms

In this Decree, the following terms are understood as follows:

1. ||| is a collection of proposals on measures for preserving, restoring, and recovering the original elements of relics, natural scenery, ecological environments, and other related factors with the aim of protecting and enhancing the value of relics. ||| Economic-technical report on preservation, restoration, and recovery of relicsNo. gNo.||| is a small-scale preservation, restoration, and recovery project for relics established according to the provisions of the Law

2. ||| on Construction and management documents for construction investment that must be followed during the preparation of the economic-technical report. ||| Preservation, restoration, and recovery standards for relics

3. ||| are mandatory regulations applicable in the activities of preserving, restoring, and recovering relics, issued by state management agencies under the Ministry of Culture, Sports, and Tourism. ||| Preservation, restoration, and recovery criteria for relics X||| are technical norms, economic-technical quotas, procedures for implementing technical tasks, technical indicators, natural indices issued by agencies and organizations with competent authority for application in the activities of preserving, restoring, and recovering relics. Article 3. Basic principles in the activities of planning, approving preservation, restoration projects for relics., amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CPfor the restoration of relics

Comprehensive planning for preservation, restoration, and recovery of relics (hereinafter referred to as comprehensive relic planning) is planning for a particularly important national relic or a cluster of national relics, provincial relics forming a complex within the same geographic area, closely related historically, culturally, and scientifically. 6. Relic planning, with products being files (drawings, descriptions) and planning projects, shall be carried out in the following sequence:

Capacity conditions of organizations and individuals in planning for preservation, restoration, and repair of relics, projects for preservation, restoration, and repair of relics, economic-technical reports on preservation, restoration, and repair of relics, and construction design drawings for preservation, restoration, and repair of relics., amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP Organizations and individuals participating in the preparation of plans for preservation, restoration, and repair of relics (hereinafter referred to collectively as relic plans), projects for preservation, restoration, and repair of relics (hereinafter referred to collectively as restoration projects), economic-technical reports on preservation, restoration, and repair of relics (hereinafter referred to collectively as economic-technical reports on restoration), and construction design drawings for preservation, restoration, and repair of relics must have the necessary capacity conditions as prescribed by laws on cultural heritage and relevant laws., amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CPThe Minister of Culture, Sports and Tourism shall issue detailed regulations on the professional conditions of organizations and individuals participating in the implementation of relic plans, restoration projects, economic-technical reports on restoration, and construction design drawings for preservation, restoration, and repair of relics.i For coal-fired thermal power plants where the enterprise holds 100% of the registered capital and uses 100% of its own capital to invest in the project approved by the competent authority, E is determined as 100%;i Article 5. Funding for preparing relic plans., amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CPFunding for preparing relic plans is balanced from the annual state budget of localities, the state budget of ministries and sectors responsible for managing relics, and other lawful sources., amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CPArticle 6. Classification of relic plans., amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CPfor the restoration of relics

1. Relic plans are classified into two types as follows:, A comprehensive plan for preservation, restoration, and repair of a system of relics (hereinafter referred to collectively as a system plan) is a plan covering all relics within the territory of a province or centrally-administered city including national special relics, national relics, provincial relics, and objects that have been registered as relics.i An overall plan for preservation, restoration, and repair of relics (hereinafter referred to collectively as an overall plan) is a plan for a national special relic or a cluster of national relics or provincial relics forming a cohesive area within the same geographic region with close historical, cultural, and scientific ties.on This Circular stipulates the use of non-fired construction materials in civil and industrial construction works for walls, partitions, and masonry. Non-fired construction materials include:

Procedures for preparing, approving, and implementing relic plans., amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CPRelic plans, which produce documentation (drawings, descriptions) and planning projects, are carried out according to the following procedures:

Requesting approval (accompanied by a preliminary estimate) for tasks related to preparing relic plans;iConducting investigations, surveys, and preliminary assessments of economic and social issues, protection and promotion of the value of relics, investment in construction, and related issues;y Collecting topographic maps of the area, approved urban planning and specialized planning maps still in effect related to the area where the relic plan is being prepared;i Conducting investigations, surveys, and preparing documentation (drawings, descriptions) assessing the historical, cultural, scientific, and aesthetic values of relics, artifacts, and intangible cultural heritage within the scope of the plan;

Soliciting opinions from relevant organizations and individuals to complete the relic plan task;nationalPreparing, reviewing, and approving the relic plan task;

Chapter II

PLANNING FOR THE CONSERVATION, REPAIR, AND RESTORATION OF CULTURAL HERITAGE SITES

Conducting detailed investigations, archaeological excavations, and collecting materials related to the content of the relic plan;

Preparing the relic plan project;

1. Soliciting opinions from relevant organizations and individuals regarding the relic plan project;No.Reviewing and approving the relic plan project;No.Publicizing the approved relic plan at the locality where the relic is located.developmentSetting boundary markers according to the approved relic plan.

2. Requesting approval (accompanied by preliminary budget estimates) for work serving the establishment of relic planning;y Organizing investigations, surveys, and preliminary assessments on: Economic and social issues; protection and enhancement of relic values; investment in construction and related issues;No.Collecting topographic maps of the area, construction planning maps, and other specialized planning maps already approved and still effective related to the area of relic planning;No.Organizing investigations, surveys, and preparing files (drawings, descriptions) assessing the historical, cultural, scientific, and aesthetic value of relics, cultural objects, intangible cultural heritage within the planning scope;of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Home AffairsSoliciting opinions from organizations and individuals concerned to perfect the relic planning task;195/2013/NĐ-CP dated November 21, 2013 of the Government detailing certain provisions and measures to enforce the Law on Publishingdevelopment Establishing, reviewing, and approving the relic planning task;No. Organizing detailed investigations, archaeological excavations, and collecting materials related to the content of relic planning;

Preparing the relic planning project;rime Minister cSoliciting opinions from organizations and individuals concerned about the relic planning project;

Reviewing and approving the relic planning project;

1. Publicizing the approved relic planning at the local level where the relic is located.

2. Organizing boundary markers according to the approved relic planning.Time limit;

3. Analyzing and evaluating the natural environment due

4. to the preservation, restoration of relics in the entire planning area; list of relic objects requiring preservation, restoration and the degree of preservation, restoration for eachamendrelic component; basic principles and solutions for the preservation, restoration of relics.

5. Orientation for organizing space, new architectural construction projects, height, density of construction, architectural style, building materials; orientation for renovating and constructing technical infrastructure systems within the comprehensive relic planning area.

6. Forecasting environmental impacts and proposing measures to protect the environment, reduce negative impacts on the environment within the comprehensive relic planning area.

7. Proposing component projects, phased investments, priority order of component projects, and funding sources for the projects.

8. Proposing mechanisms, policies, and solutions to implement comprehensive relic planning.

9. For national relic planning projects, national comprehensive relic planning projects;

10. b) The Chairman of the Provincial People's Committee, Head of the Department responsible for managing the relic approves the planning task or approves the comprehensive relic planning task within their jurisdiction.

11. Class ANo. For national relics, the Chairman of the Provincial People's Committee or the Head of the Ministry or agency directly managing the relic sends a request letter accompanied by one set of files either directly or through postal service to the Minister of Culture, Sports and Tourism to agree on the main direction, review the planning task for national relics, and the national relic planning project as stipulated in Point b, Clause 1

Article 8. Tasks of the Master Plan for Heritage Sites System

1. Determine the requirements for researching and surveying heritage sites and related socio-economic factors within the province or centrally-administered city.

2. Identify the characteristics, nature, value, current technical condition, management, usage, and enhancement of heritage values within the planning scope.

3. Propose guidelines and plans for the overall heritage site master plan, preservation, repair, restoration plans, boundary marker establishment plans for heritage protection, violation clearance plans, and plans to organize the enhancement of heritage values for each five-year and ten-year period, and propose plans. lSubmit the dossier for ranking heritage sites for objects listed in the inventory of heritage sites..

4. Conduct strategic environmental assessment, predict environmental impacts, and propose measures to protect the environment and minimize negative effects on the environment in the area.

5. Determine the detailed contents of the master plan project and the deadline for completing the master plan project.

The tasks of the master plan for the heritage sites system shall be compiled into a report to be submitted to the competent authority as stipulated in Article 12 of this Decree.

Article 9. Contents of the Master Plan for Heritage Sites System

The master plan for heritage sites includes the following contents:

1. On the basis of lPlanning;

2. Comprehensive evaluation of the characteristics, nature, value, current status, technical conditions, management, usage, and enhancement of heritage values within the planning scope;

3. Long-term goals, short-term goals;Within thirty working days from the date of receipt of the request letter and complete files, the Minister of Culture, Sports and Tourism has the responsibility to consider agreeing on the main direction, reviewing the planning task for national relics, and the national relic planning project as stipulated.

4. Statistics, evaluation of the current situation, and analysis of land management and usage conditions of heritage sites; identify the list of heritage sites requiring adjustments to protected areas;

5. Propose guidelines and plans for establishing boundary markers for heritage protection, violation clearance, lists of heritage sites that need to be preserved, repaired, and restored based on their value and degree of damage, organizing the enhancement of heritage values for each five-year and ten-year period, and plans to submit dossiers for ranking heritage sites for objects listed in the inventory of heritage sites; propose guidelines for building technical systems to serve the protection and enhancement of heritage values;No.Project, economic-technical report on preservation, restorationTechnical connection infrastructure planning;

6. Budget estimate and funding sources for implementing the master plan;Propose measures to reduce environmental impacts;

7. Solutions and policies to implement the master plan.

8. Article 10. Tasks of the Overall Master Plan for Heritage Sites

9. Determine the requirements for researching and surveying heritage sites and related socio-economic factors.

Study and evaluate socio-economic factors affecting the preparation and implementation of the master plan.

1. Identify the distinctive features and outstanding values of heritage sites..

2. Propose guidelines and plans for the overall master plan for heritage sites and detailed plans for boundary marker establishment, violation clearance, organization of heritage value enhancement, and submission of dossiers for ranking heritage sites.

3. Propose guidelines for organizing architectural space and landscape for heritage conservation and new construction.

4. The tasks of the overall master plan for heritage sites shall be compiled into a report to be submitted to the competent authority as stipulated in Article 12 of this Decree.

5. Article 11. Contents of the Overall Master Plan for Heritage Sites

6. Determine the detailed contents of the master plan project and the deadline for completing the master plan project.

Basis for preparing the heritage site repair master plan includes:

1. Strategies, overall development plans for economy and society, national defense and security, heritage site systems of the locality that have been approved;

a) Approved overall heritage site planning tasks;

b) CostpoliciesStandards and regulations on preservation, repair, and restoration of heritage sites.

c) Analyze and evaluate the current status of heritage sites and land belonging to heritage sites including:

d) Survey and research results on the characteristics and values of heritage sites; the role of heritage sites in regional relationships; technical conditions, management, usage, and enhancement of heritage values;

2. Analyze and evaluate natural and social environments; economic and social factors; current land usage status; current technical infrastructure status of the planned area;

a) Long-term and short-term perspectives of the heritage site master plan;

b) For relics under the management of the Provincial People's Committee, the Director of the Provincial Department of Culture, Sports and Tourism sends a request letter accompanied by one set of files either directly or through postal service to the Chairman of the Provincial People's Committee to agree on the main direction, approve the main direction, planning task, and the planning project for relics within their jurisdiction. For power plants invested under the Build-Operate-Transfer (BOT) model, n is determined according to the operational period of the power plant stipulated in the BOT contract.hiDefine boundaries of heritage protection zones, recommend adjustments to expand or reduce heritage protection zones, determine natural scenic areas, restricted construction areas, and new construction areas. trGuidelines for preserving, repairing, and restoring heritage sites: General directions for the preservation, repair, and restoration of heritage sites throughout the planned area; lists of heritage objects requiring preservation, repair, and restoration and the level of preservation, repair, and restoration for each heritage object; principles and basic solutions for the preservation, repair, and restoration of heritage sites.on Enhance the value of heritage sites linked with sustainable tourism development.

c) Propose guidelines for organizing architectural space and landscape for heritage conservation and new construction.

Guidelines for organizing spatial layout, architectural structures for new construction, height, density of construction, architectural style, construction materials; guidelines for renovating and constructing technical infrastructure systems within the overall heritage site planning area., amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CPDecisiondevelopment Predict environmental impacts and propose measures to protect the environment and reduce negative impacts on the environment within the overall heritage site planning area.

4. Propose component projects, phased investment, priority order of component projects, and investment capital for projects.

5. Propose mechanisms, policies, and solutions to implement the overall heritage site master plan.For relics under the management of Ministries or agencies, the head of the managing agencyg components of relics; basic principles and solutions for relic preservation, repair, and restoration.

6. Budget estimate and funding sources for implementing the master plan;to promote the value of relics in conjunction with tourism ldevelopment.

7. b) Comprehensive explanatory report; relevant agreements on policy orientation, assessment of tasks, assessment of heritage site planning projects, and other related documents;

c) Petition for approval of the heritage site planning projectFor power plants invested under the Build-Operate-Transfer (BOT) model, n is determined according to the operational period of the power plant stipulated in the BOT contract. for the heritage site system.

Article 18. Procedures for establishing, reviewing, and approving restoration projects for cultural relics

1. Request to initiate a restoration project for cultural relics;

2. Conduct surveys and collect materials related to the cultural relic and issues associated with it; lPlanning and conservation projects approved before this Decree takes effect do not need to be re-approved. Relevant work continues to be carried out in accordance with the provisions of this Decree.

3. Establish a restoration project for cultural relics;

4. Solicit opinions from organizations and individuals regarding the restoration project for cultural relics;

5. Review and approve the restoration project for cultural relics;

6. Publicly announce the approved restoration project for cultural relics at the local level where the cultural relic is located.

Article 19. Content of Restoration Projects for Cultural Relics

d) Objectives of the restoration project for cultural relics;

d) Views and principles on preserving, restoring, and recovering cultural relics applied in the restoration project for cultural relics;

e) Overall site plan design for the cultural relic; violation resolution plan for the cultural relic (if applicable); preservation, restoration, and recovery plans for each component of the cultural relic; protection plan for the cultural relic and artifacts during construction; operation maintenance plan at the cultural relic during construction; pest control and fire prevention plans; new construction and infrastructure development plans;

g) Technical solutions, technologies, and materials used for preserving, restoring, and recovering cultural relics;

h)||| Architectural design plan for new construction requiring architectural design;

i) Environmental impact assessment of the restoration project for cultural relics;

k) Budget estimate and funding sources for implementing the restoration project for cultural relics;
