PRIME MINISTER
Pursuant to the Law on the Organization of the Government dated September 30, 1992;
Pursuant to Decision No. 324/CT dated September 11, 1992 of the Chairman of the Council of Ministers (now the Prime Minister) on the restructuring of the network of scientific research institutions and technological development;
Considering the proposal of the Minister of Science, Technology, and Environment and the Minister, Head of the Government Organization and Cadre Affairs Board,
DECISION:
1. Under ministries, agencies equivalent to ministries, and government agencies (excluding security and defense sectors), there are 41 Institutes.
2. Under state-owned corporations, there are 6 Institutes.
The list of these Institutes is attached to this Decision.
3. The remaining Institutes not included in the above list will continue to be reviewed for organization in the following forms:
- Directly under ministries, agencies equivalent to ministries, government agencies, and state-owned corporations;
- Operating under a self-financing mechanism;
- Transforming into independent enterprises or becoming part of enterprises;
- Merging or dissolving.
Article 2
- For Institutes directly under ministries, agencies equivalent to ministries, and government agencies as stipulated in Point 1, Article 1 of this Decision, based on their functions, tasks, and development needs, the State will continue to provide operating funds and focus on investment for development.
- For Institutes directly under state-owned corporations as stipulated in Point 2, Article 1 of this Decision, the competent ministry and the corporation have the responsibility to manage and assign tasks so that the operation of the Institute is linked with the activities of the corporation. The State will continue to support salaries and administrative expenses for a period not exceeding five years.
- For Institutes currently receiving State funding but not included in the lists above, the State will continue to support salaries for a period not exceeding five years.
Administratively, Institutes directly under ministries, agencies equivalent to ministries, government agencies, and Institutes directly under state-owned corporations are treated equally according to current State regulations.
Article 3. The Prime Minister assigns relevant sectors to carry out the following tasks:
1. The Ministry of Science, Technology, and Environment shall coordinate with the Government Organization and Cadre Affairs Board to issue circulars guiding the operational mechanisms and relationships of scientific and technological Institutes directly under state-owned corporations.
2. The Government Organization and Cadre Affairs Board shall take the lead in coordinating with the Ministry of Labor, Invalids, and Social Affairs, the Ministry of Science, Technology, and Environment, and the Ministry of Finance to draft labor policies in scientific and technological agencies, creating conditions for scientific and technological agencies to rejuvenate and modernize cadres in accordance with the characteristics of scientific and technological activities.
3. The Ministry of Planning and Investment shall take the lead in coordinating with the Ministry of Science, Technology, and Environment, and the Ministry of Finance to draft policies to strengthen investment in building material bases for scientific and technological agencies to fulfill national priority tasks; policies on allocating funds from construction projects and economic works to implement scientific and technological tasks of the projects.
4. The Ministry of Finance shall take the lead in coordinating with the State Bank of Vietnam, the Ministry of Science, Technology, and Environment, and the Ministry of Planning and Investment to draft tax and loan policies for scientific and technological organizations, and policies to encourage enterprises to invest in science and technology.
5. The Ministry of Science, Technology, and Environment shall take the lead in coordinating with the Government Organization and Cadre Affairs Board and the Ministry of Finance to draft policies and measures to support during the transitional period for scientific and technological agencies funded by the State budget transitioning to other forms of operation.
These policies and measures need to be drafted and promulgated by December 1996.
Article 4. This Decision takes effect from January 1, 1997.
The Minister of Science, Technology, and Environment shall take the lead in coordinating with the Minister, Head of the Government Organization and Cadre Affairs Board to guide, inspect the implementation of this Decision and report periodically to the Prime Minister.
The Minister, Head of an agency equivalent to a ministry, Head of a government agency, and Chairmen of Provincial People's Committees directly under the Central Government are responsible for implementing this Decision.
