THE COUNCIL OF MINISTERS

Pursuant to Decree No. 92-CP dated May 8, 1975 of the Council of Ministers promulgating the Charter on the organization and operation of the Ministry of Construction;
Pursuant to the resolution of the Council of Ministers on strengthening organizational division of management and improving construction management No. 136-CP dated August 5, 1976;
At the proposal of the Minister of Construction,

DECISION:

1. The Ministry of Construction shall be responsible for basing on the planning distribution of economic zones to assist the Council of Ministers in organizing unified management of the arrangement and preparation for investment in construction of industrial zones across the country, from the stage of researching planning, determining the location of each project, preparing construction sites (land leveling to create a flat surface), taking the lead in coordinating with specialized management agencies such as electricity, post and telecommunications, transportation... to develop plans for construction of technical infrastructure projects down to each factory (roads, electricity, water, drainage, telephone...).

2. The Ministry of Construction needs to organize necessary specialized units from central to local levels (provinces, cities and each industrial zone) to implement the above tasks in accordance with the principle of combining state management by sector and by locality; clearly defining specific tasks and working systems between these organized units according to different functions: state management, business construction management, and exploitation management. The Ministry of Construction will take over and improve the organization of the central agency expanding technical areas (SONADEZI) of the former South including the organizational structure, staff, personnel, assets, and other economic-technical documents of the industrial zones. Based on the scale of construction of industrial zones, the Ministry of Construction and other specialized management ministries must organize or help localities organize well-equipped construction and business companies to build and manage technical infrastructure projects in those industrial zones.

3. People's Committees of provinces and centrally governed cities need to establish specialized organizational systems to manage the construction of industrial zones under their management in accordance with approved planning at all competent levels, under the unified professional, technical, and operational guidance of the Ministry of Construction.

The provinces of Dong Nai, Hau Giang, Phu Khanh, Quang Nam - Da Nang are responsible for taking over and renovating the old technical expansion branches in their respective areas.

People's Committees of provinces and centrally governed cities are the investors of residential areas and technical infrastructure projects of cities in general and individual industrial zones in particular. Based on long-term plans for economic and cultural development and based on the planning of industrial zones, the State Planning Commission will balance plans and allocate capital for specialized ministries and provincial people's committees to construct technical infrastructure and housing in industrial zones as a comprehensive investment.

In each industrial zone receiving state investment capital, the province or city must establish a separate construction management board to oversee the implementation of that investment capital.

4. The Ministry of Construction shall be responsible for:

- Studying to submit to the Council of Ministers for prompt issuance of regulations, systems, policies for managing planning construction of industrial zones from the initial preparation stage to management and exploitation.

- Organizing research and design of synchronous planning for each industrial zone, in line with the overall distribution planning of economic regions.

Each industrial zone planning design must be submitted to the Prime Minister for timely review to serve as a basis for detailed design of projects and management of all construction activities within the industrial zone.

5. All undeveloped land areas in industrial zones (including lands belonging to private owners in newly liberated areas which were granted usage permits or ownership certificates by the US puppet regime but have not yet been developed) are managed by the People's Committees of provinces and cities. All ministries and grassroots units currently holding these lands must hand them over to the People's Committees of provinces and cities for management. Central and local agencies with new construction or renovation and expansion of existing projects in industrial zones must follow the procedures stipulated in Decree No. 47-CP of the Council of Ministers dated March 15, 1972.

6. The Ministers of Construction, Chairmen of the State Planning Commission, heads of ministries, general departments, chairmen of provincial and municipal people's committees are responsible for implementing this decision.
