THE MINISTER OF FINANCE

Pursuant to Decree No. 57/2002/NĐ-CP dated June 3, 2002 of the Government detailing the implementation of the Ordinance on Fees and Charges;

Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 77/CP dated July 1, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

Based on the proposal of the People's Committee of Ba Ria-Vung Tau Province (document No. 2070/UB.VP dated April 19, 2004) and the proposal of the Director of the Tax Policy Department,

 

DECISION:

Article 1. This Decision promulgates the fee collection levels for using Ben Dam Port and Con Dao-Vung Tau Port of Ba Ria-Vung Tau Province.

The objects subject to the fee collection levels prescribed in this Decision are fishing vessels and transportation means and goods passing through Ben Dam Port and Con Dao-Vung Tau Port of Ba Ria-Vung Tau Province.

Article 2. The Port Management Board of Ben Dam, authorized by the competent state agency to organize the management of Ben Dam Port and Con Dao-Vung Tau Port, shall be responsible for collecting the port usage fees at Ben Dam Port and Con Dao-Vung Tau Port (hereinafter referred to as the fee collection unit) according to the levels set out in this Decision.

For watercraft engaged in cargo and passenger transport activities docking at the ports, the Port Management Board of Ben Dam is permitted to collect fees for using wharves, berths, and mooring buoys within the port area, according to the collection levels specified in Decisions No. 61/2003/QĐ-BTC dated April 25, 2004 of the Minister of Finance promulgating the Fee and Charge Collection Table and Service Prices for Maritime Affairs and Port Services; and Decision No. 62/2003/QĐ-BTC dated April 25, 2003 of the Minister of Finance promulgating the Fee and Charge Collection Table for Domestic Watercraft Transport and Special Maritime Fees and Charges.

Article 3. The revenue from the fees for using Ben Dam Port and Con Dao-Vung Tau Port prescribed in this Decision is a revenue item belonging to the state budget, which shall be managed and used as follows:

1. The fee collection unit is allowed to retain 80% of the collected fee revenue to cover expenses related to fee collection as stipulated in Point 4-b, Section C, Part III of Circular No. 63/2002/TT-BTC dated July 24, 2002 of the Ministry of Finance guiding the implementation of laws and regulations on fees and charges.

2. The fee collection unit is responsible for declaring, paying, and settling accounts for 20% of the collected fee revenue into the state budget according to the current state budget classification and the provisions of Circular No. 63/2002/TT-BTC dated July 24, 2002 of the Ministry of Finance.

Article 4. This Decision takes effect fifteen days from the date of publication in the Official Gazette.

Other matters related to the collection, payment, management, and use of fees not mentioned in this Decision shall be implemented in accordance with the guidance provided in Circular No. 63/2002/TT-BTC dated July 24, 2002 of the Ministry of Finance guiding the implementation of laws and regulations on fees and charges.

Article 5. Organizations and individuals subject to the obligation to pay fees, units entrusted with the task of organizing the collection of fees for using Ben Dam Port and Con Dao-Vung Tau Port, and relevant agencies are responsible for implementing this Decision.
