Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the Salary System for Civil Servants, Public Officials, and Military Personnel;

Considering the proposal of the Minister of National Defense.

Article 1. Prescribing the special allowance system for certain judicial positions and inspection posts currently working at judicial organs and inspection organs in the military as follows:

1Allowance rate:

a) Rate of 15%: applicable to Chief Judges, Deputy Chief Judges, Judges of Military Courts at all levels; Prosecutors General, Deputy Prosecutors General, Prosecutors of Military Procuratorates at all levels; Chief Inspectors, Deputy Chief Inspectors, Inspectors of Defense Inspection; Heads, Deputy Heads, Investigators of the Investigation Department of the Central Military Procuracy; Heads, Deputy Heads, Investigators of criminal investigation departments and security investigation departments at all levels; Enforcement Officers of Military Regions and Naval Forces.

b) Rate of 10%: applicable to Reviewers of Military Procuratorates at all levels; Assistant Criminal Enforcement Officers, Court Reviewers, and Court Secretaries of Military Courts at all levels; Civil Enforcement Reviewers of the Civil Enforcement Bureau of the Ministry of National Defense.

2. The special allowance prescribed in Clause 1 of this Article shall be calculated based on the current rank salary, grade level salary, leadership position allowance, and seniority allowance exceeding the ceiling (if any).

Article 2. The source of funds for paying the special allowance prescribed in Article 1 of this Decision shall be allocated from the annual state budget of the Ministry of National Defense according to the provisions of the State Budget Law.

Article 3. This Decision shall take effect fifteen days from the date of publication in the Official Gazette.

Abolish the provision on the allowance for Judges, Investigators, Prosecutors, and Court Secretaries working at judicial organs under the Ministry of National Defense prescribed in Article 1 of Decision No. 06/2001/QĐ-TTg dated January 10, 2001 of the Government Chairman regarding the allowance for certain judicial positions.

Article 4.

1. The Ministry of National Defense shall take the lead and coordinate with the Ministry of Home Affairs and the Ministry of Finance to guide the implementation of this Decision.

2. Ministers, Heads of ministerial-level agencies, and Heads of government agencies are responsible for implementing this Decision./.
