CIRCULAR
AMENDMENTS AND SUPPLEMENTS TO CERTAIN ARTICLES OF CIRCULAR NO. 279/2016/TT-BTC DATED NOVEMBER 14, 2016 OF THE MINISTER OF FINANCE ON THE LEVELS OF FEES, REGIMES FOR COLLECTION, PAYMENT, MANAGEMENT, AND USE IN FOOD SAFETY WORK
Pursuant to the Law on Fees and Charges dated November 25, 2015;
Pursuant to the Decree No. 120/2016/NĐ-CP dated August 23, 2016 of the Government detailing and guiding the implementation of certain articles of the Law on Fees and Stamp Duties;
Pursuant to Decree No. 87/2017/NĐ-CP dated July 26, 2017, issued by the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Implementing Directive No. 11/CT-TTg dated March 4, 2020 of the Prime Minister on urgent tasks and solutions to address difficulties in production and business operations and ensure social welfare in response to the COVID-19 pandemic;
At the request of the Director of the Tax Policy Department;
The Minister of Finance hereby issues this Circular amending and supplementing certain articles of Circular No. 279/2016/TT-BTC dated November 14, 2016 on levels of fees, regimes for collection, payment, management, and use in food safety work.

1. Article 4 is amended and supplemented as follows:
"Article 4. Levels of Fees
The levels of fees in food safety work shall be as follows:
1. From August 12, 2020 to December 31, 2020, pay fees at 90% of the levels specified in the Fee Schedule accompanying this Circular.
2. From January 1, 2021 onwards, pay fees according to the levels specified in the Fee Schedule accompanying this Circular."
2. Clause 2 of Article 6 is amended and supplemented as follows:
"2. In cases where the entity collecting the fees is a public service organization or a state agency allocated operational costs from fee revenues pursuant to Clause 1 of Article 4 of Decree No. 120/2016/NĐ-CP dated August 23, 2016 of the Government, it may retain 70% of the collected fees to cover expenses for the items specified in Article 5 of Decree No. 120/2016/NĐ-CP dated August 23, 2016 of the Government. The remaining 30% shall be immediately paid into the State budget according to the chapters and sub-items of the current State budget classification."
Article 2. Effective Date
1. This Circular takes effect from August 12, 2020. The provisions stipulated in Clause 2 of Article 1 of this Circular take effect from October 1, 2020.
2. Abolish the following contents:
a) The Fee Schedule in Food Safety Work issued together with Circular No. 279/2016/TT-BTC dated November 14, 2016 of the Minister of Finance regulating levels of fees, regimes for collection, payment, management, and use in food safety work.
b) Circular No. 117/2018/TT-BTC dated November 28, 2018 of the Minister of Finance amending and supplementing certain articles of Circular No. 279/2016/TT-BTC dated November 14, 2016.
3. During the implementation process, if there are any difficulties, organizations and individuals are requested to promptly report to the Ministry of Finance for research and supplementary guidance.
