ISSUING REGULATIONS ON TRAINING AND ISSUANCE OF CERTIFICATES FOR MASTER, ENGINEER, SEAMAN'S BUSINESS SKILLS, AND MARINE MECHANIC ON FISHING VESSELS

THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT
Based on the Fisheries Law dated November 26, 2003;
Pursuant to the Education Law dated June 14, 2005;
Pursuant to Decree No. 01/2008/ND-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
BASED ON THE GOVERNMENT DECREE NO. 123/2006/ND-CP OF OCTOBER 27, 2006 ON MANAGEMENT OF FISHERY ACTIVITIES BY ORGANIZATIONS AND INDIVIDUALS OF VIETNAM IN MARITIME AREAS;
BASED ON THE GOVERNMENT DECREE NO. 66/2005/ND-CP OF MAY 19, 2005 ON SAFETY ASSURANCE FOR PERSONNEL AND FISHING VESSELS ENGAGED IN FISHERY ACTIVITIES;
BASED ON THE GOVERNMENT DECREE NO. 75/2006/ND-CP OF AUGUST 2, 2006 PROVIDING DETAILED PROVISIONS AND GUIDELINES FOR IMPLEMENTATION OF CERTAIN ARTICLES OF THE EDUCATION LAW;
Considering the proposal of the Director of the Department of Organization and Cadres.
DECISION:
Article 1. ATTACHED TO THIS DECISION ARE THE REGULATIONS ON TRAINING AND ISSUANCE OF CERTIFICATES FOR MASTER, ENGINEER, SEAMAN'S BUSINESS SKILLS, AND MARINE MECHANIC ON FISHING VESSELS (HEREINAFTER REFERRED TO AS FISHING VESSEL CERTIFICATES).
Article 2. THIS DECISION SHALL TAKE EFFECT 15 DAYS AFTER ITS PUBLICATION IN THE OFFICIAL GAZETTE. PREVIOUS REGULATIONS OF THE MINISTRY OF FISHERIES (OLD MINISTRY) CONCERNING TRAINING AND ISSUANCE OF MASTER AND ENGINEER CERTIFICATES AND SEAMAN'S BUSINESS SKILLS TRAINING CERTIFICATES FOR FISHING VESSELS THAT CONTRADICT THE REGULATIONS ATTACHED TO THIS DECISION SHALL BE ABOLISHED (LISTED AT ANNEX 7).
Article 3. THE HEAD OF THE MINISTRY’S OFFICE, DIRECTORS OF THE DEPARTMENT OF ORGANIZATION AND STAFF, HEADS OF RELATED UNITS UNDER THE MINISTRY, HEADS OF ESTABLISHMENTS PERMITTED TO ORGANIZE TRAINING, PRINT BLANK CERTIFICATES, AND ISSUE FISHING VESSEL CERTIFICATES, DIRECTORS OF PROVINCE AGRICULTURE AND RURAL DEVELOPMENT DEPARTMENTS, AND RELATED ORGANIZATIONS AND INDIVIDUALS SHALL BE RESPONSIBLE FOR ENFORCING THIS DECISION./.
