The Prime Minister issues this Decision on the List and Schedule for Energy-Consuming Equipment and Devices to be Phased Out and Low-Efficiency Power Generation Units that Shall Not Be Newly Constructed,

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Law on Rational and Efficient Energy Use dated June 28, 2010;

Pursuant to Decree No. 21/2011/NĐ-CP dated March 29, 2011 of the Government detailing and providing implementation measures for the Law on Rational and Efficient Energy Use;

Pursuant to the proposal of the Minister of Science and Technology;

Issuing the List of Energy-Consuming Equipment and Devices with Low Efficiency to be Phased Out and Low-Efficiency Power Generation Units that Shall Not Be Newly Constructed, including:

Article 1. 1. Household appliances group: Fluorescent tube lamps, compact fluorescent lamps, ballasts (electronic and electromagnetic) for fluorescent lamps, household refrigerators, household washing machines, rice cookers, electric fans, hot water storage tanks.

2. Industrial equipment group: Distribution transformers, electric motors, industrial boilers.

3. Coal and gas-fired power generation units in thermal power plants.

Importation and production of equipment with lower energy efficiency than the minimum energy performance standards are prohibited:

Article 2. 1. For the household appliances group:

Energy efficiency must not be lower than the minimum energy performance standards specified in the following National Technical Regulations (NTRs):

a) Compact fluorescent lamps: NTR 7896:2008;

b) Fluorescent tube lamps: NTR 8249:2009;

c) Electronic ballasts for fluorescent lamps: NTR 7897:2008;

d) Electromagnetic ballasts for fluorescent lamps: NTR 8248:2009;

đ) Refrigerators: NTR 7828:2013;

e) Household washing machines: NTR 8526:2010;

g) Rice cookers: NTR 8252:2009;

h) Electric fans: NTR 7826:2007;

i) Hot water storage tanks: NTR 7898:2009.

2. For the industrial equipment group:

a) Distribution transformers: NTR 8525:2010;

a) Compact fluorescent lamps: NTR 7896:2008;

b) Electric motors: NTR 7450-1:2005;

c) Industrial boilers: NTR 8630:2010.

New construction of coal and gas-fired power generation units using outdated technology with an efficiency at the time of commercial operation lower than the minimum efficiency specified below is prohibited:

Article 3. 1. For coal-fired power generation units, gross efficiency based on heat value at rated capacity, standardized to inlet cooling water temperature of 28°C and ambient temperature of 30°C, must not be lower than the following values:

- Units with rated capacity ≥ 50MW and < 150MW: 34%

- Units with rated capacity ≥ 150MW and < 300MW: 38%

- Units with rated capacity ≥ 300MW and < 600MW: 39%

- Units with rated capacity ≥ 600MW and < 800MW: 41%

- Units with rated capacity ≥ 800MW: 43%

2. For gas-fired power generation units using simple cycle gas turbine technology, the gas turbine efficiency (ISO conditions) must not be lower than the following:

- Units with rated capacity ≥ 100MW and < 150MW: 33%

- Units with rated capacity ≥ 150MW and < 200MW: 34%

- Units with rated capacity ≥ 200MW and < 300MW: 37%

- Units with rated capacity ≥ 300MW: 39%

3. For gas-fired power generation units using combined cycle gas turbine technology, the combined cycle gas turbine efficiency (ISO conditions) according to single gas turbine unit capacity must not be lower than the following:

- Units with rated capacity ≥ 100MW and < 150MW: 49.5%

- Units with rated capacity ≥ 150MW and < 200MW: 51.0%

- Units with rated capacity ≥ 200MW and < 300MW: 55.5%

- Units with rated capacity ≥ 300MW: 58.5%

Strictly prohibit the import of old and outdated equipment for power plants whose unit capacity falls outside the provisions of Article 3 of this Decision; permission for construction of these power plants will be reviewed and approved by competent authorities on a project-by-project basis.

Article 4. Implementation schedule

Article 5. 1. For household appliances and industrial equipment:

From January 1, 2015, importation and production of equipment with lower energy efficiency than the minimum energy performance standards are prohibited.

2. After this Decision takes effect, approval of investment proposals for coal and gas-fired thermal power plants with lower efficiency than the minimum efficiency specified in Article 3 of this Decision is prohibited.

a) To take the lead and coordinate with ministries, ministerial-level agencies, government agencies, provincial people's committees under the central government to guide, inspect, and supervise the implementation of this Decision;

Article 6. Implementation

1. Ministry of Science and Technology:

b) Based on economic and social development conditions and management requirements during each period, to take the lead and coordinate with relevant ministries and sectors to submit to the Prime Minister for supplementation and amendment of the List of Energy-Consuming Equipment and Devices to be Phased Out and Low-Efficiency Power Generation Units that Shall Not Be Newly Constructed.

a) To take the lead and coordinate with the Ministry of Science and Technology to guide, inspect, and supervise the elimination of energy-consuming equipment and devices and low-efficiency power generation units that shall not be newly constructed as stipulated in this Decision;

2. The Ministry of Industry and Trade:

b) To take the lead and coordinate with the Ministries of Finance, Planning and Investment, and Science and Technology to implement and deploy support measures for the elimination of energy-consuming equipment and devices and low-efficiency power generation units that shall not be newly constructed as stipulated in this Decision.

3. Ministries, sectors, and localities, based on their scope and authority of management, shall take the lead in eliminating energy-consuming equipment and devices and low-efficiency power generation units listed in the prohibition from being newly constructed.

This Decision shall take effect from February 10, 2014.

Article 7. Ministers, heads of ministerial-level agencies, heads of government agencies, chairpersons of provincial people's committees under the central government, heads of agencies, units, organizations, and individuals related to this Decision are responsible for its implementation./.

Article 8. The Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial People's Committees under the central government, Heads of agencies, units, organizations, and relevant individuals are responsible for implementing this Decision./.
