Based on the Vocational Training Law dated November 29, 2006;
Based on Decree No. 127/2008/NĐ-CP dated December 12, 2008 of the Government detailing and guiding the implementation of certain provisions of the Social Insurance Law regarding unemployment insurance;
Based on Decree No. 100/2012/NĐ-CP dated November 21, 2012 of the Government amending and supplementing certain provisions of Decree No. 127/2008/NĐ-CP;

The Prime Minister issues this Decision to regulate the level of vocational training support for workers receiving unemployment benefits,
Article 1. Scope of Regulation
This Decision regulates the level of vocational training support for workers receiving unemployment benefits.
Article 2. Applicability
1. Workers receiving unemployment benefits as stipulated by the Social Insurance Law.
2. Vocational training centers, intermediate vocational schools, higher vocational schools; intermediate specialized schools, colleges, universities, other educational institutions as prescribed by laws on education; employment service centers under the Department of Labor, Invalids and Social Affairs of provinces and centrally-administered cities; enterprises, cooperatives, production, business, service establishments that have registered to conduct vocational training activities according to laws on vocational training (hereinafter referred to collectively as vocational training institutions) participate in providing vocational training to workers receiving unemployment benefits.
3. Departments of Labor, Invalids and Social Affairs of provinces and centrally-administered cities; social insurance agencies and relevant agencies involved in supporting vocational training for workers.
Article 3. Levels, duration, and methods of vocational training support
1. Level of vocational training support for workers receiving unemployment benefits:
a) For those participating in vocational training courses up to three months: Maximum support level is VND 3 million/person/course; specific support levels are calculated monthly, depending on each trade and actual training time.
b) For those participating in vocational training courses over three months: Maximum support level is VND 600,000/person/month; specific support levels are calculated monthly, depending on each trade and actual training time.
2. For workers receiving unemployment benefits who participate in vocational training with training costs exceeding the vocational training support levels prescribed in Clause 1 of this Article, the excess amount shall be borne by the worker themselves.
3. Duration of vocational training support depends on the training period of each trade and the needs of each worker, but not exceeding six months.
Workers receiving unemployment benefits who participate in vocational training are supported with funding to learn one trade and once, implemented through vocational training institutions; direct cash support to workers for self-study is not provided.
Article 4. Implementation funds
Funding for implementing vocational training support is paid from the unemployment insurance fund by the Vietnam Social Security.
State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.
The Ministry of Labor, Invalids and Social Affairs takes the lead, coordinating with the Ministry of Finance and related agencies to guide the implementation of this Decision.
Article 6. Effectiveness and Responsibility for Implementation
1. This Decision comes into effect from December 1, 2013, replacing previous regulations on vocational training support levels for workers receiving unemployment benefits.
2. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees directly under the central government are responsible for implementing this Decision./.
