Pursuant to the Government Organization Law dated December 25, 2001;

Pursuant to the Law on Legislative Acts dated November 12, 1996, amended and supplemented on December 18, 2002;

Pursuant to the Law on Officers of the Vietnam People's Army dated December 21, 1999;

Pursuant to the Ordinance on Militia and Self-Defense Forces dated April 29, 2004;

Pursuant to Decree No. 30/2004/NĐ-CP dated January 16, 2004 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of National Defense;

Pursuant to Decree No. 26/2002/NĐ-CP dated March 21, 2002 of the Government on reserve officers of the Vietnam People's Army;

Pursuant to Decree No. 184/2004/NĐ-CP dated November 2, 2004 of the Government detailing the implementation of the Ordinance on Militia and Self-Defense Forces;

Considering the proposal of the Chief of General Staff and the Director of the Political General Department,

DECISION:

Article 1.

1. Now apply the awarding of military rank insignia to reserve officers for graduates of village, town, and ward military command training as for civil servants who have graduated from reserve officer training according to the Law on Officers of the Vietnam People's Army in 1999 and Decree No. 26/2002/NĐ-CP dated March 21, 2002 of the Government on reserve officers of the Vietnam People's Army (Decree No. 26/2002/NĐ-CP).

2. Graduates of village, town, and ward military command training, upon graduation, shall be considered for the awarding of the rank of reserve second lieutenant and shall receive an additional month's salary as reserve officers as stipulated in Point 3.8, Clause 3, Section II of Circular Joint No. 170/2002/TTLT-BQP-BTC dated December 28, 2002 of the Ministry of National Defense and the Ministry of Finance guiding the implementation of policies for reserve officer trainees; when registering for the reserve officer position, they shall enjoy benefits according to current regulations.

3. Training institutions for village, town, and ward military command training shall be responsible for introducing reserve officers to the military office at the district level (where they have permanent residence) for registration in the reserve position as stipulated in Decree No. 26/2002/NĐ-CP.

Article 2.

1. The General Staff Department shall submit to the Minister of National Defense to supplement basic knowledge about officers in the training program for village, town, and ward military command training so that upon graduation, they can be awarded the rank of reserve officer according to this Decision.

2. Annually, the Political General Department shall take the lead in coordinating with the Financial Department of the Ministry of National Defense and relevant agencies to prepare the budget report to ensure the policy and benefits for the subjects specified in Article 1 of this Decision according to current regulations.

Article 3. This Decision takes effect fifteen days from the date of publication in the Official Gazette.

Chairmen of provincial and municipal people's committees directly under the central government, within their respective duties and authorities, shall be responsible for implementing this Decision. The Chief of General Staff, the Director of the Political General Department, Commanders of Military Regions, and heads of related agencies and units shall be responsible for enforcing this Decision.
