DECREE

AMENDING AND SUPPLEMENTING CERTAIN PROVISIONS OF THE DECREE NO. 36/2008/NĐ-CP OF MARCH 28, 2008 OF THE GOVERNMENT ON THE MANAGEMENT OF UNMANNED AIRCRAFT AND ULTRA-LIGHT AIRCRAFT AND THE DECREE NO. 58/2010/NĐ-CP OF JUNE 1, 2010 OF THE GOVERNMENT GUIDING THE IMPLEMENTATION OF CERTAIN PROVISIONS OF THE LAW ON PEOPLE'S DEFENSE RESERVES

THE GOVERNMENT

On the basis of Law on Government Organization December 25, 2001;

On the basis of Civil Aviation Law of Vietnam dated July 12, 2006;

On the basis of Law on People's Defense Reserves November 23, 2009;

Upon the proposal of the Minister of National Defense,

DECREE:

Clause 4 of Article 6Amending and supplementing certain provisions of Decree No. 36/2008/NĐ-CP of March 28, 2008 of the Government on the management of unmanned aircraft and ultra-light aircraft.

1. Point a Clause 1 Article 9 shall be amended and supplemented as follows:

"a) Application for permission to fly in both Vietnamese and English (according to the model attached to this Decree)."

2. Clause 2, Clause 3 Article 9 shall be amended and supplemented as follows:

"2. Not later than seven working days before the date planned for organizing flights, organizations and individuals submit applications for permission to fly to the Operations Directorate - General Staff Department.

3. Not later than seven working days before the date planned for organizing flights, organizations and individuals submit applications for modification of flight permits to the Operations Directorate - General Staff Department."

3. Clause 1, Clause 2 Article 15 shall be amended and supplemented as follows:

"1. Within five working days from the date of receipt of complete files as prescribed, the Operations Directorate - General Staff Department shall issue permission for the organization of flights.

2. Within three working days from the date of receipt of complete files as prescribed for application to modify issued flight permits, the Operations Directorate - General Staff Department shall issue permission to adjust the implementation of flights."

4. Abolishing point b and rearranging points c and d of Clause 1 Article 9 into points b and c; abolishing Model No. 1/ĐNCPB and Model No. 2/TLKTPTB (annexed to Decree No. 36/2008/NĐ-CP).

12/2025/TT-BNNMT dated June 19, 2025 issued by the Minister of Agriculture and EnvironmentAmending and supplementing certain provisions of Decree No. 58/2010/NĐ-CP of June 1, 2010 of the Government guiding the implementation of certain provisions of the Law on People's Defense Reserves.

1. Clause 3 Article 42 shall be amended and supplemented as follows:

"3. Procedures and documents for compensation when people's defense reservists fall ill or die shall be handled by the Military Command Board of the commune, the Military Command Board of the agency or organization at the grassroots level where the personnel are managed, reported to the Military Command Board of the district for submission to the District People's Committee for consideration and decision. The time limit for handling the file by the Military Command Board of the commune, the Military Command Board of the agency or organization at the grassroots level, the head of the agency or organization, the business owner or the legal representative of the business owner (where there is no Military Command Board) is three working days; the Military Command Board of the district is five working days; the District People's Committee is five working days. Documents include:

a) Application for compensation from the people's defense reservist or his/her family (if deceased), which must have the opinion and stamp confirmation of the Military Command Board of the commune; Application for compensation from the self-defense reservist or his/her family (if deceased), which must have the opinion and stamp confirmation of the Military Command Board, or if there is no Military Command Board, it must have the opinion and stamp confirmation of the head of the agency, organization, business owner or the legal representative of the business owner;

b) Discharge certificate, prescription, payment invoice, various test reports;

c) Death notice or death certificate issued by the competent authority."

2. Clause 2 Article 45 shall be amended and supplemented as follows:

"2. Procedures and documents for compensation for accidents involving people's defense reservists who have not joined social insurance shall be handled by the Military Command Board of the commune, the Military Command Board of the agency or organization at the grassroots level where the personnel are managed, reported to the Military Command Board of the district for submission to the District People's Committee for consideration and decision. The time limit for handling the file by the Military Command Board of the commune, the Military Command Board of the agency or organization at the grassroots level, the head of the agency or organization, the business owner or the legal representative of the business owner (where there is no Military Command Board) is three working days; the Military Command Board of the district is five working days; the District People's Committee is five working days. Documents include:

a) Accident investigation report by the Military Command Board of the commune, the Military Command Board of the agency or organization at the grassroots level, the Military Command Board of the Ministry or central agency, or the Public Security Agency in cases of accidents occurring during travel to and from work. The report must record the course of the accident, injuries sustained by the victim, extent of damage, cause of the accident, and must be signed by representatives of the people's defense reserve unit. In cases of accidents occurring during travel to and from work, the report must also have confirmation from the local government where the accident occurred;

b) Medical examination report or copy of the disability assessment conclusion issued by the competent authority in cases of accidents occurring during travel to and from training or duty (if applicable);

c) Death notice or death certificate issued by the competent authority;

d) Assessment report by the Military Command Board of the district."

Article 3. Effectiveness

This Decree takes effect from October 22, 2011.

Article 4. Responsibility for Implementation

Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairmen of provincial and municipal People's Committees directly under the Central Government, relevant organizations and individuals are responsible for implementing this Decree./.
