Pursuant to Decree No. 77/2003/NĐ-CP dated July 1, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Pursuant to the directives of the Government and the Prime Minister on the orientation and solutions to implement the goal of stabilizing the market and curbing inflation in 2008;
At the proposal of the Director of the Ministry of Finance's Office and the heads of units under the Ministry of Finance,

DECISION:

Article 1. Attached hereto is the "Program of Action of the Ministry of Finance to implement the goal of stabilizing the market and curbing inflation in 2008".

Article 2. Implementation organization:

1. Based on the Program of Action of the Ministry of Finance, the heads of units assigned (attached) shall be responsible for developing the content and concretizing the steps of implementation according to the plan; Regularly report monthly to the Ministry on the situation and progress of implementing the tasks pursuant to this Decision.

2. The Ministry's Office shall take the lead in monitoring and compiling monthly reports to the Ministry on the progress of implementing the Program of Action of the Ministry of Finance.

Article 3. This Decision shall take effect from the date of signing.

Article 4. The heads of units under the Ministry and the Director of the Ministry of Finance's Office shall be responsible for enforcing this Decision.

PROGRAM OF ACTION OF THE MINISTRY OF FINANCE

TO IMPLEMENT THE GOAL OF STABILIZING THE MARKET AND CURBING INFLATION IN 2008

(Issued together with Decision No. 745/QD-BTC dated April 28, 2008 of the Minister of Finance)

I. Financial, budgetary, and public expenditure supervision: Implement urgent financial-budgetary measures to curb inflation and stabilize the macro-economy in 2008, strictly enforce fiscal policy while ensuring social welfare and supporting vulnerable groups affected by market fluctuations, specifically:

(1) Promptly study and develop mechanisms and policies for state budget revenue and expenditure aimed at realizing the orientation and solutions for economic and social stability and development in the new context. Simultaneously, develop and implement plans for state budget revenue and expenditure and cut regular spending by 10% for central ministries and agencies and local budgets. Strictly adhere to the requirement of thrift in internal financial expenditures.

(2) Manage and implement the 2008 budget estimates of budgetary units in accordance with the Government's directives.

(3) Organize the implementation of support policies and social welfare tasks as stipulated in Decisions No. 289/QD-TTg dated March 18, 2008, and Decision No. 112/2007/QD-TTg dated July 20, 2007 of the Prime Minister, including: raising health insurance levels, providing health insurance support to near-poor individuals, implementing educational and training policies, subsidizing lighting fuel for ethnic minority households, households in policy areas, and poor households without access to grid electricity, and supporting fishermen.

(4) Evaluate the feasibility of the 2008 investment capital plan from government bonds to formulate plans and schemes for issuing government bonds to meet the capital needs of the state budget and development investment, and align with adjustments in state budget investment spending plans.

(5) Compile results and lists of projects that have been reduced, suspended, or delayed in progress by ministries, sectors, central authorities, and localities. Coordinate to address price increases of construction materials in 2008 for basic construction projects and propose and implement measures to expedite disbursement of construction investment funds.

(6) Strengthen the control over expenditures, implement the reduction of expenditures resolutely refuse non-essential expenses to contribute to curbing inflation. Guide and supervise units under the Ministry to effectively achieve the goal of tightening expenditures, improving the efficiency of state budget fund utilization, enhancing energy conservation, cutting non-urgent investment items, and focusing funds on effective projects.

(7) Complete the government's policy on encouraging socialization. Study and issue a list of types and criteria regarding scale, quality, and standards for entities eligible for preferential treatment under the national socialization policy.

(8) Implement the national reserve plan to ensure sufficient reserves of food, rescue equipment, vaccines, and epidemic prevention medicines to respond promptly to situations occurring in 2008.

II. Financial banking, enterprise, capital market, securities market: Implement adjustments and guidance on preferential credit policies and support for disadvantaged groups. Study and promulgate management policies for the securities market and foreign investors' participation in the Vietnamese securities market to ensure its transparent and sustainable development. Amend financial mechanisms, capital mobilization, and investment by state-owned enterprises. Specifically, the following tasks will be carried out:

(1) Review state policies on investment credit and export credit towards reasonably narrowing the scope of beneficiaries of state credit policies.

Develop a plan to mobilize capital for students and trainees to borrow funds as per Decisions No. 157/2007/QD-TTg and No. 319/2008/QD-TTg of the Prime Minister.

(2) Implement measures to develop the organized securities market while limiting risks in the unorganized market. Study and promulgate regulations on private placement of securities.

(3) Study amendments to raise standards for: issuance of securities offerings, licensing of securities companies, and fund management companies.

(4) Amend or supplement regulations related to foreign investors in the securities market: rules of operation and service provision; establishment of wholly foreign-owned fund management companies, and measures to control foreign investment flows.

(5) Develop a proposal for solutions, risk prevention, and crisis management in the securities market.

(6) Reform the management mechanism for state capital invested in other enterprises; The mechanism for foreign investors' contribution of capital and purchase of shares in Vietnamese enterprises; Organize strict inspection, supervision, and evaluation of the financial performance of economic groups, holding companies, and state-owned enterprises to promptly identify and correct issues, and report and propose measures to the Prime Minister to strengthen management and improve the organizational structure and operations of economic groups.

(7) Study policies to encourage insurance companies to provide insurance services in agriculture, forestry, fisheries, and remote areas for low-income people; Study and develop necessary legal bases to support insurance companies in launching new types of insurance products such as educational assistance, healthcare, retirement, and insurance for the poor; Strengthen inspections to ensure the healthy, safe, and effective development of the insurance market; Strictly handle violations.

III. In the field of credit and foreign financing: Evaluate the use of foreign debt and aid funds to supplement and adjust policies accordingly.

(1) Complete research on the Medium-term Debt Management Program; Develop and implement plans for foreign borrowing from now until the end of 2008 and proposals for foreign borrowing and repayment plans from now until 2010 consistent with requirements to control inflation.

(2) Develop and promulgate government regulations on foreign debt monitoring indicators; Regulations on the issuance and management of government guarantees and procedures for handling financial obligations arising from government guarantees for foreign investment projects; regulations on issuing international bonds.

IV. In the field of price management: Stabilize market prices, especially for monopoly goods, maintain stability for essential goods and services, organize inspections, and take measures against goods with sudden price increases.

(1) Coordinate and urge ministries, sectors, localities, provincial and municipal People's Committees to strengthen organization, inspection, grasp situations, and take measures against goods with sudden price increases; strengthen inspections on price labeling and sales according to labeled prices; inspect the implementation of freight rate declarations and labeling.

(2) Regularly compile, analyze, evaluate, and forecast market price conditions, particularly essential goods prices. Analyze clearly the reasons for price fluctuations; their impact on consumption, production and business activities; measures taken to stabilize prices and macroeconomic stability; management and adjustment of prices for monopoly goods such as electricity, telecommunications, oil, clean water, iron and steel, cement, coal, textbooks, rice costs, fertilizer prices... existing problems, obstacles, and solutions; Forecast prices and price control measures (including establishing a price adjustment roadmap according to market mechanisms for certain important goods regulated by the State in the last six months of 2008 and during the Tet holiday).

(3) Set public service product prices based on the principle that the State orders and allocates plans for 2008 without exceeding the budget allocated for public service products.

(4) Enact a price control mechanism for petroleum products based on the "Price Risk Prevention" approach.

V. In the Taxation and Customs Field

(1) Vigorously implement national budget revenue collection efforts, striving to increase national budget revenues in 2008 by at least 5% over the National Assembly's assigned budget.

(2) Closely monitor import prices (to prevent price fraud) for consumer goods. Strengthen post-clearance inspections, anti-smuggling efforts focused on high-tariff goods prone to price fraud (monitoring bank transactions); Collect import price information for reference when determining customs value; Facilitate export goods inspection procedures and raw material imports for export production while ensuring compliance with legal regulations; Regularly inspect customs operations (on prices, taxes, anti-smuggling, post-clearance... ) of provincial and municipal customs offices.

(3) Collaborate with relevant ministries and sectors to review and classify goods categories, especially those requiring control and restriction; Use technical barriers or combine other measures as appropriate for each category to limit imports.

(4) Continue reviewing fees and charges according to the list of exempted fees and charges issued with Directive No. 24/2007/CT-TTg; Complete and submit to competent authorities for revision and supplementation of tax, fee, and charge regulations; Study adjustments to export tax rates for natural resources and minerals, import tax rates for certain goods groups to align with current realities and implement the Prime Minister's directives in Circular No. 481/TTg-KTTH dated March 31, 2008; Adjust preferential import tariff rates for certain goods groups to fulfill Vietnam's commitments under the WTO for 2009.

(5) Study and complete tax policies related to: implementing the Law on Personal Income Tax; business license tax for individual businesses with low income below the minimum wage; tax exemptions and reductions for taxpayers affected by natural disasters, fires, and unexpected accidents in 2007.

(6) Organize audits and collect into the budget revenues from unreasonable price increases by businesses in industries with significant price hikes (steel, new drugs...); audit and inspect manufacturing and trading businesses of consumer goods suspected of intentionally increasing prices; address overdue tax debts.
