Pursuant to the Civil Servant Law on February 26, 1998 and the Law Amending and Supplementing Certain Provisions of the Civil Servant Law on April 29, 2003;
Decree No. 45/2003/ND-CP Decision No. 09/5/2003 of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;
Considering the proposal of the Director of the Civil Servant and Public Official Department.

Article 1. The attached decision sets forth the "Standards for Directors under Ministries, Agencies at the Level of Ministries, and Agencies under the Government."
Article 2. This decision replaces Decision No. 137/TCCP-CCVC dated July 11, 1996 of the Minister - Head of the Personnel Organization Department of the Government (now the Ministry of Home Affairs) regarding the issuance of standards for directors, deputy directors, and equivalent positions in ministries, agencies at the level of ministries, and agencies under the government.
Ministries, agencies at the level of ministries, and agencies under the government shall base themselves on these standards to concretize and apply them to directors under their respective ministries and agencies.
Article 3. This Decision shall take effect fifteen days from the date of publication in the Official Gazette.
Article 4. The Minister, heads of agencies at the level of ministries, and heads of agencies under the government are responsible for implementing this decision.

STANDARDS FOR DIRECTORS UNDER MINISTRIES, AGENCIES AT THE LEVEL OF MINISTRIES, AND AGENCIES UNDER THE GOVERNMENT (Issued together with Decision No. 83/2004/QĐ-BNV dated November 17, 2004 of the Minister of Home Affairs)
1. Position and responsibilities of directors under ministries, agencies at the level of ministries, and agencies under the government (hereinafter referred to collectively as ministries) are civil servants heading a department, assisting the Minister in managing state affairs in the assigned specialized field.
2. Tasks
2. 1. Directing civil servants in the department to assist the Minister in performing tasks related to the assigned specialized field, specifically:
2. 1.1. Developing planning and development plans for the specialized field, submitting to the Minister for consideration and decision;
2. 1.2. Drafting regulations and submitting them to the Minister for consideration before presenting them to competent authorities for promulgation. Proposing amendments to regulations and policies within the assigned specialized field;
2. 1.3. Organizing guidance, inspection, and participation in audits of the implementation of regulations and policies within the assigned functions and tasks;
2. 1.4. Summarizing, concluding, and evaluating the results of activities according to assigned functions and tasks;
2. 1.5. Organizing information synthesis, statistics, reporting, and archiving;
2. 2. Directing and guiding professional operations for functional agencies nationwide in the assigned specialized field;
2. 3. Leading or coordinating in resolving complaints and appeals related to the assigned specialized field;
2. 4. Leading or participating in scientific research topics within the assigned specialized field;
2. 5. Managing civil servants in the department. Effectively managing and utilizing assets allocated to the department according to regulations;
2. 6. Performing other tasks assigned by the Minister.
