Pursuant to the Law on Organization of the Government dated December 25, 2001;

At the proposal of the Minister of Planning and Investment;

The Prime Minister issues this Decision on certain special mechanisms and policies for the development of Phu Quoc Island, Kien Giang Province,

Article 1. Issuing special mechanisms and policies for the development of Phu Quoc Island, Kien Giang Province with the following contents:

1. On incentives and investment support:

Investors with projects investing in Phu Quoc Island shall enjoy the highest investment incentives and support as prescribed in Decree No. 29/2008/ND-CP dated March 14, 2008 of the Government on industrial zones, export processing zones, and economic zones.

2. On entry and exit, residence, and travel:

Foreign nationals and Vietnamese citizens holding foreign passports entering, exiting, and residing in Phu Quoc Island shall be exempt from visa requirements for a temporary stay not exceeding 30 days. In cases where foreign nationals enter through an international border gate of Vietnam (including air and sea routes), remain in the transit area at that gate, and then proceed to Phu Quoc Island, they shall also be exempt from visa requirements under this provision.

3. On selecting consulting services for planning:

The Chairman of the People's Committee of Kien Giang Province decides on hiring consultants and experts, both domestic and foreign, with the capacity to develop the overall development plan for Phu Quoc Island until 2020, with a vision to 2030, to be submitted to the Prime Minister for approval to replace Decision No. 178/2004/QD-TTg dated October 5, 2004.

4. On investment in key projects on Phu Quoc Island:

a) Based on the ability to balance local budgets, targeted central budget support, and other sources of capital during the period from 2014 to 2015, focus on investing in the following key projects:

- Road transportation system (main north-south road and ring road around the island); important branch roads connecting from the main road to the ring road or linking to key tourist areas and urban residential zones.

- Power supply sources and systems, water supply sources and systems. - Airports, seaports, and connecting infrastructure projects.

- Urban infrastructure construction projects, land clearance, compensation, resettlement, investment in resettlement housing projects, and public welfare facilities.

- Programs and projects for socio-economic development, healthcare, education, urban environment...

Investment in key infrastructure projects will be prioritized based on actual development needs, focusing resources to complete integrated and comprehensive infrastructure in specific areas to maximize investment efficiency.

b) Encourage domestic and foreign investors to invest in infrastructure on the island: Establish waste treatment and sewage systems, high-quality hospitals, commercial systems, training centers for tourism, commerce, duty-free zones linked to Phu Quoc International Airport...

5. On the use of investment capital for key projects:

a) Maximize allocation from local budgets, targeted central budget support, government bonds within annual plans and the period 2014-2015 to ensure the progress of key development projects on Phu Quoc Island.

b) Annually report to the Standing Committee of the National Assembly to allow allocation from the central budget surplus for key development projects on Phu Quoc Island.

c) Advance allocate funds from the targeted central budget support and government bonds of the following year and the period 2014-2015 according to the implementation progress of infrastructure projects on the island.

d) Be allowed to use the land development fund as prescribed by laws on land for the purpose of investing in technical and social infrastructure serving Phu Quoc Island.

đ) Prioritize attracting and mobilizing ODA and preferential credit funds for investment in technical and social infrastructure projects, necessary public utility projects on Phu Quoc Island.

e) Mobilize direct investment capital from organizations and individuals domestically, advance capital from entities requiring infrastructure use, and capital from enterprises with functions in constructing and operating infrastructure projects.

g) Encourage investment in BT, BOT, BTO, PPP... forms for infrastructure projects within the state budget expenditure tasks.

h) Mobilize foreign capital for infrastructure projects on Phu Quoc Island.

6. On other mechanisms and policies:

- The Chairman of the People's Committee of Kien Giang Province is permitted to designate contractors for infrastructure construction projects on Phu Quoc Island in accordance with the provisions of the Law on Bidding.

- Land use fees when changing land use purposes shall be collected based on the difference between the new land use value and the previous land use value at the time of change. The new land use value and the previous land use value for calculating the land use fee mentioned above are determined by the People's Committee of the province (market price under normal conditions, not the land price stipulated in the Provincial Land Price Table). If the land price determined by the People's Committee of the province (for the old purpose) is lower than the compensation and support price for land when the State expropriates it at the same time, it shall be calculated according to the compensation and support price for land, other support items according to the compensation and support policy to offset the land use fee or land lease fee payable at the same time approved by the competent authority to change the land use purpose.

- The land price for transferring to investors shall be applied uniformly across the entire area (by zone, not separately for each specific project), determined and announced annually by the People's Committee of the province in cases where the land price issued annually by the People's Committee of the province to determine the land use fee on Phu Quoc Island is close to the market price.

Article 2. Implementation clause

1. This Decision takes effect from March 10, 2014.

2. Repeal Article 2 of the Regulation on Entry and Exit, Residence of Foreign Nationals in Phu Quoc Island, Kien Giang Province promulgated together with Decision No. 229/2005/QD-TTg dated September 16, 2005 of the Prime Minister.

3. The ministers, heads of ministerial-level agencies, heads of government agencies concerned, and the Chairman of the People's Committee of Kiên Giang Province shall be responsible for implementing this Decision./.
