Considering the proposal of the Minister of Agriculture and Rural Development,
DECISION:
Article 1. Scope of Regulation
This Decision stipulates the support policies regarding training, health insurance, social insurance, unemployment insurance, labor norms, land rental fees, sources of support funds, and the responsibilities of relevant state agencies in implementing this policy.
Article 2. Applicability
The subjects to which this Decision applies include: single-member limited liability companies in agriculture and forestry in the Central Highlands owned by the State using land for agricultural and forestry production and aquaculture purposes; Specialized Forest Management Boards, Protective Forest Management Boards; non-State enterprises (excluding foreign-invested enterprises) using land for agricultural and forestry production and aquaculture purposes employing ethnic minority workers who are legally residing in the Central Highlands provinces and are eligible for State support for production land (hereinafter referred to collectively as the labor-using units).
Article 4. Preparation of Budget Estimates and Consolidation of Support Expenditure Budgets
1. On Training
The State budget will support the costs of short-term vocational training (up to primary vocational level and training under three months) with a maximum of three million VND per person per course (the specific amount of support will be determined based on each trade and actual training duration) for general workers who are ethnic minorities, meeting the recruitment conditions set forth in the recruitment and training plan of the labor-using unit.
2. On Health Insurance, Social Insurance, Unemployment Insurance
The State budget will cover the payment of social insurance, health insurance, and unemployment insurance premiums on behalf of the labor-using unit for newly recruited or contract-bound ethnic minority workers. The period of coverage is five years from the date the worker starts working at the unit.
3. On Labor Quotas
The labor-using unit may apply a labor norm equal to eighty percent of the common labor norm of the unit for allocating or paying wages to ethnic minority workers. The application period is five years from the date the worker starts working at the unit.
4. On Land Rental Fees
A labor-using unit that employs between thirty and less than fifty percent ethnic minority workers relative to the total number of workers present at the unit shall have its land rental fee reduced by fifty percent for the year for the area of land required to be rented according to the law on land. A labor-using unit that employs fifty percent or more ethnic minority workers relative to the total number of workers present at the unit shall have its land rental fee waived entirely for the year for the area of land required to be rented according to the law on land.
Article 4. Sources of Support
1. The central government budget will support one hundred percent of the costs related to training, health insurance, social insurance, unemployment insurance, and twenty percent of the common labor norm of the unit for allocating or paying wages to ethnic minority workers.
2. Training support funds will be directly provided to the labor-using unit according to the approved training plan by the provincial People's Committee for units under the province; by the Ministry or sector for units under the Ministry or sector; and by the Group or Corporation 91 for subordinate units.
State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.
1. The Ministry of Finance, in collaboration with the Ministry of Agriculture and Rural Development, will lead the implementation of this Decision.
2. The Ministry of Agriculture and Rural Development and the People's Committees of the Central Highlands provinces shall be responsible for monitoring, supervising, urging, inspecting, and directing the implementation.
Article 6. Effectiveness
1. This Decision takes effect from January 1, 2011.
2. This Decision replaces Decision No. 231/2005/QĐ-TTg dated September 22, 2005 of the Prime Minister concerning support for state-owned forestry enterprises, Specialized Forest Management Boards, and Protective Forest Management Boards employing ethnic minority workers who are legally residing in the Central Highlands provinces.
Article 7. Responsibility for Implementation
The Ministers of Ministries, Heads of ministerial-level agencies and agencies under the Government, Groups, Corporation 91, Chairmen of the People's Committees of Dak Lak, Dak Nong, Gia Lai, Kon Tum, and Lam Dong Provinces are responsible for enforcing this Decision./.
