Circular No. 76/2014/TT-BGTVT Issuing Economic and Technical Standards in the Field of Providing Public Services Ensuring Maritime Safety

CIRCULAR

ISSUING ECONOMIC AND TECHNICAL STANDARDS IN THE FIELD OF

PROVIDING PUBLIC SERVICES TO ENSURE MARITIME SAFETY

Pursuant to the Maritime Code of Vietnam dated June 14, 2005;

Pursuant to Decree No. 107/2012/NĐ-CP dated December 20, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

Pursuant to Decree No. 21/2012/NĐ-CP dated March 21, 2012 of the Government on management of seaports and maritime channels;

Pursuant to Decree No. 130/2013/NĐ-CP dated October 16, 2013 of the Government on production and supply of public goods and services;

At the proposal of the Director of the Infrastructure Department and the Director of the Vietnam Maritime Administration,

The Minister of Transport issues this Circular to establish economic and technical standards in the field of providing public services to ensure maritim safety.

Article 1. Accompanying this Circular are 10 sets of economic and technical standards in the field of providing public services to ensure maritim safety, specifically:

1. Economic and technical standards for managing and operating maritime navigation lights.

2. Economic and technical standards for managing and operating maritime channels.

3. Economic and technical standards for supply operations.

4. Economic and technical standards for maintaining and repairing maritime signaling equipment.

5. Economic and technical standards for repairing maritime buoys.

6. Economic and technical standards for replacing, deploying, adjusting, and retrieving maritime buoys.

7. Economic and technical standards for fuel consumption.

8. Economic and technical standards for repairing generators.

9. Economic and technical standards for repairing watercraft.

10. Economic and technical standards for manufacturing new maritime buoys.

Article 2

1. This Circular applies to agencies, organizations, and individuals related to the provision of public services to ensure maritim safety.

2. For newly generated channel routes, vessels, equipment, and work items within the structure of products and public services to ensure maritim safety that are not specified in the accompanying sets of economic and technical standards, the organization assigned to produce and provide such public services shall develop economic and technical standards, submit them to the Vietnam Maritime Administration for review, and present them to the Ministry of Transport for approval before implementation.

Article 3. This Circular takes effect from February 5, 2015, and replaces Circular No. 02/2011/TT-BGTVT dated February 14, 2011, issued by the Minister of Transport on establishing economic and technical standards in the field of providing public services to ensure maritim safety.

Article 4. The Director of the Ministry's Office, the Inspector General of the Ministry, Heads of Departments, Directors of the Vietnam Maritime Administration, General Directors of the Northern and Southern Vietnam Maritime Safety Assurance Corporations, and Heads of relevant agencies, organizations, and individuals are responsible for implementing this Circular./.
