THE MINISTER OF FINANCE

Pursuant to Decree No. 57/2002/ND-CP dated June 3, 2002 of the Government detailing the implementation of the Ordinance on Fees and Charges; Decree No. 24/2006/ND-CP dated March 6, 2006 of the Government amending and supplementing certain articles of Decree No. 57/2002/ND-CP dated June 3, 2002 of the Government detailing the implementation of the Ordinance on Fees and Charges;

Pursuant to Decision No. 135/2007/QD-TTg dated August 17, 2007 of the Prime Minister promulgating the Regulation on visa exemptions for overseas Vietnamese;

Pursuant to Decree No. 77/2003/ND-CP dated July 1, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

After receiving opinions from the Ministry of Public Security and upon the proposal of the Director of the Tax Policy Department,

DECISION:

Article 1. Overseas Vietnamese and foreigners who are spouses, children, or parents of Vietnamese citizens or overseas Vietnamese must pay the fee for processing applications for visa-exemption certificates according to the provisions of this Decision.

In case the visa-exemption certificate is revoked, the fee for processing the application will not be refunded.

Article 2. The level of the fee for processing applications for visa-exemption certificates is 20 USD per person for the first issuance; 10 USD per person for subsequent issuances.

Article 3. The revenue from the fee for processing applications for visa-exemption certificates as stipulated in this Decision is a state budget revenue item, managed and utilized as follows:

- The fee collecting agency (Vietnamese representative offices abroad, the Immigration Administration under the Ministry of Public Security) is entitled to retain 30% (thirty percent) of the collected fees to cover costs related to the processing of applications and the collection of fees in accordance with Clause 8 of Circular No. 45/2006/TT-BTC dated May 25, 2006 of the Ministry of Finance amending and supplementing Circular No. 63/2002/TT-BTC dated July 24, 2002 of the Ministry of Finance guiding the implementation of laws on fees and charges.

- The remaining 70% (seventy percent) of the fee collected by the agency must be deposited into the state budget according to the current state budget classification. The amount deposited into the state budget shall be allocated among different levels of the budget in accordance with the State Budget Law.

Article 4. Other contents related to the collection, submission, management, use, payment receipts, and publicizing the fee collection system not mentioned in this Decision shall be implemented in accordance with the guidance provided in Circular No. 63/2002/TT-BTC dated July 24, 2002 guiding the implementation of laws on fees and charges and Circular No. 45/2006/TT-BTC dated May 25, 2006 amending and supplementing Circular No. 63/2002/TT-BTC dated July 24, 2002 guiding the implementation of laws on fees and charges.

Article 5. This Decision takes effect fifteen days after its publication in the Official Gazette.

Article 6. During the implementation period, if there are any difficulties, organizations and individuals are requested to promptly report them to the Ministry of Finance for further study and supplementary guidance./.
