Pursuant to the Law on Competition and Rewards dated November 26, 2003 and the Law Amending and Supplementing Certain Provisions of the Law on Competition and Rewards dated June 14, 2005;

Pursuant to Decree No. 121/2005/ND-CP dated September 30, 2005 of the Government detailing and guiding the implementation of certain provisions of the Law on Competition and Rewards and the Law Amending and Supplementing Certain Provisions of the Law on Competition and Rewards dated June 14, 2005;

Pursuant to Decree No. 63/2003/ND-CP dated June 11, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Culture and Information;

Considering the proposal of the Director of the Office and the Chairman of the Competition and Reward Council of the Ministry of Culture and Information,

DECISION:

Article 1. The attached Decision hereby promulgates the Competition and Reward Regulations for the Culture and Information Sector.

Article 2. This Decision shall take effect 15 days from the date of publication in the Official Gazette and revoke Circular No. 3218/VHTT-TĐKT dated August 14, 1999 of the Ministry of Culture and Information guiding the implementation of Decree No. 56/1998/NĐ-CP dated July 30, 1998 of the Government regarding forms, subjects, and criteria for rewards granted by the Government, Ministries, agencies at the level of ministries, and local people's committees at all levels; specifically detailing the criteria for rewarding the Labor Medal in the Culture and Information Sector.

Article 3. The Director of the Office; the Chairman of the Competition and Reward Council; the Heads of the Department of Organization and Cadres; the Heads of agencies and organizations under the Ministry; the Directors of Provincial Departments of Culture and Information directly under the Central Government are responsible for implementing this Decision./.

REGULATIONS ON COMPETITION AND REWARD

FOR THE CULTURE AND INFORMATION SECTOR

(Attached to Decision No. 80/2005/QĐ-BVHTT

dated December 15, 2005 of the Minister of Culture and Information)

Chapter I

GENERAL PROVISIONS

Article 1. Competition

Competition is an organized activity with voluntary participation of individuals and collectives aimed at creating motivation to encourage, attract, and inspire every individual and collective to promote patriotic traditions, sense of responsibility, willpower to overcome difficulties, dynamism, creativity, and strive to fulfill assigned tasks well, contributing to building and developing the Culture and Information Sector.

Article 2. Awards

Reward is the recognition, praise, and honor of achievements and encouragement through material benefits by competent authorities for individuals and collectives with outstanding achievements, creative labor, and fulfillment of assigned tasks well, contributing to building and developing the Culture and Information Sector.

Article 3. Principles of competition and reward

1. Principles of Competition

1.1. Voluntary, self-awareness, transparency, democracy;

1.2. Unity, cooperation, and mutual progress.

1.3. The awarding of commendation titles must be based on the competition movement; all individuals and collectives participating in the competition movement must register for competition, set goals, and competition indicators; those who do not register for competition will not be considered or recognized for commendation titles.

2. Principles of Reward

2.1. Rewards must ensure accuracy, transparency, democracy, fairness, and timeliness based on the correct assessment of the effectiveness of competition activities of individuals and collectives; achievements to what extent, rewards to that extent.

2.2. A reward form can be awarded multiple times to the same recipient;

2.3. Ensure consistency between the nature, form, and recipients of rewards;

2.4. Closely combine spiritual encouragement with material incentives.

Article 4. Forms of organizing competition and scope of competition

1. Regular competition.

2. Periodic competition within the entire sector, among agencies and organizations under the Ministry, and localities.

Article 5. Time limit for granting rewards

1. Commendation titles and reward forms are reviewed and granted once a year during the annual summary period.

2. Individuals and collectives meeting the standards specified in Article 13 of these Regulations may be granted ad hoc rewards.

Article 6. Rights and obligations of individuals and collectives receiving rewards

1. Individuals and collectives receiving commendation titles shall be issued a Certificate of Merit and monetary rewards as prescribed.

2. Individuals and collectives receiving Certificates of Merit, Gold Medals, Silver Medals, and Awards shall receive Certificates of Merit, Certificates of Gold Medals, Silver Medals, and Awards along with frames and monetary rewards as prescribed.

3. Individuals and collectives have the right to retain, display, and use reward items.

4. Individuals and collectives receiving rewards have the obligation to preserve reward items. Strictly prohibited are acts of buying, renting, lending, giving away, or transferring reward items for illegal or immoral purposes.

Article 7. Handling Violations

1. Individuals and collectives who deceive in reporting achievements to obtain rewards shall have their reward decisions revoked, their reward items and monetary rewards reclaimed; depending on the nature and severity of the violation, they may be subject to disciplinary action, administrative penalties, or criminal prosecution; if damage is caused, compensation must be provided according to regulations.

2. Heads of agencies and organizations who certify false information or forge documents for others to request rewards shall be subject to disciplinary action, administrative penalties, or criminal prosecution depending on the nature and severity of the violation; if damage is caused, compensation must be provided according to regulations.

Chapter II

FORMS AND OBJECTS OF REWARDS

Article 8. Forms of reward

1. Certificate of Merit

- Certificate of Merit from the Heads of agencies and organizations under the Ministry of Culture and Information;

- Certificate of Merit from the Directors of Provincial Departments of Culture and Information directly under the Central Government;

- Certificate of Merit from the Chairmen of Boards of Directors and General Managers of state-owned enterprises under the Culture and Information Sector.

2. Award

- Award from the Minister of Culture and Information.

3. Commendation Titles

3.1. Commendation Titles for individuals include:

- Model Worker;

- Outstanding Competitor at the grassroots level;

- Outstanding Competitor at the Ministry level.

3.2. Commendation Titles for collectives include:

- Model Working Collective;

- Excellent Working Collective;

- Ministry's Competitive Flag;

- Ministry's Excellent Competitive Flag.

4. Gold Medal, Silver Medal

Gold Medals and Silver Medals are awarded to individuals and collectives with outstanding achievements in participating in professional and non-professional competitions based on quality criteria established by the Organizing Committee.

Article 9. Recipients of Rewards

1. Individuals and organizations within and outside the Ministry of Culture, Sports and Tourism have made many achievements in contributing to the construction and development of the Ministry of Culture, Sports and Tourism.

2. Diplomatic agencies, international organizations, foreign individuals, and overseas Vietnamese have made many achievements in building and developing the Ministry of Culture, Sports and Tourism of Vietnam and enhancing friendly cooperation between Vietnam and other countries around the world and international organizations.

Chapter III

CRITERIA FOR RECOGNITION AND AWARDS

Article 10. Criteria for awarding Certificates of Merit

1. For individuals meeting the following criteria:

1.1. Successfully completing assigned tasks;

1.2. Having good moral character, unity, and serving as exemplary models in implementing Party policies and State laws;

1.3. Continuously studying to improve professional knowledge and skills.

2. For groups meeting the following criteria:

1.1. Successfully completing assigned tasks;

1.2. Internal unity, effectively implementing grassroots democracy regulations, organizing effective competition movements;

1.3. Properly implementing systems and policies for all members of the group, practicing thrift;

1.4. The Party organization and mass organizations achieving clean and strong status.

Article 11. Criteria for awarding Commendation Certificates

1. For individuals meeting the following criteria:

1.1. Excellently completing assigned tasks, recognized by the collective;

1.2. Having good moral character, unity, and serving as exemplary models in implementing Party policies and State laws;

1.3. Actively studying to improve professional knowledge and skills.

2. For groups meeting the following criteria:

2.1. Excellently completing assigned tasks;

2.2. Internal unity, effectively implementing grassroots democracy regulations, organizing competition movements with significant results;

2.3. Properly implementing systems and policies for all members of the group, practicing thrift;

2.4. The Party organization and mass organizations achieving clean and strong status.

Article 12. Criteria for awarding commendation titles

1. For Individuals

1.1. Title "Advanced Worker" is awarded to individuals meeting the following criteria:

- Successfully completing assigned tasks with high productivity and quality;

- Adhering to Party policies and State laws, demonstrating self-reliance, unity, mutual assistance, and active participation in competition movements;

- Actively studying politics, culture, professional knowledge, and vocational skills;

- Possessing healthy morals and lifestyle.

1.2. Title "Outstanding Competitor at the Grassroots Level" is awarded to individuals meeting the following criteria:

- Meeting the criteria for the title "Advanced Worker";

- Proposing innovative ideas, technical improvements, or applying new technologies to increase labor productivity.

Innovative ideas, technical improvements, or application of new technologies must be recognized by the Scientific Council (Innovation Council) at the grassroots level.

1.3. Title "Outstanding Competitor at the Ministry Level" is awarded to individuals who have outstanding achievements among those who have continuously received the title "Outstanding Competitor at the Grassroots Level" three times consecutively.

2. For Collectives

2.1. Title "Advanced Labor Group" is awarded to groups meeting the following criteria:

- Successfully completing assigned tasks and plans;

- Regularly organizing effective and practical competition movements;

- More than 50% of individuals in the group receiving the title "Advanced Worker" and no individual being disciplined with a warning or higher;

- Internal unity, adhering to Party policies and State laws.

2.2. Title "Excellent Labor Group" is awarded to groups meeting the following criteria:

- Innovatively overcoming difficulties to excellently complete assigned tasks, fulfilling all obligations to the State;

- Regularly organizing effective and practical competition movements;

- All individuals in the group successfully completing assigned tasks, with at least 70% receiving the title "Advanced Worker";

- At least one individual receiving the title "Outstanding Competitor at the Grassroots Level" and no individual being disciplined with a warning or higher;

- Internal unity, exemplary compliance with Party guidelines and state laws.

2.3. Title "Ministry's Flag of Advanced Competition" is awarded to district, county, town, and provincial city-level groups meeting the following criteria:

- Exceeding assigned targets and plans, being the top unit in the Ministry of Culture, Sports and Tourism of the province or centrally-administered city;

- Having new factors and models for other units in the Ministry to emulate;

- Effectively practicing thrift, combating corruption, waste, and social evils.

For provinces and centrally-administered cities with sixteen (16) or more administrative units at the district, county, town, and provincial city levels, three outstanding units can be selected each year for flag awards.

For provinces and centrally-administered cities with ten to fifteen (10-15) administrative units at the district, county, town, and provincial city levels, two outstanding units can be selected each year for flag awards.

For provinces and centrally-administered cities with fewer than ten (10) administrative units at the district, county, town, and provincial city levels, one outstanding unit can be selected each year for flag awards.

2.4. Title "Ministry's Flag of Excellent Competition" is awarded to groups meeting the following criteria:

- Exceeding assigned competition targets and tasks for the year;

- Being an outstanding example in the Ministry;

- Having new factors and models for other groups to emulate;

- Internal unity, actively practicing thrift, combating waste, corruption, and other social evils.

The selection of the Ministry's Flag of Excellent Competition for provincial cultural and sports departments is divided by region, with one flag awarded for every three provinces or centrally-administered cities in the same region.

The selection of the Ministry's Flag of Excellent Competition for units under the Ministry is divided by sector, with one flag awarded for every three units in the same sector.

Article 13. Special Recognition

Special recognition is given to individuals and groups meeting the following criteria:

- Achieving outstanding and sudden success in work, labor, or study;

- Clear achievements that serve as exemplary models for the entire Ministry to learn from;

- Timely motivation and encouragement to meet political requirements and ensure timeliness.

Article 14. Forms of State Recognition

1. Forms of State recognition include: Orders, Medals of various types; national honor titles; Government Flags of Competition; Prime Minister's Commendation Certificates; National Outstanding Competitors.

Regarding criteria for awarding, procedures for submitting nomination files shall be implemented according to the provisions of the Law on Competition and Recognition and guiding documents.

2. The Council for Competition and Awards of the Ministry shall review and assess the forms of State awards for individuals and collectives within the Cultural and Information Sector each year during the following periods: the first period on the occasion of International Labor Day on May 1; the second period on the occasion of National Day on September 2; the third period on the occasion of Vietnam Teachers' Day on November 20.

- The deadline for submitting award application files for the first period is no later than February 28 of each year;

- The deadline for submitting award application files for the second period is no later than June 30 of each year;

- The deadline for submitting award application files for the third period is no later than September 30 of each year.

Chapter IV

AUTHORITY TO DECIDE AND BESTOW AWARDS

FORMS OF REWARD

Article 15. Authority to decide on awards

1. The Minister of Culture, Sports and Tourism decides to bestow Certificates of Merit; Gold Medals and Silver Medals for individuals and collectives with outstanding achievements in national professional competitions and performances; the title "Outstanding Competitor at the Grassroots Level", "Outstanding Competitor at the Ministry Level", "Excellent Labor Group", Advanced Competition Flags and Outstanding Competition Flags of the Ministry.

2. The titles of competition and forms of awards given to individuals and collectives under the Cultural and Information Sector in localities are decided by the Chairman of the People's Committee of the province, the Director of the Department of Culture, Sports and Tourism, and the Chairman of the People's Committee of the district according to the authority prescribed in the Law on Competition and Awards.

3. Heads of agencies and organizations under the Ministry that have their own seals and accounts decide to bestow Commendation Certificates and titles "Advanced Worker", "Outstanding Competitor at the Grassroots Level" and "Advanced Labor Group".

4. Heads of agencies and organizations under the Ministry that do not have their own seals and accounts decide to bestow titles "Advanced Worker" and "Advanced Labor Group".

5. Chairmen of the Board of Directors, General Directors of state-owned enterprises under the Cultural and Information Sector decide to bestow Commendation Certificates and titles "Advanced Worker", "Advanced Labor Group" and "Outstanding Competitor at the Grassroots Level".

6. The Minister of Culture, Sports and Tourism delegates the Director of the Department of Cultural and Information Affairs to decide to bestow Gold Medals and Silver Medals for individuals and collectives with outstanding achievements in non-professional regional and national competitions and performances.

7. The Minister of Culture, Sports and Tourism delegates the Director of the Department of Performing Arts to decide to bestow Gold Medals and Silver Medals for individuals and collectives with outstanding achievements in professional regional competitions and performances.

Article 16. Authority to bestow

The person authorized to decide to bestow a competition title or form of award shall directly present the award or delegate another person to present it.

Article 17. Prize Money

1. The Office of the Ministry disburses prize money for:

1.1. Competition titles and forms of awards for provincial Departments of Culture, Sports and Tourism and units under the Ministry during the annual work summary;

1.2. Individuals and collectives receiving salaries from the Office who are commended by the President, the Prime Minister, and the Minister;

1.3. Individuals and collectives in artistic units under the Ministry winning high-level awards with significant international political implications (art festivals, film festivals, other art awards);

1.4. Cases where the Minister decides to disburse prize money;

1.5. For foreign individuals and organizations: purchase accompanying gifts with Commendation Certificates and Certificates of Commemoration; no cash prizes.

2. Units under the Ministry disburses prize money for:

2.1. Individuals and collectives commended by the head of the unit;

2.2. Individuals and collectives receiving salaries from the unit who are commended by the President, the Prime Minister, and the Minister;

2.3. Other cases proposed for commendation by the unit.

3. Provincial Departments of Culture, Sports and Tourism disburse prize money for:

3.1. Individuals and collectives commended by the Director of the Department of Culture, Sports and Tourism;

3.2. Individuals and collectives receiving salaries from the Department of Culture, Sports and Tourism who are commended by the President, the Prime Minister, and the Minister;

3.3. Other cases proposed for commendation by the Department of Culture, Sports and Tourism.

Chapter V

PROCEDURE FOR ESTABLISHING AWARD APPLICATION FILES

Article 18. Commendation Certificate

Individuals and collectives within and outside the Cultural and Information Sector proposing to be awarded Commendation Certificates as stipulated in Clause 1, Article 8 shall establish files and submit them to the Council for Competition and Awards of their agency or organization;

The Council for Competition and Awards of the agency or organization reviews and submits to the head of the agency or organization for decision.

Article 19. Certificate of Merit

1. For localities: Provincial Departments of Culture, Sports and Tourism propose; the Council for Competition and Awards of the Ministry reviews and submits to the Minister for decision.

2. For units under the Ministry: The Council for Competition and Awards of the agency or organization proposes; the Council for Competition and Awards of the Ministry reviews and submits to the Minister for decision.

3. For individuals and collectives outside the Cultural and Information Sector: Application files for commendation are submitted to the Council for Competition and Awards of the Ministry;

The Council for Competition and Awards of the Ministry reviews and submits to the Minister for decision.

4. For the objects specified in Clause 2, Article 9, the Department of International Cooperation proposes; the Council for Competition and Awards of the Ministry reviews and submits to the Minister for decision.

Article 20. OF THE SUPERIOR AGENCY/UNIT

1. For Individuals

1.1. Title "Advanced Worker"

Individuals proposing to be awarded titles "Advanced Worker" establish files and submit them to the Council for Competition and Awards of their agency or organization; the Council for Competition and Awards of the agency or organization reviews and submits to the head of the agency or organization for decision.

1.2. Title "Outstanding Competitor at the Grassroots Level"

- For individuals under District, County, City, and Provincial Cultural and Information Offices, the files are sent to the Council for Competition and Awards of the Cultural and Information Office;

The Council for Competition and Awards of the Cultural and Information Office reviews and submits to the Chairman of the People's Committee of the district for decision.

- For individuals under Provincial Departments of Culture, Sports and Tourism: Establish files and submit to the Council for Competition and Awards of the Provincial Department of Culture, Sports and Tourism;

The Council for Competition and Awards of the Provincial Department of Culture, Sports and Tourism reviews and submits to the Director of the Provincial Department of Culture, Sports and Tourism for decision.

- For individuals working in units under the Ministry that have their own seals and accounts: establish files and submit to the Council for Competition and Awards of their unit;

The Council for Competition and Awards of the unit reviews and submits to the head of the unit for decision.

- For individuals working in units under the Ministry that do not have their own seals and accounts, establish files and submit to the Council for Competition and Awards of the Ministry;

The Council for Competition and Awards of the Ministry reviews and submits to the Minister for decision.

1.3. Title "Outstanding Competitor at the Ministry Level"

- For individuals in localities: Provincial Departments of Culture, Sports and Tourism recommend;

The Council for Competition and Awards of the Ministry reviews and submits to the Minister for decision.

- For individuals in units under the Ministry: The Council for Competition and Awards of the agency or organization recommends;

The Council for Competition and Awards of the Ministry reviews and submits to the Minister for decision.

2. For Collectives

2.1. Title "Advanced Labor Group"

- For agencies and organizations under Cultural and Information Offices: Application files for commendation are submitted to the Council for Competition and Awards of the Cultural and Information Office;

The Council for Competition and Awards of the Cultural and Information Office reviews and submits to the Chairman of the People's Committee of the district for decision.

- For agencies and organizations under the Department of Culture and Information: The application file shall be submitted to the Department of Culture and Information's Commendation and Award Council;

The Department of Culture and Information's Commendation and Award Council shall examine and submit to the Director of the Department of Culture and Information for decision.

- For units under the Ministry: The application file shall be submitted to their own Commendation and Award Council;

The Council for Competition and Awards of the unit reviews and submits to the head of the unit for decision.

2.2. Title "Excellent Labor Group"

- For localities: The commendation application file shall be submitted to the provincial-level Commendation and Award Council;

The provincial-level Commendation and Award Council shall examine and submit to the Chairman of the Provincial People's Committee for decision.

- For units under the Ministry: The commendation application file shall be submitted to the Ministry's Commendation and Award Council;

The Council for Competition and Awards of the Ministry reviews and submits to the Minister for decision.

2.3. Advanced Flag of the Ministry

- The Department of Culture and Information of provinces and centrally governed cities shall prepare the file and submit it to the Ministry's Commendation and Award Council;

The Council for Competition and Awards of the Ministry reviews and submits to the Minister for decision.

2.4. Excellent Flag of the Ministry

- For localities: The Department of Culture and Information shall prepare the file and submit it to the Ministry's Commendation and Award Council;

The Council for Competition and Awards of the Ministry reviews and submits to the Minister for decision.

- For units under the Ministry: The unit's Commendation and Award Council shall prepare the file and submit it to the Ministry's Commendation and Award Council;

The Council for Competition and Awards of the Ministry reviews and submits to the Minister for decision.

Article 21. Application File for Commendation

1. The proposal of the agency or organization recommending commendation (M1);

2. Extract from the minutes of the Commendation and Award Council meeting (M2);

3. Achievement report of the individual or group (M3 and M4);

4. Opinions of the Departments and Bureaus managing the relevant sector (if the individual or group recommended for commendation falls under the management of the Departments and Bureaus under the Ministry of Culture and Information)

Article 22. Deadline for receiving application files

Agencies and organizations shall submit the commendation application file during the annual work summary period to the Standing Office of the Ministry's Commendation and Award Council no later than December 15 each year.

In cases of urgent commendation recommendations, the Standing Office of the Ministry's Commendation and Award Council shall examine and submit to the Minister for decision.

Chapter VI

IMPLEMENTATION

Article 23. Standing Office of the Ministry's Commendation and Award Council

The General Affairs and Commendation Department of the Ministry's Office serves as the Standing Office of the Ministry's Commendation and Award Council, responsible for receiving, examining the files and reporting to the Ministry's Commendation and Award Council for examination and submission to the Minister for decision.

Article 24. Guidelines for Implementation

The Chairman of the Ministry's Commendation and Award Council is responsible for guiding the implementation of this Regulation.

During the implementation process, if there are difficulties or if any inappropriate provisions are discovered, the heads of agencies and organizations under the Ministry, the Directors of the Department of Culture and Information of provinces and centrally governed cities, shall reflect these issues to the Ministry of Culture and Information for study and amendment./.
