Hguiding the contents and expenditure levels for implementing the Projectorganization

to hold the 10th ASEAN Skills Competition in Vietnam in 2014

Pursuant to Decree No. 60/2003/NĐ-CP dated June 6, 2003 of the Government detailing and guiding the implementation of the Law on State Budget;

Pursuant to Decree No. 215/2013/NĐ-CP dated December 23, 2013, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

Pursuant to Decree No. 106/2012/NĐ-CP dated December 20, 2012, of the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids, and Social Affairs;

Pursuant to Decision No. 1935/QD-TTg dated October 21, 2013 of the Prime Minister approving the Project to organize the 10th ASEAN Skills Competition in Vietnam in 2014;

The Minister of Finance and the Minister of Labour, Invalids and Social Affairs issue this Joint Circular guiding the contents and expenditure levels for implementing the Project to organize the 10th ASEAN Skills Competition in Vietnam in 2014.

Article 1. Scope and Applicability

Article 1. Scope of Application:

a) This Circular stipulates the contents and expenditure levels for implementing the Project to organize the 10th ASEAN Skills Competition in Vietnam in 2014 (hereinafter referred to as the Project) from the state budget and the management, use, and handling of assets, tools, materials, and raw materials of the Project.

b) In cases where the Project uses funding from domestic and foreign organizations and individuals, such activities shall be carried out according to agreements with sponsors. If the sponsor or their authorized representative does not have an agreement on expenditure levels, the provisions of this Circular shall apply.

2. Scope of application: This Circular applies to agencies, units, organizations, and individuals using funds to implement activities under the Project.

Article 2. Funding for implementing Project activities

1. The state budget allocates within the Ministry of Labour, Invalids and Social Affairs's budget estimate, specifically:

a) From the capital of the Vocational Training Modernization and Development Project under the National Target Program on Employment and Vocational Training for the period 2012-2015 to purchase vocational training equipment along with tools, materials, and raw materials serving the competition for key occupations as determined by the Minister of Labour, Invalids and Social Affairs.

b) From the education and training budget to purchase vocational training equipment along with tools, materials, and raw materials serving the competition for non-key occupations and funding for organizing meetings, conferences, and competition activities under the responsibility of the host country.

2. Funding from domestic and foreign organizations and individuals.

3. The preparation, management, and settlement of the Project's funding shall comply with the State Budget Law and guiding documents thereof.

Article 3. Contents and expenditure levels for Project activities

1. Expenditure for planning, monitoring, examination rules, drafting outlines, programs; preparing test questions, hiring illustrative drawings for test questions, printing, packaging, sealing test questions; marking tests, evaluating results, and compiling reports; clothing expenses for the delegation participating in the ASEAN Skills Competition and rewards for contestants who win awards, teachers, experts, or expert groups directly training award-winning contestants: the contents and expenditure levels shall be implemented in accordance with Clause 8, Article 3; Clauses 2, 3, 4, and 5, Article 4; Point c, Clause 3, Article 6, and Article 7 of the Joint Circular No. 43/2012/TTLT-BTC-BLDTBXH dated March 14, 2012 of the Ministry of Finance and the Ministry of Labour, Invalids and Social Affairs on the contents and expenditure levels for vocational skills competitions at various levels.

2. Expenditure for organizing conferences, seminars, and training sessions:

a) Organizing domestic conferences, meetings of the Steering Committee, Organizing Committee, Subcommittees; press conferences; meetings to approve plans, schemes, programs, scripts for opening, closing, and summarizing; organizing training sessions to serve the organization of the competition: the contents and expenditure levels shall be implemented in accordance with Circular No. 97/2010/TT-BTC dated July 6, 2010 of the Ministry of Finance on travel expenses and expenditure levels for organizing conferences for state agencies and public service units (hereinafter referred to as Circular No. 97/2010/TT-BTC). Additionally, allowances for delegates attending are 100,000 VND/person/session. For delegates who are guests and do not receive salaries from the state budget and have been supported with meals, they can only be supported with 70,000 VND/person/session.

b) Organizing international conferences and seminars between countries before the competition: based on the Project and the regulations of the competition, participants, contents, and expenditure levels shall be implemented in accordance with Circular No. 01/2010/TT-BTC dated January 6, 2010 of the Ministry of Finance on expense regulations for receiving foreign visitors to work in Vietnam, organizing international conferences and seminars in Vietnam, and hosting guests domestically (hereinafter referred to as Circular No. 01/2010/TT-BTC). Some specific contents and expenditure levels are as follows:

- Lunch expenses during meetings:

+ Delegation leaders: maximum 500,000 VND/per meal;

+ Other delegates (including Vietnamese delegates): maximum 300,000 VND/per meal.

The above amount includes beverage costs but excludes taxes payable to service providers according to current regulations.

- Allowances:

+ Subcommittee members, technical supervisors, and technical support staff appointed in writing by the Competition Organization Committee Chairman to serve the conference and seminar: maximum 150,000 VND/day/person;

+ Service personnel (security, medical, protection, drivers, receptionists, volunteers, liaison officers), Vietnamese journalists covering the conference approved by the Conference Organization Committee Chairman: maximum 100,000 VND/day/person.

If a person performs multiple tasks in one day, they will only receive the highest allowance. The number of days eligible for allowances is the actual number of days served during the official conference and seminar period. Those who receive allowances cannot also receive overtime pay.

- Supporting mobile phone charges for staff during the first Organizing Committee Meeting and the first Technical Committee Meeting:

+ Organizing Committee members, subcommittee heads: 300,000 VND/person/meeting;

+ Subcommittee members: 200,000 VND/person/meeting;

+ In necessary cases, the Organizing Committee Chairman decides the list of staff eligible for mobile phone charges reimbursement, with a maximum charge of 200,000 VND/person/meeting.

3. Purchase equipment and tools for trades that cannot be rented on the market according to the examination requirements; materials, raw materials, goods, and related services serving the examination according to the examination requirements of each trade. Procurement shall be carried out in accordance with the laws on bidding and Circular No. 68/2012/TT-BTC dated April 26, 2012, of the Ministry of Finance, which stipulates the bidding process for purchasing assets to maintain regular operations of state agencies, political organizations, socio-political organizations, socio-professional organizations, social organizations, social-professional organizations, and people's armed units.

4. Rent venues and premises for organizing competition activities; rent machinery, equipment, tools, and related services such as transportation, dismantling, loading and unloading, installation, troubleshooting, packaging, storage locations for goods, safety inspections serving the competition (if applicable). The expenditure level is based on the approved budget estimate, contracts, invoices, and other lawful receipts. The Chairman of the Organizing Committee decides on rental items suitable to the scale and nature of the competition to ensure economy and efficiency.

5. Expenditure on printing and duplicating materials and forms; purchasing office supplies, badges, signs, logos, mascots, delegate cards, flowers, certificates of merit, certificates of participation, picture frames, commemorative flags, sending out invitations, express delivery, and other related items (if applicable). The expenditure level is based on the approved budget estimate, contracts, invoices, and other lawful receipts.

6. Expenditure on overtime work during the days of competition activities (if applicable). Implementation shall be in accordance with the current laws on wage regulations for night work and overtime for civil servants and public officials.

7. Expenditure on information and publicity activities for the ASEAN Skills Competition such as: photography, filming, making promotional materials, television broadcasts, radio programs, writing articles for newspapers and media outlets, compiling competition yearbooks, banners, slogans, posters, and operating a website providing information about the competition and related activities according to the approved budget estimate. The expenditure level is based on contracts, invoices, and other lawful receipts.

8. Translation and interpretation expenses for ASEAN competition materials and questions: apply the expenditure levels prescribed in Circular No. 01/2010/TT-BTC.

9. Renting cars for the heads of delegations from countries and international organizations; cars for picking up and dropping off members of delegations from countries and international organizations and those participating in organizing the competition activities. The expenditure level is based on the approved budget estimate, contracts, and actual payment invoices.

10. Expenditure on meals and accommodation for the heads of delegations participating in the competition and heads of international organization delegations during the competition period:

a) Dinner: VND 500,000 per meal (lunch is centralized according to Clause 11 of this Article).

b) Hotel accommodation: one Deluxe room per head of delegation.

11. Expenditure on meals, accommodation, and travel for the Steering Committee, Organizing Committee, Specialized Sub-committees, experts, contestants, and service staff during the competition:

a) Centralized lunch organization at the competition venue during competition days:

- Contestants, members of delegations, experts, Steering Committee, Organizing Committee, Sub-committees, examiners, inspectors, technical supervisors, and technical support staff: maximum expenditure of VND 300,000 per meal.

- Service staff for the competition (security, medical, protection, drivers, receptionists, volunteers, liaison officers), Vietnamese journalists participating in reporting the competition, approved by the Organizing Committee Chairman: maximum expenditure of VND 150,000 per meal.

The above expenditure includes beverage costs but does not include taxes payable to service providers under current regulations.

b) Support for food, accommodation, and travel expenses for management staff, experts, and Vietnamese contestants throughout the competition period: contents and expenditure levels are implemented according to Circular No. 97/2010/TT-BTC. For food during competition days, only VND 70,000 per person per day will be supported due to centralized lunch arrangements as stipulated in Point a, Clause 11 of this Article. In cases where centralized accommodation must be arranged for Vietnamese management and expert staff receiving visiting delegations, expenditure levels are implemented according to Point a, Clause 3 of Article 3 of Circular No. 01/2010/TT-BTC.

Those who have been reimbursed for the above support by the competition organizing committee will not be reimbursed for travel allowances from their dispatching agencies or units.

12. Expenditure on allowances for staff directly involved in serving during the competition period (including holidays and Sundays):

a) Heads and deputies of the Steering Committee and Organizing Committee, members of the Steering Committee, permanent members of the Organizing Committee, Chairpersons, Vice-Chairpersons, Secretaries of the Examination Board, technical experts: VND 200,000 per person per day.

b) Members of the Organizing Committee, heads and deputies of Sub-committees, members of the Examination Board, examiners: VND 150,000 per person per day.

c) Members of Sub-committees, teams, and working groups decided upon in writing by the Organizing Committee Chairman (including examiners, inspectors, technical supervisors, and technical support staff): VND 120,000 per person per day.

d) Service staff for the competition (security, supervision, technical, medical, protection, drivers, receptionists, volunteers, liaison officers), Vietnamese journalists participating in reporting the competition, approved by the competent authority: VND 100,000 per person per day.

If a person performs multiple tasks in one day, they will only receive the highest allowance. The number of days eligible for allowance is the actual number of days served during the official competition period. Once an allowance has been received, overtime pay will not be granted.

13. Expenditure on mobile phone communication fees for staff during the competition period:

a) Heads and deputies of the Steering Committee and Organizing Committee, members of the Steering Committee, permanent members of the Organizing Committee, Chairpersons, Vice-Chairpersons, Secretaries of the Examination Board, technical experts: VND 400,000 per person.

b) Members of the Organizing Committee, heads and deputies of Sub-committees, members of the Examination Board, examiners, heads of attending delegations, official representatives, technical representatives, assistant technical representatives, contestant managers: VND 300,000 per person.

c) Members of Sub-committees, service staff approved by the competent authority: VND 200,000 per person.

14. Financial support for uniforms (pants and shirts) for members of subcommittees and examination service staff shall be provided at a maximum rate of VND 100,000 per person per day.

15. Expenses for organizing cultural exchange activities, arts performances, and sightseeing trips for participating teams shall be based on the approved budget, contracts, invoices, and valid expense receipts.

16. Expenses for ensuring security, order, sanitation, and healthcare during the organization of conferences and examinations shall be based on the approved budget and valid expense receipts.

17. Any additional expenses arising from actual needs to serve the organization or preparation for, or participation in, the ASEAN Skills Competition (if applicable) shall be implemented according to current regulations. If there are no current regulations, the Chairman of the Organizing Committee shall decide on the content of such expenses. The amount of expenditure shall be based on contracts, invoices, and valid expense receipts, ensuring economy and efficiency.

18. Awards for collectives and individuals with outstanding achievements in implementing the Project's activities, as decided by the competent authority (excluding prize-winning contestants, teachers, experts, and expert groups as stipulated in Clause 1 of this Article), shall be carried out in accordance with the provisions of the Law on Encouragement of Excellence and Rewards; the Law Amending and Supplementing Certain Provisions of the Law on Encouragement of Excellence and Rewards, and guiding documents thereof.

Article 4. Management, Use, and Disposal of Assets, Equipment, Materials, and Raw Materials of the Project

1. The management, use, and disposal of assets, equipment, materials, and raw materials of the Project shall be conducted in accordance with Circular No. 198/2013/TT-BTC dated December 20, 2013, issued by the Ministry of Finance, regarding the management, use, and disposal of assets of projects funded by state capital (hereinafter referred to as Circular No. 198/2013/TT-BTC).

2. To ensure proper use, economy, and effectiveness, equipment, tools, materials, and raw materials (if remaining) after serving the examination organization shall be handled as follows:

- For equipment, tools, materials, and raw materials of key trades: transfer to vocational schools specializing in key trades as approved by Decision No. 854/QĐ-LĐTBXH dated June 6, 2013, of the Minister of Labor, Invalids, and Social Affairs, which approves key trades and vocational schools selected for the period 2011-2015 and the orientation until 2020.

- For equipment and materials not belonging to key trades: transfer to public vocational training institutions suitable as chosen by the Ministry of Labor, Invalids, and Social Affairs.

- In cases where equipment and tools are damaged during the examination service and cannot be used, the Minister of Labor, Invalids, and Social Affairs shall decide to organize their destruction and liquidation in accordance with Decree No. 52/2009/NĐ-CP dated June 3, 2009, of the Government detailing and guiding the implementation of certain articles of the Law on State Asset Management and Use (hereinafter referred to as Decree No. 52/2009/NĐ-CP); Circular No. 245/2009/TT-BTC dated December 31, 2009, guiding the implementation of certain contents of Decree No. 52/2009/NĐ-CP; and Circular No. 09/2012/TT-BTC dated January 19, 2012, amending and supplementing Circular No. 245/2009/TT-BTC of the Ministry of Finance, or other amended and supplemented documents (if any).

3. The Minister of Labor, Invalids, and Social Affairs shall decide or delegate authority to decide on the transfer of assets from the Office of the General Department of Vocational Training to public vocational training institutions under the management of the Ministry of Labor, Invalids, and Social Affairs; prepare proposals for asset transfers involving vehicles and assets from the Office of the General Department of Vocational Training to relevant agencies, units, and public vocational training institutions under the management of central ministries and local authorities, and submit them to the Ministry of Finance for decision on asset transfers in accordance with Circular No. 198/2013/TT-BTC.

Article 5. Implementation Provisions

1. This Circular takes effect from August 1, 2014.

2. In case the referenced documents in this Circular are amended, supplemented, or replaced, they shall be implemented according to the newly issued documents.

3. During the implementation process, if any difficulties arise, units are requested to promptly report to the Ministry of Finance - Ministry of Labor, Invalids, and Social Affairs for research and resolution.
