REGULATIONS ON THE RECONSTRUCTION OF MOTOR VEHICLES AND SPECIAL-PURPOSE MOTORCYCLES UNDER THE MANAGEMENT SCOPE OF THE MINISTRY OF NATIONAL DEFENSE
SCOPE OF MANAGEMENT OF THE MINISTRY OF NATIONAL DEFENSE
BASED ON THE ROAD TRAFFIC ORDER AND SAFETY LAW dated June 27, 2024;
Pursuant to Decree No. 01/2022/NĐ-CP dated November 30, 2022 of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of National Defense;
At the proposal of the Director of the General Department of Technology;
The Minister of National Defense issues this Circular to regulate the reconstruction of motor vehicles and special-purpose motorcycles under the management scope of the Ministry of National Defense.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular regulates the reconstruction of motor vehicles and special-purpose motorcycles (hereinafter referred to collectively as military vehicles) under the management scope of the Ministry of National Defense.
Article 2. Applicability
This Circular applies to agencies, units, organizations, and individuals related to the reconstruction of military vehicles under the management scope of the Ministry of National Defense.
Article 3. Explanation of Terms
In this Circular, the following terms are understood as follows:
1. Motor vehicles including automobiles, including chassis automobiles, tractor automobiles, electric automobiles; trailers and semi-trailers, including trailers and semi-trailers equipped with special-purpose equipment.
a) Cars including passenger cars, transport vehicles, special-purpose vehicles;
b) Passenger car refers to vehicles carrying up to nine passengers.
c) Transport vehicle refers to vehicles designed for cargo transportation or used to tow artillery and equipment.
d) Special-purpose vehicle refers to vehicles with specific structures suitable for the technical and functional requirements of each type of technical equipment, including general special-purpose vehicles and military special-purpose vehicles (referred to as special vehicles).
2. Specialized motor vehicles including military special-purpose motorcycles, construction motorcycles, loading and unloading motorcycles, and other types of special-purpose motorcycles participating in traffic as stipulated in Appendix I attached hereto.
3. Reconstruction of military vehicles refers to changing the usage function or altering the system and assemblies of the vehicle; replacing systems and assemblies with the same model, manufacturer, and spare part code does not constitute reconstruction.
4. Original vehicle refers to military vehicles that have not been reconstructed without changes to their functions or systems compared to the manufacturer's design.
5. Pre-reconstruction vehicle (military vehicle before reconstruction) refers to original vehicles or military vehicles that have undergone reconstruction.
6. System includes: Power transmission system, drive system, suspension system, braking system, steering system, fuel system, electrical system, lighting and signaling system, electro-hydraulic system, automation system, hydraulic system, work system.
7. Main assembly including engine, frame, cab, body or cargo box, specialized equipment.
8. Changing usage function refers to altering the current functionality of military vehicles.
9. Changing system refers to replacing part or all of a system with another part or all of a different system ensuring the combat and technical performance of military vehicles.
10. Changing assembly refers to replacing an assembly with another assembly ensuring the combat and technical performance of military vehicles.
11. Gross Weight is the total weight of the vehicle itself and its load capacity.
12. Design review refers to checking and comparing the design documentation contents with the configuration and combat-technical performance approved by the Chief of General Staff and current technical standards, regulations to ensure the quality, safety, and environmental protection of reconstructed military vehicles.
13. Acceptance Reconstructed military vehicle refers to inspecting and comparing to evaluate the quality, safety, and environmental protection of military vehicles after reconstruction according to the design documentation approved by the competent authority.
Chapter II
CONTENT AND PRINCIPLES OF MILITARY VEHICLE RECONSTRUCTION
Article 4. Content of motor vehicle reconstruction
1. Changing the usage function of motor vehicles
a) Converting passenger cars and transport vehicles into special-purpose vehicles or converting one type of special-purpose vehicle into another;
b) Converting special-purpose vehicles into transport vehicles or passenger cars;
c) Converting trailers and semi-trailers into specialized trailers and semi-trailers, or converting specialized trailers and semi-trailers into different specialized trailers and semi-trailers;
d) Installing technical equipment on motor vehicles after improvement, modification, or modernization.
2. Replacing original systems and assemblies with different systems and assemblies ensuring the combat and technical performance of motor vehicles.
Article 5. Contents of改装专用摩托车的改造
1. Changing the usage functions of specialized motorcycles
a) Modifying the functions of specialized motorcycles from one type to another;
b) Installing technical equipment on specialized motorcycles after improvement, modification, and modernization.
2. Replacing the original system or assembly with another system or assembly ensuring the combat-technical capabilities of specialized motorcycles.
Article 6. Principles for Military Vehicle Modification
1. Not replacing the frame but only changing its length or reinforcing the original frame without altering the original vehicle's wheelbase, except for trailers and semi-trailers.
2. Each motor vehicle may only modify or change the engine and no more than three systems or assemblies out of seven original systems or assemblies. Specifically:
a) Power transmission system (clutch, gearbox, drive shaft, main drive axle);
b) Drive system (wheels);
c) Suspension system;
d) Braking system;
đ) Steering system;
e) Cab, cargo box, or self-dumping box;
g) Vehicle electrical system (for electric cars: Battery Energy Storage System (BESS), management system: charging status indicator, battery temperature control, electronic converter, motor, and controller; wiring and connectors; external charging system if equipped; charging port connection on the vehicle).
3. Each specialized motorcycle may only modify the engine and no more than four systems or assemblies out of eight original systems or assemblies.
Specifically:
a) Power transmission system including (clutch, gearbox, drive shaft, main drive axle, hydraulic transmission);
b) Drive system (wheels, passive axle, moving motor);
c) Suspension system;
d) Braking system;
đ) Steering system;
e) Electrical, hydraulic, and automated electrical systems;
g) Cab, body;
h) Specialized equipment.
4. Must comply with technical standards, regulations, and laws and regulations of the Ministry of National Defense regarding quality, safety, environmental protection, and state secrets in the field of national defense.
5. The total weight of military vehicles after modification must meet the stability and operational safety criteria and comply with the weight requirements stipulated in the Road Traffic Order and Safety Law.
6. The width limit of military vehicles after modification shall not exceed the width limit prescribed in the Road Traffic Order and Safety Law.
7. Military vehicles after modification must be registered according to the law.
Chapter III
PROCEDURE AND PROCEDURES FOR MILITARY VEHICLE MODIFICATION
Article 7. Procedure for Military Vehicle Modification
1. Units under the Ministry of National Defense that require military vehicle modification shall establish the configuration and combat-technical functions of the vehicle (in cases where the combat-technical functions are changed) and submit them for approval by the Chief of General Staff.
2. Permit for military vehicle modification.
3. Design for military vehicle modification.
4. Review and approve the design modification documents for military vehicles.
5. Construction of military vehicle modification.
6. Acceptance of military vehicles.
Article 8. Issuance of Military Vehicle Modification Permits
1. Authority to issue permits for military vehicle modification
a) The Chief of General Staff issues permits for military vehicle modification in cases as specified in Clause 1, Article 4 and Clause 1, Article 5 of this Circular.
b) The Director of the Motorcycles-Vehicle Transport Department/Logistics-Technical General Department issues Military Vehicle Modification Permits according to Form No. 02 Appendix II attached to this Circular in cases as specified in Clause 2, Article 4 and Clause 2, Article 5 of this Circular.
2. Military vehicle modification permits are issued for each individual vehicle or series of vehicles and serve as the basis for technical design, construction of modifications, and registration.
3. Application for issuance of military vehicle modification permits
a) The vehicle-motorcycle department or motorcycle-transport department of units directly under the Ministry of National Defense is responsible for preparing one set of application documents for military vehicle modification permits and submitting them to the competent authority through the military network or directly or by military mail;
b) For cases as specified in Clause 1, Article 4 and Clause 1, Article 5 of this Circular, the application documents include: the unit's request for approval of military vehicle modification permits according to Form No. 01 Appendix II attached to this Circular; copies of the Chief of General Staff's decision approving the post-modification configuration and combat-technical functions of the vehicle; copies of the origin certificate for the vehicle if it has not been registered and copies of the registration certificate if it has been registered, and copies of the original certificates of the replaced assemblies;
c) For cases as specified in Clause 2, Article 4 and Clause 2, Article 5 of this Circular, the application documents include: the technical department or logistics-technical department's request for approval of military vehicle modification permits according to Form No. 01 Appendix II attached to this Circular; copies of the origin certificate for the vehicle if it has not been registered; copies of the registration certificate if it has been registered, and copies of the original certificates of the replaced assemblies.
Article 9. Design of Military Vehicle Renovation
1. The agency, unit with the function and mission to design military vehicle renovation or organization licensed by the competent authority to operate the business of designing road motor vehicles shall be responsible before the law and the Ministry of National Defense for the content and quality of the military vehicle renovation design dossier. In cases where technical equipment is installed on military vehicles, it must be carried out by a design unit under the Ministry of National Defense.
2. Dossier for the design of military vehicle renovation
a) Technical drawings presented according to current Vietnamese standards including: General layout drawing of the military vehicle after renovation; general layout drawing of the military vehicle before renovation for comparison; installation drawing of the complete assembly and system being renovated; detailed drawings of components being renovated and newly manufactured including technical requirements, technology and materials permitted for use during renovation and replacement;
b) Calculation explanation including the following contents: The necessity of renovating the vehicle; basic combat-technical characteristics of the military vehicle before and after renovation; content and steps to implement the renovation; calculation of dynamic and dynamic characteristics related to the renovation content; calculation of durability testing and economic efficiency; instructions for using the military vehicle after renovation; conclusion;
c) Acceptance technical conditions and quality inspection of military vehicles after renovation.
3. Military vehicles undergoing renovation do not need to establish a design dossier in the following cases:
a) Training and examination military vehicles installing or removing auxiliary brake pedals (auxiliary brake pedal connected to the main brake pedal through mechanical drive lever);
b) Installing or removing dust covers for cargo boxes of dump trucks without changing the cargo box dimensions;
c) Installing or removing cargo compartment covers, luggage compartments of pickup trucks without changing the vehicle's overall dimensions.
Article 10. Review and Approval of Military Vehicle Renovation Design Dossier
1. The Motor Transport Department under the Logistics and Engineering General Department or the agency assigned the task shall be responsible for reviewing the military vehicle renovation design dossier in accordance with the provisions of the law; the Director of the Motor Transport Department under the Logistics and Engineering General Department shall approve the military vehicle renovation design dossier.
2. The agency or unit requesting review and approval of the military vehicle renovation design dossier shall be responsible for establishing one dossier in accordance with the provisions of Clause 4 of this Article and sending the dossier via the military network or directly or by military mail to the Motor Transport Department under the Logistics and Engineering General Department. Within fifteen working days from the date of receipt of a complete and valid dossier in accordance with the provisions of Clause 4 of this Article, the reviewing agency at Clause 1 of this Article must send a review document to the requesting unit. In case the dossier is invalid, the Motor Transport Department under the Logistics and Engineering General Department shall issue a document requesting the agency or unit to supplement the dossier; the time for supplementing the dossier shall not be counted towards the processing period.
In cases where military vehicles are renovated from new base vehicles, lacking technical documentation of the base vehicle, requiring additional research time, the dossier review agency must notify in writing the reasons to the design submission unit; the extended time shall not exceed ten working days.
3. Military vehicles requiring renovation that have been reviewed by the Vietnam Inspection Agency or provincial transportation departments do not need to go through the review process; the units with renovated vehicles must send to the Motor Transport Department under the Logistics and Engineering General Department the original design dossier that has been reviewed or a copy accompanied by the original for verification.
4. Dossier for Requesting Review and Approval of Military Vehicle Renovation Design
a) Dossier for cases stipulated in Clause 1 of Article 4 and Clause 1 of Article 5 of this Circular, including: A letter from the technical agency or logistics-engineering agency of subordinate units under the Ministry of National Defense or the design unit submitting for review and approval of the military vehicle renovation design dossier in accordance with Model No. 03 Appendix II attached to this Circular; a copy of the Decision approving the configuration and combat-technical characteristics of the renovated vehicle by the Chief of the General Staff; a copy of the Military Vehicle Renovation Permit issued by the Chief of the General Staff and the military vehicle renovation design dossier;
b) Dossier for cases stipulated in Clause 2 of Article 4 and Clause 2 of Article 5 of this Circular, including: A letter from the technical agency or logistics-engineering agency of subordinate units under the Ministry of National Defense or the design unit submitting for review and approval of the military vehicle renovation design dossier in accordance with Model No. 03 Appendix II attached to this Circular; a copy of the Military Vehicle Renovation Permit issued by the Director of the Motor Transport Department under the Logistics and Engineering General Department; the military vehicle renovation design dossier.
5. The approved design dossier shall be stored at the Motor Transport Department under the Logistics and Engineering General Department and sent to the following agencies:
a) The design unit;
b) The vehicle-motor or motor-transport agency of subordinate units under the Ministry of National Defense;
c) The construction unit carrying out the renovation.
Article 11. Construction and renovation of military vehicles
1. Units and organizations conducting construction and renovation of military vehicles
a) Organizations with legal personality, registered to conduct construction and renovation, production, and assembly of road motor vehicles;
b) Units within the Ministry of National Defense having the function and mission of constructing and renovating military vehicles.
2. Construction and renovation of military vehicles must comply with design documents that have been approved by competent authorities.
3. Units and organizations conducting construction and renovation of military vehicles as stipulated in Clause 1 of this Article shall be responsible for the quality of military vehicles after renovation.
4. The construction and renovation of military vehicles must be carried out in accordance with the provisions of the law on bidding. In cases where technical equipment is installed on military vehicles, such work must be undertaken by units under the Ministry of National Defense.
Article 12. Procedures and documents for acceptance of renovated military vehicles
1. Documents for requesting acceptance of renovated military vehicles include:
a) A letter from the technical agency or logistics-technical agency of subordinate units of the Ministry of National Defense proposing acceptance (in accordance with Model No. 04 attached as Appendix II to this Circular), sent to the Motor Vehicle Transport Department of the Logistics and Technical General Department through the military network or directly or by military mail;
b) A copy of the Decision of the General Staff approving the configuration and combat-technical features of the vehicle after renovation (for cases involving changes in features);
c) A copy of the Permit for Renovation of Military Vehicles;
d) Design documents for the renovation of military vehicles that have been approved;
đ) A copy of the original certificate of the vehicle for vehicles not yet registered (Certificate of Registration for registered vehicles, original certificate of replaced assemblies);
e) Certificate of Quality at Factory Out of the construction organization;
g) Minutes of acceptance by the acceptance committee at the base level.
2. Minutes of acceptance of renovated military vehicles (for motor vehicles according to Model No. 05, for specialized motorcycles according to Model No. 06 attached as Appendix II to this Circular) serve as the basis for the Director of the Motor Vehicle Transport Department of the Logistics and Technical General Department to issue a Certificate of Technical Safety and Environmental Protection for renovated military vehicles (for motor vehicles according to Model No. 07, for specialized motorcycles according to Model No. 08 attached as Appendix II to this Circular).
3. Documents for acceptance of renovated military vehicles include: Documents for requesting acceptance of renovated military vehicles as stipulated in Clause 1 of this Article and minutes of acceptance of renovated military vehicles by the acceptance committee of the Motor Vehicle Transport Department of the Logistics and Technical General Department as stipulated in Clause 2 of this Article, which will be stored by the Motor Vehicle Transport Department of the Logistics and Technical General Department one set, the vehicle-motorcycle or motorcycle-transport unit under the Ministry of National Defense (the unit with renovated vehicles) one set, and the construction organization one set.
Article 13. Acceptance Committee for Renovated Military Vehicles
1. The vehicle-motorcycle or motorcycle-transport agency of subordinate units of the Ministry of National Defense proposes to the Technical Chief or Logistics and Technical Chief of the same level to report to the Unit Commander to establish a base-level acceptance committee, the composition of the acceptance committee is decided by the Unit Commander.
2. The Motor Vehicle Transport Department of the Logistics and Technical General Department establishes an acceptance committee to inspect technical safety and environmental protection, issue Certificates of Technical Safety and Environmental Protection, the composition of the acceptance committee is decided by the Director of the Motor Vehicle Transport Department of the Logistics and Technical General Department (the composition of the acceptance committee according to Model No. 05 and Model No. 06 attached as Appendix II to this Circular).
3. Principles of operation of the acceptance committee
a) The committee operates based on the principle of collective decision-making, members of the committee participate in discussions to reach consensus, in cases where there are differing opinions, decisions are made by majority vote, in cases where opinions are evenly divided, the Chairman of the committee decides;
b) For products produced in batches, after the first product has been accepted and meets requirements, the acceptance committee of the Motor Vehicle Transport Department of the Logistics and Technical General Department may authorize the base-level acceptance committee to independently inspect the technical safety and environmental protection of subsequent products. Minutes of acceptance by the base-level acceptance committee have validity for procedures to issue Certificates of Technical Safety and Environmental Protection.
Chapter IV
RESPONSIBILITIES OF THE AGENCIES AND UNITS
Article 14. General Staff Department
1. Approves the configuration and combat-technical capabilities of vehicles after modification for cases specified in Clause 1, Article 4 and Clause 1, Article 5 of this Circular.
2. Grants permission for modification for vehicles specified in Clause 1, Article 4 and Clause 1, Article 5 of this Circular.
Article 15. Logistics and Technical General Department
1. Advises the Minister of National Defense on state management of military vehicle modification work within the scope of the Ministry of National Defense's management.
2. Directs the Motor Transport Bureau
a) Is responsible to the Minister of National Defense and the Director of the Logistics and Technical General Department for directing, guiding, organizing implementation, and inspecting military vehicle modification work; granting permission for modification for vehicles specified in Clause 2, Article 4 and Clause 2, Article 5 of this Circular;
b) Reviews and approves design modification files for military vehicles;
c) Organizes technical safety quality and environmental protection inspections; issues certificates of technical safety quality and environmental protection for modified military vehicles;
d) Manages and stores military vehicle modification files in accordance with this Circular.
Article 16. Agencies and Units
1. Heads of agencies and units under the Ministry of National Defense are responsible for their agency or unit’s military vehicle modification work in accordance with the law and this Circular.
2. Vehicle or motor transport agencies of units under the Ministry of National Defense
a) Advises the head of the agency or unit on implementing military vehicle modification work in accordance with this Circular;
b) Is responsible for the legality of the modification application files;
c) Strictly follows the direction, guidance, and inspection of the Motor Transport Bureau/Logistics and Technical General Department regarding military vehicle modification work.
Chapter V
IMPLEMENTING PROVISIONS
Article 17. Effective Date
This Circular takes effect from January 1, 2025, and replaces Circular No. 95/2023/TT-BQP dated November 29, 2023, issued by the Minister of National Defense on the modification of military vehicles and specialized motor vehicles within the scope of the Ministry of National Defense's management.
Article 18. Transitional Provisions
1. Military vehicles with modification design files approved before the effective date of this Circular continue to be implemented according to Circular No. 95/2023/TT-BQP dated November 29, 2023, issued by the Minister of National Defense on the modification of military vehicles and specialized motor vehicles within the scope of the Ministry of National Defense's management.
2. Military vehicles that have been granted permission for modification by authorized authorities before the effective date of this Circular, subsequent steps shall be carried out in accordance with this Circular.
Article 19. Responsibility for Implementation
The Chief of General Staff, the Director of the Logistics and Technical General Department, heads of agencies, units, organizations, and related individuals are responsible for implementing this Circular./.
