THE MINISTER OF EDUCATION AND TRAINING

Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 85/2003/NĐ-CP dated July 18, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

Pursuant to Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain provisions of the Education Law;

Pursuant to Directive No. 23/2006/CT-TTg dated July 12, 2006 of the Government Chairman on strengthening school health work;

Considering the proposal of the Director of the Student and Youth Affairs Department,

DECISION:

Article 1. The attached Decision promulgates regulations on health activities in primary schools, junior high schools, senior high schools, and general education schools with multiple levels.

Article 2. This Decision takes effect fifteen days from the date of publication in the Official Gazette. All previous regulations that conflict with this Decision are hereby abolished.

Article 3. The Head of the Office, Directors of the Student and Youth Affairs Department, Heads of relevant units under the Ministry of Education and Training; Chairpersons of People's Committees of provinces and centrally governed cities, Directors of Departments of Education and Training are responsible for implementing this Decision.

REGULATIONS

on health activities in primary schools, junior high schools, senior high schools, and general education schools with multiple levels

Chapter 1

GENERAL PROVISIONS

Article 1. Scope of application

This document regulates health activities in primary schools, junior high schools, senior high schools, and general education schools with multiple levels, including purposes, contents of activities, and conditions for ensuring these activities.

Article 2. Applicability

These regulations apply to primary schools, junior high schools, senior high schools, and general education schools with multiple levels (hereinafter referred to collectively as general education schools).

Chapter 2

OBJECTIVES AND CONTENT OF ACTIVITIES

Article 3. Purpose

Health activities in general schools aim to protect, educate, and care for the health of students, teachers, staff, and school employees.

Article 4. Content of activities

1. Management and health care within the school, specifically:

a. Organizing regular health check-ups and categorizing student health at least once a year at the beginning of the academic year;

b. Managing and keeping health monitoring records of students;

c. Purchasing, storing, and distributing medicine according to regulations;

d. Providing first aid and initial emergency care; providing initial health care according to the Ministry of Health's regulations; transferring patients to healthcare facilities when necessary.

2. Promoting, educating, and advising on health-related issues for students, teachers, staff, and parents of students. Encouraging students to participate in voluntary health insurance.

3. Implementing school hygiene, environmental sanitation, preventing school epidemics, diseases, and disabilities, ensuring food safety, preventing accidents and injuries, preventing HIV/AIDS, social diseases, and other school health activities.

4. Cooperating with healthcare facilities, related units in the locality, and organizations and groups within the school to implement school health activities and other health activities, creating a healthy and safe school environment.

5. Implementing professional guidance from local health authorities.

6. Summarizing, concluding, and reporting on the results of school health work as prescribed.

Chapter 3

CONDITIONS FOR ENSURING 

Article 5. Organization and personnel

1. The number of personnel engaged in school health work according to the current state staffing regulations.

2. The qualifications of personnel engaged in school health work must be at least a secondary level in medical studies. Personnel involved in school health work can participate in seminars, training courses, and specialized training sessions organized by the education sector, the health sector, and other local departments. For personnel concurrently engaged in school health work, they must receive specialized training in school health work.

3. Personnel engaged in school health work belong to the Office Department's staffing as stipulated in the Elementary School Charter and the Middle and High School Charter issued by the Minister of Education and Training; they enjoy salaries, benefits, and preferential allowances as prescribed by the State.

Article 6. Workroom

Each general school should arrange one workroom (school health room) that meets the following requirements:

- Sanitation;

- Area of at least 12 square meters;² /second or more;

- Convenience for initial first aid, emergency care, initial health care, and patient transportation.

Article 7. Equipment and Medicines

1. The school health room should have a medicine cabinet ensuring essential medicines as prescribed by the Ministry of Health; there should be a record book for managing, checking, and reconciling medicine intake and outtake as prescribed.

2. It should be equipped with all essential medical equipment as prescribed by the Ministry of Health; there should be at least one examination bed for patient observation.

3. There should be desks, chairs, cabinets, and other common office equipment.

Article 8. Funding

1. Funding for school health work comes from:

a. The state budget allocated annually for educational and training services of educational institutions according to current budget levels;

b. Funds remaining from the voluntary health insurance examination and treatment fund for students;

c. Donations and support from domestic and foreign organizations and individuals as prescribed by law;

d. Other legitimate sources (if any).

2. Funding for school health work must be managed and used for their intended purposes according to current regulations.

3. Budget preparation, execution, and settlement for funding school health work must be carried out according to current regulations.

Chapter 4

IMPLEMENTATION 

Article 9. Responsibilities of the People's Committee of provinces and centrally governed cities

1. Directing the implementation of school health work.

2. Establishing a multi-sectoral steering committee for school health work headed by the provincial or centrally-administered city People's Committee leader, with members representing the education sector, the health sector, and other relevant departments and organizations.

3. Increasing investment in human resources, funding, infrastructure, and equipment for school health work.

4. Organizing inspections and audits of the implementation of this Regulation.

Article 10. Responsibilities of the Department of Education and Training

1. Coordinating with local healthcare facilities and related units in directing and organizing the implementation of school health activities within their jurisdiction.

2. Directly directing, inspecting, supervising, and urging district education and training offices, high schools, and general schools with the highest grade being high school within their jurisdiction to implement this Regulation.

Article 11. Responsibilities of District Departments of Education and Training

1. Coordinating with local healthcare facilities and related units in directing and organizing the implementation of school health activities within their jurisdiction.

2. Directly directing, inspecting, supervising, and urging elementary schools, middle schools, and general schools with the highest grade being middle school within their jurisdiction to implement this Regulation.

Article 12. Responsibilities of the School Principal

Implementing the contents of this Regulation within the scope of the school./.
