Regulations on military control,
inspection of military vehicles participating in road traffic
BASED ON THE ROAD TRAFFIC ORDER AND SAFETY LAW dated June 27, 2024;
Pursuant to Decree No. 01/2022/NĐ-CP dated November 30, 2022 of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of National Defense;
At the proposal of the Director of the General Department of Technology;
The Minister of National Defense promulgates this Circular regulating military control and inspection of military vehicles participating in road traffic.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
1. This Circular regulates the inspection work of military vehicles; conditions of military vehicles and drivers of military vehicles participating in road traffic under the management of the Ministry of National Defense.
2. Military control work shall be carried out in accordance with the provisions of Section 5 Chapter V of the Internal Regulations for the People's Army of Vietnam issued together with Circular No. 193/2011/TT-BQP dated November 23, 2011 of the Minister of National Defense.
Article 2. Applicability
This Circular applies to the force inspecting military vehicles; responsibilities of agencies, units, military enterprises (hereinafter referred to collectively as agencies, units); organizations and individuals related to the management and use of military vehicles and driving military vehicles on road traffic.
Article 3. Explanation of Terms
In this Circular, the following terms are understood as follows:
1. Inspection of military vehicles including:
a) Technical safety inspection of military vehicles;
b) Legal condition inspection of military vehicles and drivers of military vehicles;
c) Etiquette and conduct inspection of military personnel driving military vehicles;
d) Inspection of compliance with laws and regulations on traffic order and safety, regulations of the Ministry of National Defense, and other relevant laws concerning drivers of military vehicles participating in road traffic.
2. Vehicle and Transport Department is the Vehicle and Transport Department or the Logistics and Engineering Department directly subordinate to agencies and units from division level and equivalent.
3. Professional military vehicle inspection force consists of officers and assistants specializing in military vehicle inspection assigned to the Department of Military Mechanical Safety/Department of Vehicle and Transport/Logistics and Engineering General Department.
4. Non-professional military vehicle inspection force consists of officers and assistants belonging to the Vehicle and Transport Departments of agencies and units directly subordinate to the Ministry of National Defense, team leaders of Military Vehicle Inspection Teams, and military vehicle inspectors appointed by competent authorities to establish Military Vehicle Inspection Teams and assign them inspection tasks in accordance with this Circular.
5. Driver of military vehicles participating in road traffic refers to the driver of military motor vehicles and special-purpose motorcycles under the management of the Ministry of National Defense participating in road traffic.
Article 4. Object, file, authority, procedure for issuing Military Vehicle Inspection Authorization Certificate, Team Leader Certificate of Military Vehicle Inspection Team
1. Recipients of Military Vehicle Inspection Authorization Certificate, Team Leader Certificate of Military Vehicle Inspection Team:
a) Military Vehicle Inspection Authorization Certificate: Heads of the Department of Vehicle and Transport, heads of relevant departments and officers of the Department of Military Mechanical Safety/Department of Vehicle and Transport/Logistics and Engineering General Department; heads of departments or sections responsible for Vehicle and Transport work under the Logistics and Engineering Department of military regions, corps, and equivalent; officers and assistants responsible for vehicle inspection work in the Vehicle and Transport Departments of agencies and units under the Logistics and Engineering Department of military regions, corps, and equivalent;
b) Team Leader Certificate of Military Vehicle Inspection Team: Officers and professional soldiers belonging to the Vehicle and Transport Departments from division level and equivalent, proposed according to the decision to establish Military Vehicle Inspection Teams of agencies and units in accordance with Clause 3, Article 7 of this Circular.
2. Documents include:
a) File for issuing Military Vehicle Inspection Authorization Certificate:
- Request for issuance of Military Vehicle Inspection Authorization Certificate signed by the head of the Logistics and Engineering Department of military regions, corps, and equivalent, proposing to the Department of Vehicle and Transport/Logistics and Engineering General Department in accordance with Model No. 03 Appendix I attached to this Circular;
- Copy of appointment decision;
- Copy of Military ID;
- Two color photographs in regular uniform (20 x 30 mm).
b) File for issuing Team Leader Certificate of Military Vehicle Inspection Team:
- Request for issuance of Team Leader Certificate of Military Vehicle Inspection Team signed by the head of the Logistics and Engineering Department of military regions, corps, and equivalent, proposing to the Department of Vehicle and Transport/Logistics and Engineering General Department in accordance with Model No. 03 Appendix I attached to this Circular;
- Copy of decision to establish Military Vehicle Inspection Team;
- Copy of Military ID;
- Two color photographs in regular uniform (20 x 30 mm).
3. Issuing Authority: The Director of the Department of Vehicle and Transport/Logistics and Engineering General Department decides to issue Military Vehicle Inspection Authorization Certificate, Team Leader Certificate of Military Vehicle Inspection Team to the recipients specified in points a and b of Clause 1 of this Article when receiving complete valid files in accordance with points a and b of Clause 2 of this Article.
4. Issuing Procedure:
a) Within five working days from the date of receipt of complete valid files, the competent agency of the Department of Vehicle and Transport/Logistics and Engineering General Department is responsible for checking the validity of the files, compiling a list, printing all information onto the Military Vehicle Inspection Authorization Certificate and Team Leader Certificate of Military Vehicle Inspection Team in accordance with Model No. 01 and Model No. 02 Appendix I attached to this Circular, and submitting it to the Director of the Department of Vehicle and Transport/Logistics and Engineering General Department for issuance to the recipients specified in points a and b of Clause 1 of this Article;
b) In case the files are not valid, the Department of Vehicle and Transport/Logistics and Engineering General Department requests the agency or unit to supplement the files completely within three working days in accordance with points a and b of Clause 2 of this Article; if the agency or unit fails to supplement the files completely within three working days, the Department of Vehicle and Transport/Logistics and Engineering General Department returns the files to the agency or unit and specifies the reasons; the time for supplementing the files does not count towards the processing period.
The Vehicle and Transport Departments under the Logistics and Engineering Departments of military regions, corps, and equivalent are responsible for preparing one set of files, drafting a request, and sending it to the Department of Vehicle and Transport/Logistics and Engineering General Department through the military data transmission network or military post.
Article 5. Issuance, Replacement, and Revocation of Military Vehicle Inspection Delegation and Military Vehicle Inspection Team Leader Certificate
In December each year, the Motor Transport Agency under the Logistics and Technical Department of Military Regions, Corps, and equivalent units shall inspect, review, and compile a proposal to the Motor Transport General Department/Central Logistics and Technical Department for the issuance, replacement, and revocation of Military Vehicle Inspection Delegation and Military Vehicle Inspection Team Leader Certificate according to Model No. 03 in Appendix I attached to this Circular.
1. Replacement:
a) Circumstances for replacement:
- Expiration of validity period;
- Change in position or rank;
- Damage or wear.
b) Documents include:
- The request for replacement of Military Vehicle Inspection Delegation and Military Vehicle Inspection Team Leader Certificate must be proposed by the Head of the Logistics and Technical Department of Military Regions, Corps, and equivalent units according to Model No. 03 in Appendix I attached to this Circular;
- A copy of the decision appointing the position or promoting military rank (if there is a change);
- The current Military Vehicle Inspection Delegation and Military Vehicle Inspection Team Leader Certificate;
- Two color photographs in uniform (20 x 30 mm);
- The Motor Transport Agency under the Logistics and Technical Department of Military Regions, Corps, and equivalent units is responsible for compiling one set of files and sending the request to the Motor Transport General Department/Central Logistics and Technical Department via the military data transmission network or military postal service.
c) Procedure for replacement: Follow the provisions of Clause 4, Article 4 of this Circular.
2. Revocation and cancellation of Military Vehicle Inspection Delegation and Military Vehicle Inspection Team Leader Certificate in the following cases:
a) Change in job position, no longer suitable for the subject defined in Points a and b, Clause 1, Article 4 of this Circular;
b) Misuse of purpose;
c) Damage or wear;
d) Already replaced according to the provisions of Clause 1 of this Article;
đ) Resignation from active duty in the Military.
Article 6. Prohibited Acts
1. Insulting, threatening, obstructing, opposing, or failing to comply with the instructions, guidance, and requests for inspection by the military vehicle inspection force.
2. Organizing military vehicle inspections without being assigned tasks by competent authorities or without a military vehicle inspection plan approved according to Clause 1, Article 11 of this Circular.
3. Imposing fines; using positions or powers to accept money or material from violators; arbitrarily searching, examining, and improperly using temporarily detained items.
4. Engaging in violent acts, threatening drivers of military vehicles participating in road traffic during inspections.
5. Interfering or influencing the inspection process and handling violations by the military vehicle inspection force.
6. Other acts prohibited by law.
Chapter II
PROVISIONS ON MILITARY VEHICLE INSPECTION
Section 1
ORGANIZATIONAL FORM; FUNCTIONS, DUTIES; LIMITATIONS;
WORK RELATIONSHIP OF THE MILITARY VEHICLE INSPECTION FORCE
Article 7. Organizational Form
The military vehicle inspection force is a system under the Motor Transport Service of the Military, organized or assigned tasks from the Motor Transport General Department/Central Logistics and Technical Department to the Motor Transport Agencies at division level and equivalent (excluding factories, hospitals, battalions, and military enterprises):
1. The Military Mechanical Safety Office under the Motor Transport General Department/Central Logistics and Technical Department is the specialized agency responsible for directing, guiding, and inspecting the military vehicle inspection work of agencies, units, and military vehicle inspection teams throughout the country.
2. The Motor Transport Agency under the Logistics and Technical Departments of Military Regions, Corps, and equivalent units:
a) Advising leaders and commanders of competent agencies and units to issue decisions establishing Military Vehicle Inspection Teams and assigning tasks to team leaders and members of Military Vehicle Inspection Teams;
b) Directly directing, inspecting, and guiding the professional work of military vehicle inspections for Military Vehicle Inspection Teams under their jurisdiction.
3. Military Vehicle Inspection Teams established by the command of agencies and units at division level and above include:
a) One team leader, who is an officer or professional soldier, having a technical degree in vehicles-machinery from secondary level upwards;
b) Two members:
- One member is a professional soldier, having a technical degree in vehicles-machinery from primary level upwards;
- One member is a professional soldier or non-commissioned officer, private.
Article 8. Functions and Tasks
1. Functions:
a) Assist commanders in inspecting the management and use of military vehicles;
b) Inspect the technical safety of military vehicles when participating in road traffic;
c) Inspect the etiquette and conduct of military personnel driving military vehicles;
d) Inspect compliance with laws and regulations of the Ministry of National Defense regarding traffic order and safety work;
đ) Timely detect and prevent violations of traffic order and safety laws, military discipline, and other laws when military vehicles participate in road traffic;
2. Tasks:
a) Inspect the technical safety of military vehicles; inspect the etiquette and conduct of military personnel; inspect compliance with laws and regulations of the Ministry of National Defense regarding traffic order and safety work; inspect the legal conditions of military vehicles and drivers participating in road traffic;
b) Coordinate with military control forces: Inspect military vehicles; inspect the etiquette and conduct of military personnel driving military vehicles participating in road traffic according to plans; coordinate with public security forces and other relevant forces to control road traffic when assigned tasks; guide and lead convoys to ensure traffic safety for mobile military vehicle convoys performing tasks; guide and ensure the safety of international delegations when assigned tasks by competent authorities;
c) Summarize, study, and analyze the causes of traffic order and safety violations and traffic accidents; propose solutions and measures to prevent traffic order and safety violations and traffic accidents; manage statistics and retain files on traffic order and safety violations and traffic accidents within the Ministry of National Defense and provide data to related agencies and units; compile and report to command agencies and units and higher-level business agencies as prescribed;
d) Regularly, the Military Vehicle - Transportation Department under the General Logistics and Technical Department, and the Military Vehicle - Transportation Agency at the military region level shall work with the Traffic Police Department and local traffic police agencies within their jurisdiction to grasp the situation of traffic order and safety and violations of traffic order and safety by people and military vehicles under the management of the Ministry of National Defense;
đ) Participate in the appraisal of traffic accidents involving people and military vehicles under the management of the Ministry of National Defense upon request from functional agencies; guide the resolution of traffic accidents and compensation for damages caused by traffic accidents for people and military vehicles that have compulsory civil liability insurance and military vehicle property insurance according to classification;
Article 9. Authorities
1. The Military Vehicle - Transportation Department under the General Logistics and Technical Department shall inspect all agencies and units throughout the army:
a) Inspect and correct the activities of military vehicle inspection forces;
b) Inspect and handle compliance with laws and regulations of the Ministry of National Defense regarding traffic order and safety work for military vehicles and drivers participating in road traffic;
c) Inspect the management and use of military vehicles;
d) When inspecting, the Military Vehicle - Transportation Department under the General Logistics and Technical Department must have an inspection plan as prescribed (except for spot inspections conducted according to directives or orders of competent authorities);
2. The Military Vehicle - Transportation Agencies of agencies and units under the Logistics and Technical Department at the military region, corps, and equivalent levels shall inspect subordinate agencies and units:
a) Inspect and correct the activities of military vehicle inspection teams when there are signs of law violations and military discipline breaches;
b) Inspect the management and use of military vehicles;
c) Inspect and handle compliance with laws and regulations of the Ministry of National Defense regarding traffic order and safety work for military vehicles and drivers participating in road traffic;
d) When inspecting, the Military Vehicle - Transportation Agency must have an inspection plan as prescribed (except for spot inspections conducted according to directives or orders of competent authorities);
3. Military vehicle inspection teams:
a) Have the authority to issue commands to stop vehicles for inspection according to plans;
b) Depending on the degree of violation by military vehicles and drivers, and the technical safety condition of the vehicles, the team leader of the Military Vehicle Inspection Team has the authority to prepare a record to suspend the operation of the vehicle: temporarily detain the vehicle, driver's license, related documents, and non-compliant goods as stipulated in Clauses 2 and 3, Article 13 of this Circular;
4. Personnel authorized to inspect military vehicles have the following rights:
a) Inspect and correct the activities of military vehicle inspection forces when there are signs of violations;
b) Stop vehicles to inspect and handle compliance with laws and regulations of the Ministry of National Defense regarding traffic order and safety work for military vehicles and drivers participating in road traffic when there are signs of violations;
c) When inspecting and discovering violations by military vehicle inspection forces and drivers, they must immediately inform the functional agency of the Military Vehicle - Transportation Department under the General Logistics and Technical Department or the commander of the unit directly managing the military vehicle inspection forces and drivers to take appropriate measures as prescribed;
Article 10. Work Relations
1. The relationship between military vehicle inspection forces and leaders and commanders of directly managing agencies and units is a relationship of obedience to leadership and command;
2. The relationship between military vehicle inspection teams and the Mechanized Safety Office under the Military Vehicle - Transportation Department under the General Logistics and Technical Department and superior Military Vehicle - Transportation Agencies is a directive relationship where they are subject to direction and inspection regarding military vehicle inspection work;
3. The relationship between military vehicle inspection forces and military control forces, defense inspectors, criminal investigators, traffic police, and other related forces is a cooperative relationship;
Section 2
ORGANIZATION OF MILITARY VEHICLE INSPECTION ACTIVITIES
Article 11. Construction and Implementation of Inspection Plans
1. Plan formulation:
a) Annually, the Motorcycles and Transport Department under the Logistics and Engineering General Department shall develop plans for inspecting military vehicle operations within the entire military force, submit them to the Chief of the Logistics and Engineering General Department for approval, and organize their implementation; develop inspection plans for military vehicles in Hanoi City and assign tasks to relevant agencies and units on the ground to implement according to the plan; once the plan is approved, the Motorcycles and Transport Department under the Logistics and Engineering General Department must send the inspection plan to the inspected agencies and units for coordination in its implementation;
b) The Motorcycles and Transport Departments under the Logistics and Engineering Departments of Military Regions, Corps, and equivalent units shall develop plans for inspecting military vehicles in their areas of deployment, report to the Chief of Logistics and Engineering for submission to the head of the directly subordinate agency of the Ministry of National Defense for approval and organization of implementation, while also sending the plans to the Motorcycles and Transport Department under the Logistics and Engineering General Department for monitoring and guidance, and to the Military Regions in their areas of deployment for coordination in implementation. The plan for the following year must be completed and approved before December 10 each year;
c) Unscheduled inspections of military vehicles shall be carried out when there is a directive or order from the competent authority or when there is a request for cooperation from functional agencies in the area of deployment.
2. Implementation of the Plan:
a) The Head of the Military Vehicle Inspection Team must disseminate and ensure understanding among team members about the content of the military vehicle inspection plan and related matters; check and prepare equipment, devices, tools, uniforms, insignia, and related documents. Promptly correct and address deficiencies and issues of subordinates before conducting military vehicle inspections;
b) Members of the Military Vehicle Inspection Team must be proficient in military vehicle inspection procedures, the content of the inspection plan; assigned tasks, communication methods; proactively prepare according to the division of labor by the Team Leader.
Article 12. Conducting Inspections
1. The Military Vehicle Inspection Team may only stop military vehicles for inspection according to the inspection plan that has been approved by the competent authority of the agency or unit.
2. Inspection Locations: Places that are easily observable, have parking spaces, and do not obstruct traffic; inspections should not be organized at intersections, steep roads, curves, or places with limited visibility.
3. When a military vehicle requiring inspection is detected approximately 50 meters away from the inspection location, the member of the Military Vehicle Inspection Team shall use a traffic direction stick (at night, the traffic direction stick must have a light) and a whistle to signal the driver to stop the vehicle. Once the vehicle has stopped completely, the driver must present relevant documents for inspection; the inspection must be conducted in a systematic, careful, and thorough manner:
a) Technical Safety Inspection of Vehicles:
- Inspect steering system, braking system;
- Inspect the synchronization and operation of lighting and signaling systems (headlights, turn signals, brake lights, license plate lights, horn...);
- Inspect rearview mirrors, windshields, side windows, wipers;
- Inspect tires and wheels according to the technical specifications of each type of vehicle;
- Inspect mufflers and smoke reduction systems;
- Inspect fixed seating (for training driving practice vehicles and troop transport vehicles);
- Inspect cargo stacking and securing (for cargo transport vehicles).
b) Legal Conditions of Military Vehicles and Drivers:
- Vehicle registration certificate, Driving Practice Permit (for training driving practice vehicles), Work Vehicle Permit, Valid Inspection Certificate, Inspection Sticker affixed on the windshield;
- Front and rear license plates;
- License plate on the rear of the cargo box (for cargo transport vehicles);
- "Practice Driving" sign (for training driving practice vehicles);
- Auxiliary number system;
- Military Driver's License;
- Driving Instructor Permit (for driving instructors);
- Specialized Motorcycle Operation Certificate or Traffic Law Knowledge Training Certificate (for specialized motorcycle operators without a Driver's License);
- Cargo documents (for cargo transport vehicles);
c) Military Etiquette and Conduct of Military Vehicle Drivers;
d) Alcohol and other stimulant concentration tests (if there are signs).
Article 13. Handling Violations After Inspection
1. Criticize, remind, and record in the Military Vehicle Work Permit and the Vehicle Inspection Logbook for military vehicle drivers who commit minor violations.
2. Prepare a temporary detention record for the Driver's License, Driving Instructor's License, and Special Purpose Vehicle Operator's Certificate, and require the relevant agency or unit to resolve the matter for military vehicle drivers who violate any of the following circumstances:
a) Operating a military vehicle without a Registration Certificate.
b) The vehicle does not have a Calibration Label or the Calibration Label has expired.
c) The Driver's License, Driving Instructor's License, or Special Purpose Vehicle Operator's Certificate is erased, torn, illegible, or inappropriate for the type of vehicle being operated; using a civilian Driver's License to operate a military vehicle (except in cases where military drivers serve Party and State leaders according to regulations of the Ministry of Defense).
d) Operating a military vehicle with alcohol or other prohibited stimulants in their breath.
đ) Transporting prohibited goods or goods without valid documentation: Warehouse Release Order (sales invoice or purchase, sale, transportation contract); legal documents related to the goods, transport, and personnel outside of duty.
e) Transporting oversized or overweight cargo; super-long or super-heavy vehicles without a special permit as prescribed by law.
g) Refusing to stop the vehicle for inspection upon command from enforcement authorities.
3. Suspend operations and temporarily detain the vehicle:
a) Suspend operations and require return to the unit, record in the Military Vehicle Work Permit and the Vehicle Inspection Logbook: Using a military vehicle in violation of regulations (content not matching the Military Vehicle Work Permit, incorrect vehicle group).
b) Prepare a temporary detention record for the vehicle and require the relevant agency or unit to resolve the matter for military vehicle drivers who violate any of the following circumstances:
- The vehicle does not meet technical safety standards.
- The military vehicle driver does not have a Driver's License or the Driver's License has expired or is not appropriate for the type of vehicle being driven.
- Lack of a Special Purpose Vehicle Operator's Certificate (for those operating special purpose vehicles).
- The vehicle has not been registered.
- The military vehicle driver and vehicle violate the provisions at points d, đ, e, g of Clause 2 of this Article.
4. Prepare a temporary detention record for the vehicle; coordinate with relevant agencies on the local area (Defense Inspectorate or Criminal Investigation) to handle strictly and promptly according to the law for violations involving Registration Plates, Registration Certificates, Calibration Labels, Driver's Licenses, and Special Purpose Vehicle Operator's Certificates that have been erased or are not issued by authorized agencies; vehicles with frame numbers and engine numbers inconsistent with those recorded in the Registration Certificate; vehicles transporting prohibited goods or goods without valid documentation.
5. For all violations under Clauses 2, 3, and 4 of this Article, the head of the Military Vehicle Inspection Team must immediately report to the direct superior commander and send the temporary detention papers along with the record to the Motor Transport Department under the Logistics and Engineering Department of the Military Region, Army Corps, and equivalent units; within no more than two working days from the date of preparing the temporary detention record, the Motor Transport Department must report in writing and send the temporary detention record to the Motor Transport Department/Logistics and Engineering General Department to notify relevant agencies and units with military vehicles and drivers who violated regulations for handling according to the law.
The deadline for the driver to go to the Motor Transport Department under the Logistics and Engineering Department of the Military Region, Army Corps, and equivalent units to resolve the violation shall not exceed seven working days from the date of preparing the temporary detention record.
6. During the period of temporary detention of the vehicle and related documents, the Military Vehicle Inspection Team is responsible for managing the vehicle and related documents; do not temporarily detain goods on the vehicle (except prohibited goods or goods without valid documentation).
Article 14. Termination of Inspection Rounds
1. Upon completion of an inspection round, the Military Vehicle Inspection Team must strictly manage and store vehicles, equipment, and tools for military vehicle inspections; organize experience reviews and compile inspection results to report to the command of the unit and the Motor Transport Department at higher levels as prescribed.
2. Promptly address post-inspection tasks to avoid backlog, negative consequences, or impact on violators.
Article 15. Reporting Inspection Results of Military Vehicles
1. Immediate Report: When discovering vehicles with registration plates, vehicle registration certificates, inspection seals, driver's licenses, or special-purpose vehicle control certificates that have been tampered with or not issued by authorized agencies; vehicles with chassis numbers or engine numbers inconsistent with those recorded in the vehicle registration certificate; vehicles carrying prohibited goods or goods without valid documentation. The head of the Military Vehicle Inspection Team must immediately report to the Motor Transport Department under the Logistics and Technical Department of the Corps and the Motor Transport Department of the General Logistics and Technical Department for timely guidance and direction.
2. Regular Reports: After each inspection round, the head of the Military Vehicle Inspection Team must promptly report to the Motor Transport Department under the Logistics and Technical Department of the Military Region, Army Corps, and equivalent units according to Model No. 08 in Appendix III attached to this Circular. Specifically, for Military Vehicle Inspection Teams in the Hanoi area, reports should be sent to the Motor Transport Department of the General Logistics and Technical Department as prescribed.
3. Periodic Reports: The Motor Transport Departments under the Logistics and Technical Departments of the Military Regions, Army Corps, and equivalent units must compile the results of military vehicle inspections and report them to the Motor Transport Department of the General Logistics and Technical Department according to Model No. 09 in Appendix III attached to this Circular:
a) Report on the first quarter results and second quarter objectives, on March 15;
b) Report on the first half-year results and second half-year objectives, on June 15;
c) Report on the nine-month results and fourth quarter objectives, on September 15;
d) Report on the annual results and next year's objectives, on December 10 annually.
4. Methods of Sending and Receiving Reports: Through the military data transmission network or military postal service.

VEHICLES, EQUIPMENT, TOOLS; UNIFORMS;
BADGES, FORMS OF THE MILITARY VEHICLE INSPECTION FORCES
Article 16. Vehicles, Equipment, Tools
1. Vehicles, Equipment:
a) Special-purpose vehicles for inspecting military vehicles shall be affixed with the inscription "MILITARY VEHICLE INSPECTION" in accordance with Appendix II attached to this Circular. In cases where units do not have special-purpose vehicles for inspecting military vehicles, they may use command vehicles as inspection vehicles;
b) Communication equipment;
c) Video recording equipment;
d) Breath alcohol concentration measuring device;
đ) Speed radar;
e) Brake deceleration measuring device;
g) Other equipment for inspection purposes.
2. Tools:
a) Tables, chairs, umbrellas;
b) Traffic direction batons;
c) Whistles;
d) Steering wheel play measurement ruler;
đ) Free travel measurement ruler for brake and clutch pedals;
e) Length measurement ruler;
g) Other tools for inspection purposes.
Article 17. Uniforms when Performing Military Vehicle Inspection Duties
Personnel performing military vehicle inspection duties shall wear regular uniforms appropriate to the season, wear peaked caps, and wear badges and inspection armbands as prescribed in Clauses 1, 2, and 3 of Article 18 of this Circular.
Article 18. Badges, Forms
1. The badge for the Head of the Military Vehicle Inspection Team as specified in Form No. 01 in Appendix III attached to this Circular.
2. The badge for the staff of the Military Vehicle Inspection Team as specified in Form No. 02 in Appendix III attached to this Circular.

1. Direct the Training Department:
a) To direct, guide, and inspect agencies and units throughout the army to strictly maintain the operation of the military control force within the Ministry of National Defense: Inspecting military vehicles and their drivers participating in road traffic according to the Regulations on Managing the People's Army of Vietnam;

RESPONSIBILITIES OF THE AGENCIES AND UNITS
b) Regularly coordinate with the Motor Transport Department under the Logistics and Technical General Department to build plans and organize inspections of military personnel's etiquette, conduct, and compliance with laws and military discipline when performing military vehicle inspection tasks as stipulated in this Circular.
2. Direct the Force Department: Take the lead and coordinate with relevant agencies and units to inspect, review, and report to the General Staff Department to decide on ensuring dedicated vehicles for military vehicle inspections for agencies and units with such forces throughout the army.
Article 20. Logistics and Technical General Department
1. Assist the Minister of National Defense in implementing and managing military vehicle inspections within the scope of the Ministry of National Defense as stipulated in this Circular.
2. Direct the Motor Transport Department:
a) To direct, guide, and inspect agencies and units, and Military Vehicle Inspection Teams throughout the army to strictly maintain military vehicle inspections as stipulated in this Circular;
b) To develop content, programs, and organize training sessions on military vehicle inspection procedures for relevant personnel as prescribed;
c) To develop software applications for information technology in directing, managing, and supervising military vehicle inspection work; guide and direct agencies and units, and Military Vehicle Inspection Teams throughout the army to operate and use them;
d) To regularly, periodically, and randomly supervise the activities of military vehicle inspections by agencies and units, and Military Vehicle Inspection Teams; during supervision, if violations are discovered, depending on the severity of the violation, proceed to issue a suspension order and cooperate with competent authorities to handle according to the law and military discipline;
đ) To organize the issuance, replacement, recovery, and cancellation of Military Vehicle Inspection Authorization Letters and Military Vehicle Inspection Team Leader Certificates for officers and forces performing military vehicle inspection duties throughout the army as stipulated in Articles 4, 5 of this Circular.
e) To ensure adequate equipment, tools, badges, and forms for the military vehicle inspection force as stipulated in points b, c, d, đ, e, g of Clause 1, Clause 2 of Article 16; Article 18 of this Circular.
d) Regularly, periodically, and at random inspect and supervise the inspection activities of military vehicles by relevant agencies, units, and Military Vehicle Inspection Teams; during the inspection and supervision process, if violations are discovered, depending on the severity of the violation, issue a record to suspend operations and cooperate with competent authorities to handle according to the provisions of the law and military discipline;
đ) Organize the issuance, replacement, recovery, and cancellation of Military Vehicle Inspection Authorization Certificates and Military Vehicle Inspection Team Leader Certificates for officers and forces responsible for inspecting military vehicles throughout the military as stipulated in Articles 4 and 5 of this Circular;
e) Ensure that inspection forces for military vehicles have adequate equipment, tools, insignia, and forms as prescribed in Points b, c, d, đ, e, g of Clause 1 and Clause 2 of Article 16; Article 18 of this Circular;
Article 21. Agencies and units
1. Instruct military vehicle drivers within agencies and units under their authority:
a) Strictly comply with legal regulations and regulations of the Ministry of National Defense when operating vehicles on public roads;
b) Comply with traffic order and safety inspections conducted by traffic police forces and requests for courtesy and military conduct checks, as well as compliance with legal and Ministry of National Defense regulations during road traffic participation, as stipulated in this Circular.
2. Direct the Motor Vehicle - Transport Office under the Logistics and Engineering Department to establish files and prepare documents requesting the Motor Vehicle - Transport Bureau/Logistics and Engineering General Department to issue, renew, and revoke Military Vehicle Inspection Authorization Certificates and Military Vehicle Inspection Team Leader Certificates according to Articles 4 and 5 of this Circular.
Article 22. Military Vehicle Inspection Teams
1. Be subject to guidance, inspection, supervision, and control over military vehicle inspection activities by the Motor Vehicle - Transport Bureau/Logistics and Engineering General Department;
2. Inspect courtesy, military conduct, and compliance with legal and military discipline regulations of the Training Department/General Staff Headquarters and superior Motor Vehicle - Transport Offices according to this Circular;
3. Organize the implementation of military vehicle inspections; compile and report inspection results and violations to the agency or unit commanders and the Motor Vehicle - Transport Office according to Clauses 1 and 2 of Article 15 of this Circular.
Article 23. Agencies and units with Military Vehicle Inspection Teams
1. Coordinate with functional offices of the Motor Vehicle - Transport Bureau/Logistics and Engineering General Department to direct, guide, inspect, and supervise Military Vehicle Inspection Teams under their authority to strictly maintain military vehicle inspection activities as stipulated in this Circular;
2. Strictly implement reporting systems for military vehicle inspection results according to Clauses 3 and 4 of Article 15 of this Circular.
Chapter IV
IMPLEMENTING PROVISIONS
Article 24. Effective Date
1. This Circular takes effect from January 1, 2025.
2. Decision No. 326/QĐ-TM dated June 24, 1996 of the Deputy Chief of General Staff promulgating regulations on Military Vehicle Safety Inspection ceases to be effective from the date this Circular takes effect.
3. In cases where referenced documents in this Circular are amended, supplemented, or replaced, they shall be applied according to the amended, supplemented, or replacement documents.
Article 25. Responsibilities for Implementation
The Deputy Chief of General Staff, Director of the Logistics and Engineering General Department, Heads of agencies, units, and military enterprises; related organizations and individuals are responsible for implementing this Circular./.
