On pilot auctioning of vehicle license platesng

OF THE NATIONAL ASSEMBLY

On the basis of the Constitution of the Socialist Republic of Vietnam;

BASED ON THE LAW ON THE ORGANIZATION OF THE NATIONAL ASSEMBLY NO. 57/2014/QH13, AS AMENDED BY SOME ARTICLES IN LAW NO. 65/2020/QH14;

Pursuant to the Law on Legislative Regulatory Documents No. 80/2015/QH13, which has been amended and supplemented by some articles according to Law No. 63/2020/QH14;

RESOLUTION:

Article 1. Scope of Regulation and Applicability

1. This Resolution stipulates the pilot auctioning of vehicle license plates including: vehicle license plates put up for auction, organization of asset auctions; starting price, deposit, bid increment, proceeds from the auction; form, method, procedure, and process of auctioning; auctioning in cases where there is only one person registered to participate in the auction, one participant in the auction, or one bidder; rights and obligations of the successful bidder of vehicle license plates.

2. This Resolution applies to agencies assigned by the Ministry of Public Security to organize auctions; organizations conducting asset auctions; auctioneers; organizations and individuals participating in auctions and other agencies, organizations, and individuals related to the auctioning of vehicle license plates.

Article 2. Vehicle License Plates Put Up for Auction, Organization of Asset Auctions

1. Vehicle license plates put up for auction are white-background license plates with black letters and numbers, except for license plates issued to military enterprises engaged in business, project vehicles, joint venture economic organizations with foreign countries, vehicles of foreign organizations and businesses, diplomatic missions, consular posts, international organization representative offices, and foreigners working in foreign and international organizations operating within the territory of Vietnam.

2. The selection of vehicle license plates for auction shall be regulated as follows:

a) The Ministry of Public Security and organizations conducting asset auctions have the responsibility to publicly announce the vehicle license plates specified in Clause 1 of this Article that have not been registered and are expected to be newly issued on the national online auction asset information portal, the Ministry of Public Security's online portal, the Traffic Police Corps' website, and the online auction asset information portal of the auction organization.

b) Organizations and individuals may select vehicle license plates of provinces and centrally-administered cities to register for participation in the auction.

c) Vehicle license plates that cannot be selected for auction, and those that fail to sell at auction, shall immediately be transferred into the registration and management system for registration according to regulations.

3. During the implementation of this Resolution, the Ministry of Public Security will select an organization conducting asset auctions among those with online auction portals, ensuring network security and safety when connected to the vehicle registration and management system to conduct the auction of vehicle license plates.

Article 3. Starting Price, Deposit, Bid Increment, Proceeds from Auctioning Vehicle License Plates

1. The starting price for one vehicle license plate put up for auction is VND 40,000,000.

2. The deposit is equal to the starting price of one vehicle license plate put up for auction.

3. The bid increment is VND 5,000,000.

4. The proceeds from the auction of vehicle license plates, after deducting the costs of organizing the auction, shall be deposited into the central budget in accordance with laws on state budget.

The Government shall specify the management and use of the proceeds from the auction of vehicle license plates.

Article 4. Form, Method, Procedure, and Process of Auctioning Vehicle License Plates

1. Form of auction is online auction.

2. Method of auction is the upward bidding method.

3. The Government shall stipulate the procedure and process of auctioning vehicle license plates.

Article 5. Auctioning in Cases Where There Is Only One Person Registered to Participate in the Auction, One Participant in the Auction, or One Bidder

When the deadline for registering to participate in the auction has expired and there is only one person registered to participate in the auction, or there are multiple registrations but only one participant in the auction, or multiple participants but only one bidder offering at least the starting price of one vehicle license plate put up for auction, then the vehicle license plate put up for auction shall be transferred to that person.

Article 6. Rights and Obligations of the Successful Bidder for Car Number Plates; Recipient of Transfer, Exchange, Gift, or Inheritance of Cars with Successful Bid Number Plates

1. The rights of the successful bidder for car number plates include:

a) Receiving a confirmation document for the successful bid car number plate after paying the full amount of the successful bid price;

b) Registering the successful bid car number plate to be attached to their own car at the police agency managing the successful bid car number plates or at the place where the successful bidder is registered to reside or has its headquarters;

c) Retaining the successful bid car number plate in cases where the car is lost, damaged and unusable, or transferring, exchanging, or gifting it to register another car owned by themselves within twelve months from the date the car was lost, damaged and unusable, or when ownership was transferred;

d) Receiving a replacement for the successful bid car number plate or confirmation document for the successful bid car number plate if they are lost, faded, or damaged;

đ) Within twelve months from the date of receiving the confirmation document for the successful bid car number plate, if the successful bidder dies without completing the procedures to register the car to attach the successful bid number plate, the successful bid car number plate will be entered into the vehicle registration and management system, and the heir, according to the law on inheritance, will receive the amount paid by the successful bidder after deducting auction organization costs;

2. The obligations of the successful bidder for car number plates include:

a) Paying the full amount of the successful bid price within fifteen days from the date of the approval document for the auction results; the successful bid price does not include registration fees and license plate issuance fees;

b) Completing the procedures to register the car to attach the successful bid number plate within twelve months from the date of receiving the confirmation document for the successful bid car number plate; in case of force majeure or objective obstacles, this period may be extended but not exceeding six months. After the specified period, if the successful bidder for the car number plate does not complete the procedures to register the car to attach the successful bid number plate, the successful bid car number plate will be entered into the vehicle registration and management system, and the successful bidder will not be refunded the successful bid price paid;

c) Not transferring, exchanging, gifting, or leaving as inheritance the successful bid car number plate, except in cases where the car with the successful bid number plate is transferred, exchanged, gifted, or inherited;

3. The rights and obligations of the recipient of transfer, exchange, gift, or inheritance of cars with successful bid number plates shall be carried out in accordance with the provisions of the law on the process of issuing and revoking vehicle registration and number plates for motor vehicles;

Article 7. Implementation Provisions

1. This Resolution takes effect from July 1, 2023 and is implemented for three years;

2. After the trial period expires, the successful bidder for car number plates, the recipient of transfer, exchange, gift, or inheritance of cars with successful bid number plates shall continue to perform the rights and obligations stipulated in Article 6 of this Resolution, except where other laws or resolutions of the National Assembly provide otherwise;

3. The Standing Committee of the National Assembly, the National Ethnic Council, the Committees of the National Assembly, the Delegations of the National Assembly, and the Members of the National Assembly, within their respective duties and powers, supervise the implementation of this Resolution;

4. The Government shall provide detailed regulations and guidance for the implementation of this Resolution, take responsibility for organizing its implementation, report to the National Assembly on the results of the implementation of the Resolution and propose improvements to the law on auctioning car number plates at the first session in 2026;

This Resolution was adopted by the National Assembly of the Socialist Republic of Vietnam, the fifteenth term, fourth session, on November 15, 2022.
