SOCIALIST REPUBLIC OF VIET NAM
BASED ON THE CONSTITUTION OF THE SOCIALIST REPUBLIC OF VIETNAM IN 1992 AS AMENDED AND COMPLEMENTED BY RESOLUTION NO. 51/2001/QH10;
Pursuant to the Law on the Organization of the People's Courts No. 33/2002/QH10;
Pursuant to the Ordinance on the Organization of the Military Courts No. 04/2002/PL-UBTVQH11;
Considering the proposal of the President of the Supreme People's Court,
RESOLUTION:
Article 1. Supplement 1,500 (one thousand five hundred) positions for People's Courts at all levels in 2009 and 2010, including 508 (five hundred eight) judges of People's Courts at district, city district, provincial city level. The total staffing quota of People's Courts at all levels is 13,524 (thirteen thousand five hundred twenty-four) people, including 5,436 (five thousand four hundred thirty-six) judges of People's Courts at all levels, specifically as follows:
1. Supplement 119 (one hundred nineteen) positions for the Supreme People's Court. The staffing quota of the Supreme People's Court is 722 (seven hundred twenty-two) people. Maintain the number of judges of the Supreme People's Court at 120 (one hundred twenty) people as stipulated in Resolution No. 716/2004/NQ-UBTVQH11 dated June 18, 2004 of the Standing Committee of the National Assembly.
2. Supplement 112 (one hundred twelve) positions for People's Courts at provincial and centrally-administered city level. The staffing quota of People's Courts at provincial and centrally-administered city level is 3,711 (three thousand seven hundred eleven). Maintain the number of judges of People's Courts at provincial and centrally-administered city level at 1,118 (one thousand one hundred eighteen) people as stipulated in Resolution No. 716/2004/NQ-UBTVQH11 dated June 18, 2004 of the Standing Committee of the National Assembly.
3. Supplement 1,269 (one thousand two hundred sixty-nine) positions for People's Courts at district, city district, provincial city level, including 508 (five hundred eight) judges. The staffing quota of People's Courts at district, city district, provincial city level is 9,091 (nine thousand ninety-one) people, including 4,198 (four thousand one hundred ninety-eight) judges.
Article 2. Maintain the staffing quota of Military Courts at all levels at 315 (three hundred fifteen) people, including the number of judges of Military Courts at all levels at 141 (one hundred forty-one) people as stipulated in Resolution No. 716/2004/NQ-UBTVQH11 dated June 18, 2004 of the Standing Committee of the National Assembly, including:
1. Central Military Court is 54 (fifty-four) people, including the number of judges of the Central Military Court is 19 (nineteen) people.
2. Military Court of Military Region and equivalent is 108 (one hundred eight) people, including the number of judges of Military Court of Military Region and equivalent is 54 (fifty-four) people.
3. Military Court of Military Zone is 153 (one hundred fifty-three) people, including the number of judges of Military Court of Military Zone is 68 (sixty-eight) people.
Article 3. The implementation of the staffing quota of People's Courts and Military Courts at all levels as prescribed in Article 1 and Article 2 of this Resolution must ensure the correct structure of positions, standards, and procedures for recruitment and appointment as provided by law. Annually, the Supreme People's Court shall be responsible for reporting the implementation of the Resolution to the Standing Committee of the National Assembly.
Article 4
1. This Resolution takes effect from March 1, 2009.
2. The President of the Supreme People's Court and the Minister of National Defense within their respective duties and authorities shall be responsible for implementing this Resolution./.
