Directive No. 766/TTg on assigning responsibilities to implement measures to prevent the illegal exportation of women and children abroad

DIRECTIVE

On Allocation of Responsibilities to Implement Measures to Prevent the Illegal Exportation of Women and Children Abroad.

In recent years, the situation of buying and selling women and children for illegal exportation abroad has become severe. Although relevant agencies have actively cooperated with People's Committees at all levels to detect, arrest, and handle many individuals involved in trafficking women and girls for prostitution abroad or forced marriage to foreigners, the situation remains complex.

To promptly and effectively prevent this crime and ultimately eliminate it completely, the Prime Minister requests that ministries, sectors, and local People's Committees strictly implement the following specific tasks as allocated:

1. Ministry of Interior:

- Lead and coordinate with related ministries and sectors (Defense, Foreign Affairs, Labor - Invalids and Social Affairs, Justice, Education and Training, Committee for Child Protection and Care...) and provincial and municipal people's committees to thoroughly grasp the situation and fully compile statistics on Vietnamese women and children illegally exported abroad (including for the purpose of prostitution or forced foreign marriages and those who have fled abroad).

- Identify key areas, focus on directing police forces at all levels to strengthen investigative measures to detect, prevent, and dismantle organizations illegally exporting women and children abroad. Strictly manage household registration and population records at commune, ward, and town levels; coordinate with the Vietnam Fatherland Front and mass organizations to launch campaigns mobilizing the public to participate in preventing and combating individuals violating the law or facilitating such offenses.

Together with related sectors and local people's committees, inspect and eliminate matchmaking service bases and friendship organizations with foreigners, and handle tourism service establishments violating the law in exporting people abroad.

- Strengthen organizational structure and increase specialized staff to promptly detect, quickly investigate, and severely handle organizations and individuals, particularly the masterminds and leaders, involved in illegally exporting women and children for prostitution or forced foreign marriages.

- Coordinate with Border Guard Forces to strengthen border control measures and effectively combat illegal exportation of women and children across borders.

- Coordinate with Interpol and neighboring countries' police forces, especially China and Cambodia, to detect, prevent, and eliminate organizations trafficking women and children.

- Lead and coordinate with the Ministries of Foreign Affairs, Justice, and Labor - Invalids and Social Affairs to develop a plan to prevent the crime of trafficking women and children, and reintegrate women and children who have returned from being illegally exported abroad.

2. Ministry of Foreign Affairs:

- Coordinate with the Ministry of Public Security on political external affairs in international cooperation against this crime. Prepare appropriate strategies to work with international organizations and related countries regarding the issue of eliminating the illegal exportation of Vietnamese women and children abroad.

- Coordinate with mass organizations in mobilizing non-governmental organizations abroad to participate in addressing this situation.

3. Ministry of Labor - Invalids and Social Affairs:

- Lead and coordinate with the Ministry of Public Security, Ministry of Health, Vietnam Committee for Child Protection and Care, Central Vietnam Women's Union, and local people's committees at all levels to develop a plan to provide vocational training and employment for women and children who have been illegally exported abroad and have returned; and place those suffering from social diseases in educational and treatment facilities.

4. Ministry of Justice:

- Lead and coordinate with the Ministry of Public Security, Supreme People's Procuracy, and Supreme People's Court to review current legal regulations related to this matter, propose amendments and supplements to align with the current situation. In the short term, issue a Joint Circular of the Procuracy, Justice, Public Security, and Courts to guide levels in investigating, prosecuting, and adjudicating this type of crime seriously.

- Lead and coordinate with the Ministry of Foreign Affairs and the Ministry of Public Security to draft a Judicial Assistance Agreement with China and Cambodia, including provisions to address this issue.

5. Ministry of Trade and the General Administration of Tourism coordinate with the Ministry of Public Security, provincial and municipal people's committees, and related sectors to strictly manage tourism services and entry-exit activities to detect and prevent the activities of domestic and foreign entities organizing the illegal exportation of women and children abroad.

Coordinate with the Ministry of Public Security to inspect and severely handle service establishments using the guise of organizing overseas tours to illegally export Vietnamese women and children for prostitution or sale to foreigners.

6. Ministry of Culture and Information leads and coordinates with the Vietnam Committee for Child Protection and Care, Central Vietnam Fatherland Front, Central Vietnam Women's Union, other mass organizations, and media outlets to disseminate information through mass media and conduct direct education and propaganda to inform the public about the tactics of traffickers, prevention, and reporting of crimes; strongly condemn violations.

7. Ministry of Planning and Investment, Ministry of Finance allocate budgets to fund anti-trafficking efforts and the reintegration of victims into society.

8. Chairmen of provincial and municipal people's committees enhance guidance and create conditions for local police forces and related sectors to implement coordinated border management plans, strictly manage household registration and population records, and proactively prevent and combat trafficking of women and children. Direct the Departments of Labor - Invalids and Social Affairs and Health to develop plans to strengthen and strictly manage compulsory medical facilities, effectively collect and train women. Closely inspect cases of issuing licenses for matchmaking services, service provision, and adoption in localities.

9. The Ministers, Heads of ministerial-level agencies, Heads of government agencies, and Chairpersons of provincial People's Committees under the direct control of the central government shall be responsible for organizing the implementation of this Directive.

The Ministry of Home Affairs shall take the lead in coordinating with the Ministry of Labor, Invalids, and Social Affairs to monitor, urge, and implement this Directive, and regularly report the results to the Prime Minister.
