CIRCULAR

Regulations on management, provision, and use of applications, services, and information on the Internet within the Ministry of National Defense

on the Ministry of National Defense's internet network

Pursuant to Decree No. 42/2022/NĐ-CP dated June 24, 2022 of the Government stipulating the provision of information and online public services by state agencies in the digital environment;

Pursuant to Decree No. 147/2024/NĐ-CP dated November 9, 2024 of the Government on the management, provision, and use of Internet services and information on networks;

Pursuant to Decree No. 01/2022/NĐ-CP dated November 30, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of National Defense; and Decree No. 03/2025/NĐ-CP dated February 28, 2025 of the Government amending and supplementing certain articles of Decree No. 01/2022/NĐ-CP dated November 30, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of National Defense;

At the proposal of the Commander of the 86th Military Region;

The Minister of National Defense promulgates this Circular stipulating the management, provision, and use of applications, services, and information on the Internet within the Ministry of National Defense.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular stipulates the management, provision, and use of applications, services, and information on the Internet; the responsibilities of agencies, units, organizations, and individuals within the Ministry of National Defense.

Article 2. Applicability

This Circular applies to agencies, units, organizations, and individuals related to the management, provision, and use of applications, services, and information on the Internet within the Ministry of National Defense.

Article 3. Principles for managing, providing, and using applications, services, and information on the Internet within the Ministry of National Defense

1. The Ministry of National Defense uniformly manages the provision and use of applications, services, and information on the Internet in accordance with the law and regulations of the Ministry of National Defense.

2. To meet the requirements of promoting the application and development of information technology to implement administrative reform tasks, build a digital government, and breakthroughs in national science and technology development, innovation, and digital transformation within the Ministry of National Defense.

3. Management, provision, and use of applications, services, and information on the Internet must be strictly controlled; linked to protecting state secrets in the defense sector, ensuring information security, and cyber security for information systems under the management of the Ministry of National Defense.

4. Agencies and units shall handle matters within their assigned authority and according to prescribed procedures, formalities, and deadlines; when immediate reporting is required, they shall comply with the demands of the competent authority.

Chapter II

PROVISION OF INFORMATION AND ONLINE PUBLIC SERVICES

TON THE INTERNET

Article 4. Provision of Information on the Internet

1. The Ministry of National Defense's Electronic Portal is the official channel for centralized information provision, connecting information, and publicly disclosing information of the Ministry of National Defense on the Internet, accessible at https://mod.gov.vn or https://bqp.vn.

2. The electronic portal and online newspapers of agencies and units within the Ministry of National Defense must be components of the Ministry of National Defense's Electronic Portal; they should connect, integrate, display banners, and link to the Ministry of National Defense's Electronic Portal.

3. Information provided on the Internet shall be carried out in accordance with points a, c, and d of Clause 1, Article 4 of Decree No. 42/2022/NĐ-CP dated June 24, 2022 of the Government stipulating the provision of information and online public services by state agencies in the digital environment; strictly adhering to regulations on information provision within the Ministry of National Defense; ensuring that no secrets are disclosed.

Article 5. Provision of online public services

1. The levels of provision of online public services, channels for providing online public services, the list of online public services, technical requirements for providing online public services, responsibilities for providing online public services, supervision, evaluation of effectiveness, and usage rates of online public services shall be implemented in accordance with the provisions of Articles 11, 12, 13, 14, and 15 of Decree No. 42/2022/ND-CP and Circular No. 01/2023/TT-VPCP dated April 5, 2023, issued by the Government Office on certain contents and measures for implementation in digitizing files, results of administrative procedures, and conducting administrative procedures in an electronic environment.

2. The information system for handling administrative procedures of the Ministry of National Defense shall be constructed centrally and uniformly to provide information, online public services, and support the resolution, monitoring, and evaluation of the quality of administrative procedures within its jurisdiction for organizations and individuals.

3. The websites of agencies and units shall place banners and links connecting to the information system for handling administrative procedures of the Ministry of National Defense to serve organizations and individuals when they need to use online public services.

Article 6. Provision and Sharing of Information on Social Networks

1. Agencies, units, organizations, and individuals under the management of the Ministry of National Defense, when participating in the provision and sharing of information on social networks, shall have the responsibility to:

a) Understand and comply with the terms and conditions of service provided by the social network service provider before registering to participate. Individuals using social networks for personal purposes shall not use information related to agencies or units when setting up a social network account;

b) Only share information from reliable sources; do not post or share information classified as state secrets, information that violates the law, defames the reputation, or affects the legitimate rights and interests of agencies, units, organizations, and individuals inside and outside the military;

c) Report immediately to specialized forces on information technology and security forces of the military upon discovering unauthorized access to their social network accounts or identifying information that violates the law, classified as state secrets, or false information that negatively impacts the reputation of the Party, State, and military, so that they can cooperate in handling the situation according to regulations;

d) Remove information that violates the law, false information that negatively impacts the reputation and legitimate rights and interests of other organizations and individuals posted on their social network accounts no later than one hour after receiving a request by phone, in writing, or through another communication method from the General Department 86, the Bureau of Military Security Protection, or authorized agencies or persons.

2. Commanders of agencies and units are responsible for establishing social network accounts and the content provided on social networks related to their tasks; managing and licensing such activities similar to the management of websites.

3. Agencies, organizations, and individuals shall not name their social network accounts similarly or identically to those of press agencies, state agencies, or other agencies within the Ministry of National Defense, nor shall they use language that may cause confusion with press agencies, state agencies, or other agencies within the Ministry of National Defense.

Chapter III

MANAGEMENT OF THE ESTABLISHMENT OF WEBSITES,

ELECTRONIC NEWSPAPERS ON THE INTERNET

Article 7. Establishing electronic information websites, online newspapers

1. Comprehensive electronic information websites shall be established in accordance with the provisions of Government Decree No. 147/2024/NĐ-CP dated November 9, 2024 on management, provision, and use of Internet services and information on networks; online newspapers shall be established in accordance with the Press Law 2016 and the provisions of this Circular.

2. Electronic information websites providing specialized services and internal electronic information websites shall be established upon obtaining a permit from competent authorities with jurisdiction as stipulated in this Circular. The permit for establishing an electronic information website has a term according to the request of the agency or unit but shall not exceed five years at most.

3. Conditions regarding organization, personnel, technology, content management, and information for electronic information websites providing specialized services and internal electronic information websites:

a) The managing agency or unit of the electronic information website must ensure technical conditions, manage content and information; issue regulations governing the operation of the electronic information website;

b) Have mechanisms to control information sources, ensuring that published information does not infringe copyrights; have tools to receive and handle complaints from users;

c) Receive and handle warnings about information violations from service users;

d) Have contingency plans to ensure safe, continuous operation and to address incidents when they occur.

4. Electronic information websites and online newspapers of agencies and units under the Ministry of National Defense must use at least one domain name as a subdomain of the Ministry of National Defense's Electronic Information Portal (mod.gov.vn or bqp.vn); implement connectivity, integration, and sharing of information and databases with the Ministry of National Defense's Electronic Information Portal.

5. Agencies and units responsible for managing must promulgate management and operation regulations for electronic information websites before their official operation; bear responsibility for content administration and regular updates for electronic information websites within their management scope.

Article 8. Documents, procedures, authority for registering, amending, supplementing, extending, and reissuing permits for establishing online newspapers and comprehensive electronic information websites

1. Agencies and units requiring registration, amendment, supplementation, extension, or reissue of permits for establishing online newspapers and comprehensive electronic information websites shall prepare the necessary documents and submit them directly or online to the Propaganda Department of the Political General Department. Within one working day, the Propaganda Department of the Political General Department will check the validity of the documents. If the documents are invalid, the Propaganda Department of the Political General Department will return the documents to the agency or unit requesting additional information.

2. Within ten working days from the date of receiving valid documents, the Propaganda Department of the Political General Department, in coordination with relevant functional agencies, will review the documents. If the documents do not meet requirements, the Propaganda Department of the Political General Department will notify in writing, specifying reasons and returning the documents to the agency or unit.

3. Within three working days from the date of receiving the review document along with the documents, the head of the Political General Department or delegate the Propaganda Department of the Political General Department to consider and approve the application for registration, amendment, supplementation, extension, or reissue of the permit for establishing an online newspaper or comprehensive electronic information website, and send it to the competent authority as prescribed by law.

Article 9. Documents, procedures, formalities, authority for registration, amendment, supplementation, extension, reissue of the Permit to establish an electronic information website providing specialized services, internal electronic information website

1. The application dossier shall be established in one set, including:

a) An application form for registration, amendment, supplementation, extension, or reissue of the Permit, implemented according to the Model prescribed in Decree No. 147/2024/NĐ-CP;

b) A project to build an electronic information website with signatures and seals of the command of the agency or unit applying for the permit, including main contents: Purpose of providing information; content of provided information; target audience; scope of information provision; source of information; basic support functions; plans to ensure information security, cybersecurity, and management of information content on the electronic information website; structure diagram, introduction of the electronic information website.

2. Agencies or units wishing to establish an electronic information website shall submit the dossier directly or online to the Propaganda Department/Political General Department. Within one working day, the Propaganda Department/Political General Department shall check the validity of the dossier. In case the dossier is invalid, the Propaganda Department/Political General Department shall return the dossier to the agency or unit requesting supplementary information.

3. Within ten working days from the date of receiving a valid dossier, the Propaganda Department/Political General Department shall take the lead and coordinate with relevant agencies and units to review the dossier. In case the dossier does not meet requirements, the Propaganda Department/Political General Department shall notify in writing, specifying the reasons and returning the dossier to the agency or unit.

4. Within three working days from the date of receiving the review document along with the dossier, the Head of the Political General Department or delegate the Propaganda Department/Political General Department to consider and approve the document requesting registration, amendment, supplementation, extension, or reissue of the Permit to establish an electronic information website providing specialized services, internal electronic information website.

Article 10. Procedures and formalities for suspending operations, revoking the Permit to establish an electronic information website providing specialized services, internal electronic information website

1. The Head of the Political General Department or delegate the Propaganda Department/Political General Department shall suspend operations of an electronic information website providing specialized services, internal electronic information website for a period of three months when the agency or unit violates one of the following cases:

a) Violating laws and regulations in the field of information security, cybersecurity, protection of state secrets, and personal data protection;

b) Violating provisions stipulated in Clause 3, Article 7 of this Circular.

2. The Head of the Political General Department or delegate the Propaganda Department/Political General Department shall revoke the Permit to establish an electronic information website providing specialized services, internal electronic information website when the agency or unit violates one of the following cases:

a) Not implementing measures to ensure feasibility after the three-month suspension period;

b) Submitting a written request to cease operations or failing to commence actual operations within twelve months from the effective date of the permit without reporting to the competent authority issuing the permit;

c) The Permit to establish an electronic information website providing specialized services, internal electronic information website expires according to regulations.

3. Upon discovering that an agency or unit has violated the provisions stipulated in Clause 1 and Clause 2 of this Article, depending on the nature and severity of the violation, the Head of the Political General Department or delegate the Propaganda Department/Political General Department shall notify in writing the suspension of operations or revocation of the permit to establish an electronic information website providing specialized services, internal electronic information website.

4. The competent authority shall apply necessary technical measures to block or suspend operations of the electronic information website if the agency or unit managing the electronic information website providing specialized services, internal electronic information website fails to stop or terminate operations as required by the competent authority according to Clause 3 of this Article.

Chapter IV

 MANAGEMENT OF APPLICATIONS AND SERVICES ON THE INTERNET FOR MILITARY AND NATIONAL DEFENSE TASKS

MILITARY AND NATIONAL DEFENSE TASKS

Article 11. Management and Development of Applications and Services for Military and National Defense Tasks

1. The Command of Unit 86 shall take the lead and coordinate with relevant agencies and units under the Ministry of National Defense to manage and develop applications and services on the Internet for military and national defense tasks within the Armed Forces.

2. Applications and services of agencies and units under the Ministry of National Defense operating on the Internet must be strictly managed during the process of construction, exploitation, and use.

3. Agencies and units shall complete acceptance records; issue management regulations for applications and services; update them into the application management system of the Ministry of National Defense before putting them into use; and simultaneously send the content to the Command of Unit 86 in quarterly reports on digital transformation and administrative reform work for consolidation.

4. Commanders of agencies and units with applications and services shall be responsible for the activities of such software.

Article 12. Management of Commonly Used Applications and Services on the Internet

1. Commonly used applications and services for digital transformation in the Ministry of National Defense must ensure uniformity and comply with the provisions set out in the Electronic Government Architecture Framework of the Ministry of National Defense.

2. The Command of Unit 86 shall take the lead in compiling a list of commonly used applications and services in the Ministry of National Defense and guide all units to widely use them.

Article 13. Domain Name Management in the Ministry of National Defense

1. When registering, leasing, or purchasing national or international domain names on the Internet from service providers, agencies and units must be strictly managed, used for their intended purposes, and comply with legal regulations on domain name registration and use. They must immediately send a document to the Command of Unit 86 and the Ministry of National Defense's Electronic Information Portal after registration, leasing, or purchase for centralized management, including basic information such as: domain name; IP address; purpose of use; service provider; start date of operation, duration; agency or unit assigned to manage; individual assigned to manage (name, unit, phone number).

2. The Command of Unit 86 shall serve as the coordinating body with the competent agencies of the Ministry of Science and Technology and other relevant state agencies regarding domain name management and use; organize the management of information on domain names registered, leased, or purchased for use by agencies and units within the Ministry of National Defense.

3. The Command of Unit 86 shall organize monitoring, early detection, and warning of agencies and units about cybersecurity risks related to domain names and provide guidance on handling solutions.

Article 14. Planning and Management of the Ministry of National Defense Data Center

1. Applications, services, databases at the ministry level, and websites of agencies and units on the Internet shall be installed at the Ministry of National Defense Data Center. Internal applications, services, and databases may be installed at the Ministry of National Defense Data Center or at the data centers or server rooms of agencies and units.

2. Within two years from the effective date of this Circular, agencies and units must complete the transfer of ministry-level applications, services, databases, and websites on the Internet to the Ministry of National Defense Data Center.

3. In cases where ministry-level applications, services, databases, and websites serving military and national defense tasks on the Internet are not installed at the Ministry of National Defense Data Center but at the data center of an agency or unit, they must comply with personnel, technical infrastructure, cybersecurity, and cyber security requirements and obtain permission from the Minister of National Defense.

4. The Command of Unit 86 shall be responsible to the Ministry of National Defense for planning, developing, managing, operating, and using the Ministry of National Defense Data Center; advise on ensuring resources, technical platforms, and cybersecurity solutions to meet the operational needs of commonly used applications and services of agencies and units under the Ministry of National Defense.

Article 15. Registration and Issuance of Permission to Use Internet Services

1. Agencies and units requiring the use of Internet services within the Military shall submit their application files to the information technology management agency under the authority responsible for issuing permission to use such services.

2. The application file for permission to use Internet services within the Military includes:

a) A request for permission to use Internet services within the Military, carried out according to Appendix I attached hereto.

b) A plan to ensure information security and cyber security for equipment using Internet services.

3. The agency receiving the application file shall take the lead in organizing the review of the application file in conjunction with relevant agencies; within ten working days from the date of receipt of all necessary documents, it must present the file for consideration and decision by the command of the agency or unit according to Appendix II attached hereto; in cases where permission is not granted, a written notification must be issued, clearly stating the reasons.

4. The command of agencies and units subordinate to the Ministry of National Defense shall issue permission to use Internet services within the Military to agencies and units under its jurisdiction.

Chapter V

RESPONSIBILITIES OF THE AGENCIES AND UNITS

Article 16. General Political Department

1. To implement the tasks assigned in this Circular.

2. To direct the Propaganda and Education Department to guide the management, inspection, and supervision of the content provided on online newspapers, websites, and other forms of electronic information provision by agencies and units within the Military.

3. To direct the Department of Military Security to proactively prevent, detect, inspect, investigate, and handle acts that infringe upon national security and military security related to the management, provision, and use of applications and services on the Internet within the Ministry of National Defense; to advise the Ministry of National Defense on information security assurance work for agencies and units participating in activities on the Internet.

Article 17. Command of the 86th Corps

1. To advise the Ministry of National Defense on the management, provision, and use of Internet services within the Military.

2. To take the lead in coordinating with relevant agencies and units in planning, developing, inspecting, and supervising the organization of Internet connection and use by agencies and units within the Ministry of National Defense.

3. To take the lead in managing, inspecting, urging, and guiding agencies and units to comply with legal regulations regarding the provision and use of applications and services serving military and defense missions on the Internet.

Article 18. Office of the Ministry of National Defense

To direct the Ministry of National Defense's Electronic Information Portal:

1. To take the lead in managing, maintaining, and operating the Information Ecosystem providing information and online public services of the Ministry of National Defense, the Ministry of National Defense's Electronic Information Portal, and the Administrative Procedure Information System of the Ministry of National Defense.

2. To take the lead in guiding, monitoring, urging, inspecting, and supervising business operations; planning, managing, and allocating domain names for the Ministry of National Defense (bqp.vn or mod.gov.vn); integrating information and databases with the websites and online newspapers of agencies and units within the Ministry of National Defense, and implementing integration and connection with the Government's Electronic Information Portal and other ministries, sectors, and localities in accordance with the law.

Chapter VI

IMPLEMENTATION PROVISIONS

Article 19. Effective Date and Transitional Provisions

1. This Circular shall take effect from September 15, 2025, and replace Circular No. 110/2014/TT-BQP dated August 22, 2014, issued by the Minister of National Defense on the Regulations on Management, Provision, and Use of Internet Services in the Vietnam People's Army.

2. In cases where referenced documents in this Circular are amended, supplemented, or replaced, the corresponding provisions in the amended, supplemented, or replacing documents shall apply.

Article 20. Responsibility for Implementation

1. The Chief of General Staff, Director of the General Political Department, Heads of agencies and units, and individuals concerned are responsible for implementing this Circular.

2. The Commander of the 86th Corps is responsible for guiding, inspecting, and urging the implementation of this Circular./.
