PART I

GENERAL PROVISIONS

CLASSIFICATION OF RESERVES AND RESOURCES

Article 3. Classification of reserves and resources

Articleon1. Copper mineral resources are divided into two groups:No.1.3.4. Fault

a) Identified resources;

Chapter II

b) Predicted resources.

2. The identified resource group is divided into two types: reserves and resources

a) The reserve type is classified into two levels, including level 121 and level 122;

b) The resource type is classified into three levels, including level 221; level 222 and level 333.

3. The predicted resource group is classified into two levels, including level 334a and level 334b.

4. The classification table of reserves and resources of copper minerals is specified in Appendix 1 attached to this Circular.

Article 4. Requirements for level 121 reserves

1. Geological assessment level

a) Determination of the ore deposit structure; characteristics of shape, size, position, variation patterns of shape and internal structure of the ore body; detailed delineation of boundaries of interbedded rock layers and lenses without ore according to reserve calculation criteria, presence of faults causing ore displacement;

b) Accurate classification of natural and industrial ores with distinct characteristics in terms of mineral composition, structure, architecture, chemical composition, mechanical properties, and technological properties of the ore; boundaries between different types of ores are accurately defined;

c) Ore quality is determined with certainty, clearly identifying the material composition, mechanical properties, and technological properties of the main mineral, which is copper; thoroughly researching the characteristics of accompanying beneficial components' content and form; technological properties of the ore are evaluated to determine a reasonable beneficiation process flow for copper concentrate recovery and assess the recoverability of accompanying minerals such as gold, silver, iron, etc. (if present), ensuring sufficient data to determine the ore processing technology flow;

d) Hydrogeological conditions, engineering geology conditions, mining conditions, and other relevant natural factors are evaluated in detail to provide reliable data for establishing a mine development project;

đ) Reliability of reserves must be at least 80%.

2. Delineation of reserve boundaries

The boundary of level 121 reserves is delineated within the control range of exploration works and mining works (if any). Depending on the complexity of the geological structure, stability of ore thickness and grade, and distance between exploration works, it may vary but must not exceed the maximum value of the grid spacing for level 121 reserves as specified in Appendix 2 attached to this Circular.

3. Level of technical and economic feasibility assessment

a) Reasonable ore processing technologies have been selected based on technological sample research results or investment construction project reports;

b) The determined reserve level is economically viable based on research of investment construction project reports or meets the reserve calculation criteria in the exploration result report.

Article 15. Requirements for level 122 reserves

a) Determination of the ore deposit structure characteristics; characteristics of shape, size, position of the ore body; characteristics of thickness and grade variation of ore bodies, presence of interbedded rock layers without meeting reserve calculation criteria and faults destroying the ore;

b) Assessment of the reliability of natural and industrial ores based on their mineral composition, structure, architecture, chemical composition, mechanical properties, and technological properties;

c) Ore quality is assessed in detail, clearly identifying the material composition, mechanical properties, and technological properties of the main mineral, which is copper; researching and evaluating the characteristics of accompanying beneficial components' content and form; technological properties of the ore are evaluated to determine a reasonable beneficiation process flow for copper concentrate recovery and assess the recoverability of accompanying minerals such as gold, silver, iron, etc. (if present), ensuring sufficient data to determine the ore processing technology flow;

3. Amend Clause 3 Article 2 as follows:a) The specialized department as stipulated in Clause 2, Article 14 of Decree No. 127/2007/NĐ-CP dated August 1, 2007, issued by the Government detailing a number of articles of the Law on Standards and Technical Regulations; d) Basic characteristics of hydrogeological conditions, engineering geology conditions, and technical mining conditions are determined as a basis for establishing a mine development project;

d) Hydrogeological conditions, engineering geology conditions, mining conditions, and other relevant natural factors are evaluated in detail to provide reliable data for establishing a mine development project;

đ) Reliability of reserves must be at least 50%.

2. Delineation of reserve boundaries

a) The boundary of level 122 reserves is delineated within the control range of exploration works and mining works (if any). Depending on the complexity of the ore body's geological structure, stability of ore thickness and grade, and distance between exploration works, it may vary but must not exceed the maximum value of the grid spacing for level 122 reserves as specified in Appendix 2 attached to this Circular;

b) For ore bodies with a non-complex structure, relatively stable thickness and quality, the boundary of level 122 reserves can be extrapolated within limits based on geological and geophysical data, but must not exceed half of the grid spacing specified for this reserve level.

đ) Reliability of the minimum assured reserve of 50%.

2. Boundaries for Reserves Aggregation

a) The boundaries of Class 122 reserves are delineated within the scope controlled by exploration works and exploitation works (if any). Depending on the complexity of the ore body geological structure, the stability of thickness and grade of the ore, the distance between exploration works may vary but must not exceed the maximum value of the grid specified for Class 122 reserves in Appendix 2 attached to this Circular;

b) For ore bodies with a structure that is not overly complex, relatively stable thickness and quality of ore, the boundaries of Class 122 reserves may be extrapolated based on geological and geophysical data, but must not exceed half of the grid specified for this reserve class.

3. The level of assessment for technical feasibility, technology, and economic efficiency shall be carried out in accordance with the provisions of Clause 3, Article 4 of this Circular.

Article 6. Requirements for Resource Class 221

1. The level of geological assessment and delineation of Resource Class 221 shall be conducted in accordance with the provisions of Clause 1 and Clause 2, Article 4 of this Circular.

2. The level of assessment for technical feasibility, technology, and economic efficiency

A suitable method of mining and processing technology has been selected based on the results of technological sample testing reports, but the investment construction project report for the mine determines that the exploitation and processing of minerals from this resource source is not economically viable or does not meet the calculated reserve criteria set forth in the appendix explaining the calculation criteria in the exploration report and/or meets the calculated reserve criteria but falls within a prohibited or temporarily prohibited area for mineral activities.

Article 7. Requirements for Resource Class 222

1. The level of geological assessment and delineation of Resource Class 222 shall be conducted in accordance with the provisions of Clause 1 and Clause 2, Article 5 of this Circular.

2. The level of assessment for technical feasibility, technology, and economic efficiency shall be carried out in accordance with Clause 2, Article 6 of this Circular.

Article 8. Requirements for Resource Class 333

d) Hydrogeological conditions, engineering geology conditions, mining conditions, and other relevant natural factors are evaluated in detail to provide reliable data for establishing a mine development project;

a) General characteristics of the geological structure of the mine, shape, position, distribution of copper ore bodies in the mine have been identified; thickness and grade of the ore bodies have been determined based on engineering data intersecting ore;

b) Copper ore quality is determined based on sampling results from natural exposures, cleaned trenches, shafts, drilling, or extrapolation based on detailed geological assessment data from adjacent areas;

c) Natural factors determining mining conditions are not required to be assessed in detail, mainly understood preliminarily and compared with similar data from adjacent areas that have undergone more detailed assessments.

2. Estimated resource boundary

The estimated resource boundary for Class 333 is determined based on individual exploration works meeting the calculated reserve criteria and permitted limited extrapolation according to the controlling geological structure of the ore and/or extrapolation not exceeding twice the exploration grid of Class 122 reserves. For small scattered ore bodies where reserves cannot be calculated, the resource boundary for Class 333 must have at least two control works.

3. Level of assessment for technical feasibility, technology, and economic efficiency

It has not been determined whether the exploitation and processing of copper ore from this resource source is economically viable or has potential economic viability at the time of evaluation.

Chapter III

CLASSIFICATION OF MINES AND REQUIREMENTS FOR EXPLORATION WORKS

3. Amend Clause 3 Article 2 as follows:a) The specialized department as stipulated in Clause 2, Article 14 of Decree No. 127/2007/NĐ-CP dated August 1, 2007, issued by the Government detailing a number of articles of the Law on Standards and Technical Regulations; 9. Classification of Exploration Mines

1. Basis for classification of exploration mines

a) Based on the shape, size, position of the ore body and the complexity of the geological structure of the mine;

b) Based on quantitative indicators assessing the variability of thickness and grade of the main components of the ore body and the geological conditions for mining;

c) Based on specific arguments and evaluations for the main ore bodies accounting for no less than 70% of the mine's reserves. The classification of exploration mines is proposed in the exploration plan and confirmed in the report on the results of mineral exploration.

2. Classification of exploration mines into groups

a) Simple Mine Group (I);

b) Relatively Complex Mine Group (II);

c) Complex Mine Group (III);

d) Very Complex Mine Group (IV).

3. Conditions for classifying exploration mines

a) Simple Mine Group (I) includes mines or parts of mines with simple geological structures featuring flat or gently inclined bedded ore bodies; simple shapes with perimeter modulus (m) not exceeding 1.4; ore content factor from 0.8 to 1.0; stable thickness variation of the ore body, thickness variation coefficient along the work not exceeding 40%; uniform distribution of copper grade in the ore body for calculated reserves, grade variation coefficient according to single samples not exceeding 40%;

b) Relatively Complex Mine Group (II) includes mines or parts of mines with relatively complex geological structures featuring medium to large-sized ore bodies; ore bodies with relatively simple to complex shapes with perimeter modulus (m) from 1.4 to 1.6; ore content factor from 0.6 to 0.8; unstable thickness variation of the ore body, thickness variation coefficient along the work from over 40% to 100%; non-uniform distribution of copper grade in the ore body for calculated reserves, grade variation coefficient according to single samples from over 40% to 100%;

c) Complex Mine Group (III) includes mines or parts of mines with complex geological structures featuring bedded, lens-shaped, pod-shaped, vein-type ore bodies of small to medium sizes; very complex shapes of ore bodies with perimeter modulus (m) from 1.6 to 1.8; ore content factor from 0.4 to 0.6; highly unstable thickness variation of the ore body, thickness variation coefficient along the work from over 100% to 150%; very non-uniform distribution of copper grade in the ore body for calculated reserves, grade variation coefficient according to single samples from over 100% to 150%;

d) Very Complex Mine Group (IV) includes areas belonging to disseminated or small-scale mineral deposits or parts of mines with extremely complex geological structures featuring small to very small-sized vein, lens, column, pod-type ore bodies; extremely complex shapes of ore bodies with perimeter modulus (m) greater than 1.8; ore content factor less than 0.4; exceptionally unstable thickness variation of the ore body, thickness variation coefficient along the work over 150%; extraordinarily non-uniform distribution of copper grade in the ore body for calculated reserves, grade variation coefficient according to single samples over 150%.

Article 10. General requirements for exploration work

1. Conducted according to the principle from unknown to known, sequential exploration from surface to deeper depths, exploration network from sparse to dense, geological mapping from small scale to large scale maps.

2. Collect all information, data, geological, hydrogeological, engineering geological, environmental geological, and mining conditions for evaluating, preparing investment projects for mineral exploitation, and designing mines.

3. The exploration sequence is established based on compatibility with the complexity of geological structure, reserve scale, and economic value of the mine.

4. Carry out exploration work throughout the entire area and depth where the ore body exists within the boundaries selected in the exploration project.

Article 11. Requirements for topographic basis and geodetic work

1. Exploration areas must conduct topographic mapping at corresponding scales as required by exploration work. Topographic maps must be established according to current regulations on geodetic work in mineral exploration. The scale of topographic maps ranges from 1/5,000 to 1/1,000, depending on geological structure, ore body size, and terrain complexity.

2. All exploration works, mining works (if any), and corner points of the exploration area must determine coordinates and elevations and must relate to the national coordinate network according to current regulations on geodetic and geological work.

Article 12. Requirements for geological mapping

1. Geological mapping during exploration of copper ore deposits is carried out at scales ranging from 1/5,000 to 1/1,000, depending on the size of the ore body and the complexity of the geological structure of the deposit.

2. Geological maps must clearly depict the characteristics of the deposit's geological structure, distribution features of sedimentary, metamorphic, igneous rock formations, folds, destructive tectonic fractures, metamorphic zones, mineralization zones, and copper ore bodies within the exploration area; provide a basis for assessing the distribution characteristics, formation conditions of ores, relationships between ore bodies and surrounding rocks, and major geological structures.

Articleonu 13. Requirements for selection and layout of exploration works

1. Selection of exploration works

a) In the exploration of copper ore deposits, excavation works (trenches, shafts, adits) and drilling can be chosen. Selected exploration works must be suitable for the lying position, depth distribution, geological structure, shape, thickness of each ore body, and the characteristics of overburden;

b) At each work site, detailed samples must be taken to determine the quality, distribution patterns of various types of ore, depth of weathering, structural characteristics of ore body walls and pillars;

c) For deposits with very complex geological structures, to clarify the lying position, shape, and internal structure of the ore body, vertical adits or cross-sectional adits should be used, minimizing the use of drilling works;

d) Drilling works must recover the highest possible core intact. The sampling rate of drill cores must not be less than 70% through rock and 85% when drilling through ore, encouraging the use of a combination of borehole geophysical methods;

đ) For vertical drill holes over 100 meters deep and inclined drill holes, direction and deviation of the drill hole must be checked every 10 to 20 meters;

e) For dipping and vertical ore bodies, inclined or horizontal drilling methods must be applied;

g) Exploration works must cut through the entire thickness of the ore body.

2. Layout of exploration works and selection of exploration network density

a) The layout of exploration works must comprehensively evaluate the characteristics of geological structure, shape, size, lying position, and stability of ore body thickness;

b) The orientation network of exploration works specified in Appendix 2 attached to this Circular;

c) Exploration works, mining works, natural and artificial exposures within the exploration area must be promptly, fully, and accurately described, geologically mapped, and original documentation established according to current regulations on collecting original documentation in mineral exploration and included on the actual documentation map.

1. Exploration works encountering ore must take detailed and systematic samples to assess the quality of copper ore and associated valuable components. The location of samples and their characteristics must be detailed in original documentation. Types and quantities of samples taken must be appropriate for the purpose of exploration and must be reflected in the exploration project.

2. Basic sampling must be conducted at works encountering ore. Depending on changes in the ore body, continuous sampling must be done throughout the entire thickness of the ore body and some samples must be taken from pillar and wall rocks, with intervals equal to the thickness of interbedded rock layers within the ore body. At excavation and exposure sites encountering ore, sampling is done using trench methods, with the cross-section of the trench sample varying within a rectangular area with a width of 5cm to 10cm and a depth of 3cm to 5cm. The length of basic samples is determined by the structure, thickness, quality, and uniformity of the ore body; for thin ore bodies with non-uniform structure and composition, the length of a single sample ranges from 0.4m to 1.0m, up to 2.0m; for thick ore bodies with relatively uniform structure and composition, the length of a single sample ranges from 1m to 2m, up to 3m; at drilling sites, samples are taken using half-core splitting methods, with one half retained in a sample tray.

3. Comprehensive sampling must be conducted for each ore body and type of natural ore by grouping basic samples taken from exploration works distributed evenly across the entire deposit.

4. Technological test samples must be representative of chemical composition, mineralogy, physical-mechanical properties, particle size, and other properties consistent with the average composition of each type of ore and main ore body in the deposit. Sample mass is unified with the testing agency.

5. Large bulk samples are taken with a volume of 3 to 5 samples for each type of natural ore. Along with each large bulk sample, 3 to 4 small bulk samples are simultaneously taken for analysis and comparison. The volume of each large bulk sample varies from 0.5m3 up to 1 meter3Clause 1. The expansion coefficient must be determined simultaneously with large sample bulk weight. For compact ores, the ore bulk weight is mainly determined by small samples and verified by large samples. For loose, fractured, and porous ores, the ore bulk weight is determined by large samples; moisture content of the ore must also be determined alongside its bulk weight.

Article 15. Requirements for Sample Processing

1. All samples must be crushed and ground to particle sizes smaller than 0.1 mm, subsequent processing and reduction shall be carried out according to the processing scheme for each mine.

2. The quality of sample processing must be systematically checked at all stages, compliance with the sample processing scheme must be verified. All basic analytical samples before analysis must be processed to a particle size of 0.074 mm.

Article 16. Requirements for Sample Analysis

1. The results of sample analysis must determine the content and form of existence of the main beneficial component, harmful components, and accompanying beneficial components.

a) The content of the main beneficial component (Cu) in copper ore must be determined through chemical analysis or other methods. The analysis process follows current regulations; basic chemical analysis samples analyze the Cu component, additional analysis criteria may be added depending on the presence of accompanying beneficial components. Basic chemical analysis is conducted on 100% of the samples taken from exploration sites;

b) Accompanying beneficial components, harmful components, and other components are determined through group chemical analysis samples, at least 10% of the basic samples;

Group chemical analysis samples, in addition to the components analyzed in the basic samples, need to select supplementary analysis of the following components: S, As, Fe, Au, Ag, Te, TR2O3, Mo, W, Pt, Co, Se, In, Ge, U3O8, SiO2, Al2O3, MnO, CaO... suitable for each type of ore;

c) Mineral composition, structural characteristics, architectural features, and other physical properties of the ore must be evaluated using petrographic, mineralogical, physicochemical, and other analytical methods.

2. Technological sample research work

Technological samples must be studied at laboratory scale or expanded laboratory scale. For new types of ore, difficult-to-treat ores, or ores without industrial production experience, separate research and evaluation programs must be established;

The results of technological sample research must assess the ore's material composition, determine the key economic and technical parameters of the beneficiation stages, propose reasonable grinding and beneficiation technology schemes to recover the main beneficial component as copper concentrate and the recovery capability of accompanying beneficial components such as Au, Ag, Fe, S, TR2O3,... (if present).

Article 17. Requirements for Sample Analysis Inspection

1. Sample analysis inspection must be regularly and systematically conducted.

2. Quality control of sample analysis results is implemented according to Circular No. 62/2014/TT-BTNMT dated December 9, 2014, issued by the Minister of Natural Resources and Environment regarding National Technical Regulations on Quality Control of Geological and Mineral Sample Analysis Results.

Article 18. Requirements for Hydrogeological and Engineering Geological Evaluation

1. Requirements for Hydrogeological Evaluation

a) Meteorological and hydrological data of the exploration area must be collected for at least the last five years;

b) Surface water sources and major aquifers within the exploration area must be studied; it must be possible to evaluate aquifers that could flood the mine, especially in areas with high flooding potential to address drainage and mine drying issues;

c) For aquifers, thickness, lithological composition, water supply conditions must be determined; relationships between aquifers must be identified, as well as relationships between surface water, groundwater, and related parameters;

d) Chemical and microbiological components of water must be studied, the ability of water to corrode concrete and metals, the content of beneficial and harmful components in water must be assessed; the impact of mine water pumping on underground water usage facilities in the region, as well as the usability of water for domestic purposes must be evaluated. Recommendations for water supply and drainage solutions and the extent of the impact of mine drying on the surrounding environment must be proposed.

2. Requirements for Engineering Geological Evaluation

a) Engineering geological units existing in the exploration area must be identified; the mechanical properties of the ore, surrounding rock, and overburden under natural and saturated conditions must be determined; geological engineering characteristics of soil and rock layers and their anisotropic properties, rock composition, fracturing, destruction, karst, and weathering phenomena must be clarified;

b) The stability of mine structures must be evaluated, and basic parameters of the open pit and mining shafts must be calculated.

3. All hydrogeological, engineering geological conditions, and other natural factors must be evaluated to meet the requirements for establishing investment projects for mineral exploitation and mine design. In cases where hydrogeological and engineering geological conditions are complex, specialized investigation evaluation projects must be established.

Article 19. Requirements for Environmental Impact Assessment

1. The exploration process must collect geological environmental data to forecast and assess the main factors affecting the environment.

2. Assess geological hazards and negative impacts on the environment caused by exploration activities, and propose preventive and mitigating solutions. The content and level of environmental impact assessment must be included in the exploration project proposal.

Article 20. Requirements for Technical Conditions Assessment for Mine Exploitation

1. Preliminarily assess the boundaries of the mining area, the slope angle of the seam face, the slope angle of the pit edge, stripping ratio, volume of overburden, and preliminarily assess the rock pressure on the seam walls and pillars.

2. Assess areas without industrial copper ore deposits as the basis for establishing investment projects for mineral exploitation and mine construction designs.

Article 21. Requirements for Calculating Reserves and Resources

1. Calculating reserves and resources of copper ore must be based on detailed criteria for calculating reserves as explained in the mineral exploration report for each mine.

2. Methods for calculating reserves and resources of copper ore must be selected according to the structural characteristics of the ore body for each mine and the characteristics of the exploration works already constructed. It is encouraged to apply specialized software for calculating reserves.

3. Reserves and resources of copper ore are calculated as current underground reserves, not including losses during extraction and processing, and are expressed in units of thousands of tons for ore and copper metal.

4. Reserves and resources of each copper ore body are presented on reserve calculation maps or sections at scales equal to or larger than geological map scales, depending on the scale and characteristics of the ore body. Reserve calculation results must be presented by each ore body, by reserve and resource categories.

5. Reserves and resources of copper ore and accompanying beneficial components (if any) are calculated and presented in the mineral exploration result report. Calculation materials for overburden used as construction materials and other accompanying minerals are presented as appendices to the report.

Article 22. Requirements for Highest Reserve Categories and Proportions of Reserve Categories l体制机制各级储量

1. For mines in Group I and II, the highest reserve category must be Category 121; for mines in Group III and IV, it must be Category 122.

2. The proportions of Categories 121 and 122 are determined by the investor based on the geological characteristics of the mine, financial capacity, technical conditions for exploitation, expected production capacity, but must ensure that the proportion of the highest reserve category does not fall below 10% of the total reserves of the mine and must be reflected in the exploration project proposal.

Article 23. Content and Presentation Form of the Mineral Exploration Result Report

The content and presentation form of the mineral exploration result report shall be implemented in accordance with Circular No. 16/2012/TT-BTNMT dated November 29, 2012, issued by the Minister of Natural Resources and Environment regarding exploration project proposals, closure of mineral mines, and sample reports on mineral activity results, sample documents in mineral activity permit files, reserve approval files, and mine closure files.

Chapter IV

IMPLEMENTATION

Article 24.Article litselfpowers as prescribed by law and other tasksi ADJUSTMENT

1. This Circular takes effect from February 15, 2016.

2. In cases where the referenced provisions in this Circular are amended or supplemented, they shall be applied according to the amended or supplemented legal documents.

Article 25. Responsibilities1. This Circular takes effect from July 8, 2016.

1. The National Mineral Reserve Evaluation Council Office and the Vietnam General Department of Geology and Minerals are responsible for guiding and inspecting the implementation of the provisions of this Circular.

2. During the implementation process, if there are difficulties or obstacles, organizations and individuals should promptly reflect them to the Ministry of Natural Resources and Environment for consideration and resolution./.
