CIRCULAR

Regulations on the Implementation of the Minimum Salary in Public Security Forces

Based on Decree No. 02/2025/NĐ-CP dated February 18, 2025 of the Government on the Functions, Powers, Tasks, and Organizational Structure of the Ministry of Public Security, amended and supplemented by Decree No. 11/2025/NĐ-CP;

Based on Decree No. 161/2026/NĐ-CP dated May 15, 2026 of the Government which regulates the minimum salary and reward system for civil servants, public employees, staff members, and military personnel;

In accordance with the proposal by the Director of the Personnel Organization Department;

The Minister of Public Security promulgates this Circular to regulate the implementation of the minimum salary in Public Security Forces.

Article 1. Scope of Application

This Circular regulates the implementation and calculation of the minimum salary, as well as the various benefits based on the minimum salary for personnel in Public Security Forces.

Article 2. Applicability

1. Applicable Subjects

a) Officers, non-commissioned officers, conscripts, trainees, and public security workers; individuals working under contract or temporary recruitment who are currently receiving salary, allowances, and subsistence allowance from the state budget according to the wage tables, allowances, and subsistence allowances issued in conjunction with Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the remuneration system for civil servants, public employees, staff members, and military personnel;

b) Units under the Ministry of Public Security; provincial and municipal public security forces (hereinafter collectively referred to as local public security units).

2. Non-Applicable Subjects

a) Civil servants, workers, or staff members in enterprises of the People's Public Security Force;

b) Contractual laborers who do not receive salary from the state budget or are paid according to an agreed wage (not ranked according to the wage scale prescribed by the Government);

c) Individuals referred to in point a of paragraph 1 of this Article who have received retirement, demobilization, or transfer benefits before July 1, 2026.

Article 3. Minimum Salary

1. As of July 1, 2026, the minimum salary is 2,530,000 Vietnamese dong per month.

2. The minimum salary serves as a basis for:

a) Calculating wages in various wage tables, allowance levels, and subsistence allowances, and implementing other benefits based on the minimum salary according to the provisions of competent authorities;

b) Calculating deductions and benefits based on the minimum salary.

Article 4. Calculation of Various Amounts Based on the Minimum Salary

3. For benefits specified by an absolute amount of money, they remain unchanged according to the current regulations. 4. In cases of overseas official business or study, the percentage (%) of salary retained for family is calculated in accordance with the guidance provided in paragraph 2 of this Article. Upon return, if assigned work from any month, full salary and allowances are enjoyed from that month.

5. The Ministry of Public Security will provide separate guidelines on social insurance benefits and preferential treatment for veterans; demobilization, resignation, or transfer benefits for officers, non-commissioned officers, conscripts, public security workers, contractual laborers, temporary recruits, and trainees in the People's Public Security Force.

 

6. For cases with incomplete months of service or partial salary and allowance periods, the following applies: If the period of service or receipt of benefits is 15 days or more, full month benefits are enjoyed; if less than 15 days, half-month benefits are enjoyed.

The percentage rate (%) to be enjoyed

3. For allowances, subsidies, and compensations stipulated by an absolute monetary amount, the current regulations shall remain unchanged.

4. In cases of official business trips or study abroad, the percentage rate (%) of the salary remaining for family is calculated in accordance with the guidance provided in Clause 2 of this Article. Upon return to the country, if assigned work from any given month, then full salary and allowances shall be enjoyed from that month.

5. The calculation of social insurance benefits and preferential treatment for those who have served in the revolution; discharge, resignation, or transfer of duty for conscript officers, non-commissioned officers, soldiers, public security workers, labor contracts, temporary recruits, and People's Public Security cadets shall be provided separately.

6. For cases with incomplete months of service or receiving salary and allowances in partial months, the following applies: If the period of service or entitlement to benefits is 15 days or more, then full month benefits are enjoyed; if less than 15 days, then half-month benefits are enjoyed.

Article 5. Enforcement

1. This Circular shall take effect from July 1, 2026.

2. The Circular No. 33/2024/TT-BCA dated July 18, 2024 by the Minister of Public Security on implementing the basic salary in the People's Public Security shall cease to have effect from the date this Circular takes effect.

Article 6. Implementation

1. The Director of the Personnel Department is responsible for guiding and inspecting the implementation of this Circular.

2. The head of the public security unit or locality is responsible for organizing the implementation of this Circular.

3. The Planning and Finance Department is responsible for guiding the People's Public Security units and localities on funding sources for implementation, and compiling final accounts in accordance with regulations.

In the event of any difficulties during implementation, the public security unit or locality shall report to the Ministry of Public Security (through the Personnel Department) for timely guidance./.
