DECISION OF THE MINISTER OF PLANNING AND INVESTMENT
On the issuance of the reporting system on the implementation of
Official Development Assistance (ODA) programs and projects
THE MINISTER OF PLANNING AND INVESTMENT
Pursuant to Decree No. 61/2003/ND-CP dated June 6, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Planning and Investment;
Pursuant to Decree No. 131/2006/ND-CP dated November 9, 2006 of the Government promulgating the Management and Utilization Regulations for Official Development Assistance (hereinafter referred to as the Regulations);
Pursuant to Decision No. 94/2007/QD-TTg dated June 27, 2007 of the Prime Minister approving the Action Plan to implement the Project Proposal: "Orientation for Attracting and Using Official Development Assistance during the 2006-2010 Period";
Pursuant to Decision No. 52/2007/QĐ-TTg dated April 16, 2007 of the Prime Minister on the reporting system for the implementation of state capital investment plans;
Pursuant to Decision No. 555/2007/QD-BKH dated May 30, 2007 of the Minister of Planning and Investment promulgating the Framework for Monitoring and Evaluating Based on Results of the Implementation of the Socio-Economic Development Plan for the 2006-2010 Period;
Considering the proposal of the Director of the Department of Foreign Economic Relations, Ministry of Planning and Investment.
DECISION:
Article 1. Issuing the Reporting System on the Implementation of Official Development Assistance Programs and Projects (hereinafter referred to as the Reporting System).
Article 2. Scope of regulation and applicable subjects
Article 1. Scope of Application: The Reporting System shall apply to Official Development Assistance programs and projects.
Article 2. Subjects of Application: Program and project sponsors (referred to as sponsors), supervisory agencies of Official Development Assistance programs and projects, the Ministry of Planning and Investment, and the Ministry of Finance.
Article 3. Forms for reporting under the Reporting System for program and project levels.
Clause 1. Forms for Reporting
The set of forms for reporting at the program and project level includes monthly (Annex 1), quarterly (Annex 1), and annual reports (Annex 2) and final reports on the completion of programs and projects (Annex 3) attached to this Decision. However, for Official Development Assistance programs and projects ending in 2007, these forms will not be applied, but instead, they will continue to follow the existing reporting forms.
In accordance with Article 36 of the Regulations, during the implementation of Official Development Assistance programs and projects, the management boards must prepare and submit the aforementioned reports to the sponsors, who then send them to relevant agencies.
The training institution is responsible for submitting reports on the results of each course to the Construction Department of the locality where its headquarters is located and where the training takes place for monitoring and management (according to the model in Appendix 11 of this Circular);
Point a. Monthly Report
The monthly report applies to investment programs and projects within the approval authority of the Prime Minister and Official Development Assistance programs and projects equivalent to Group A.
Within ten working days after the end of each month, the sponsor must submit the report according to Forms 1 and 2 (Annex 1) in writing, via fax, and email to the supervisory agency, the Ministry of Planning and Investment, the Ministry of Finance, and the People's Committee of the province or city where the program or project is implemented (hereinafter referred to as the Provincial People's Committee). Form 1 is only submitted once after the specific international agreement on Official Development Assistance becomes effective (unless there is a change).
Point b. Quarterly Report
The quarterly report applies to all Official Development Assistance programs and projects.
Within fifteen working days after the end of each quarter, the sponsor must submit the report according to Forms 1 through 20 (Annex 1) via email (Forms 1 and 2 also sent in writing, via fax, and email) to the supervisory agency, the Ministry of Planning and Investment, the Ministry of Finance, the Provincial People's Committee, related ministries and sectors, and donors (in English unless otherwise agreed). Form 1 is only submitted once after the specific agreement on Official Development Assistance becomes effective (unless there is a change).
For programs and projects that do not involve land acquisition, resettlement, and environmental protection, Forms 13 to 18 need not be prepared.
Point c. Annual Report
The annual report applies to all Official Development Assistance programs and projects.
By January 31 of the following year, the sponsor must submit the report according to the Annual Implementation Status Report form (Annex 2) in writing, via fax, and email to the supervisory agency, the Ministry of Planning and Investment, the Ministry of Finance, the Provincial People's Committee, related ministries and sectors, and donors (if required).
Point d. Final Project Report
The final project report applies to all Official Development Assistance programs and projects.
Within six months from the date of completion of the Official Development Assistance program or project, the sponsor must submit the report according to the Final Official Development Assistance Program and Project Report form (Annex 3) in writing, via fax, and email to the supervisory agency, the Ministry of Planning and Investment, the Ministry of Finance, the Provincial People's Committee, related ministries and sectors, and donors.
Article 4. Reporting System and Forms for Supervisory Agencies of Official Development Assistance Programs and Projects
Within twenty working days after each quarter, the supervisory agency must prepare and submit a consolidated report on the mobilization of Official Development Assistance, and an evaluation report on the implementation of Official Development Assistance programs and projects under its jurisdiction according to the Report Form (Annex 4) in writing, via fax, and email to the Ministry of Planning and Investment and the Ministry of Finance.
Article 5. Reporting System and Forms for the Ministry of Planning and Investment
The Ministry of Planning and Investment prepares periodic semi-annual and annual comprehensive reports on the attraction and utilization of Official Development Assistance nationwide (Annex 5) to be submitted to the Prime Minister (in writing), and to inform the Ministry of Finance and related agencies (in writing, via fax, and email).
- Semi-annual report to be submitted before July 31 each year.
- Annual report to be submitted before January 31 of the following year.
Article 6. Reporting System and Forms for the Ministry of Finance
The Ministry of Finance prepares periodic semi-annual and annual comprehensive reports on the disbursement of Official Development Assistance programs and projects (Annex 6) to be submitted to the Prime Minister (in writing), and to inform the Ministry of Planning and Investment and related agencies (in writing, via fax, and email).
- Semi-annual report to be submitted before July 31 each year.
- Annual report to be submitted before January 31 of the following year.
Article 7. Implementation Provisions
Clause 1. Heads of agencies and units specified in Clause 2 of Article 1 are responsible for implementing this Decision.
Clause 2. This Decision takes effect fifteen days after its publication in the Official Gazette. During the implementation process, if there are any difficulties, ministries, localities, and related units should promptly reflect them to the Ministry of Planning and Investment to further supplement and perfect the Reporting System prescribed in this Decision./.
