Article 1. Position and Functions

The Civil Servant - Public Officer Department is an organization under the Ministry of Home Affairs, with the function of advising the Minister to implement state management over the cadre, civil servant, and public officer workforce.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

1. Assist the Minister in drafting laws, ordinances, regulatory legal documents on cadres, civil servants, public officers, and reserve civil servants for submission to competent authorities for issuance;

2. Develop plans and programs for building and developing the cadre, civil servant, and public officer workforce, including reserve civil servants, and guide their implementation upon approval by competent authorities;

3. Draft decisions on the structure of administrative civil service grades to be submitted to the Minister for issuance. Guide ministries, ministerial-level agencies, government agencies, provincial committees, and centrally governed city committees (hereinafter referred to collectively as ministries and provinces) in developing the structure of public officer grades;

4. Draft proposals for the Minister to submit to the Prime Minister for the division of responsibilities and delegation of authority in managing cadres, civil servants, public officers, and reserve civil servants;

5. Draft systems of positions and standards for administrative civil service grades to be submitted to the Minister for issuance. Guide ministries in drafting positions and standards for specialized civil service grades and public officer grades to be issued by the Minister of Home Affairs;

6. Draft regulations on recruitment, promotion, appointment, transfer, utilization, deployment, assignment, rotation, resignation, dismissal, evaluation, reward, punishment, retirement, and policies for cadres, civil servants, public officers, and reserve civil servants, including state enterprise managers (including Board of Directors, General Director, Deputy General Director, Director, Deputy Director, Chief Accountant);

7. Review personnel matters for cadre, civil servant, and public officer positions presented by ministries, provinces, and state enterprises to the Prime Minister, and for positions delegated by the Prime Minister to the Minister of Home Affairs for decision or agreement;

8. Lead the organization of examinations for grade promotions:

a) From Senior Specialist to Senior Specialist (High Rank) and equivalent;

b) From Specialist to Senior Specialist;

c) Guide, inspect, and supervise ministries, sectors, and provinces in organizing examinations for grade promotions from the Specialist level downwards;

9. Appoint grades and reclassify grades for cadres, civil servants, and public officers holding leadership positions within the Prime Minister's jurisdiction; for those entering the Senior Specialist (High Rank) grade; participate in discussions with the Salary Department regarding grade reclassification and promotion for these individuals;

10. Aggregate and statistically analyze the cadre, civil servant, and public officer workforce, including reserve civil servants; apply information technology in professional work; coordinate with the Information Technology Center to apply information technology in management, exploitation, and utilization of data to serve leadership and management by the Ministry;

11. Submit pilot project proposals within its area of responsibility to the Minister for approval and organize their implementation thereafter;

12. Uniformly manage identification numbers, cards, and files for civil servants, public officers, and reserve civil servants;

13. Organize visits and condolences for senior cadres, civil servants, public officers, and their relatives when they are ill or deceased, following directives from the Minister and national regulations;

14. Inspect and participate in audits concerning the implementation of regulations on recruitment, grade promotion, appointment, transfer, utilization, deployment, assignment, rotation, resignation, dismissal, evaluation, reward, punishment, retirement, and policies for cadres, civil servants, public officers, and reserve civil servants;

15. Lead or coordinate in resolving complaints and appeals related to cadre, civil servant, and public officer management, including reserve civil servants, according to the division of responsibilities by the Ministry and legal provisions;

16. Lead or participate in scientific research projects and professional training on civil servants and public service. Organize domestic and international conferences on civil servants and public service according to the Minister's directives;

17. Perform other tasks assigned by the Minister;

Article 3. Organization and Working System

1. The Department has a Director, several Deputy Directors, and civil servants;

2. The Director shall be responsible to the Minister for organizing and implementing the tasks specified in Article 2 and shall have the following specific duties and powers:

a) Organizing and directing the implementation of the Department's tasks and being accountable to the Minister for all aspects of the Department's work;

b) Assigning tasks, supervising, urging, and inspecting the implementation of tasks by Deputy Directors and civil servants in the Department;

c) Sign on behalf of the Minister to respond, clarify, provide guidance on professional matters, and request information from organizations and individuals regarding the management of the cadre, civil servant, and public officer workforce, including reserve civil servants;

d) Coordinate with organizations within the Ministry and relevant agencies in resolving issues related to the Department's functions, tasks, and powers;

đ) Implement information dissemination for civil servants in the Department according to the Ministry's working regulations;

e) Decide on the contents of reports, summaries, conclusions, and recommendations to the Minister regarding policies and solutions in implementing the Department's tasks;

f) Implement the Ministry's regulations; manage civil servants and assets allocated according to the Ministry's delegation;

3. Deputy Directors perform professional tasks and assist the Director in overseeing one or more aspects of work as assigned by the Director; are responsible to the Director for the tasks assigned;

4. Civil servants carry out professional tasks assigned by the Director and are responsible to the Director for their execution;

5. The Department operates under a specialist system combined with a chief executive system; in cases where the Ministry leadership directly works with Deputy Directors or specialists, Deputy Directors and specialists are responsible for implementing the leadership's opinions and promptly reporting back to the Director;

Article 4. Effectiveness and Responsibility for Implementation

1. This Decision takes effect fifteen days from the date of signing;

2. The Ministry's Office Director, Director of the Civil Servant - Public Officer Department, Director of the Cadre Organization Department, heads of related organizations under the Ministry, and civil servants are responsible for implementing this Decision.
