OF THE MINISTRY OF FINANCE NUMBER 7779/TC-HCSN DATED JULY 29, 2003
ON THE USE OF BUDGET FUNDS AND MANAGEMENT OF STATE ASSETS

 

Dear: - Ministries, ministerial-level agencies, and government-affiliated agencies

- People's Committees of provinces and centrally-administered cities

 

To implement the policy of gradually monetizing salaries, since 1993 the Government has issued Decree No. 25/CP dated May 23, 1993 to temporarily establish a new salary system for civil servants, administrative officials, public service staff, and military personnel; as a result, certain provisions providing material benefits such as housing standards and furniture... have been abolished. To ensure uniform management and proper use of state assets, the Government has issued Decree No. 14/1998/NĐ-CP dated March 6, 1998 on the management of state assets; Article 8, Clause 1 of the Decree stipulates: "State assets in administrative and public service sectors must be used for their intended purposes according to regulations, standards, and quotas; they shall not be used for personal or business purposes or other purposes except as otherwise provided by law."

However, recently through inspection activities at some agencies and units, the Ministry of Finance has found that there are still cases where budget funds are being used to repair and purchase equipment for use in private residences of leaders under the guise of loans; this practice is contrary to current regulations.

To correct improper use of state budget funds and management of public assets, the Ministry of Finance proposes:

- Administrative agencies and public service units strictly adhere to regulations on managing state assets and shall not use their unit's funds for repairing, renovating, or purchasing equipment for private residences of leaders in any form (except for fixed-line telephones at home according to current provisions).

- Heads of ministries, ministerial-level agencies, government-affiliated agencies, Chairmen of People's Committees of provinces and centrally-administered cities instruct subordinate units to check the use of funds within their agencies and localities to ensure proper use in accordance with prescribed standards. In cases where improper use of state budget funds is discovered, measures should be taken to recover and return such funds to the state treasury and disciplinary actions should be imposed on individuals involved.

- Financial departments at all levels and State Treasury offices must control expenditures to ensure compliance with regulations for using state budget funds; they shall firmly refuse payment and recovery of improperly spent amounts.
