Pursuant to Decree No. 86/2003/NĐ-CP dated July 18, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Decree No. 33/2005/NĐ-CP dated March 15, 2005 of the Government detailing the implementation of certain provisions of the Animal Health Ordinance;

Considering the proposal of the Director of the Department of Animal Health and the proposal of the Head of the Personnel Department,

Article 1. Position and Functions

1. Establish the Animal Health Agency Region VI under the Department of Animal Health based on the merger and reorganization of the Animal Health Center of Ho Chi Minh City and the permanent office of the Department of Animal Health in Ho Chi Minh City.

2. The Animal Health Agency Region VI shall perform state management functions in animal health and diagnose and test animal diseases and animal products within the assigned region.

3. The Animal Health Agency Region VI has legal personality, its own seal, receives funding from the state budget, and is allowed to open bank accounts in accordance with the law. The headquarters of the Animal Health Agency Region VI is located in Ho Chi Minh City.

4. The scope of operation of the Animal Health Agency in Region VI includes provinces and centrally governed cities (hereinafter referred to as provinces): Ho Chi Minh City, Ba Ria-Vung Tau Province, Dong Nai Province, Ninh Thuan Province, Binh Thuan Province, Binh Duong Province, Binh Phuoc Province, Tay Ninh Province, Long An Province, Tien Giang Province, and Ben Tre Province.

Article 2. Tasks and Authorities

1. Participate in drafting normative legal documents, plans, programs, projects, standards, procedures, and technical regulations on animal health.

2. Guide, urge, and inspect the implementation of normative legal documents, programs, projects, standards, and technical procedures on animal health for provincial Animal Health Sub-Departments.

3. Regarding disease prevention and control:

a) Monitor disease situations; create epidemiological maps; propose measures to prevent and control animal diseases in the region.

b) Coordinate and support provincial Animal Health Sub-Departments in diagnosing and determining diseases and organizing disease prevention and control activities.

c) Regularly inspect and diagnose animal diseases at breeding facilities in accordance with regulations.

d) Guide and evaluate the construction of disease-free zones and regions.

4. Regarding quarantine of animals:

a) Implement quarantine of exported, imported, temporarily imported for re-export, temporarily exported for re-import, transshipped, and transiting animals and animal products.

b) Directly handle or guide and supervise the handling of waste, transport vehicles, containers, animals, and animal products according to regulations.

c) Manage animal quarantine stations at border gates, railway stations, airports, ports, and international post offices as assigned by the Director of the Department of Animal Health.

5. Regarding slaughter inspection:

a) Directly inspect slaughtering of export animals at slaughterhouses in the region.

b) Guide and inspect the implementation of hygiene, disinfection, and decontamination of storage, transportation, and packaging equipment; handle animals and animal products that do not meet veterinary hygiene standards and manage waste at export slaughterhouses.

6. Regarding veterinary hygiene inspection:

a) Inspect veterinary hygiene conditions at quarantine isolation sites, monitor the quarantine of exported and imported animals and animal products according to the guidance of the Department of Animal Health.

b) Inspect veterinary hygiene conditions for slaughterhouses, preservation, preliminary processing facilities for exported and imported animals and animal products, and breeding facilities as assigned by the Director of the Department of Animal Health.

c) Inspect veterinary hygiene of exported, imported, transshipped, temporarily imported for re-export, temporarily exported for re-import, transiting, and using Vietnam's routes animals and animal products.

7. Participate in publicizing knowledge, disseminating laws, conducting specialized veterinary inspections. Participate in implementing agricultural extension and food safety in the field of animal health in provinces in the region.

8. Participate in research, application of scientific and technological progress, and international cooperation according to the program and plan of the Department of Animal Health. Coordinate with provincial Animal Health Sub-Departments in organizing training and upgrading skills and expertise in animal health.

9. Carry out fee and tax collection as prescribed.

10. Manage the organization, personnel, labor, finance, and assets of the Agency in accordance with regulations.

11. Implement administrative reform, comply with information and periodic and ad hoc reporting systems as prescribed by the Department of Animal Health.

12. Perform other tasks assigned and delegated by the Director of the Department of Animal Health in accordance with the law.

Article 3. Organizational Structure

1. The leadership of the Animal Health Agency Region VI includes a Director and Deputy Directors appointed and relieved from duty by the Director of the Department of Animal Health in accordance with regulations and the classification of cadre management authority of the Ministry.

The Director is responsible to the Director of the Department of Animal Health and to the law for the activities of the Agency and the tasks assigned.

The Deputy Director assists the Director, is responsible to the Director and to the law for the performance of tasks assigned by the Director.

2. Management structure:

a) General Affairs Office.

b) Inspection and Slaughter Control Office.

c) Epidemiology Office.

3. Subordinate units:

a) Animal Quarantine Station at Tan Son Nhat Airport.

b) Animal Quarantine Station at Vung Tau.

c) Animal Quarantine Station at Mo Cay.

d) Animal Disease Diagnosis and Testing Center.

The Stations and Centers mentioned in Clause 3 of Article 3 shall have their own seals to perform tasks as prescribed.

The Ministry authorizes the Director of the Department of Animal Health to specify the duties of the management structure, existing animal quarantine stations, and issue decisions to establish animal quarantine stations at border gates, railway stations, airports, ports, international post offices, and the Animal Disease Diagnosis and Testing Center under the Animal Health Agency Region VI.

The staffing of the Animal Health Agency Region VI shall be arranged by the Director of the Department of Animal Health according to the quota allocated by the Ministry to the Department.

The Director of the Department of Animal Health shall manage the recovery and return of seals of agencies and units consolidated and reorganized as stipulated in Article 1 to the competent authority issuing registration seal certificates in accordance with regulations.

Article 4. Responsibilities for Implementation

1. This Decision takes effect fifteen days after its publication in the Official Gazette. It abolishes Point h Clause 2 Article 3 of Decision No. 89/2003/QD-BNN dated September 4, 2003 of the Minister of Agriculture and Rural Development on the functions, tasks, powers, and organizational structure of the Department of Animal Health; Decision No. 1602 NN-TCCB/QD dated December 12, 1994 of the Minister of Agriculture and Food Industry on the transfer of the Animal Disease Diagnosis and Quarantine Center in Ho Chi Minh City to the Animal Health Center in Ho Chi Minh City; and previous regulations of the Ministry of Agriculture and Rural Development that conflict with this Decision.

2. The Director of the Department of Animal Health shall provide detailed guidance for the implementation of this Decision.

3. The Head of the Office, Heads of the Cadre Organization Department, the Director of the Department of Animal Health, Heads of relevant agencies and units under the Ministry of Agriculture and Rural Development, and the Director of the Animal Health Agency Region VI are responsible for implementing this Decision./.
