RESOLUTION

SIXTH SESSION, FOURTEENTH NATIONAL ASSEMBLY

OF THE NATIONAL ASSEMBLY

 

WHEREAS The Constitution of the Socialist Republic of Vietnam;policiesWHEREAS The Law on Organization of the National Assembly;

Pursuant to the Law on the Organization of the National Assembly No. 57/2014/QH13;

Based on the results of the session from October 22 to November 20, 2018;

In accordance with the proposal of the Standing Committee of the National Assembly and the opinions of the National Assembly deputies;

 

RESOLUTION:

 

Article 1

The Fourteenth National Assembly has completed the agenda items for the sixth session. The results of the session further affirm the responsibility, efforts, and high determination of the National Assembly, the State President, the Government, and relevant agencies and organizations in preparing and conducting the session, ensuring that the activities of the National Assembly become increasingly democratic, transparent, and closely connected with the people, subject to strict supervision by the people. The National Assembly has examined and decided on the following matters:policies1. Electing the State President and adopting the Resolution on electing the State President.

Approving the removal and appointment of the Minister of Information and Communications and adopting two resolutions regarding these personnel matters.

2. Adopting nine laws: Law on Anti-Corruption; Law on People's Police; Law on Pardon; Law Amending and Supplementing Certain Provisions of the Higher Education Law; Livestock Law; Crop Production Law; Vietnam Coast Guard Law; Law on Protecting State Secrets; Law Amending and Supplementing Certain Provisions of 37 Laws Related to Planning.

Directing the Government to urgently prepare and submit to the Standing Committee of the National Assembly for examination and adoption of the Ordinance Amending and Supplementing Certain Provisions of Relevant Ordinances Related to Planning; promulgate the list of planning categories to be integrated into national-level, regional, and provincial planning according to Clause 4, Article 59 of the Planning Law No. 21/2017/QH14. In cases where the integrated planning expires before the decision or approval of the national-level, regional, or provincial planning, the Government shall direct the adjustment of the planning period in accordance with the specialized laws governing the integrated planning until the national-level, regional, or provincial planning is decided or approved.

Adopting the Resolution approving the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP) and related documents. Directing the Government to study and propose amendments and supplements to legal regulations to fully leverage the important role of the Agreement in the country's socio-economic development, and implement Vietnam's commitments to actively and proactively integrate into the international community.national3. Considering six draft laws: Education Law (Amended); Architecture Law; Tax Administration Law (Amended); Law Amending and Supplementing Certain Provisions of the Public Investment Law; Criminal Enforcement Law (Amended); Law on Combating the Harmful Effects of Alcohol and Beer.

The National Assembly decides to remove the Administrative Services Law project from the legislative program for 2019 and stop its development; examine and adopt the amended Education Law project at the seventh session (May 2019); expand the scope of amendment and supplementation and rename the Law Amending and Supplementing Certain Provisions of the Criminal Enforcement Law to the Criminal Enforcement Law (Amended).

4. Voting on confidence and adopting the Resolution confirming the results of the confidence vote for 48 individuals holding positions elected or approved by the National Assembly.

Questioning and responding to questions about the implementation of National Assembly resolutions on thematic oversight and questioning from the beginning of the term to the end of the fourth session. The National Assembly requires members of the Government, heads of sectors to thoroughly study and absorb the opinions of National Assembly deputies, promptly implement comprehensive and effective solutions, and address shortcomings in the implementation of resolutions on thematic oversight and questioning from the beginning of the term to the end of the fourth session, and report to the National Assembly at subsequent sessions.

5. Examining reports evaluating the results of implementing National Assembly resolutions on: Economic and Social Development Plan, State Budget for 2018, Economic and Social Development Plan, State Budget for 2019; mid-term review of the implementation of the public investment plan for the 2016-2020 period. Adopting four resolutions on: Economic and Social Development Plan for 2019, State Budget Estimate for 2019, Central Budget Allocation for 2019, Adjustment of the Mid-Term Public Investment Plan for 2016-2020.

6. Examining reports evaluating the mid-term implementation of the five-year plans for 2016-2020 on economic and social development, economic restructuring, national target programs, and national finance. The National Assembly acknowledges and highly commends the achievements made by the Government, the Supreme People's Court, the Supreme People's Procuracy, the State Audit Agency, all levels, and sectors, while praising the spirit of effort and dedication of businesses and the people in implementing the National Assembly's resolutions on the five-year plans for 2016-2020 during the first half of the term. The National Assembly requests the Government, all levels, and sectors to continue to leverage positive aspects, innovate, and be more resolute in leadership and management; strive to achieve and exceed targets set out in the National Assembly's resolutions on the five-year plans for 2016-2020 in the years 2019-2020. Directing the Government to continue researching and perfecting laws on public-private partnership (PPP), in the short term, directing relevant ministries and sectors to promptly establish mechanisms to resolve difficulties and obstacles related to payment to investors under build-transfer (BT) projects.

7. Examining reports evaluating the three-year implementation of policies for economic and social development in ethnic minority and mountainous regions. Directing the Government to develop an overall investment and development plan for ethnic minority and mountainous regions, and areas with particularly difficult conditions, to be submitted to the National Assembly for examination and decision at the eighth session (October 2019) for implementation starting from 2021.

7. Reviewing the mid-term reports on the implementation of the five-year socio-economic plans for 2016-2020, economic restructuring, national target programs, and state finance. The National Assembly acknowledges and highly commends the achievements of the Government, the Supreme People's Court, the Supreme People's Procuracy, the State Audit Agency, all levels and sectors, while also praising the efforts of businesses and people at all levels in implementing the National Assembly’s resolutions on the five-year plans for 2016-2020 during the past half term. The National Assembly requests the Government, all levels, and sectors to continue to leverage positive aspects, innovate, and be more resolute in guidance and management; strive to achieve and exceed targets set out in the National Assembly’s resolutions on the five-year plan for 2016-2020 in the two years 2019-2020. The Government is tasked with continuing to study and improve laws on public-private partnership (PPP) investment, initially directing relevant ministries and sectors to promptly develop mechanisms to address difficulties and obstacles related to payments to investors under build-transfer (BT) projects.h 8. Reviewing the report on the results of three years of implementing policies for socio-economic development in ethnic minority and mountainous regions. The Government is tasked with developing an overall investment proposal for socio-economic development in ethnic minority and mountainous regions, and areas with particularly difficult conditions, to be submitted to the National Assembly for consideration and decision at the eighth session (October 2019) for implementation starting from 2021.

8. Review the report assessing the three-year implementation results of policies for economic and social development in ethnic minority and mountainous regions. Entrust the Government to develop a comprehensive investment plan for economic and social development in ethnic minority and mountainous regions, and areas with particularly difficult conditions, to be submitted to the National Assembly for consideration and decision at its eighth session (October 2019) for implementation starting from 2021.

9. Review reports on crime prevention and control activities, enforcement of judgments, anti-corruption efforts, complaint and denunciation resolution work, and the work of the President of the Supreme People's Court and the Prosecutor General of the Supreme People's Procuracy in 2018; compile the opinions and suggestions of voters and the people; results of oversight on the handling and response to voter suggestions sent to the fifth session and some other relevant agencies' reports. The National Assembly requests the Government and relevant agencies to thoroughly study and adopt the opinions of National Assembly deputies, voters, and the people sent to various sessions; implement comprehensive measures to enhance the effectiveness of all areas of work in the future.

10. Extend the trial period for issuing electronic visas to foreigners entering Vietnam under Resolution No. 30/2016/QH14 of the National Assembly for a maximum of two years from February 1, 2019. Entrust the Government to promptly conclude the implementation of the Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam, and submit draft amendments and supplements to the National Assembly for consideration to ensure the Law takes effect before February 1, 2021.

11. Entrust the Government to develop the national land use strategy until 2045; continue to perfect the legal system and mechanisms and policies to implement Resolution No. 36-NQ/TW of the Central Committee of the Communist Party of Vietnam, the 12th tenure, on the sustainable development strategy of Vietnam’s marine economy until 2030 with a vision to 2045.

12. Amend the tasks assigned to the State Audit Office according to Resolution No. 60/2018/QH14 of the National Assembly from "auditing the use of land revenue from state-owned enterprises that have been equitized during the period 2011-2017" to "auditing land management and utilization before and after the equitization process of state-owned enterprises during the period 2011-2017".

Article 2

1. The Standing Committee of the National Assembly, the Government, the Vietnam Fatherland Front Central Committee, the Supreme People's Court, the Supreme People's Procuracy, the Ethnic Council, the National Assembly Committees, the State Audit Office, local authorities at all levels, and relevant sectors shall organize the effective implementation and intensify the dissemination and education of laws to quickly bring enacted laws and resolutions into practice. Study, explain, and incorporate the contributions of National Assembly deputies to improve draft laws that have been reviewed by the National Assembly. Urgently prepare contents for submission to the National Assembly at the seventh session to ensure quality and progress.

2. The Standing Committee of the National Assembly, the National Ethnic Council, the Committees of the National Assembly, the Delegations of National Assembly members, and individual National Assembly deputies shall supervise the implementation of laws and resolutions of the National Assembly.

The Vietnam Fatherland Front Central Committee and member organizations of the Front shall supervise and encourage all strata of the people to implement laws and resolutions of the National Assembly.

This Resolution was adopted by the National Assembly of the Socialist Republic of Vietnam, the fourteenth tenure, sixth session, on November 20, 2018.
