Based on the Law on the Organization of the Government dated December 25, 2001;

Pursuant to the Employment Law dated November 26, 2013;

On the basis of The Vocational Training Law dated November 29, 2006;

At the proposal of the Minister of Labor, Invalids and Social Affairs,

The Prime Minister issues this Decision to provide the level of vocational training support for workers participating in unemployment insurance.

Article 1. Scope of Regulation

This Decision provides the level of vocational training support for workers participating in unemployment insurance.

Article 2. Applicability

1. Workers participating in unemployment insurance and meeting the conditions for vocational training support as stipulated in Article 55 of the Employment Law.

2. Agencies, organizations, enterprises registered to operate vocational training activities in accordance with the laws on vocational training (hereinafter referred to collectively as vocational training institutions) shall provide vocational training to workers participating in unemployment insurance.

Provincial Departments of Labor, Invalids and Social Affairs; Vietnam Social Security; Employment Service Centers established by state management agencies for employment; and other relevant agencies involved in providing vocational training support to workers.

Article 3. Level of vocational training support

1. The maximum level of vocational training support for workers participating in unemployment insurance is VND 1,000,000 (one million dong) per person per month. The specific level of support is calculated monthly based on the type of trade, tuition fees, and actual duration of vocational training as prescribed by the vocational training institution.

In cases where workers participating in vocational training have partial days that do not constitute a full month according to the vocational training institution's regulations, these partial days will be rounded up to one month to determine the level of vocational training support.

2. For workers participating in unemployment insurance who enroll in vocational training courses with higher training costs than the prescribed vocational training support level under Clause 1 of this Article, the excess amount must be paid by the worker themselves.

Article 4. Implementation funds

The funding for implementing vocational training support is provided by Vietnam Social Security from the Unemployment Insurance Fund.

Article 5. Effectiveness and Responsibility for Implementation

1. This Decision takes effect from February 10, 2015.

a) The level of vocational training support as prescribed in this Decision shall apply from January 1, 2015.

b) Workers who have submitted applications for unemployment benefits or who have received decisions granting unemployment benefits before January 1, 2015 and wish to participate in vocational training after January 1, 2015 shall be subject to the provisions of this Decision.

c) Workers who have received vocational training support decisions before January 1, 2015 shall not be subject to the provisions of this Decision.

2. Decision No. 55/2013/QĐ-TTg dated October 3, 2013 of the Prime Minister regarding the level of vocational training support for workers receiving unemployment benefits shall cease to be effective from the date this Decision takes effect.

3. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of provincial People's Committees directly under the Central Government are responsible for enforcing this Decision./.
