The National Assembly enacts the People's Police Law.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Law stipulates principles on organization and operation; functions, tasks, powers and regimes and policies for the People's Police.
Article 2. Applicability
This Law applies to the People's Police, agencies, organizations, Vietnamese citizens and foreign organizations and individuals residing or operating within the territory of the Socialist Republic of Vietnam; in cases where international treaties to which the Socialist Republic of Vietnam is a party provide otherwise, such treaties shall apply.
Article 3. Explanation of Terms
In this Law, the following terms shall be understood as follows:
1. National security protection means preventing, detecting, stopping, and struggling to defeat activities that infringe upon national security.
2. Social order and safety assurance means preventing, detecting, stopping, and struggling against criminal acts and violations of laws concerning social order and safety.
3. Officer, non-commissioned officer in specialized fields is a Vietnamese citizen selected, trained, and engaged in various specialized fields of the People's Police who can be conferred and promoted to ranks of general, senior colonel, major, non-commissioned officer.
4. Officer, non-commissioned officer in technical fields is a Vietnamese citizen with technical qualifications, working in the People's Police who can be conferred and promoted to ranks of senior colonel, major, non-commissioned officer.
5. Non-commissioned officer, conscript soldier is a Vietnamese citizen fulfilling their obligation to participate in the People's Police who can be conferred and promoted to ranks of senior sergeant, corporal, sergeant, private first class, private second class.
6. Police worker is a person recruited to work in the People's Police but not eligible for conferment of officer, non-commissioned officer, or conscript soldier ranks.
Article 4. Position and structure of the People's Police
The People's Police is a people's armed force serving as the backbone in carrying out tasks to protect national security, ensure social order and safety, and combat crime prevention.
The People's Police consists of the People's Security Force, the People's Public Security Force, and Village Police.
Article 5. Principles of organization and operation of the People's Police
1. The People's Police operates under the absolute and direct leadership of the Communist Party of Vietnam in all aspects, the command of the President, the unified management of the State by the Government, and the direct command and management by the Minister of Public Security.
2. The People's Police is organized centrally and uniformly, and according to administrative levels from central to grassroots.
3. Activities of the People's Police must comply with the Constitution and laws; subordinates must obey superiors; rely on the people and be subject to people's supervision; protect the interests of the State, the rights and legitimate interests of organizations and individuals.
Article 6. Traditional Day of the People's Police
August 19th of each year is the traditional day of the People's Police and the "National People's Security Day".
Article 7. Selection of citizens into the People's Police
1. Citizens meeting political criteria, moral qualities, educational qualifications, health standards, having a willingness and aptitude suitable for police work may be selected into the People's Police.
2. The People's Police gives priority to selecting outstanding graduates from academies, universities, colleges, vocational schools, and vocational training institutions who meet the criteria for training and supplementing the People's Police.
Article 8. Obligation to Participate in the People's Police
1. Citizens performing the obligation to participate in the People's Police is to fulfill the obligation to protect the Fatherland within the people's armed forces. Each year, the People's Police recruits citizens of conscription age to serve in the People's Police for a period of three years.
2. The procedures for recruiting citizens to perform the obligation to participate in the People's Police shall be applied similarly to those for citizens performing military service.
Article 9. Service System of Officers, Non-commissioned Officers, and Soldiers of the People's Police and Police Workers
1. Officers of the People's Police serve under a professional system; non-commissioned officers and soldiers of the People's Police serve under either a professional system or an obligation system; police workers serve under a recruitment system.
2. Citizens serving in the People's Police who are discharged from military service or transferred to another profession must fulfill their reserve duty obligations according to the provisions of the law.
Article 10. Building the People's Police
1. The State has policies for training and nurturing officers, non-commissioned officers, and soldiers of the People's Police; building the People's Police as revolutionary, regular, elite, and gradually modern.
2. Agencies, organizations, and citizens have the responsibility to participate in building the People's Police to be clean, strong, and solid.
Article 11. Supervision of the Activities of the People's Police
1. The National Assembly, its agencies, Delegations of National Assembly members, National Assembly deputies, People's Councils, and People's Council deputies within the scope of their duties and powers supervise the activities of the People's Police.
2. The Vietnam Fatherland Front and its member organizations have the responsibility to publicize and encourage all strata of the population to participate in the mass movement to protect national security, cooperate and assist the People's Police in fulfilling their tasks and building the People's Police, and supervise the implementation of laws on the People's Police.
Article 12. Coordination Relationship between the People's Army, Self-Defense Forces, and the People's Police
1. The People's Army and Self-Defense Forces have the responsibility to closely coordinate with the People's Police to protect national security, ensure social order and safety, and build the People's Police.
2. The coordination between the People's Army, Self-Defense Forces, and the People's Police is regulated by the Government.
Article 13. Responsibilities and Policies for Agencies, Organizations, and Individuals Participating, Cooperating, and Assisting the People's Police
1. Agencies, organizations, and individuals operating on the territory of the Socialist Republic of Vietnam and Vietnamese agencies, organizations, and citizens abroad have the responsibility to participate, cooperate, collaborate, and assist the People's Police in performing their functions, tasks, and powers as prescribed by law.
2. The State protects and keeps confidential for agencies, organizations, and individuals participating, cooperating, collaborating, and assisting the People's Police in protecting national security, ensuring social order and safety, and combating crime.
Agencies, organizations, and individuals participating, cooperating, collaborating, and assisting the People's Police in protecting national security, ensuring social order and safety, and combating crime who achieve outstanding results shall be rewarded; if they suffer damage to their reputation, it shall be restored; if they suffer property losses, compensation shall be provided; if they are injured, suffer health damage, or endanger their lives, themselves and their families shall enjoy benefits and policies as prescribed by law.
Chapter II
FUNCTIONS, TASKS AND
POWERS OF THE PEOPLE'S POLICE
Article 14. Functions of the People's Public Security
The People's Public Security has the function of advising the Party and State on national security protection, ensuring social order and safety, combating crime; being responsible before the Government for unified state management over national security, social order and safety; struggling to prevent and combat hostile forces' plots and activities, various types of crimes, and violations of laws concerning national security, social order and safety.
Article 15. Tasks and Authorities of the People's Public Security
1. Collecting information, analyzing, evaluating, forecasting situations, and proposing to the Party and State to issue and implement policies, laws, and strategies for protecting national security, ensuring social order and safety, and combating crime; participating in assessing the impact on national security, social order and safety regarding planning, plans, and development projects; closely combining tasks of protecting national security, ensuring social order and safety, and combating crime with tasks of building and developing the economy, culture, and society; effectively coordinating security activities with defense and foreign affairs activities.
2. Proactively preventing, detecting, blocking, and struggling to defeat plots and activities that infringe upon national security, eliminating threats to national security; protecting the Party, State, and socialist regime, protecting independence, sovereignty, unity, and territorial integrity of the country; protecting political security, security in ideological-cultural, economic, defense, diplomatic, information, social, environmental fields, and other national interests; protecting the great solidarity of the entire people; protecting citizens' lives, health, honor, dignity, property, freedom, and democratic rights; protecting the legitimate rights and interests of agencies, organizations, and individuals.
3. Conducting intelligence operations as prescribed by law.
4. Protecting high-ranking Party and State officials, international guests visiting and working in Vietnam; protecting important events and targets related to politics, economy, diplomacy, science and technology, culture, and society; protecting key facilities related to national security, foreign representative offices, and international organization representatives in Vietnam; protecting individuals holding or closely related to state secrets as prescribed by law.
5. Implementing management over national security protection and state secret protection; taking the lead in implementing management over entry, exit, transit, and residence of foreigners in Vietnam; controlling entry, exit, and transit at border gates as prescribed by the Government; coordinating with Border Guard Forces, relevant sectors, and local authorities in managing and protecting the national border, maintaining security, order, and social safety in border areas as prescribed by law.
6. Implementing management over criminal investigation work and crime prevention; taking the lead in implementing anti-terrorism, riot prevention, and resolving complex situations involving national security, social order, and safety as prescribed by law; proactively preventing, detecting, blocking, and struggling against crimes and violations of laws concerning social order and safety, environmental protection; receiving and handling reports and accusations about crimes, initiating prosecution; investigating crimes according to the law; conducting criminal statistics work; discovering causes and conditions leading to crimes and violations of laws concerning social order and safety, environmental protection, and recommending measures to address them; educating law violators in the community as prescribed by law.
7. Implementing management over criminal enforcement; managing detention centers, compulsory education facilities, juvenile rehabilitation schools, temporary detention centers, and holding houses; organizing the execution of criminal judgments and decisions, judicial measures, and supporting judicial activities as prescribed by law.
8. Implementing management over administrative penalties in the field of national security, social order, and safety; imposing administrative penalties and applying administrative measures as prescribed by law; ensuring security and order during the implementation of forced execution orders when requested by competent authorities.
9. Implementing management over residence, national population database, citizen identity cards, seals, traffic order and safety, public order, weapons, explosives, support tools, fire prevention, and rescue operations as prescribed by law; issuing citizen identity cards; registering and issuing license plates for motor vehicles; conducting fire prevention, firefighting, and rescue operations; managing security and order in regulated industries and security services as prescribed by law.
10. Taking the lead and coordinating in managing and implementing propaganda and education work on national security protection, ensuring social order and safety, and combating crime; guiding, inspecting, auditing, and resolving complaints and accusations in national security protection, ensuring social order and safety, and combating crime activities.
11. Being the core force in building the people's security posture, promoting the whole people's movement to protect national security; guiding agencies and organizations in internal political security protection, economic, financial, monetary, investment security, ideological-cultural security, information security, social security, and environmental security.
12. Guiding and training professional skills and legal knowledge for neighborhood watch forces, enterprises, and agency security personnel as prescribed by law.
13. Applying mass mobilization methods, law, diplomacy, economics, science and technology, professional skills, and armed forces to protect national security and ensure social order and safety as prescribed by law.
14. Being authorized to use weapons, explosives, and support tools to attack, pursue criminals, stop persons committing criminal acts or other illegal acts, and for lawful self-defense as prescribed by law.
15. Decision to temporarily suspend or suspend the activities of agencies, organizations, or individuals whose actions cause or threaten to cause harm to national security, public order, and social safety; request agencies, organizations, or individuals to provide information, documents, and items when there is evidence indicating their involvement in activities that infringe upon national security, public order, and social safety as prescribed by law. Mobilize and requisition communication means, transportation means, other means, and the persons using or controlling such means under urgent circumstances to protect national security, public order, and social safety or to prevent ongoing or potential social damage.
16. Implement measures to protect national security and ensure public order and social safety during wartime, emergency situations, or when there is a threat to national security, public order, and social safety but not yet at the level requiring the declaration of an emergency situation as prescribed by law.
17. Study, apply, and mobilize scientific and technological achievements in protecting national security, ensuring public order and social safety, and building the People's Public Security force.
18. Build a revolutionary, regular, efficient People's Public Security force, gradually modernized, serving as the core in carrying out tasks to protect national security, ensure public order and social safety, and combat crime.
19. Implement international cooperation in combating crime, protecting national security, ensuring public order and social safety, and building the People's Public Security force; act as the lead agency for extradition, transfer of prisoners serving sentences, and mutual legal assistance in criminal matters as prescribed by law and international treaties to which the Socialist Republic of Vietnam is a party.
20. Carry out other tasks and powers as prescribed by law.
Chapter III
ORGANIZATION OF THE PEOPLE'S PUBLIC SECURITY FORCE
Article 16. The organizational system of the People's Public Security Force
1. The organizational system of the People's Public Security Force includes:
a) Ministry of Public Security;
b) Provincial and centrally-administered city police;
c) District and town police;
d) Commune, ward, and town police.
2. Based on the requirements for fire prevention, firefighting, and rescue operations, the Government shall stipulate the establishment of provincial and centrally-administered city Fire Prevention and Firefighting Police.
3. Commune police is the backbone of the nationwide movement to protect national security, ensuring security, public order, and social safety at the grassroots level. The functions, duties, powers, organization, operation, and regulations and policies for commune police are prescribed by law.
4. Based on the requirements to ensure security and public order within their scope of duties and powers, the Minister of Public Security decides to establish police stations, posts, and independent units in necessary areas; stipulates the assignment of officers and non-commissioned officers of the People's Public Security Force to commune police positions.
Article 17. Authority to specify the functions, duties, powers, and organizational structure within the People's Public Security Force
1. The Government specifies the functions, duties, powers, and organizational structure of the Ministry of Public Security.
2. The Minister of Public Security specifies the functions, duties, powers, organizational structure, and machine of general bureaus, commands, subordinate units of the Ministry, units under general bureaus and commands, provincial and centrally-administered city police, district and town police, and remaining units within the People's Public Security Force.
Article 18. Command in the People's Public Security Force
1. The Minister of Public Security is the highest commander in the People's Public Security Force.
2. A lower-level public security commander is responsible to a higher-level public security commander for the organization and operation of the assigned public security unit. A local public security commander is responsible to a higher-level public security commander and to the same-level Party Committee and administration.
3. An officer, non-commissioned officer, or soldier with a higher rank or grade than another officer, non-commissioned officer, or soldier is their superior. An officer, non-commissioned officer, or soldier with a higher position but equal or lower rank is the superior of an officer, non-commissioned officer, or soldier with an equal or higher rank but a lower position.
Chapter IV
OFFICERS, NON-COMMISSIONED OFFICERS, AND SOLDIERS OF THE PEOPLE'S PUBLIC SECURITY FORCE
Article 19. Classification of officers, non-commissioned officers, and soldiers of the People's Public Security Force
1. By force, in the People's Public Security Force there are:
a) Officers, non-commissioned officers, and soldiers of the People's Security Force;
b) Officers, non-commissioned officers, and soldiers of the People's Police Force.
2. By nature of activity, in the People's Public Security Force there are:
a) Operational officers;
b) Technical officers;
c) Conscript non-commissioned officers and soldiers.
Article 20. System of ranks for officers, non-commissioned officers, and soldiers of the People's Public Security Force
1. Operational officers:
a) General officers have four grades:
Grand General;
Senior General;
Major General;
Lieutenant General;
b) Colonel-grade officers have four grades:
Senior Colonel;
Colonel;
Lieutenant Colonel;
Major;
c) Captain-grade officers have four grades:
Senior Captain;
Captain;
Lieutenant Captain;
Second Lieutenant;
d) Non-commissioned officers have three grades:
Senior Sergeant;
Sergeant;
Corporal.
2. Technical officers:
a) Colonel-grade officers have three grades:
Colonel;
Lieutenant Colonel;
Major;
b) Captain-grade officers have four grades:
Senior Captain;
Captain;
Lieutenant Captain;
Second Lieutenant;
c) Non-commissioned officers have three grades:
Senior Sergeant;
Sergeant;
Corporal.
3. Conscript non-commissioned officers and soldiers:
a) Non-commissioned officers have three grades:
Senior Sergeant;
Sergeant;
Corporal;
b) Soldiers have two grades:
Private First Class;
Private Second Class.
Article 21. Subjects, conditions, and time limits for granting and promoting ranks for officers, non-commissioned officers, and soldiers of the People's Public Security Force
1. Subjects for granting ranks:
a) Students receiving living expenses at public security schools, upon graduation, will be granted ranks as follows:
College: Sergeant;
University: Senior Sergeant;
Bachelor's degree: Second Lieutenant;
Outstanding graduates may be granted a higher rank;
b) Cadres, civil servants, or individuals graduating from academies, universities, colleges, or vocational schools who are selected to join the People's Public Security Force shall be granted ranks based on their level of education, work experience, assigned tasks, and salary grade;
c) Conscript soldiers will be granted the initial rank of Private Second Class.
2. Conditions for promotion in rank:
Officers, non-commissioned officers, and soldiers of the People's Public Security Force can be promoted in rank when they meet the following conditions:
a) Fulfilling duties, meeting political standards, moral qualities, professional qualifications, and health requirements;
b) When their current rank is lower than the highest rank prescribed for their position or title;
c) Meeting the time limit for promotion in rank as stipulated in Clause 3 of this Article.
3. Time limits for promotion in rank:
a) Non-commissioned officers and operational officers:
Corporal to Sergeant: 1 year;
Sergeant to Senior Sergeant: 1 year;
Senior Sergeant to Second Lieutenant: 2 years;
Second Lieutenant to Lieutenant Captain: 2 years;
Lieutenant Captain to Captain: 3 years;
Captain to Senior Captain: 3 years;
Senior Captain to Major: 4 years;
Major to Lieutenant Colonel: 4 years;
Lieutenant Colonel to Colonel: 4 years;
Colonel to Senior Colonel: 4 years;
Senior Colonel to Senior Colonel: 4 years;
The minimum time limit for promotion in each general rank is 4 years;
b) Time limits for promotion in rank for technical officers, non-commissioned officers, and conscript soldiers are specified by the Government;
c) The time spent by officers, non-commissioned officers, and soldiers studying at school counts towards the time limit for promotion in rank; for officers, non-commissioned officers, and soldiers demoted in rank, if they show progress within one year from the date of demotion, they may be considered for promotion in rank.
4. The age of officers eligible for promotion from Senior Colonel to Lieutenant General does not exceed 57 years old; in exceptional cases, it may be higher as decided by the President.
Article 22. Granting and advancing ranks ahead of schedule and skipping ranks
1. Officers, non-commissioned officers, and soldiers of the People's Public Security who have achieved outstanding results in national security protection, social order and safety assurance, crime prevention and suppression, scientific research, and study, and whose current rank is lower than the highest rank prescribed for their position or title, shall be considered for granting and advancing ranks ahead of schedule.
2. Officers, non-commissioned officers, and soldiers of the People's Public Security who have achieved outstanding results in national security protection, social order and safety assurance, and crime prevention and suppression, and whose current rank is two or more ranks lower than the highest rank prescribed for their position or title, may be considered for granting and advancing ranks skipping ranks, but not exceeding the highest rank prescribed for their position or title.
3. The President decides on granting and advancing ranks ahead of schedule and skipping ranks for general ranks. The Minister of Public Security decides on granting and advancing ranks ahead of schedule and skipping ranks from Colonel downwards.
Article 23. Positions of officers of the People's Public Security
1. Basic positions of military officers include:
a) The Minister of Public Security;
b) Director-General, Commander;
c) Bureau Chief;
d) Provincial Public Security Director, Director of Public Security in centrally governed cities;
đ) Department Head; Public Security Chief of district, town, city under province; Brigade Commander;
e) Team Leader; Public Security Chief of ward, town; Battalion Commander;
g) Company Commander;
h) Platoon Commander;
i) Squad Leader.
2. Positions and titles equivalent to those specified in point b, Clause 1 of this Article shall be prescribed by the Government; positions and titles equivalent to those specified in points c, d, đ, e, g, h, and i, Clause 1 of this Article shall be prescribed by the Minister of Public Security.
Article 24. Highest rank for positions of officers of the People's Public Security
1. The highest rank for positions of officers is prescribed as follows:
a) General: Minister of Public Security;
b) Senior Lieutenant General: Deputy Minister of Public Security;
The number of Deputy Ministers of Public Security with the rank of Senior Lieutenant General shall not exceed six;
c) Major General:
Director-General; Commander, Political Commissar of the Mobile Police Corps Command; Commander of the Security Guard Corps Command;
Director of the Ministry of Public Security Office; Director of the Ministry of Public Security Inspectorate; Director of the Institute of Strategy and Public Security Science;
Chiefs of bureaus: Cybersecurity; Traffic Police; Fire Prevention, Firefighting and Rescue; Foreign Affairs; Legal Reform and Administrative Justice; Popular Movement Building for National Security; Directors of academies: People's Public Security Academy, People's Police Academy, Public Security Political Academy;
One Deputy Director-General who is Secretary or Deputy Secretary of the Party Committee of the General Department;
Director of Public Security of Hanoi City; Director of Public Security of Ho Chi Minh City;
d) Lieutenant General:
Assistant Minister of Public Security;

Chiefs of bureaus related to staff work, political work, and business operations under the General Department of Security, except for the Chief of the Logistics Bureau, the Director of the Permanent Office of the Steering Committee on Human Rights, and the Director of the Inspectorate of the General Department;
Chiefs of bureaus related to staff work, political work, and business operations under the General Department of Intelligence, except for the Chief of the Logistics Bureau;

Director of Fire Prevention and Firefighting in Hanoi City; Director of Fire Prevention and Firefighting in Ho Chi Minh City;
Deputy positions of chiefs prescribed in point c of this clause shall have the highest rank of Lieutenant General, with the following numbers: of Director-General not exceeding five; of Commander of the Mobile Police Corps not exceeding four; of Political Commissar of the Mobile Police Corps being one; of Commander of the Security Guard Corps not exceeding four; of Director of the Ministry of Public Security Office not exceeding three; of Director of the Ministry of Public Security Inspectorate not exceeding three; of Director of the Institute of Strategy and Public Security Science not exceeding three; of Chiefs of the Cybersecurity Bureau, Traffic Police Bureau, Fire Prevention, Firefighting and Rescue Bureau, Foreign Affairs Bureau, Legal Reform and Administrative Justice Bureau, Popular Movement Building for National Security Bureau not exceeding two; of Director of the Public Security Academy not exceeding three; of Director of the People's Police Academy not exceeding three; of Director of the Public Security Political Academy not exceeding three; of Director of Public Security of Hanoi City not exceeding three; of Director of Public Security of Ho Chi Minh City not exceeding three;
đ) Colonel:
Bureau Chief, Equivalent Unit Head under General Departments, Corps Commands; Principals of university-level schools, officer training schools, except as provided in point d of this clause;
The Director of the Provincial Police, excluding the Directors of the Police of Hanoi City and Ho Chi Minh City;
The deputy position of the head specified in point d of this clause;
e) Senior Lieutenant Colonel: Head of Department; Head of Police of district, town, city under province; Regiment Commander;
g) Lieutenant Colonel: Team Leader; Head of Police of ward, town; Battalion Commander; Head of Police Station;
h) Major: Company Commander; Head of Police Station;
i) Captain: Platoon Leader;
k) Senior Warrant Officer: Squad Leader.
2. The Deputy Permanent Chairman and the Deputy Specialized Chairman of the Central Party Committee for Public Security Inspection Commission shall implement the rank of general according to the regulations of the competent authority.
3. A People's Public Security officer on secondment who is a permanent member of the National Defense and Security Committee of the National Assembly or appointed to the position of General Director or equivalent shall have the highest rank of Lieutenant General; a People's Public Security officer on secondment who is a Deputy Chairman of the National Defense and Security Committee of the National Assembly or appointed to the position of Deputy Minister or equivalent shall have the highest rank of Major General; a People's Public Security officer on secondment with a higher position shall be conferred and promoted to the rank of general according to the regulations of the competent authority.
4. The highest rank of general shall be decided by the Standing Committee of the National Assembly for the position of officers in newly established units.
The highest rank for the remaining officers is colonel, captain, and non-commissioned officer, warrant officer, and soldier shall be regulated by the Minister of Public Security.
Article 25. Authority to confer, promote, demote, strip ranks of officers, non-commissioned officers, and soldiers; appoint, relieve, remove, demote positions in the People's Public Security
1. The President confers and promotes the rank of general for People's Public Security officers.
2. The Prime Minister appoints positions of Deputy Minister, General Director, Commander, Political Commissar of the Command in the People's Public Security.
3. The Minister of Public Security confers and promotes the rank of colonel; appoints positions of Deputy General Director, Deputy Commander, Deputy Political Commissar of the Command, Director, Deputy Director of the Ministry, Director, Deputy Director of Fire Prevention and Fighting Department of the Province, City under central jurisdiction; regulates the procedures for conferring and promoting ranks, appointing positions and titles remaining in the People's Public Security.
4. The person authorized to confer and promote a certain rank has the authority to strip and demote that rank; each time only one rank can be promoted or demoted, except in special cases where multiple ranks may be considered for promotion or demotion. The person authorized to appoint a certain position has the authority to relieve, remove, and demote that position.
Article 26. Procedures for conferring and promoting ranks in the People's Public Security
1. The Prime Minister submits to the President for conferring, promoting, demoting, and stripping the rank of general.
The procedure for conferring, promoting, demoting, and stripping the rank of general for People's Public Security officers on secondment is based on the proposal of the agency or organization where they are seconded and the Minister of Public Security.
2. The procedures for conferring, promoting, demoting, and stripping the rank of colonel, captain, and non-commissioned officer, warrant officer, and soldier are regulated by the Minister of Public Security.
Article 27. Transfer of officers, non-commissioned officers, and soldiers of the People's Public Security
1. The person authorized to appoint to a position shall have the authority to transfer the person holding that position.
2. Officers, non-commissioned officers, and soldiers of the People's Public Security must comply with the transfer orders from the competent authority.
Article 28. Detachment of officers of the People's Public Security
1. Based on the requirements for national security protection, social order and safety assurance, crime prevention and suppression, the competent authority decides to detach officers to work at agencies and organizations outside the People's Public Security in accordance with the provisions of the law.
2. Detached officers enjoy the same treatment and policies as officers working within the People's Public Security. Promotion, demotion, and reduction of rank for detached officers are carried out as for officers working within the People's Public Security, except for the provisions of Clause 3, Article 24 and Clause 1, Article 26 of this Law.
3. Agencies and organizations where detached officers are assigned to work are responsible for assigning tasks, maintaining confidentiality, and ensuring working and living conditions for detached officers in accordance with the provisions of the law.
Article 29. Age limit for service of officers of the People's Public Security
1. The highest age limit for service of officers of the People's Public Security is specified as follows:
a) Commissioned officer: 53;
b) Lieutenant Colonel, Major: male 55, female 53;
c) Senior Colonel: male 58, female 55;
d) Colonel: male 60, female 55;
e) General: male 60, female 55.
2. In cases where public security units have needs, officers specified in points a, b, and c of Clause 1 of this Article who meet the required qualities, are proficient in their specialties, have good health, and voluntarily agree may be allowed to extend their service age according to the regulations of the Minister of Public Security, but not exceeding 60 for males and 55 for females.
3. Officers who are professors, associate professors, doctors, senior experts, and female general officers may be allowed to extend their service age beyond 60 for males and 55 for females according to the regulations of the Government; in special cases, extension may be granted upon request as decided by the President of the State.
4. Officers of the People's Public Security shall retire when they meet the conditions stipulated by law; if they do not meet the retirement conditions stipulated by law and the People's Public Security has no need to arrange positions for them or they cannot change professions, or if the officers voluntarily request retirement, male officers with twenty-five years of service and female officers with twenty years of service in the People's Public Security may retire before the age limit specified in Clause 1 of this Article.
Article 30. Obligations and responsibilities of officers, non-commissioned officers, and soldiers of the People's Public Security
1. Absolute loyalty to the Homeland, the People, the Party, and the State.
2. Strictly abide by the Party's guidelines and policies, the State's policies and laws, the People's Public Security regulations, directives, and orders from superiors.
3. Be honest, brave, vigilant, ready to fight, and complete all assigned tasks.
4. Respect and protect the legitimate rights and interests of agencies, organizations, and individuals; closely connect with the People; serve the People wholeheartedly, and show respect and politeness towards the People.
5. Continuously study to improve political, legal, scientific and technical, professional, and vocational knowledge; cultivate revolutionary qualities, organizational discipline awareness, and physical fitness.
6. Bear responsibility under the law and to superiors for their own orders, for compliance with superiors' orders, and for the performance of subordinates' duties under their jurisdiction. When receiving an order from a commander, if there is evidence that the order is contrary to the law, they must immediately report it to the person issuing the order; in cases where they still have to comply with the order, they must promptly report to the direct superior of the person issuing the order and will not be held responsible for the consequences of implementing the order.
Article 31. Matters that officers, non-commissioned officers, and soldiers of the People's Public Security shall not engage in
1. Exploiting assigned positions and powers to infringe upon the interests of the State, lawful rights and interests of agencies, organizations, and individuals.
2. Acts contrary to the law, regulations of the People's Public Security, and other acts prohibited for civil servants as stipulated by law.
Chapter V
ENSURING OPERATIONS AND REGIME,
POLICIES FOR THE PEOPLE'S PUBLIC SECURITY
Article 32. Ensuring financial resources and material infrastructure for the operations of the People's Public Security
1. The State ensures budgetary conditions and material infrastructure for national security protection, social order and safety assurance, crime prevention and suppression, and the construction of the People's Public Security force including: financial investment, weapons, support tools, equipment, technical devices, technical means, land, headquarters, facilities, industrial bases, and other material technical conditions.
2. In cases where it is necessary for national security protection, social order and safety assurance, and crime prevention and suppression, the State mobilizes scientific and technological achievements to serve the operations of the People's Public Security including: technology transfer, results of scientific research and technological development; ensuring material and technical infrastructure for training, education, and scientific research institutions of the People's Public Security; ensuring information resources, databases, scientific and technological materials; supplementing forces, training, and nurturing scientific and technological human resources to serve national security protection, social order and safety assurance, and crime prevention and suppression.
3. For weapons, support tools, equipment, technical devices, and technical means serving the operations of the People's Public Security which are not produced domestically or cannot meet the needs, the Minister of Public Security shall submit to the Prime Minister for a decision on importation in accordance with the provisions of the law.
Clause 4. The Government shall provide detailed regulations on Clauses 1 and 2 of this Article.
Article 33. Equipping weapons, support tools, and technical means for the People's Public Security
1. The People's Public Security shall be equipped with weapons, explosives, support tools, and technical means suitable for their assigned tasks by the State.
2. The State has a policy of prioritizing the application of modern scientific and technological achievements; investing in researching and producing technical devices, technical means, and support tools to serve work, combat, and the construction of the People's Public Security force.
Article 34. Uniforms, insignia, flags, rank badges, service badges, and identification cards of the People's Public Security
The uniforms, insignia, flags, rank badges, service badges, and identification cards of the People's Public Security shall be prescribed by the Government.
Article 35. Policies for training and nurturing officers, non-commissioned officers, and soldiers of the People's Public Security
1. Officers, non-commissioned officers, and soldiers of the People's Public Security shall be trained and nurtured in politics, law, specialized knowledge, professional skills, and other necessary knowledge suitable for their assigned tasks; encouraged and provided conditions by the State to develop their talents to serve the People's Public Security.
2. The State has a preferential policy for training and nurturing officers, non-commissioned officers, and soldiers of the People's Public Security who are ethnic minorities.
Article 36. Salary, Allowances, Housing, and Working Conditions for Officers, Non-commissioned Officers, and Soldiers of the People's Police
1. The salary and allowances shall be regulated by the Government; the salary of officers and non-commissioned officers serving under the professional system shall be calculated based on their position, title, rank, and in accordance with the nature and tasks of the People's Police; seniority allowances shall be calculated based on the current salary level and the time served in the People's Police; they shall also enjoy subsidies and allowances equivalent to those of civil servants and officials working under similar conditions, as well as special allowances of the People's Police.
2. If an officer of the People's Police holds multiple positions or titles simultaneously, they shall enjoy the benefits of the highest position or title and additional allowances for兼任多个职位或头衔的人民警察军官应享受最高职位或头衔的利益以及法律规定兼任职位或头衔的额外津贴。此处翻译更准确为:If an officer of the People's Police holds multiple positions or titles simultaneously, they shall enjoy the benefits of the highest position or title and additional allowances for concurrently holding positions or titles as prescribed by law.
3. An officer of the People's Police shall retain the benefits of the position or title currently held when assigned a lower position or title due to work requirements or organizational restructuring.
4. When an officer of the People's Police is relieved of their position or title, they shall enjoy the benefits according to the new position or title.
5. Officers, non-commissioned officers, and soldiers of the People's Police shall be provided with barracks and working and living conditions suitable for the nature of their work and assigned tasks.
6. Operational officers and technical officers shall enjoy housing allowances and be provided with official housing; officers, non-commissioned officers, and soldiers of the People's Police shall benefit from social housing support policies as prescribed by law.
Article 37. Health Care for Officers, Non-commissioned Officers, Soldiers, Students, and Pupils of the People's Police and Their Dependents
1. Officers, non-commissioned officers, soldiers, students, and pupils of the People's Police shall be guaranteed health care; when injured, sick, or involved in accidents or occupational risks far from People's Police medical facilities, or suffering from diseases that such facilities cannot treat, they shall be entitled to medical examinations and treatment at other medical facilities, and hospital fees shall be reimbursed and other benefits shall be implemented as prescribed by law.
2. The father, mother, or legal guardian of the husband or wife, spouse, and children under 18 years old of officers, non-commissioned officers, soldiers, students, and pupils of the People's Police who do not have medical insurance shall be covered by the People's Police to purchase medical insurance and shall be entitled to medical examinations and treatment at medical facilities as prescribed by law.
3. The State shall ensure funding to implement the provisions of Clause 1 and Clause 2 of this Article.
Article 38. Rest and Leave System for Officers, Non-commissioned Officers, and Soldiers of the People's Police
Officers, non-commissioned officers, and soldiers of the People's Police currently in service shall take rest and leave as prescribed by the Labor Code and by the Minister of Public Security.
Article 39. Benefits and Policies for Officers, Non-commissioned Officers, and Soldiers of the People's Police Upon Retirement, Transfer, Discharge, Medical Retirement, Martyrdom, or Death
1. Officers of the People's Police upon retirement shall enjoy the following rights:
a) Pension calculated based on the provisions of Clause 1 of Article 36 of this Law and in accordance with the regulations on social insurance;
b) If retiring before the service age specified in Clause 1 and Clause 2 of Article 29 of this Law due to organizational restructuring or lack of need for deployment, in addition to the social insurance benefits prescribed by the law on social insurance, they shall also receive a one-time allowance as prescribed by the Government;
c) Use police uniforms, badges, insignia, and emblems on holidays, meetings, and traditional exchanges of the People's Police;
d) Local authorities where they reside shall provide conditions to stabilize their lives; if they do not have housing, they shall enjoy social housing support policies as prescribed by law;
đ) Enjoy medical insurance benefits as prescribed by law, and be entitled to medical examinations and treatment at People's Police medical facilities according to their rank, position, or title prior to retirement, as prescribed by the Minister of Public Security.
2. Officers and non-commissioned officers of the People's Police upon transfer shall enjoy the following rights:
a) The State shall ensure necessary professional and vocational training for transferred officers and non-commissioned officers as required by organizations;
b) Maintain the salary and seniority allowances at the time of transfer for a minimum period of 18 months;
c) The rights prescribed in point c of Clause 1 of this Article;
d) In cases where they are redeployed to serve in the People's Police due to work requirements, the transfer period shall be counted towards continuous service time for consideration of promotion in rank and seniority;
đ) Upon retirement, they shall enjoy seniority allowances calculated based on the time served in the People's Police and the current salary level; if the current salary level is lower than the salary at the time of transfer, the salary at the time of transfer shall be used to calculate the pension according to the law.
3. Officers and non-commissioned officers upon discharge shall enjoy the following rights:
a) Employment assistance and a one-time allowance as prescribed by the Government;
b) The rights prescribed in points c and d of Clause 1 of this Article;
c) If they have served for fifteen years or more in the People's Police, they shall be entitled to medical examinations and treatment at People's Police medical facilities when ill, as prescribed by the Minister of Public Security.
4. Officers and non-commissioned officers upon medical retirement shall enjoy the following rights:
a) Preferential treatment for persons contributing to the revolution and social insurance benefits as prescribed by law;
b) The rights prescribed in points c and d of Clause 1 of this Article.
5. Officers and non-commissioned officers who have directly participated in combat, served in combat zones, or worked in difficult areas or special professions shall have their time converted to calculate benefits when leaving service in the People's Police.
6. In case of death while on duty, the dependents of the officers, non-commissioned officers, and soldiers shall enjoy benefits as prescribed by law on preferential treatment for persons contributing to the revolution, social insurance benefits as prescribed by the law on social insurance, and a one-time allowance as prescribed by the Government.
7. In the case of officers, non-commissioned officers, and soldiers of the People's Public Security Force who die while on duty, their relatives shall be entitled to social insurance benefits as prescribed by laws on social insurance and shall also be entitled to a one-time allowance as prescribed by the Government.
Article 40. Regulations and policies for students, pupils, police workers, non-commissioned officers, and conscripted soldiers
1. Students and pupils of the People's Public Security Force shall be entitled to living expenses and regulations and policies as prescribed by laws for non-commissioned officers and conscripted soldiers.
2. Police workers shall have rights and obligations as prescribed by labor laws and other relevant laws.
3. Non-commissioned officers, conscripted soldiers, and their relatives shall be entitled to the regulations and policies prescribed for non-commissioned officers and soldiers serving in the armed forces; upon completion of their service period, they shall be entitled to vocational training allowances or job creation allowances and shall be given priority in admission to public security schools, and shall enjoy other benefits and policies as prescribed by the Government.
Chapter VI
REWARD AND VIOLATION HANDLING
Article 41. Awards
1. Officers, non-commissioned officers, soldiers, and police workers of the People's Public Security Force who achieve meritorious deeds in combat or work shall be considered for awards such as medals, orders, state honorary titles, and other forms of recognition as prescribed by law, depending on their achievements.
2. Organizations, individuals participating, cooperating, assisting the People's Public Security Force in national security protection, maintaining public order and safety, and combating crime shall be considered for awards as prescribed by law, depending on their achievements.
Article 42. Handling Violations
1. Officers, non-commissioned officers, soldiers, and police workers of the People's Public Security Force who violate discipline or laws shall be subject to disciplinary action, administrative penalties, or criminal prosecution, depending on the nature and severity of the violation; if they cause harm to the health, life, property, or legitimate interests of others, they must compensate according to the law.
2. Officers, non-commissioned officers, and soldiers of the People's Public Security Force may not use police insignia when they are under investigation, detained, or imprisoned; if they are sentenced to imprisonment, their police insignia will be automatically revoked when the judgment becomes legally binding.
3. Organizations, individuals engaging in acts opposing or obstructing the activities of officers, non-commissioned officers, and soldiers of the People's Public Security Force in performing their duties shall be subject to legal sanctions, depending on the nature and severity of the violation.
Chapter VII
IMPLEMENTING PROVISIONS
Article 43. Effective Date
This Law shall take effect from July 1, 2015.
Provisions regarding promotions, demotions, and revocations of ranks for general officers; appointments, dismissals, removals, and demotions of positions with the highest rank being general officer shall take effect from the date this Law is promulgated.
The Law on the People's Public Security Force No. 54/2005/QH11 dated November 29, 2005, shall cease to be effective from the date this Law takes effect.
Article 44. Transitional Provisions
1. The use of weapons, explosives, and support tools by the People's Public Security Force shall be carried out in accordance with current laws until the law on weapons, explosives, and support tools is issued.
2. Functions, tasks, powers, organization, operation, and regulations and policies for village police shall be implemented in accordance with current laws until the law on village police is issued.
Article 45. Detailed provisions
The Government and competent authorities shall issue detailed regulations for the Articles and Clauses assigned in this Law.
