DIRECTIVE

Regarding the organization of investigations, surveys, and statistics on civil transactions concerning housing established before July 1, 1991, and the Housing Fund managed by the State during the implementation of housing policies

The Prime Minister issued Directive No. 952/TTg on December 21, 1996, requiring the People's Committees of provinces and centrally governed cities to conduct investigations, surveys, and statistics on specific data in their respective localities regarding privately owned housing and unresolved issues related to housing between individuals, between individuals and state agencies, economic organizations, and social organizations concerning rental, borrowing, and residing in housing established before July 1, 1991, and to submit reports to the central level for the basis of perfecting the draft Resolution to be submitted to the National Assembly for approval.

However, due to insufficient recognition of the importance of conducting investigations and statistics, many localities have not strictly implemented the Prime Minister's Directive; only a few localities (only nine provinces and cities) have reported to the central level, among which some localities have not reported comprehensively, and some have conducted investigations on incorrect subjects, thus failing to meet the requirements.

Due to the lack of sufficient data preparation, the Resolution on civil transactions concerning housing established before July 1, 1991 has yet to be approved, and at the session on August 25, 1997, the Standing Committee of the National Assembly requested localities to conduct more comprehensive and detailed surveys and statistics to ensure feasibility after the Resolution is approved.

To implement the Standing Committee of the National Assembly's opinion, the Prime Minister instructs:

1. Chairpersons of the People's Committees of provinces and centrally governed cities shall direct relevant agencies to continue conducting investigations, surveys, and statistics on housing data according to the spirit of Directive No. 952/TTg dated December 21, 1996, of the Prime Minister, while also conducting statistics on the Housing Fund managed by the State during the implementation of previous housing policies.

Investigation reports must be sent to the Ministry of Construction, simultaneously to the Ministry of Justice and the Government Office, by December 31, 1997.

2. The Ministry of Construction shall provide model forms, direct localities to organize investigations, surveys, statistics, and data compilation, propose solutions for each type of subject, clearly stating the capacity of individuals to manage themselves, the responsibility of localities, and the portion requested from the State for support, and specify the implementation schedule.

3. Regarding funding:

- The Ministry of Construction may use funds allocated to the Central Steering Committee for Housing and Land Policies to implement this Directive. - The People's Committees of provinces and centrally governed cities may use local budgets to carry out investigations, statistics, and data compilation.

4. Based on the results of investigations and surveys, the Ministry of Justice, in collaboration with the Ministry of Construction and relevant agencies, shall complete the draft Resolution of the Standing Committee of the National Assembly for the Government's consideration in February 1998.

The Ministers of Construction and Justice and the Chairpersons of the People's Committees of provinces and centrally governed cities are responsible for implementing this Directive.
