JOINT MINISTRY OF FINANCE - LABOR, INVALIDS AND SOCIAL AFFAIRS

Guidelines for Implementing Funds for Martyrs' Graves Work

Pursuant to Article 15 and Article 18 of Decree No. 28/CP dated April 29, 1995 of the Government on the settlement of issues related to the graves of martyrs who died during various periods of resistance and national defense; the Joint Ministry of Finance - Labor, Invalids and Social Affairs guides the implementation of funds for the work of martyrs' graves as follows:

I. SURVEYING AND SEARCHING FOR MARTYRS' GRAVES

1. The subjects conducting surveys and searching for martyrs' graves are areas with intense combat, long-term battles, mountainous districts, remote areas, bases of resistance, and rear areas.

2. Contents and levels of expenditure for surveying and searching for graves include:

a. Allowance for those guiding the way, up to VND 25,000/person/day

b. Allowance for cadres directly involved in surveying and searching for graves, VND 25,000/person/day (in addition to travel expenses)

c. Expenditure for transportation tickets and conveyance means

d. Purchase of tools for excavation and search activities

e. Purchase of common medicines and anti-malaria drugs (if necessary)

The expenditures mentioned in points c, d, and e above shall be calculated based on actual occurrences (if any).

II. SUPPORT FOR RELATIVES OF MARTYRS VISITING MARTYRS' GRAVES

1. For departure locations: Relatives of martyrs (father, mother, wife, husband, children, persons who have raised the martyr, siblings) if they are granted a certificate by the People's Committee at their place of residence or the Department of Labor, Invalids and Social Affairs authorized by the People's Committee to visit the grave of the martyr according to the list announced by the Department of Labor, Invalids and Social Affairs, and if their family circumstances are truly difficult, they will be supported by the local People's Committee for part of the expenses for visiting the grave.

2. For arrival locations (the locality where the martyr's grave is located):

a. The Department of Labor, Invalids and Social Affairs has the responsibility to guide and assist relatives of martyrs in visiting the grave of the martyr.

b. If relatives visiting the grave of the martyr stay for a long time and incur significant expenses and encounter difficulties, the local Department of Labor, Invalids and Social Affairs may provide a one-time subsidy for a maximum of three people at the location visited as follows:

Subsidy for meals, VND 12,000/person/day, maximum not exceeding four days.

Partial subsidy for transportation tickets according to ordinary means of transport to return home, in cases of extreme difficulty, full transportation tickets may be provided but must be approved by the Director of the Department of Labor, Invalids and Social Affairs or the Chairman of the People's Committee of the district, city where the visit takes place.

III. STATISTICAL WORK AND THE ESTABLISHMENT OF A LIST OF MARTYRS' GRAVES

1. Provincial Departments of Labor, Invalids and Social Affairs are responsible for establishing, retaining, and sending lists of martyrs' graves under their management in local cemeteries according to the guidelines in Circular No. 95/TBLS-CV dated January 8, 1994 of the Ministry of Labor, Invalids and Social Affairs to serve the announcement of martyrs' graves as stipulated in Article 15 of Decree No. 28/CP dated April 29, 1995 of the Government.

2. The cost for statistical work, retention, and reporting of the list of martyrs' graves averages VND 500/grave.

IV. SOURCES OF FUNDS FOR THE WORK ON MARTYRS' GRAVES

1. The funds for the work on martyrs' graves mentioned in points a, b, c, d, and e of Section 2, Part I; point b of Section 2, Part II; and Section 2, Part III are guaranteed from the central budget through social assistance funds announced annually by the State. Labor, Invalids and Social Affairs agencies at all levels base their budget estimates for the work on martyrs' graves and quarterly and annual social assistance budgets on the tasks assigned by competent authorities and the aforementioned expenditure levels, and settle accounts according to the guidelines in Circular No. 25/TT-LB dated October 24, 1994 of the Joint Ministry of Labor, Invalids and Social Affairs - National Defense - Finance.

2. The funds for the work on martyrs' graves mentioned in Section 1, Part II are guaranteed from the local budget through social assistance funds in the annual plan and settled according to current regulations. The Chairman of the People's Committee of provinces and centrally-administered cities shall specify conditions for subsidies, subsidy levels, places for implementing subsidy policies, and inform the local population to implement them.

V. EFFECTIVE PROVISIONS:

1. This Circular takes effect from January 1, 1995, and does not retroactively apply to cases resolved before the issuance of this Circular.

2. In case of difficulties during implementation, timely reports should be made to the Joint Ministry for resolution.
