THE MINISTER OF FINANCE
Pursuant to Decree No. 118/2008/NĐ-CP dated November 27, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Pursuant to Decision No. 09/2007/QD-TTg dated January 19, 2007 of the Prime Minister on the reorganization and handling of houses and land owned by the State;
Pursuant to Decision No. 140/2008/QD-TTg dated October 21, 2008 of the Prime Minister amending and supplementing some articles of Decision No. 09/2007/QD-TTg dated January 19, 2007;
Pursuant to Decree No. 52/2009/ND-CP dated June 3, 2009 of the Government detailing and guiding the implementation of certain provisions of the Law on Management and Use of State Assets;
Pursuant to the opinion of the Vietnam Social Security at Circular No. 4882/BHXH-BC dated November 9, 2010 regarding the proposal to approve the plan for reorganizing and handling some facilities and land of the Vietnam Social Security in Hanoi according to Decision No. 09/2007/QD-TTg dated January 19, 2007 of the Prime Minister;
Pursuant to the opinion of the People's Committee of Hanoi at Circular No. 1599/UBND-KT dated March 10, 2011 regarding the plan for reorganizing and handling houses and land owned by the State of the Vietnam Social Security according to Decision No. 09/2007/QD-TTg dated January 19, 2007 of the Prime Minister;
At the proposal of the Director of the State Asset Management Agency,
DECISION:
Article 1. The sale of assets on land and the transfer of land use rights shall be conducted through public auction for the facility and land managed by the Vietnam Social Security located at No. 106 To Hien Thanh Street, Hai Ba Trung District, Hanoi with a total area: 981.7 m²; usable floor area: 829.74 m²2;2.
Article 2. The public auction of assets on land and the transfer of land use rights for the facility and land specified in Article 1 of this Decision shall be carried out in accordance with current regulations. The price of the sale of assets on land and the transfer of land use rights shall be approved by the Chairman of the People's Committee of Hanoi in accordance with the law.
Article 3. The proceeds from the sale of the facility and land specified in Article 1 of this Decision shall be used in accordance with Clause 5, Article 1 of Decision No. 140/2008/QD-TTg dated October 21, 2008 amending and supplementing some articles of Decision No. 09/2007/QD-TTg dated January 19, 2007 of the Prime Minister.
Article 4. This Decision takes effect from the date of issuance. The Director of the Ministry's Office, the Director of the State Asset Management Agency, and the heads of units related to the Vietnam Social Security and the People's Committee of Hanoi are responsible for implementing this Decision.
If the unit has not sold within 12 months from the date this Decision takes effect, this Decision will cease to be enforceable.
