RESOLUTION

REGARDING THE TRANSFER OF JURISDICTION TO TRY CRIMINAL CASES AS PROVIDED FOR IN CLAUSE 1 OF ARTICLE 170 OF THE CRIMINAL PROCEDURE CODE AND THE JURISDICTION TO SETTLE CIVIL MATTERS AS PROVIDED FOR IN ARTICLE 33 OF THE CIVIL PROCEDURE CODE TO COURTS OF COUNTIES, DISTRICTS, TOWNS, AND CITIES UNDER PROVINCES

BASED ON THE CONSTITUTION OF THE SOCIALIST REPUBLIC OF VIETNAM IN 1992 AS AMENDED AND COMPLEMENTED BY RESOLUTION NO. 51/2001/QH10;
Pursuant to the Criminal Procedure Code No. 19/2003/QH11 and the Civil Procedure Code No. 24/2004/QH11;
Pursuant to Resolution No. 24/2003/QH11 dated November 26, 2003 of the National Assembly, Session XI on the implementation of the Criminal Procedure Code and Resolution No. 32/2004/QH11 dated June 15, 2004 of the National Assembly, Session XI on the implementation of the Civil Procedure Code;
Pursuant to Resolution No. 509/2004/NQUBTVQH11 dated April 29, 2004 of the Standing Committee of the National Assembly guiding the implementation of the National Assembly's Resolution on the implementation of the Criminal Procedure Code;
Considering the proposal of the President of the Supreme People's Court,

RESOLUTION:

Article 1. The following courts of counties, districts, towns under provinces shall exercise jurisdiction to try criminal cases as provided for in Clause 1 of Article 170 of the Criminal Procedure Code and jurisdiction to settle civil matters as provided for in Article 33 of the Civil Procedure Code from July 1, 2009:

Article 2. Courts of counties, districts, towns, cities under provinces and military regional courts established after July 1, 2009 shall exercise jurisdiction to try criminal cases as provided for in Clause 1 of Article 170 of the Criminal Procedure Code and jurisdiction to settle civil matters as provided for in Article 33 of the Civil Procedure Code.

Article 3. The Supreme People's Court shall take the lead and coordinate with central judicial agencies to conduct a review of the implementation of Resolution No. 24/2003/QH11 dated November 26, 2003 of the National Assembly, Session XI on the enforcement of the Criminal Procedure Code, Resolution No. 32/2004/QH11 dated June 15, 2004 of the National Assembly, Session XI on the enforcement of the Civil Procedure Code, and Resolutions of the Standing Committee of the National Assembly regarding the delegation of jurisdiction to hear criminal cases as stipulated in Clause 1, Article 170 of the Civil Procedure Code to the People's Courts at district, city district, provincial city levels, and Military Region Courts, and report to the Standing Committee of the National Assembly before August 30, 2009 for the Standing Committee of the National Assembly to report to the National Assembly at its sixth session (October 2009).

Article 4.

1. The People's Courts at district, city district, and provincial city levels mentioned in Article 1 shall be responsible for implementing this Resolution.

2. The Government, the Supreme People's Court, and the Supreme People's Procuracy within their respective functions and powers shall be responsible for guiding the implementation of this Resolution./.
